property they manage. Restoration of riparian habitat on private property
has lagged behind, with a few notable exceptions where private property
owners received financial support from the Town. W idespread restoration of
riparian buffers on private property must occ ur in order to achieve the goals
laid out in the Gore Creek Strategic Plan.

I. PURPOSE
The purpose of the memo is to outline the agenda and discussion points for the joint meeting
between the Vail Town Council and the Commission on Special Events. The Town Council and
the CSE traditionally meet yearly to discuss high level strategy and align the vision of the CSE
to that of Council. With the changes to the event industry due to the COVID-19 Pandemic, it is
especially relevant to review the goals of the Town Council for CSE this year.

2021 Funded Events and Process
The full list of funded events for 2021 is included below. The 2021 allocation included $625,554
for Cultural Recreation and Community (CRC) events, $154,530 for Education and Enrichment
(E&E) events, $510,100 for Signature events, and $520,000 for Destination events for a total of
$1,810,184 for all 2021 events. Economic Development and Finance Department staff have
modified the payment process slightly this year due to learnings from the beginning of the
COVID-19 Pandemic. New this year, all events will receive their funding agreements via
DocuSign (electronic platform). The payment schedule for the funding agreements has been
adjusted to pay the first 1/3 of the contribution no sooner than 60 days prior to the event, and
after a review of the event by CSE to confirm the event will meet the established goals identified
during the funding process.
Based on Town of Vail finance policies, all event funding agreements over $50,000 will be
approved by Town Council prior to being sent for signature. At the March 2nd, Town Council
evening meeting, the following event agreements are on the consent agenda. Vail Farmers’
Market and Art Show, Vail America Days, Vail Oktoberfest, GRFA Live Music and
Entertainment, Vail Jazz, Summer Mountain Games, and Bravo! Vail.

Event Strategy in Response to the Pandemic
The event industry has changed dramatically in response to the pandemic. Many events have
reimagined their structure to address capacity restrictions, resulting at times in smaller
audiences and a more intimate, VIP experience. Other events are holding out, adhering to their
traditional event models until they can return with larger capacities. Both approaches feature
pros and cons, and there is room for both. As the CSE looks to fund and support future events,
we are interested in feedback on the following questions:
What is the vision of the Town Council on events considering public health crisis and
orders?
As case numbers decrease and capacity numbers potentially improve, is town council
supportive of the Economic Development team pursuing productions that may involve
events with larger capacity that would still comply with the public health orders? i.e., concert
at Solaris?
As capacities increase with modifications of public health orders, does Vail want to be one of
the first to market with large scale events or do we want to take a more measured
approach?
Early Winter Season Events and Activations
The Town has three events in recent years that occur during early ski season.
Revely Vail is the result of collaboration with Vail Mountain on the Guest Experience Initiatives
programming. The goal is to stimulate early season demand and visitation to provide a
complement to the resort’s 2019 investment in snowmaking improvements that results in a more
consistent and high quality early season mountain experience. Revely Vail was only in its
second year when the pandemic took hold which significantly changed the programming of the
event.
Snow Days was also created in partnership with Vail Mountain to provide incentive for snow
sports enthusiasts to choose Vail in early December by offering large scale concerts at Ford
Park. Snow Days occurred in 2019 and was canceled for 2020. Snow Days has not requested
funding for 2021, presumably as they are committed to the large scale concert model that likely
will not be possible.
Vail Holidays begins in mid-December and was created to provide animation and village
opportunities to enhance the holiday experience in Vail for the community and our guests. Vail
Holidays continued in 2020 with many of the events going virtual.
Looking at early winter season 2021/2022, what is the council’s vision for the right blend of
events?
For discussion:
1. Is the town still committed to Revely Vail, Welcome to the Brilliance of Winter to
provide early season activation in the villages? Activation dates November 19 through
December 17.
2. Would council consider aligning a music production by Powabunga with the early
activation of Revely. The promoter has received funding for a 2021 event, canceled the
April 2021 concerts, and is hoping to move the ticketed event to early December of

2021. Powabunga is willing to work with capacity limits imposed by public health orders
to reimagine the event and would like to host at Ford Park. Concert dates proposed
include December 3 and 4.
3. Is the town interested in considering the possibility of a more traditional large-scale
concert in December 2021 as allowed by public health?
Ambient Entertainment: Summer
To support the vibrancy of the villages, the Town Council approved $300,000 for ambient music
and family entertainment in 2021. The Town contracted with Resort Entertainment for $120,000
for January 1 – April 11 to provide approximately 50 days of strolling, acoustic musicians in both
villages as well as strolling family themed/character entertainers. The winter program has been
running 3 days per week during off peak weeks and up to 7 days per week during peak weeks
with 4 entertainers per day. The strolling, mobile nature has allowed the performers to maintain
social distancing and avoid gathering with the flexibility to adjust to the traffic in the village and
activate different areas at different times.
The proposal for the summer activation from High Altitude Entertainment is to return to a single
location, larger production concert in one village location per weekend. Shows would be held on
Saturdays and Sundays with a few Fridays added in August. Locations include Solaris,
Children’s Fountain, and in front of Bart & Yetis. The current proposal is to host up to 36 shows
for a total of $150,000. The programming (includes five hour staged concerts at $4K) would not
include the smaller ambient music or family entertainment production described above held
during the winter months. High Altitude Entertainment has indicated they will pursue the 5 Star
Certification from Eagle County Public Health.
The guests and community have enjoyed both kinds of entertainment in the villages as the
activations have had added energy and vibrancy to the town’s brand. The summer budget has
been dedicated to the HAE proposal. In light of that, the discussion question will offer more
insight into what type of summer programming is desired:
For Discussion:
1. Would council support an ambient entertainment model whereby entertainers are
provided in smaller venues with more frequency, or does it prefer fewer, larger scale
staged concerts in the villages with less frequency?
Ford Park Lower Bench Event Venue
The Ford Park Lower Bench event venue was activated by the town in 2020 in response to the
pandemic to provide a staged outdoor environment for special event productions within public
health orders and capacity limitations. Typically the lower bench is offered as general public use
park area. Events including Bravo, Vail Jazz, Craft Beer and Wine and Shakedown Presents
successfully hosted their programming in summer 2021 after being reimagined to accommodate
flights of 175 people.
Several event producers have expressed an interest in using the Lower Bench for events in
2021, while others have voiced their concerns that the venue compromises the programming at
the Gerald R. Ford Amphitheater and should not be reestablished in 2021.

