The Vail Recreation District (VRD) hereby grants
Sawatch Land Co., Inc. (Contractor) and its
subcontractors permission to utilize the service road
from the Vail Golf Club parking lot to access the
property at 1801 Sunburst Drive for the purposes of
going to and from the property. This agreement is
conditioned by the Contractor using the road for
access only and not any staging, parking, or other
use that would inhibit its use by employees of the
VRD. The VRD also reserves the right to amend or
terminate this agreement for any reason and at any
time without the consent of said contractor or
subcontractors.

Please submit four complete sets of revised construction documents containing the
requested information with all plan revision items clouded or otherwise identified.
Partial plan sets or loose plan sheets are not accepted.
• Steve Croke will take the (4) Permit Sets apart, replace all sheets A-2.1,
replace all sheets A-5.1, and add sheets A-6 to the existing sets. That
would be a serious waste of paper to reprint all the remaining pages.
Please respond in writing to each comment by marking the attached list or creating a
response letter. Indicate which plan sheet, detail, specifcation, or calculation shows
the requested information. Please send revisions to the attention of the plans
examiner with the building permit application number noted.

Please be sure to include on the resubmittal the engineer's or architect's "wet"
stamp, signature, registration number and date on the cover page of any structural

prop��sed addiiions on August 18 and I 9, ?OOR. The purpose ef our observations was to verify that zl?e proper belrin.� iz�aterial
had b>cn exposed i,i l.he excavations for cl�e proposed additions.
The e�xc�vations fa� the proposed additions v�ried in depth from flpproximately 8 ulches to 3.0 feet for the interior continuous
faotinrs and footin;; pads and 4.5 to 6.0 feec Por the exterior continuous footin�s and footin�, pads. The m�terial exposerl in the
bono�n of the exca���ations consisted of cither a nafur�tl, brown to dnrk brown, moist to wet, mediurn �ensc: to dense, sanci�� silt
witl� sca:tered �rav��l or d campleced svidy silt. Ponded water and muddy soils were obse�•ed durint our initifll observctioi7 ir,
an isolated ponion oi' one of the exclvations, In the area tl�at water was observed, the underlying so ls w�.re loose. Tlie loose
soils an�l water had heen removed and replaced with 8 to ]0 inches of compacted fill at the; time oFuur fin�l observation, Ta
water or esr�anies we,�z observed in the completed excavations at the time oCour tinal o6scrvaeion. lr� addition, ch�e majuri�r oF
the soils exposed i i the base of the excavations had been compacted prior to our fin$I observatian. We recommend 'r.hat all
f�un,�i.a�ion subgraces be compacied prior to the placement of concrete.

The Developer agrees to establis a ca de �osit account with the Town of Vail, as
escrow agent, in the amount of $ , as collateral for the

default under this Agreement by the Developer.
NOW THEREFORE, in consideration of the following mutual covenants and agreements,
the Developer and the Town agree as follows:
1. The Developer agrees, at its sole cost and expense, to furnish all equipment and
materials necessary to perform and complete all improvements referred to in this Agreement. The
Developer grees to omplete all improvements referred to in this Agreement on or before the ,�

Developer agrees to provide collateral as follows:

3. The Developer may at any time substitute the collateral originally set forth above

the terms of this Agreement. Such acceptance by the Town of alternative security or collateral
shall be at the Town's sole discretion.
4. The Town shall not, nor shall any officer or employee thereof, be liable or
responsible for any accident, loss or damage happening or occurring to the work specified in this
Agreement prior to the completion and acceptance of the same, nor shall the Town, nor any
officer or employee thereof, be liable f�r �� person�, or property in�ured by reas.Q�n� of the nature
of said work, but all of said liabilities sh�ll b-a�ld are her�ibq��,}ssumed b�r;�he t�evePC�per.

The Developer hereby �ig�s''t�d=i�e�nraify and �old harmles� �ie �o�vn; and'�any of its
officers, agents and employees against any losses, claims, damages, or lia lities to v�rhich the
Town or any of its officers, agents or e�mployees may b�Com�ubject""�o, i� far as any such
losses, claims, damages or liabilities �ol�r., a�tions in respect therEOf�;ari�e ot�t t�)f �r are based upon
any performance by the De�ieloper hereunder; and the De�veloper shall� reimburse the Town for
any and all legal or other expenses reasonably incurred by the Town in connection with
investigating or defending any such loss, claim, damage, liability or action. This indemnity
provision shall be in addition to any other liability which the Developer my have.
5. It is mutually agreed that the Developer may apply for and the Town may
authorize a partial release of the collateral deposited with the Town for each category of
improvement after the subject improvement is constructed in compliance with all plans and
specifications as referenced hereunder and accepted by the Town. Under no condition shall the
dollar amount of the collateral that is being held by the Town be reduced below the dollar amount
necessary to complete all uncompleted improvements referred to in this Agreement.
6. ' If the Town determines, at its sole discretion, that any of the improvements
referred to in this Agreement are not constructed in compliance with the approved plans and
specifications filed in the office of the Community Development Department of the Town of Vail or
not accepted by the Town as complete on or before the date set forth in Paragraph 1 of this
Agreement, the Town may, but shall not be required to, draw upon the security referred to in this
Agreement and complete the uncompleted improvements referred to in this Agreement. Pursuant
to Section 12-11-8, Vail Town Code, the Temporary Certificate of Occupancy referred to in this
Agreement may be revoked until all improvements referred to herein are completed by the
Developer or the Town in accordance with this Agreement.

If the costs of completing the uncompleted improvements referred to in this Agreement
exceed the dollar amount of the deposit, the excess, together with interest at finrelve percent
(12%) per annum, shall be a lien against the prope�ty and may be collected by civil suit or may be
certified to the treasurer of Eagle County to be collected in the same manner as delinquent ad
valorem taxes levied against such property. If the Developer fails or refuses to complete the
improvements �eferred to in this Agreement, such failure or refusal shall be cons'rdeced a violation
of Title 12 (Zoning Regulations), of the Vail Town Code, and the Developer shall be subject to
penalties pursuant to Section 12-3-10 (Violations: Penalties) and Chapter 1-4 (General Penalty),
of the Vail Town Code.
7. The Developer shall warranty the work and materials of all improvements referred
to in this Agreement located on Town property or within a Town right-of-way, pursuant to Chapter
8-3, of the Vail Town Code, for a period of two years after the Town's acceptance of said
improvements.
