Applicant: Vail Resorts

1. Approval of this Conditional Use is contingent upon the applicant
obtaining Town of Vail design review approval for this proposal.
2. The applicant shall operate the base area improvements in a manner
generally consistent with the approved plan dated 11/22/2021.
Planner Leaman -Miller gives a short presentation on the application. He
shows the vicinity map for the location of the proposed conditional use
permit improvements. The application includes food and beverage service,
lighting, and seating.
Jeffery Babb, representing the applicant, goes over their proposal. The
name of the proposal has been changed to "Trail's End Treats". The goal of
this proposal is to draw more people to the golden peak area as an access
to the mountain. He goes over the presentation and the items included in the
application.
Perez asks if the vehicle and airstream will be driven over the grass.
Babb answers that they will not be putting it in place until there is snow
covering the area.
Phillips asks about the operating hours.
Babb answers 8:00 am - 4:30 pm.
Phillips asks for the purpose of the lighting if it is only open during the day.
Babb says it is for the ambience in the area.
Kurz asks if lights will be on all night.
Babb say they will not.
Perez asks if the neighbors had been notified. Babb said yes, they did
notification beyond what was required to those in the area.
Gillette asks about the lights and how they were allowed in Town Code.
Staff answers that it will be addressed at DRB and holiday lights are allowed.
Kjesbo asks if this will be a tester for a more permanent placement.
Babb says that it is not proposed to be permanent. Maybe during the
summer if it goes well, but they have no intention to build anything
permanent at this time.
Perez asks about the airstream as it doesn't seem to match the Vail Brand.
No public comment
Kurz says it could be a benefit to move people around and make some other
portals less crowded. Is there surety that this can be staffed all season long?
Babb notes that consistency is key. They believe they can operate with one
person as they are not making items, only dispensing. The production will be
taking place inside the adjacent buildings with those facilities.
Perez asks if there will be supervision for kids.
Babb says that there will be no staff to supervise, and they would anticipate
this being done with the parents. Not only is this for kids, but more for
families to enjoy at the end of the day.
Perez has concerns about one employee being there.
Phillips asks if anyone has responded with comments.
Babb, and staff, noted that there were no public comments received prior to
the meeting.
Kjesbo asks about the conditional use and how this is classified. Staff
responds about how the application fits into the conditional uses.
Rollie Kjesbo moved to approve with conditions. Reid Phillips seconded the
motion and it passed (6-0).

2.2. A request for review of a Conditional Use Permit pursuant to Section 20 min.
9C-3 Conditional Uses, Vail Town Code, in accordance with Title 12,
Chapter 16, Conditional Use Permits, Vail Town Code, for improvements
including the installations of restrooms at the Booth Falls Trailhead located at
the terminus of Booth Falls Drive, Unplatted, Parcel # 2101-022-00-002,
and setting forth details in regard thereto. (PEC21-0056)

1. Approval of this Conditional Use is contingent upon the applicant
obtaining Town of Vail design review approval for this proposal.
Planner Spence gives an explanation of the application. He gives a short
history of the facilities currently in place on the site. The TOV did hold an
open house at the Vail Mountain School that had some public attendance
from the neighborhood.
Phillips asks if this will be attached to the utilities or a pump out facility.
Spence answers that this will have full hookups to water and sewer.
Todd Oppenheimer notes that this is a funded project for 2022. This trail
averages over 200 hikers a day and peaks at 400 per day. The current Port-
o -lets need to be serviced multiple times per week to keep up with the use.
Gillette asks if this gets plowed and if we are creating snow storage issues.
Todd answers that it does not get plowed so there are no snow storage
issues.
Gillette asks about the public comments we've received.
Spence says that none have been received. Todd says that the comments at
the open house were about the traffic and parking, not the proposed facility
addition.
Gillette asks staff to confirm that the required notification was done.
Spence confirms.
Public comment opens.
Tom Talbot speaks for the homeowners at Booth Falls Mountain Homes.
They are in support of this application. They've seen how the lack of
facilities has affected the area and their enjoyment of their property. They
want to make it clear that they support this and encourage the PEC to
approve the application. They've asked for additional plantings for screening
and staff has responded.
Public comment is closed.
Kurz notes that he expects the standards of quality for the rest of Town
facilities to be continued here.
Rollie Kjesbo moved to approve with conditions. Reid Phillips seconded the
motion and it passed (6-0).