Subject: Ownership/Land Deal Options for Consideration
I. Purpose
The purpose of this memorandum is to present a summary of land deal options for the
Town Council’s review and consideration. The information in this memorandum is
intended to further inform an eventual determination of the Town’s participation in the
Middle Creek Project. In many ways, determining a land deal option in a public/private
partnership is as much a matter of achieving policy objectives, as it is a matter of
generating a financial return.
II. Ownership Options
There are two basic means of approaching the ownership of a land deal of town-owned
land (the land) in a public/private partnership to develop deed-restricted homes (the
improvements). Ownership may be either:
1. A ground lease, or
2. Sale of the fee interest in the land
The policy objectives of the Town in a public/private partnership will determine which
ownership option and land deal structure is most appropriate for a given situation.
Ground Lease
If the Town’s objective is to retain title to the land and generate income from the value of
the land over time, a ground lease is preferable. In sum, a ground lease allows the
Town to generate an income stream based upon the value of the land without investing
the time and capital needed to construct improvements, and preserves ownership of the
land for future use at the end of the lease term. With a ground lease, the ownership of
the land remains with the Town and the ownership of the improvements remains with
the developer. Ground leases typically range in length from 50 to 99 years. The Middle
Creek at Vail Apartments is an example of a ground lease option.

Terms and obligations of a ground lease include:
• Length of the ground lease
• Annual lease payment with escalation over the term of the lease
• Obligations for maintenance and repairs of the improvements
• Condition of the improvements upon surrender
• Considerations for the projected life cycle of the improvements
• Relationship of the land to the improvements
Land Sale
If the Town’s objective is to receive a one-time, lump sum payment and retaining title is
not of high importance, selling the Town’s fee interest in the land is preferable. A land
sale allows the Town to receive the fair market value of the land and recoup or reinvest
the sales proceeds elsewhere in the community. A land sale typically occurs when
ownership of the land is not critical to achieving long and short-term objectives. The
Chamonix Vail Townhomes are an example of a land sale option.
Ground Lease with Option
A third approach is a hybrid that combines both a ground lease and a sale of the fee
interest in the land. This approach is commonly described as a ground lease with an
option/obligation to purchase. When pursuing this option, it is important to note that in
the end, the Town is acknowledging giving up ownership of the land. If the Town’s
objective is to lower the upfront cost of development but wishes to sell its interest in the
land in the long term, a ground lease with an option/obligation to purchase is preferable.
The Lions Ridge Apartments is an example of this hybrid approach.
There are a number of factors the Vail Town Council should consider when determining
which ownership option and land deal structure is most appropriate. Those factors
include:
• What is the future use of the land?
• Is the Town’s ownership of the land needed to achieve its long and short-term
objectives?
• Is there an immediate need for income or is generating income over time
acceptable?
• What is the intended use of the proceeds from a sale?
• Is retaining the title to the land of high importance?
• Does the location of the land impact the determination of future uses?
• Which of the two options produces the highest yield?
• Is the Town motivated to lower the upfront cost of the development?
• How is the value of the land expected to change over time; increase or
decrease?

• Which option best aligns with the Town’s policy objectives?
III. Next Steps
The Vail Town Council has yet to fully consider and provide input on the desired terms
and obligations of an ownership option and land deal structure with Triumph
Development for the Middle Creek Project. An opportunity to do so will be afforded at
an upcoming Town Council meeting. The Town and Triumph have until to June 28 to
finalize the terms of the land deal, based upon the draft Development Agreement.
Town staff has engaged Jones, Lang & Lasalle to advise the Vail Town Council on the
estimated value of Lot 3, Middle Creek. Jones, Lang & LaSalle (JLL) is a reputable
commercial real estate services company. Based in Chicago, IL., JLL operates a
regional office in Denver, CO. The Denver team at JLL has extensive knowledge of the
real estate development markets of the Vail Valley. JLL will present the findings of their
work to the Vail Town Council on April 6.
It is important the Town has a firm understanding of the value of an ownership option
and land deal structure it is granting. In the end, when combined, the terms and
obligations dictate the value of the land deal to the Town. Once a value has been
determined, the Town is able to project a rate of return on the investment made in a
public/private partnership. For instance, though the Town is not making a financial
investment in the construction of the Middle Creek Project, it is funding the investment
in the entitlement process up to $690,000, tying up the use of its land, and paying the
costs to relocate the Children’s Garden of Learning. It is reasonable and appropriate for
the Town to realize a return on the community’s investment.

