1. Explanation of status as aggrieved party: The Linns are an adjacent property owner.
2. Precise nature of appeal
The Linns believe that the installation of a new 21 foot long wall/box that is 20 inches high and
25 inches deep ("Constructed Improvements") constructed by Urban 22 Studio LLC required
design approval pursuant to VMC § 12-11-3. Photos of the Constructed Improvements are
attached as Exhibit 1.
No permit for these Constructed Improvements was obtained. It is the Appellant's
understanding that Staff may have determined that the Constructed Improvements are exempt
from Town design approval as "addition of plant materials to existing landscaping, gardening
and landscape maintenance." It is this exemption that the Linns dispute.

Subject: Modifications to the theater space at Solaris (previously Cinebistro)

This memo is intended to summarize the proposed changes to the exterior of Solaris as part of the new
theater proposed in the space previously occupied by Cinebistro. This information provides an
overview of the changes proposed and is a supplement to the plans submitted for Design Review
Board.
1. Changes to the front entry:
• Storefront will change to dark wood and metal — black metal to match existing retail metal
• New door, recessed lighting
• Stone columns to remain, light fixtures to remain
• Signage under future separate application
2. Changes in the breezeway:
• Metal paneling added adjacent to stone column to cover existing window openings
• Possible location for digital movie posters (will be a separate application for signage)
• Reflective metal ceiling panels
• Lighting
3. Changes to rear exit:
• Enlarge door opening
• Upgrade doors, metal to match front
• Lighting
• Roof overhang to remain

Building Materials Listings for Wildland Urban Interface Building Materials
The Office of the State Fire Marshal's (SFM) Building Materials Listing Program (BML) was originally created to mandate that all fire alarm
systems and fire alarm devices be approved and listed by the State Fire Marshal prior to sale or marketing within the state. The program
later was expanded to include many other materials such as: roof coverings, fire resistive wall and ceiling -floor assemblies, wall finish
materials, fire and non -fire related hardware, insulating products, fire doors, fire dampers, electrical appliances and devices. Each product
approval and listing is based upon an evaluation of test results that include an analysis of required product performance and reliability
features.