I. SUMMARY
The applicant, Vail Resorts, represented by Jeffrey Babb, is requesting the review of a
Conditional Use Permit, pursuant to Section 12-16, Conditional Use Permits, Vail Town Code, to
allow for the installation of base area improvements at Golden Peak consisting of food and
beverage offerings, seating, and lawn games.
Based upon Staffs review of the criteria outlined in Section VIII of this memorandum and the
evidence and testimony presented, the Community Development Department recommends
approval, with conditions of this application subject to the findings noted in Section VIII of this
memorandum.
II. DESCRIPTION OF REQUEST
The applicant, Vail Resorts, is requesting the review of a Conditional Use Permit, pursuant to
Section 12-16, Conditional Use Permits, Vail Town Code, to allow for the installation of base
area improvements including food and beverage offerings, seating, and lawn games.
The proposal will operate in a 50 by 50 -foot area north of the pedestrian path and Golden Peak
lift (see attached vicinity map). The operating hours will be between 8:00 am and 5:00 pm, and
all noise be in compliance with Town regulations. This area will feature food and beverage
service in a vintage Airstream measuring 24 feet by 8 feet. The Airstream includes an eight -foot
service window, along with indoor seating for eight and a service area for up to four staff. A hot
chocolate bar will be included to attract kids and emphasize the family -friendly nature of the
proposal. The area will also feature 12 to 18 Adirondack chairs as well as two to four picnic
tables. Additionally, there will be five propane mushroom heaters (around seven feet tall), as
well as 200 feet of bistro string lights. Finally, the area will feature a Toyota Tundra and Sequoia
provided by the sponsor (see attached proposal).
III. BACKGROUND

The site (210108109006) Tract B, Vail Village Filing 7 is designated Open Space land use, with
Ski Base land use on the rest of the site. The proposed base area improvements are located
next to the Vail Trail.
The Golden Peak Base Area has historically been lesser used in winter than the other lifts in
town. However special events in the past have shown that the area can become lively when
programming occurs. The proposal reflects the continued efforts in the town to provide cultural
activities and experiences for both residents and visitors.
IV. APPLICABLE PLANNING DOCUMENTS
CHAPTER 12-16: CONDITIONAL USE PERMITS (in part)
SECTION 12-16-1: PURPOSE; LIMITATIONS:
In order to provide the flexibility necessary to achieve the objectives of this title, specified
uses are permitted in certain districts subject to the granting of a Conditional Use Permit.
Because of their unusual or special characteristics, conditional uses require review so
that they may be located properly with respect to the purposes of this title and with
respect to their effects on surrounding properties. The review process prescribed in this
chapter is intended to assure compatibility and harmonious development between
conditional uses and surrounding properties in the Town at large Uses listed as
conditional uses in the various districts may be permitted subject to such conditions and
limitations as the Town may prescribe to insure that the location and operation of the
conditional uses will be in accordance with the development objectives of the Town and

will not be detrimental to other uses or properties. Where conditions cannot be devised,
to achieve these objectives, applications for Conditional Use Permits shall be denied.
CHAPTER 12-8D SKI BASE/RECREATION DISTRICT (in part)
SECTION 12-8D-1: PURPOSE
The ski base/recreation district is intended to provide for the base facilities necessary to
operate the ski mountain and to allow multi -family residential dwellings as a secondary
use if certain criteria are met. In addition, summer recreational uses and facilities are
encouraged to achieve multiseasonal use of some of the facilities and provide for
efficient use of the facilities.
SECTION 12-8D-3: CONDITIONAL USES
The following conditional uses shall be permitted in the ski base/recreation district,
subject to the issuance of a conditional use permit in accordance with the provisions
of chapter 16 of this title:
Addition or expansion of storage buildings for mountain equipment.
Additions or expansions of public or private parking structures or spaces.
Bed and breakfasts, as further regulated by section 12-14-18 of this title.
Child daycare center.
Communications antennas and appurtenant equipment.
Food and beverage cart vending.
Public, private or quasi -public clubs.
Recreation room/minor arcade.
Redevelopment of public parks, playgrounds.
Redevelopment of ski lifts and tows.
Redevelopment of ski racing facilities.
Redevelopment of water storage extraction and treatment facilities.
Religious institutions.
Seasonal structures to accommodate athletic, cultural, or educational activities.
Summer outdoor storage for mountain equipment.
Summer seasonal community offices and programs.
VAIL LAND USE PLAN GOALS
2.1: The community should emphasize its role as a destination resort while
accommodating day visitors.
2.2: The ski area owner, the business community and the Town leaders should work
together closely to make existing facilities and the Town function more efficiently.
3.5: Entertainment oriented business and cultural activities should be encouraged in the
core areas to create diversity. More night-time businesses, on-going events and
sanctioned "street happenings" should be encouraged.