White Paper on Potential for a Stream Corridor Protection Ordinance
Restore the Gore Programs, Accomplishments and Challenges
Gore Creek has been listed as “impaired” by the state of Colorado since 2012 for failing to meet state
standards for aquatic life. The Gore Creek Strategic Plan (GSP), adopted by the Vail Town Council in
2016, identifies three main causes of Gore Creek’s impairment:
• Pollutants from land-use activities
• Drainage from impervious surfaces and,
• The loss of riparian and streamside vegetation
The plan recommends 219 individual actions to address and correct the causes of Gore Creek’s
impairment. These actions fit into five categories. Up to this time, Restore the Gore programs and
initiatives have largely focused on the areas of Education and Outreach, Best Management Practices,
Data Collection and Research, and Site Specific Projects. Impressive progress has been made in all four of
these focus areas including completion several enormous stormwater treatment projects, more than
10,000 native plants introduced in riparian areas, and the development of popular education series and
programs that have resulted in greater awareness and water quality literacy in the community.
Among the high priority actions that remain largely unaddressed are several that fall into the category of
Rules and Regulations.
• Update stream setback, riparian zone, vegetative buffer zone and other water quality objective
definitions and maps (title 12 review and amendments).
• Consider the legal ramifications of partially or fully restricting commercial application of
pesticides near streams and rivers.
• Delineate Stream Protection Overlay/Hazard Zones adjacent to waterbodies. Restrict land uses
in near-stream zones to maintain and/or restore water quality buffer characteristics.
Since adoption of the GSP in 2016, the TOV has undertaken a dedicated and targeted effort to reverse
the declining macroinvertebrate populations in Gore Creek. The Town has overseen the planting of
more than 10,000 native trees and shrubs on town-owned property spanning more than 4 miles of creek
front. Major stormwater filtration projects involving a combination of custom infiltration systems,
manufactured water treatment vaults, natural vegetation, and man-made wetlands have been
completed at the East Vail highway interchange, TOV Public Works yard and the TOV snow dump. Major
stormwater projects are also planned for Westhaven Drive and the West Vail Roundabout in 2020.
Steady, incremental progress toward the recovery of aquatic insect populations has been documented
as a result of these efforts to restore riparian habitat on town-owned parcels and update stormwater
infrastructure for which TOV is responsible.
Educational initiatives have raised awareness of the threats to Gore Creek. Community awareness and
concern are high as has been consistently reflected in the town’s bi-annual surveys. Thirty-five to forty
private landscapers and property managers participate in an annual workshop showcasing the town’s

own shift to an Integrated Pest Management (IPM) approach for maintaining town-owned landscapes.
This landscaping strategy advocates a holistic approach that prioritizes proper plant care, diverse plant
species, thoughtful plant selection, and the use of alternative methods of pest control; reserving
chemical treatments as a last resort. The Town has demonstrated that beautiful landscaping can be
maintained using the IPM method and without the use of foliar-applied pesticides, but there is little
indication that private landscapers and property managers are following through on this approach.
Project Re-Wild, a public-private cost-share program designed to encourage private property owners to
restore riparian buffers and stream setbacks along Gore Creek, was unveiled in 2017. Initially, the
program provided 75% funding for the design of such projects, but property owners were responsible
for the entire cost of construction, implementation and management. Under this model, five projects
were designed but only one was constructed. Thanks to grant funding from the Eagle River Watershed
council and design funds from Project Re-Wild, this project was completed at no cost to the HOA or
homeowners.
In the winter of 2018-19, following a report on the slow progress made toward restoring riparian buffers
on private property under the public-private cost-share program called Project-Re-Wild, Town Council
directed staff to use remaining funds allocated for the program to complete the five projects that had
already been designed. Two major projects including nearly 1,000 native plants and the restoration of a
floodplain wetland were completed in East Vail in the summer of 2019. These projects were made
possible by an additional $15,000 in funding from the Colorado Water Conservation Board (CWCB) and
again were completed with very modest investments from the property owners. A third bank
stabilization and riparian restoration project in East Vail is very likely to move forward in the summer of
2020 with approximately 25% funding from Project Re-Wild.
In response to the high average cost the town was incurring for the relatively small number of projects
Project Re-Wild was managing to incentivize, the lack of riparian restoration projects occurring on
private property and the demonstrated need to restore riparian habitat, Town Council directed staff to
research and recommend code changes that would require private property owners to address the root
causes of Gore Creek’s impairment by:
• Encouraging private property owners and managers to re-establish riparian buffers
• Reducing impervious surfaces on private property
• Discouraging the use of landscaping chemicals, especially pesticides, and encouraging adoption
of IPM strategies
Numerous Colorado municipalities have successfully addressed similar challenges impacting their local
waterways through code changes restricting land use activities adjacent to streams and wetlands, by
establishing stream setback zones, and by limiting the application of pesticides and other activities in the
setback through a Source Water Protection Ordinance (SWPO).
Current Status of Town Code Concerning Stream Setbacks and Vegetated Buffers

