On behalf of Michael Suman and myself, thank you for your time to discuss the water feature proposed for the Property. In light of the Eagle River Water and Sanitation District's (the "District") position that it cannot lawfully supply water to the feature, this letter provides information you requested concerning a proposed water supply for it. The owner agrees that no water from the District will be used to fill or refill the water feature. Instead, the owner will contract with a water hauling company(ies) to supply water to fill and refill, as needed, the water feature. There are several companies in Colorado that provide this service. Water would be delivered to the Property by water truck and deposited into the water feature. Many properties within the Town of Vail have water features. This proposal will allow the owner to enjoy its Property and water feature without posing any risk to the District's water rights or supplies. The lot shares a driveway with the adjacent existing home located on Lot 11. Lot 10 is a .68 acre lot that slopes upward to the north. We have completed the study to confirm that the lot is not a `Hazzard' property due the slope greater than 30%. The lot is Zoned as a Primary/Secondary lot. We are proposing that a Mountain Modern style Primary/Secondary be constructed. The lot is steep off the existing drive access and we are proposing that regrading along the south property line occur to improve the access so that a drive can be constructed to serve the property/homes. We are in discussions with the Neighbor on lot 8 and lot 9 to grade onto their properties to `ease' the steep slope appearance of the existing hillside. They are in favor of our design direction. We shall have adjacent property letters and sign -off before building permit submittal. There is an access isle easement to a water tank that Eagle River Water and Sanitation District will require access to and thru the property. We have proposed that this lot 10, take the access isle completely onto lot 10. This reworking is being reviewed by ERW&SD. The access will be a straight - shot rather than the current curving steep gravel road. Surface will be gravel, and be approved by ERW&SD as the design progressed into permit submittal. The Primary Unit (West) will have a 5 bedrooms and a 2 car garage. The Secondary Unit (East) will have 3 bedrooms + an office off the garage for the Owner and a 3 car garage. Please refer to sheet A0.0 thru A0.4 for the size/GRFA calculations. The homes are 3 stories cut into the hillside to step back the front facade to reduce the overall height appearance.