Commission shall consider the following factors with respect to the proposed use:

in the 2020 Strategic Action Plan; "We are the `Premier Mountain Resort Community' by
providing high quality of life and experiences for both residents and visitors". Finally, the
proposed use addresses several goals identified in the Vail Land Use Plan.
Vail Land Use Plan:
Goal #2.1: The community should emphasize its role as a destination resort while
accommodating day visitors.
Goal #2.2: The ski area owner, the business community and the Town leaders should work
together closely to make existing facilities and the Town function more efficiently.
Goal #3.5 Entertainment oriented business and cultural activities should be encouraged in the
core areas to create diversity. More night-time businesses, on-going events and sanctioned
"street happenings" should be encouraged.
The Community Development Department finds this criterion to be met.
2. The effect of the use on light and air, distribution of population, transportation

via the pedestrian trail or transit. The site is not adjacent to the street but does have adjacent
parking. Additionally, the proposed use will only occur during the daylight hours between 8:00
am and 5:00 pm. All noise will be in compliance with the Town's regulations. The use will have
minimal effects on light and air, distribution of population, utilities, or schools.
The Community Development Department finds this criterion to be met.
3. Effect upon traffic with particular reference to congestion, automotive and pedestrian
safety and convenience, traffic flow and control, access, maneuverability, and removal of
snow from the street and parking areas.
The proposed conditional use will have a positive impact on pedestrian convenience through
lively programming in a pedestrian -accessible location. The site is situated adjacent to the Vail
Trail with a five-minute walk to both Ford Park and Vail Village. The site is also connected via a
short transit ride with Vail Village and Lionshead. The location also has parking facilities to the
north and east. The proposal does not increase traffic but will provide additional amenities in the
Golden Peak area and could relieve congestion from the other busy base areas in town. The
use will have minimal effects on automotive safety, traffic flow, and snow removal from the
street.
The Community Development Department finds this criterion to be met.
4. Effect upon the character of the area in which the proposed use is to be located,
including the scale and bulk of the proposed use in relation to surrounding uses.
The proposed conditional use will have a positive impact on the character of the area.
The proposed structures including the Airstream, seating, and heaters are of a scale and
character appropriate to the location. As stated previously, this proposal will enliven an
underutilized area, increase pedestrian convenience, have a positive recreational impact, and
bring additional cultural activity to the area.
The Community Development Department finds this criterion to be met.
5. Such other factors and criteria as the commission deems applicable to the proposed
use.
6. The environmental impact report concerning the proposed use, if an environmental
impact report is required by Chapter 12 of this title.
An environmental impact report is not required by Chapter 12. This project will not significantly
change the environment in the surrounding area.
VIII. RECOMMENDATION
The Community Development Department recommends the Planning and Environmental
Commission approve, with a condition the Conditional Use to allow for base area
improvements with food and beverage cart vending and seating. This recommendation is based
upon the review of the criteria outlined in Section VII of this memorandum and the evidence and
testimony presented.

Should the Planning and Environmental Commission choose to approve this Conditional Use
Permit request, the Community Development Department recommends the Commission passes
the following motion:
"The Planning and Environmental Commission approves this request for a Conditional
Use Permit, pursuant to Section 12-16, Conditional Use Permits, Vail Town Code, to
allow for a base camp area with food and beverage cart vending (210108109006) Tract
B, Vail Village Filing 7, and setting forth details in regard thereto. (PEC21-0054)."
Should the Planning and Environmental Commission choose to approve, with a condition, this
conditional use request, the Community Development Department recommends the
Commission applies the following conditions:
1. "Approval of this Conditional Use is contingent upon the applicant obtaining Town of
Vail design review approval for this proposal."
2. "The applicant shall operate the base area improvements in a manner generally
consistent with the approved plan dated 11 /22/2021."
Should the Planning and Environmental Commission choose to approve this Conditional Use
Permit request, the Community Development Department recommends the Commission makes
the following findings:
"Based upon the review of the criteria outlined in Section Vll of the Staff memorandum to
the Planning and Environmental Commission dated November 22, 2021 and the
evidence and testimony presented, the Planning and Environmental Commission finds:
1. The proposed Conditional Use Permit is in accordance with the purposes of
the Ski Base/Recreation District (SBR).
2. The proposed location of the use and the conditions under which it will be
operated or maintained are not detrimental to the public health, safety, or
welfare or materially injurious to properties or improvements in the vicinity.
3. The proposed Conditional Use Permit complies with each of the applicable
provisions of Chapter 12-16, Conditional Use Permit, Vail Town Code."