The Town of Vail currently has two regulations that address the construction of improvements in
proximity to watercourses. The first is a setback requirement that is measured from the centerline of the
watercourse:
12-14-17: SETBACK FROM WATERCOURSE:
Minimum setback from a creek or stream shall be not less than thirty feet (30') from the center of the
established creek or stream channel as defined by the town comprehensive plan base maps; provided,
however, that the setback from Gore Creek shall be fifty feet (50'). Natural creek or stream channels may
not be rechanneled or changed.
Additionally, Town of Vail prohibits improvements within any flood hazard zones:
12-21-10: DEVELOPMENT RESTRICTED:
A. No structure shall be built in any flood hazard zone or red avalanche hazard area. No structure shall
be built on a slope of forty percent (40%) or greater except in single-family residential, two-family
residential, or two-family primary/secondary residential zone districts. The term "structure" as used
in this section does not include recreational structures that are intended for seasonal use, not
including residential use.
At this time, the Town of Vail code of ordinances prohibits removal of vegetation without obtaining a
permit but does not restrict mowing or pesticide use within a riparian, or creekside, zone.
12-11-3: DESIGN APPROVAL:
A. Scope: No person shall commence removal of vegetation, site preparation, building construction or
demolition, dumping of material upon a site, sign erection, exterior alteration or enlargement of an
existing structure, paving, fencing or other improvements of open space within the corporate limits of
the town unless design approval has been granted as prescribed in this chapter. The addition of plant
materials to existing landscaping, gardening and landscape maintenance shall be exempt from this
provision.
Why undertake code changes?
The GSP, adopted by Council in 2016, recommends that the town develop rules and regulations to
govern activities in delineated “Stream Protection Overlay/Hazard Zones adjacent to water bodies,” and
“Restrict land uses in near-stream zones to maintain and/or restore water quality buffer characteristics.”
Chemical Use
Currently, pesticide use is regulated by the State of Colorado and the label on the pesticide container is
the law. Municipalities have not had the authority to regulate pesticides within their jurisdictions since
2005. While Town of Vail does not currently regulate chemical use on private property, TOV shifted
from spraying over 2,000 trees with foliar applied pesticides in 2014 to none in 2016 and beyond. The
largest improvements in Gore Creek macroinvertebrate scores achieved so far have occurred following
this policy change.

While the town has educated and encouraged professional landscape contractors, arborists and
residents to follow the town’s example, foliar applied pesticides are still in wide use in Vail and examples
of irresponsible and excessive application of pesticides has been observed. In a survey of actions taken
in response to mountain pine beetle, the number of Vail residents who reported “spraying trees with
chemicals” jumped from 35% in 2007 to nearly 50% in 2018 (Hua, Sanders Prentice & Vickery, Mountain
Pine Beetles and Colorado Forests: Vail community re-survey report, University of Missouri-Columbia and
University of Colorado Boulder). The survey did not ask a follow up question about what motivated this
rise in prevalence of tree spraying in the decade from 2007 but it was likely related to ongoing concern
about pine beetle infestations, in spite of education and outreach efforts informing both residents and
landscape professionals that new infestations of mountain pine beetle have become exceedingly rare in
Vail since about 2015. There appears to be a lag between the end of the pine beetle epidemic and public
recognition that the beetle is not much of a threat to their trees at this time.
In the spring of 2020, a bill lifting the preemption on local control of pesticide regulations was tabled as
COVID-19 relief work took precedence in the state legislature. Barring the passage of this or a similar bill
in the future, Source Water Protection is the only justification municipalities can use to exercise the
power to regulate pesticide use at the local level. Town of Vail staff are working closely with Eagle River
Water & Sanitation District to develop a Source Water Protection Plan (SWPP). Because most drinking
water intakes on Gore Creek are upstream of Vail Village, this may or may not be a feasible option
through which to regulate a reduction in pesticide use in Vail.
At this time, the only option Vail has which is likely to withstand potential legal challenges is to adopt
code language which reiterates state and/or federal pesticide regulations. It may seem counter intuitive
to adopt redundant regulations but there is a benefit to doing so in this case. A part of Colorado’s
preemption on local pesticide regulations also reserves the authority to enforce those regulations for
state agencies. By adopting code language that reiterates some or all of the state regulations at the local
level, the Vail Town Council could empower its police and code enforcement officers to enforce those
pesticide regulations. Considering that state enforcement agents have only issues one citation in Eagle
County since 2015, having local authorities capable of enforcing safe and responsible pesticide
application may have potential to change the behavior of bad actors in the pesticide application sector.
Riparian Buffer Restoration
Riparian habitat is crucial to a healthy waterway. Riparian plants prevent erosion and sedimentation,
filter runoff, and provide shade, food and shelter for aquatic animals. While riparian areas makeup only
2% of wild land in Colorado, 95% of Colorado animal species depend on riparian areas at some point in
their lifecycle.
Vail is fortunate to own nearly 40% of the stream front along Gore Creek. The restoration of riparian
habitat on this town-owned stream tract has resulted in a measurable improvement in Gore Creek
macroinvertebrate populations. However, restoration of riparian habitat on private property has been
very limited despite financial incentives, education and training offered by the town. The restoration
and sustainability of healthy water quality for aquatic life like fish and macroinvertebrates in Gore Creek

