Dear George:
Attached you will find an application form, filing fee and proposed preliminary and final
plats for a Major Subdivision at the Lodge at Vail. As you may recall from our previous
conversations, the purpose of this plat is to simply formalize the parcel of land beneath
the Lodge South Condominiums. As you know, for many years the Lodge South has
been regarded as "its own" development site. However, this parcel has not been legally
subdivided. The proposed subdivision will simply clarifu an existing condition and in
doing so, will not convey or create any development rights to the Lodge South or to the
remaining Lodge at Vail parcel.

Creek Drive/Lots A & C, Block 5-C, Vail Village First Filing.

SUMMARY
The applicant, Vail Resorts Development Company (VRDC), represented by Braun
Associates Inc., is requesting a major subdivision, pursuanl to Chapter 13-3, Vail Town
Code, to allow for the platting of Lots 1 and 2, Lodge Subdivision, located at 164 Gore
Creek Drive/Lots A & C, Block 5-C, Vail Village First Filing. Staff has reviewed the
application and is recommending that the Commission approves the request subject to
the findings outlined in Section Vl of this memorandum.
DESCRIPTION OF THE REQUEST
The applicant, Vail Resorts Development Company (VRDC), represented by Braun
Associales Inc., is requesting a major subdivision, pursuanl to Chapter 13-3, Vail Town
Code, to allow for the platting of Lots 1 and 2, Lodge Subdivision, located at 164 Gore
Creek Drive/Lots A & C, Block 5-C, VailVillage First Filing.
The purpose of the major subdivision is to vacate the common lot line creating Lot C and
to establish Lots 1 and 2, Lodge Subdivision (Lot 1 - Lodge at Vail/Lot 2 - Lodge South
Condominiums). According to the proposed plat, Lot 1 is 17,337 square feet (0.398
acre) in size and Lot 2 is 88,165 square teet (2.024 acres) in size. This is a slight
change from the previously approved lot sizes ol 14,680 square leet (0.337 acre) and
90,822 (2.08 acres), respectively.
BACKGROUND
On April 14, 1997, the Town of Vail Planning and Environmental Commission approved
a minor subdivision of the Lodge Tower Parcel. The purpose of the minor subdivision
was to formalize the ownership and historic developmenl pattern of the Lodge Tower
Parcel since it was divided pursuant to a condominium plat recorded in October of 1973.
For zoning purposes, the Lodge Tower Parcel development site is considered legally
established, non-conforming wilh respect to site coverage, GRFA, landscape area,
density, and parking.

MAJOR SUBDIVISION CRITERIA
According to Section 13-3-4, Commission Review of Application; Criteria, Vail Town
Code,
"The burden of proof shall rest with the applicant to show that the application is in
compliance with the intent and purposes of the Chapter, Zoning Ordinance and
other pertinent regulations that the Planning and Environmental Commission
deems applicable. Due consideration shall be given to the recommendations
made by public agencies, utility companies and other agencies consulted under
subsection 13-3-3C above. The Planning and Environmental Commission shall
review the application and consider its appropriafeness in regard to Town
policies relating to subdivision control, densities proposed, regulations,
ordinances and resolutions and other applicable documents, environmental
integrity and compatibility with surrounding land uses and other applicable
documents, effects on the aesthetics of the Town."
One of the basic premises of subdivision regulations is that minimum standards for the
crealion of a new lol must be met. This project will be reviewed under the Major
Subdivision Criteria, pursuant to Section 13-3-4, Subdivision Regulations, Vail Town
Code.
The first criterion to be considered by the Planning and Environmental Commission for a
Major Subdivision application is:
Lot Area - The Zoning Code requires that lhe minimum lot or site area for a lot
located in the Commercial Core I (CCl) zone district shall be 5,000 square feet of
buildable area.
Staff Respnse-The major subdivision meets this requirement.
Frontage - The Subdivision Regulations require a minimum street frontage of
thirty feet (30').
Staff Response - Through the provision of a perpetual parking and entrance
easement (book 231, page 613), adequate and acceptable means of ingress and
egress will be provided.
The second set of criteria to be considered by the Planning and Environmental
Commission for a Major SuMivision application is the subdivision purpose stalements.
The suMivision purpose slatements are as follows:
1. To inform each subdivider of lhe standards and criteria by which development
and proposals will be evaluated and to provide information as to the type and
extent of improvemenls required.
Staff Response - The review of this request has followed the regulations
prescribed for major subdivisions of land.
2. To provide lor the suMivision of property in the future without conflict with
development on adjacent properties.
Staff Response - This proposal simply formalizes the subdivision approvals
granted in 1973 and 1997. The subdivision will not conflict with future
development on adjacent propefties.
3. To protect and conserve the value of land throughout the municipality and the
value of buildings and improvements on the land.
Staff Response - Staft does not believe that the proposed subdivision request
will have any negative impacts on the value of land or the value of buildings and
improvements on the land.
4. To insure that suMivision of property is in compliance with the Town Zoning
Ordinance, to achieve a harmonious, convenient, workable relationship among
land uses, consistent with municipal development objectives.
Staff Response - The proposed subdivision meets the intent and purpose of the
Zoning Regulations for the parcel of land. The improvements on the land are
considered to be legally established non-conforming and will continue to be so
upon subdivision of the parcel. According to Town of Vail records, the two
parcels have been treated separately for zoning purposes since 1973.
5. To guide public and private policy and action in order to provide adequale and
efficient transportation, water, sewage, schools, parks, playgrounds, recreational
and other public requiremenls and facilities and generally to provide that pubic
facilities will have sufficient capacity to serve the proposed subdivision.
Staff Response - Staff does not believe the requested major suMivision will
have any adverse impacts on the above-described criteria.
6. To provide lor accurate legal descriptions of newly subdivided land and to
establish reasonable and desirable construclion, design standards and
procedures.
Staff Response - The proposal will result in an accurate legal description of the
subdivided land.

