In accordance with the Amended and Restated Development Agreement, recorded June 11, 2018 under reception no. 201809885, section 5.b.ii East Wing Mitigation, the purpose of the Agreement “is to provide off-site housing for 5.14 employees. Mitigation to be provided by VVMC (dba Vail Health) purchasing and deed restricting dwelling units within the Town of Vail or purchasing deed restrictions as per the Town's "InDeed" housing program.” I understand Vail Health has acquired three deed restrictions located at: 1) 1975 West Gore Creek Drive, Ptarmigan Townhome, Unit 27, a two-bedroom home, 2) 1040 Vail View Drive, Unit 307, a two-bedroom home, and 3) 2773 Kinnikinnick Road, Unit 1-D, a two-bedroom home. Per our prior conversation, the Ptarmigan Townhome 27 shall qualify as three bedroom home of more than 1,225 square feet for purposes of determining compliance with Vail Health’s employee housing mitigation obligation provided the proposed interior remodel to add a third bedroom is completed with a certificate of occupancy prior to a request for any certificate of occupancy associated with the East Wing redevelopment. In the event Vail Health complies with this stipulation, a 3.5 employee mitigation rate will be applied to this home. Both 1040 Vail View Drive, Unit 307 and 2773 Kinnikinnick Road, Unit 1-D are two-bedroom homes with more than 788 square feet each and comply with Table 23-2 Size of Employee Housing units and a 2.25 mitigation rate will be applied for both homes for a total mitigation of 8 employees (3.5 + 2.25 + 2.25) The off-site credit will be 2.86 employees to be housed pursuant to the Vail Town code section 12-23-3 Commercial Linkage: Size and Building Requirements; Table 23-2, Size of Employee Housing Units. If all actions are completed as contemplated herein, Vail Health will have met its employee housing requirement for the East Wing obligation. In doing so, a credit of 2.86 will be granted for future application, subject to the terms and provisions of Section 12-23-7 of the Vail Town Code, depending upon the outcome of the proposed remodel at 1975 West Gore Creek Drive. If the remodel is not completed, Vail Health will have a credit of 1.61 employees for future applications. Should you have any additional questions, as always, please do not hesitate to reach out.