will depend on the establishment of a continuous, interconnected corridor of riparian habitat along
most of the length the stream. If Gore Creek is to make a full recovery, private property owners need to
follow the town’s lead in restoring native vegetation in the riparian corridor.
Effectiveness of Existing Regulations in Achieving Water Quality Goals
Under current code language the setback from a watercourse in Vail is determined based on the
centerline of the creek. This method for determining a setback is problematic for several reasons and
can be cause for confusion and discrepancy. Most communities have moved away from using centerline
to determine setback for these reasons.
First, there are places on Gore Creek where 50 feet from the centerline is still inside the stream channel,
or even still in the water. This means that there is effectively no setback on properties adjacent to those
wide portions of stream. On braided reaches of creek, where the stream splits into multiple channels, it
can be difficult or even subjective to ascertain which is the primary channel and where the centerline
should be established.
Additionally, centerline is difficult to measure and fluctuates more radically and frequently than the top
of bank or ordinary highwater mark (OHM). A measurement from top of bank or OHM can be taken on
the property where the setback is being determined with a single measurement and without the need to
wade in the creek or enter an adjacent property. Determining centerline requires measurements be
taken across the stream channel with a surveyor entering the water and entering at least one property
on the other side of the creek. Centerline is also not an effective way to establish setbacks from ponds
or wetlands. Establishing setbacks from top of bank or OHM creates continuity among setback
regulations around all water bodies and wetlands.
Finally, using centerline to determine the setback requirements often does not achieve the objectives of
establishing riparian buffers on private property or even ensuring development does not creep too close
to waterways. Additionally, measuring from centerline creates inequitable setbacks on properties
adjacent to wide portions of creek as compared to those adjacent to narrower reaches.
Stream Corridor Protection Codes from around the State
The GSP, adopted by the Town Council in 2016, recommends a bold series of legislative options
designed to protect riparian habitat and restore water quality in Gore Creek. While Vail has taken an
innovative and active approach to restoring its main water body, Vail is not the first to consider an
ordinance to achieve its goals of stream restoration. Many Colorado communities, faced with declining
water quality and dwindling populations of fish and aquatic invertebrates, have seen the need to
establish regulations to halt and reverse those downward trends. These communities are our peers in
many ways, whether they are mountain resort communities, rural communities or strive to be leaders in
environmental stewardship. Their water protection regulations fall into two categories: those designed
for the protection of in-stream water quality and aquatic ecosystems, and those designed for the
protection of drinking water sources. However, all are effective in establishing protections for in stream
water quality and aquatic life.

Collbran
Collbran is a small, rural community on the Grand Mesa in western Colorado. The Source Water
Protection Ordinance adopted by Collbran is primarily focused on protecting the community’s drinking
water sources from contamination. Its stated purpose is to “protect the Town’s watershed and
waterworks from damage, harm or injury and preventing pollution of the town’s water supply.” While
primarily focused on the protection of the watershed and water supply for human health, the ordinance
also has the effect of providing protection for aquatic ecosystems and wetlands. Collbran is a rural
community where agricultural, mining and forestry all take place. As such, their ordinance bans surface
and subsurface mining within the watershed, the use of restricted-use pesticides (pesticides not
available to the general public that can only be applied by state-certified applicators) within 100 feet of
a waterway and removal of trees or vegetation in excess of 0.5 acres. As is the case with most SWPOs,
the jurisdiction of the ordinance applies to a blanket district extending 5 miles upstream of all the
town’s drinking water source points (including wells and intakes). The area of jurisdiction is defined in a
publicly available map that was established as part of the ordinance.
Larimer County
The regulations Larimer County has adopted are for the purpose of wetland more than stream
protection but can be informative in their methods of protecting those aquatic and semi-aquatic
habitats with a tiered series of buffer zones, similar to those established in Boulder’s stream protection
regulations. The Larimer County regulations express their goals as protecting water quality, wildlife
habitat, flood protection and other critical environmental functions. The regulations establish a list of
activities that are prohibited in wetlands and establish minimum buffer zones based on the size of the
wetlands (50 feet for wetlands smaller than one acre, 100 feet for wetlands larger than an acre). The
ordinance establishes a comprehensive map of wetlands as well as a process for challenging the
boundaries of a wetland. While the Army Corps of Engineers establishes national regulations governing
the modification, development and destruction of wetlands, Larimer County has established a broader
definition of what qualifies as a wetland and created a comprehensive map of qualifying wetlands within
the county.
Buena Vista
Like Collbran, Buena Vista adopted a source water protection ordinance with the primary stated
intention of protecting the community’s drinking water supply. The adopted regulations apply to a
blanket area extending 5 miles upstream of all drinking water intakes. This zone is outlined in a map that
was established at the time the ordinance was passed and is publicly available upon request to the town
clerk’s office. Activities requiring a permit from the town include commercial application of landscaping
chemicals, mining, drilling, timber harvesting and use or storage of toxic waste materials, among others.
Steamboat Springs
The ordinance Steamboat has in place is primarily a drinking water protection ordinance, similar to
those established by Buena Vista and Collbran. Like those other source water protection ordinances, it