7. To prevent the pollution of air, streams, and ponds, to insure adequacy of
drainage facilities, to safeguard the water table and to encourage lhe wise use
and management of natural resources throughout the municipality in order to
preserve the integrity, stability and beauty of the community and the value of
land.
Staff Response - Staff does not believe the proposed major subdivision will have
any negative impacts on the above-descibed criteria.
STAFF RECOMMENDATION
The Community Development Department recommends that the Planning and
Environmental Commission approves lhe request for a major suMivision, pursuant to
Chapter 13-3, Vail Town Code, to allow for the platting of Lols 1 and 2, Lodge
Subdivision, located at 164 Gore Creek Drive/Lots A & C, Block 5-C, Vail Village First
Filing. Staff's recommendation of approval is based upon the review of the criteria
outlined in Section V of this memorandum and lhe evidence and testimony presented on
the request.
Should the Planning and Environmental Gommission choose to approve this request,
staff recommends that the following finding be made as part of the motion,
"The Commission finds that the applicant has demonstrated to the satisfaction of
the Commission that the application is in compliance with the intent and
purposes of the Chapter, Zoning Ordinance and other pertinent regulations that
the Planning and Environmental Commission deems applicable- Further, the
Commission finds that the request if appropriate in regard to Town policies
relating to subdivision ontrol, densities proposed, regulations, ordinances and
resolutions and other applicable documents, environmental integrity and
compatibility with surrounding land uses and other applicable documents, effects
on the aesthetics of the Town."

Tom Braun explained the desire of the school to utilize a portion of the approved employee
housing units for storage while the school is being completed. He explained that the current
number of students did nol require an increase in the number of slafl members, therefore the
need lor the EHUs is not necessary at the current time. The proposal is to use six of ihe eight
EHUs for office space and storage. He continued by explaining the timeline for getting the other
EHUs operation and occupied by the new staff. The applicant requested that they be able to use
all eight garages for storage.
No public input.
George Lamb sees this as a housekeeping item. No problem utilizing the EHUs for storage
however the storage should be maintained within the building and garages in order to maintain a
residential character. He believes nro of the garages should be available for the occupants of
rhe EHUs.
Doug Cahill agreed with George Lamb's comments. He reiterated that lhere should be a
residential character to the property regardless of its use for storage if approved.
Chas Bernhardt asked if there was excess parking on the campus to accommodate the two
occupants of the EHUs.

Chip Melick discussed the proposed development and the standard lrom which the project deviated.

George Lamb expressed his appreciation to the applicant for breaking up the proposed ridgeline.
He suggested that the applicant communicate their plans with the residential owners in Golden Peak
and other neighboring property owners to avoid lasl minule concerns about impacts to views to the
east. George stated that traffic impacts on Vail Valley Drive could be a concern.
Doug Cahill expressed a suggestion to create the connectivity between buildings on the first floor
instead of the third floor. He suggested further research into the use of the surplus parking spaces to
avoid further congesting Vail Valley Drive. He questioned the applicant's intent to "clean up" lhe
Gore Creek and Mill Creek riparian corridors.
Chas Bernhardt indicated that he liked this proposal betler than the previous plan. He felt that
landscaping should be considered to help visually break mass the horizontal mass of the buildings.
Chas suggested that the applicant conceptually explore the possibility of large trees in the landscape
plan.
John Schofield stated his concern that the redevelopment of residential condominiums can not rely
solely upon deviations from the development regulations to'Tund" renovation projects. That said, he
suggested the applicant now submit a complete application and proceed towards a decision ol the
Commission. He expressed that building bulk and mass and building height were the two most
important concerns of the Commission and needed to be addressed. He further stated that parking
and impacts to traffic on Vail Valley Drive.

John Schofield stated that if the negative impacts of parking could be addressed, then surplus
parking on the Manor Vail Lodge development site could be acceptable.

crafted as special circumstances exist.

George Lamb believes this is a unique situation which warrants the allowance of an office use.
John Schofield does not believe that the location is at street level. He pointed out the
Conditional Use process.
George Ruther explained that he heard that the Commission disagreed with Staff's
interpretation therefore this regulation would not burden this applicant.
Motion was made that this location is not located at street grade.
George Ruther restated for clarification the Commission's understanding of how the space in
question differed from Karats.
