Dear Ned:
Enclosed is a copy of he minutes of the PEC Meeting Date, July 13, 1992 Planning and
Environmental Commission (PEC) meeting at which your conditional use permit and site
coverage variance requests were approved. The attached copy of the minutes will serve as
your record of the conditions of approval.
Please note that these approvals of the conditional use permit and site coverage variance
shall lapse and become void il a building permit is not obtrained and construction not
commenced and diligently pursued toward completion, or if the use for which the permit is
granted has not commenced within two years lrom approval (July 13, 1992). lf approval of
this conditional use permit lapses, an application must be resubmitted for reconsideration by
the Community Development Department staff and the PEC.

The meeting was called to order al2:6 p.m. by Chairperson Diana Donovan.
Public Hearino
1. A request for a conditional use permit and a site coverage variance to allow for the
expansion of an existing outdoor dining deck for Sweet Basil Restaurant, 193 Gore
Creek Drive, part of Lot A, Block 58, Vail Village First Filing.Applicant Kevin ClairPlanner: Shelly Mello
Shelly presented the request to the Commission. She stated the main concems of the
statf were the expansion on the deck onto public property, additional landscaping, the
use of charcoal pavers and the deck railing material. Ned Gwathmey, representing the
applicant, addressed the Commission reviewing the changes they are proposing. He
stated that the applicant agreed with all of the staffs recommendations with the
exception ol the railing. There was discussion regarding the plan around the deck as
far as pavers versus he asphalt presenUy there. lt was agreed that he pavers should
replace the asphalt for a more uniform look. A discussion followed regarding the
planting of a tree in the planter in front of the restauranl Kevin Clair, he applicant, felt
a tree planted in tront of his door would deter customers from entering his
establishment. After some discussion, it was agreed by the applicant and the
Commission to plant t$ro trees on either side of the business in the two 'notches'
already lhere. After further question, Jeff Bowen made a motion to approve the
request with the inclusion of the tree compromise and the use of pavers around the
soldier course to be included in the staff memo. Greg Amsden seconded he motion.
A vote was taken and fie motion passed, 5-0, witr Kathy Langenwalter and Diana
Donovan voting against the motion.
2. A request to amend a condition of a previously approved variance and exterior
alteration, regarding fte CCI parking pay-in-lieu fee for he Red Lion Building, located
at 304 Bridge SEeeULots E, F, G and H, Block 5A, Vail Village First Filing.