establishes a jurisdiction extending 5 miles upstream from all drinking water intakes. The ordinance
dictates that a permit is required for a suite of activities including use of any restricted use pesticide,
removal of vegetation in excess of 0.5 acres, removal of vegetation within 100 feet of a waterway and
mining.
Glenwood Springs
Glenwood Springs is in the process of adopting code changes designed to protect waterways, stream
channels and riparian habitat for the benefit of water quality and aquatic species. The proposed code
language would establish a 50-foot setback from the Ordinary Highwater Mark (OHM). This is a
designation recognized and defined by the Army Corps of Engineers. The proposed changes would
prohibit building, grading, excavation, backfill, dumping, vegetation removal (in excess of 10% on a
property), and chemical treatments (with exceptions made for noxious weed control).
Boulder
The ordinance that the City of Boulder adopted to protect waterways and wetlands makes specific
reference to the fact that non-point source impacts to waterways were historically of little concern
throughout most of the City’s development. This is true of many Colorado communities, Vail included.
The Boulder ordinance offers a detailed explanation of its legislative intent, indicating that waterways
are “indispensable and fragile natural resources” and that “it is necessary for the city to ensure
protection by discouraging development activities in streams, wetlands and water bodies and those
activities at adjacent sites that may adversely affect the visibility and functional values of these
resources.”
To that end, Boulder adopted a suite of regulations that establish a tiered series of zones including the
water bodies themselves, an inner buffer and an outer buffer. Within those zones, activities are
characterized as Exempted, Conditional Use, Standard Permit Review, Prohibited Activities or Allowed
with Notice. This strategy allowed the city to create a single set of standards, made available and easily
understood through a chart that appropriately limits, discourages or bans various activities that have an
adverse impact on the water resources within the city based on the proximity of those activities to
valuable water resources. For example, construction of new or expansion of existing impervious surfaces
(such as pathways and driveways) are prohibited within the wetland or waterbody itself, and subject to
standard permit review in both the inner and outer buffer zones.
Legislation can help us achieve our goal of permanently removing Gore Creek from the 153d list
In 2018, the Colorado Department of Health and Environment (CDPHE) amended the formula it used to
calculate macroinvertebrate scores in Gore Creek (MMI v4). When applied to all macroinvertebrate
samples taken from Gore Creek since 2009, all but one site in one year (2011) failed to meet the
standards set with this new formula. This policy change essentially revised Gore Creek scores down.
While still showing that steady, if modest, improvements have been made in recent years due to
Restore the Gore initiatives, Gore Creek is farther from reaching its goal of removal from the state’s
153d list than it was under the previous formulation (MMI v3).

Setback overlay zone
The most effective buffer zone ordinances delineate at least two separate areas of influence along
creeks, streams, wetlands and ponds. Setbacks are measured from top of bank or OHM, which can be
established objectively and easily measured. Within a narrow, inner buffer land use activities are tightly
restricted. Mowing, vegetation removal, chemical use and establishment of impervious surfaces are
prohibited with only few exceptions for control of invasive weeds. Beyond that an outer zone
establishes less stringent restrictions on land use and landscaping activities but still provides a level of
protection for water quality by limiting or prohibiting high impact activities such as construction of
hardscapes, development and storage of materials, even if vegetation removal and landscape
maintenance are permitted within this outer zone. The existence of multiple zones also allows for
exceptions to be made for properties where existing buildings are very close to the top of bank. In such
places, municipalities sometimes choose to only apply a strict inner buffer, allowing property owners to
manage areas outside that buffer as they always have.

Exemptions should be made for certain permitted activities within even the inner buffer. For example,
should the use of pesticides be prohibited within an inner buffer at some time in the future,
opportunities need to exist for property owners to obtain a permit to manage an infestation of noxious
weeds like Canada thistle, which are nearly impossible to maintain without the use of herbicide. There
also needs to be a mechanism through which removal of dead vegetation, such as hazard trees and
potential fuel sources, can be permitted.
Legal Considerations
As outlined in the attached legal memo authored by Matt Mire and Kendra Carberry of HPWC Law, a
small “no-mow zone” or riparian buffer zone would likely withstand potential legal challenges. It is the
opinion of the Town’s legal counsel that requiring a 5-10 foot vegetated buffer to be restored or
preserved on private property would not constitute a “regulatory taking.”
Legal considerations relating to pesticide regulations are somewhat more complicated because of the
“local preemption” clause of the Colorado Pesticide Applicators Act. As they are currently written,
statewide pesticide regulations include language that constrains the ability of local jurisdictions to pass
more stringent regulations than those that exist at the state level. At this time, Vail town council is
therefore prohibited from adopting pesticide regulations divergent from, or above-and-beyond,
statewide regulations already on the books.
The attached memo from the town’s legal counsel, however, points out that the Town of Vail may
regulate pesticides “in the same manner that state or federal government” regulates their use. At first
blush, it may seem futile and redundant to adopt a local ordinance that imposes the same restrictions as
those already in place at the state level. In fact, doing so could resolve enforcement challenges that
town staff have faced in the past.
Statewide pesticide regulations may only be enforced by the Colorado Department of Agriculture. Town
of Vail staff have struggled to convince state officials to make the trip to Vail to investigate and enforce
egregious violations of state pesticide regulations in the past. In fact, there has only been one instance
of state regulators enforcing pesticide regulations in Eagle County since 2015. By adopting code
language that reiterates state pesticide regulations, town council could empower the Vail Police
Department to enforce those regulations without relying on state investigators making the trip up from
Denver.
Conclusion
A stream corridor protection ordinance, while recommended by the GSP, has not yet been adopted in
the Town of Vail. While steady, modest progress has been made in recovering aquatic
macroinvertebrate numbers in Gore Creek, full recovery is unlikely to occur without the widespread
restoration of riparian buffers on both public and private property. Adoption of a well-thought-out
ordinance that regulates vegetation removal, construction, hardscape and other activities within a near
stream zone has enormous potential to help Town of Vail achieve its goal of permanently removing Gore
Creek from the state’s 303d list of impaired waterways.

Subject: Stream Corridor Protection Ordinance
I. PURPOSE
The purpose of this memorandum, alongside the accompanying white paper, is to present a
framework for a stream corridor protection ordinance in Vail. Staff is seeking a Council directive
on the following:
Does the Vail Town Council support staff moving forward drafting of a stream corridor
protection ordinance for Planning and Environmental Commission review, including the
elements as presented?
II. BACKGROUND
The Gore Creek Strategic Plan was adopted by Resolution 9, Series of 2016 on March 15,
2016. The Strategic Plan identifies the “loss of riparian vegetation and habitat” as one of the
three main causes of the declining health of Gore Creek. Additionally, town-led efforts to reduce
the use of pesticides near waterways have resulted in modest but consistent improvements in
aquatic macroinvertebrate numbers. Because of the widespread nature of the degradation of
riparian habitat along Gore Creek in Vail, the efforts to restore Gore Creek must also be
widespread and diverse and will require the engagement of all creekfront land managers.
The Town and key partners like Eagle River Water & Sanitation District, Eagle River Watershed
Council and Vail Recreation District have made impressive strides toward restoring riparian
habitat on property they manage. Restoration of riparian habitat on private property has lagged
behind, with a few notable exceptions where private property owners received financial support
from the Town. Widespread restoration of riparian buffers on private property must occur in
order to achieve the goals laid out in the Gore Creek Strategic Plan.
III. GOALS AND OBJECTIVES
The over-arching goal of a stream corridor protection ordinance is to establish best practices on
private property that, when implemented, restore streambank habitat to the highest
environmental standards by both private and public property owners, contributing to removal of
Gore Creek from the 303d list of impaired waterways.
Objectives:
1. Create a clear set of requirements for establishment and maintenance of riparian
setbacks.
2. Limit turfgrass and hardscape and deter excessive chemical use within a delineated
buffer zone.

3. Educate property owners and managers about how to implement best management
practices in riparian restoration and raise awareness of the importance of riparian
buffers on private property.
4. Increase the area of riparian buffer adjacent to Gore Creek and its tributaries.
5. Incentivize creek-friendly landscaping practices by assisting private property owners
with project design and implementation.
IV. STREAM CORRIDOR PROTECTION ORDINANCE
To be effective and aligned with best management practices, any stream corridor protection
ordinance in Vail should include restrictions on removal of vegetation, construction and
hardscape to successfully achieve the goals and objectives above. In addition, efforts to deter
excessive landscape chemical use should be pursued to the extent possible under current state
law. To be appropriate for Vail the ordinance would need to establish exceptions and
exemptions for existing structures and hardscapes, the control of invasive weeds, and removal
of dead and hazardous vegetation.
Paramount to the success of an ordinance in achieving the goals stated above is establishment
of a clear and easily measured setback in which specific activities are limited or prohibited.
These adopted setbacks could be adapted from the recommendations in the Environmental
Protection Agency’s (EPA) “Aquatic Buffer Model Ordinance,” but will be modified to take into
account the nature of existing development in the Town of Vail.
Exemptions could be made, for example, if the property owner obtains a permit by providing
clear and convincing evidence to the Design Review Board or Vail Fire Department that one or
more of the following criteria is met:
• In cases where existing structures fall within 20 feet of the Ordinary High Water Mark
(OHWM), the “no-mow-zone” would extend half the distance measured from OHWM to
the structure.
• Vegetation removal would be permitted in cases where trees pose a threat to people,
structures, or property or have been identified by Vail Fire Department as potential fuel
sources or are recommended for removal as part of the establishment of defensible
space around a structure in accordance with Vail Fire-Resistant Landscaping guidelines.
• Property owners will be given permission to maintain a limited path for creek access.
• Variances may be issued by the Design Review Board (DRB) or Vail Fire Department.
While the framework for a Stream Corridor Protection Ordinance outlined in this memorandum
is the result of extensive research by town environmental staff, all of the suggested elements
will be vetted through the Planning and Environmental Commission and public hearings before
code language is brought before Town Council before approval.
V. LEGAL OPINIONS
The legal memorandum from J. Matthew Mire and Kendra Carberry presented during executive
session supports the power of Town Council to adopt code language that establishes a
mandated riparian setback on private property. It concludes that such an ordinance would not
be considered a legal “taking” and is supported by existing case law.
The memo also delves into the powers Town Council has to regulate pesticides within its
jurisdiction. While Council is forbidden by Colorado law to adopt language which is more
stringent than statewide pesticide regulations, Council may reiterate those statewide regulations
in municipal code. This would have the benefit of empowering town police and code
enforcement officers to enforce pesticide regulations, a power which is currently reserved for

state Department of Agriculture officers based in Denver. There has only been one instance of
enforcement action taken in Eagle County since 2015. The presence in Vail of local law
enforcement with the power to intervene in cases of excessive or irresponsible use of pesticides
could offer a strong deterrent to bad actors who have otherwise been able to operate with little
fear of repercussion.
VI. IMPLEMENTATION
While town staff already provides high level technical assistance to homeowners, a successful
stream corridor protection ordinance should be accompanied by additional outreach, education
and support for private property owners and managers. Such support could include native plant
giveaways, a rebate program, assistance with design and plant selection, assessments of buffer
zones and free consultations from town staff.
VII. NEXT STEPS
Should the Town Council decide to move forward with a stream corridor protection ordinance,
staff will begin drafting code language to take to the Planning and Environmental Commission
(PEC) for a recommendation to adopt. Pending such a recommendation from PEC, staff would
then return to Council with draft code language for a first reading.
VIII. STAFF RECOMMENDATION
Staff recommends the Vail Town Council support development of a stream corridor protection
ordinance that includes:
1. A ten-foot setback from the high-water mark that limits removal of vegetation, mowing,
establishment of hardscapes, and construction. Exemptions will be made for specific cases
(existing structure, requirements for fire protection, fuels reduction and hazardous vegetation
removal).
2. Adopt code language that reiterates statewide pesticide regulations, thereby giving town
law enforcement officers the power to enforce those regulations.
3. Amend current code language to establish a building setback of 25 feet from OHWM.
• Eventually, Council should consider appropriating funds for incentive programs and
technical assistance for property owners as they undertake bank stabilization and
riparian restoration projects in compliance with this ordinance.

The Authority suggested using the voter registrations to confirm full time residents. Moffett
suggested EPS work with the Economic Development department as they may have some
applicable data.
The assessor data will be used to form the basis of gathering and build upon the properties
using multiple data sources.
Next steps, EPS will test the options to confirm accessibility and ease of updates then come
back to provide an update at a future meeting.
4.2. Commercial Linkage / Inclusionary Zoning Update
Presenter: Andrew Knudtsen & Rachel Shindman, Economic Planning Systems
Current summary status of mitigation methods was reviewed by EPS. Graphics provided
presented five options with the goal to obtain units versus a fee-in-lieu. The chart recognized
a step up in mitigation for down valley housing.
Discussion ensued between EPS and the Authority.
The Authority wishes to retain a fee-in-lieu as well to acquire units. EPS will continue
reviewing options and return at a future meeting as well they will provide findings from
residential linkage.
4.3. West Middle Creek Rezoning Application Status
Presenter: George Ruther, Housing Director
According to Ruther the application is submitted for the February 22nd PEC meeting.
Comments from the Authority are due to planning no later than February 12th. Item 5 is
where Ruther believes the Authority concentrate. Focus on the larger environmental
impacts, increased traffic, parking ones that are constant and recurring. The Authority
discussed application revisions. Emphasis for PEC is to focus on criteria and Council review
policies.
4.4. West Vail Master Plan - Housing Element
Presenter: Steve Lindstrom, Chairman
Lindstrom spoke with Mauriello Planning Group requesting to provide update to Housing.
Lindstrom asked the Authority members to appropriate funds to hire Mauriello Planning
Group as consultant. McDougall and Lindstrom will work with MPG. Lindstrom requested
authorization to encumber $5K for consulting fees.

Sales Tax
Upon receipt of all sales tax returns, January collections are estimated to be
$3,211,435 down (21.2)% from last year and down (4.9)% compared to budget.
Inflation as measured by the consumer price index was up 1.4% for January. The
annual budget totals $22.5 million.
Real Estate Transfer Tax (RETT)
RETT collections through February 24th total $565,339 down (39.6)% from this
time last year. The 2021 annual RETT budget totals $7,000,000, down 32% from
2020 actual collections.
Construction Use Tax
Use Tax collections through February 24 total $277,512 compared to $178,354
from this time last year. The 2021 annual budget totals $2,250,000.
Lift Tax
Lift tax collections for the 2020/2021 ski season through January 31 total
$2,248,732 up 1.2% or $27,225 from this time last year.
Parking Revenue
Season to date:
Pass sales from November through February 24 total $1,093,294 down $(655,953)
or (37.5)% from prior winter season. The majority of the decrease in pass sales is
due to fewer purchases of blue passes and lower prepaid revenue on value
passes.
Daily sales from the parking structures from November through February 22 total
approximately $3,398,825, up $315,027, or 10.2% from this time last year.

The Vail Business Review breaks down the four percent sales tax collected for the
month of December and the year.
Overall, December sales tax decreased (14.9)% with retail decreasing (6.3)%, lodging
decreased (20.0)%, food and beverage decreased (23.7)%, and utilities/other
decreased by (9.0)%. Excluding the out of town category; sales tax for the month of
decreased (28.4)%.
The year resulted in a (14.9)% decrease overall with retail decreasing (4.7)%, lodging
decreased (20.5)%, food and beverage decreased (24.0)%, and utilities/other
decreased by (6.8)%. Excluding the out of town category; sales tax for 2020 was down
(20.6)%.