I. SUMMARY
The applicant, the Town of Vail, represented by Senior Landscape Architect Gregg Barrie, is
requesting the review of a Conditional Use Permit, pursuant to Section 12-16, Conditional Use
Permits, Vail Town Code, for improvements including the installations of restrooms at the Booth
Falls Trailhead located at the terminus of Booth Falls Drive, Unplatted, Eagle County Parcel #
2101-022-00-002.
Based upon Staff's review of the criteria outlined in Section VII of this memorandum and the
evidence and testimony presented, the Community Development Department recommends
approval, with a condition, of this application subject to the findings noted in Section VIII of
this memorandum.
DESCRIPTION OF REQUEST
The applicant, the Town of Vail, is requesting the review of a Conditional Use Permit, pursuant
to Section 12-16, Conditional Use Permits, Vail Town Code, for improvements including the
installations of restrooms at the Booth Falls Trailhead located at terminus of Booth Falls Drive.
The project consists of the following components:
Approximately 173 square foot two -unit restroom building
Site work including bicycle parking, trash and recycling containers and a water
bottle filler

Please see the project narrative for additional details concerning the proposed improvements
and the operation thereof.
The Town of Vail held an Open House on November 5, 2021 at the Vail Mountain School that
was attended by approximately 15 community members in addition to Town representatives.
Parking lot operations and management including hours of operation, signage and the role of
the Vail Mountain School were discussed.
A vicinity map (Attachment A), project narrative (Attachment B) and project plan set (Attachment
C) are attached to this memorandum for review.
III. BACKGROUND
The Booth Lake Trailhead is one of four trailheads located in Vail that access the Eagles Nest
Wilderness Area. The trail leads to Booth Falls and eventually to Booth Lake. Booth Falls is the
most popular hiking destination in the Vail area. Trail counts collected over the past three years
indicate over 6,000 hikers each month between June 1 -Sept 30, an average of over 200 each
day, with peak days over 400 hikers per day. Several days during the fall topped 700 hikers in
one day. During the COVID lockdown year of 2020, nearly 50,000 people hiked Booth Lake
Trail from January -December. See the attached trail count document for summer counts of
2019-2021.
In 2018, noting the significant use and lack of a restroom facility, the town started placing
portable toilet facilities at all Wilderness Area trailheads between May 15 -Nov 15. Three "porto-
lets" were placed at the Booth Lake trailhead. Almost immediately, the need for these toilets
was recognized as it became necessary to empty/clean the toilets twice each week.

Unfortunately, during 2021, there were times when the toilets were not able to be emptied twice
per week due to staffing challenges by the toilet contractor, leading to less -than -sanitary
conditions. In a community that prides itself on world-class service, it has been determined to be
unacceptable
IV. APPLICABLE PLANNING DOCUMENTS
2018 OPEN LANDS PLAN UPDATE
USFS Trails and Trailheads Eight trailheads within the Town of Vail provide access to trails on
USFS lands. A number of these trails are new or have been improved in recent years. In many
cases the current use of these trailheads is significant, to the point where the trail experience is
compromised and there are issues with congestion at the trailheads. This is particularly true with
the Booth Falls trail and others in East Vail. The Town should initiate dialogue with the USFS to

1.1. Vail should continue to grow in a controlled environment, maintaining a balance between
residential, commercial and recreational uses to serve both the visitor and the
permanent resident.
2.4. The community should improve summer recreational options to improve year-round
tourism.
2.5. The community should improve non -skier recreational options to improve year-round
tourism.
2.7. The Town of Vail should improve the existing park and open space lands while
continuing to purchase open space.
CHAPTER 12-16: CONDITIONAL USE PERMITS (in
SECTION 12-16-1: PURPOSE; LIMITATIONS:
In order to provide the flexibility necessary to achieve the objectives of this title, specified
uses are permitted in certain districts subject to the granting of a Conditional Use Permit.
Because of their unusual or special characteristics, conditional uses require review so
that they may be located properly with respect to the purposes of this title and with
respect to their effects on surrounding properties. The review process prescribed in this
chapter is intended to assure compatibility and harmonious development between
conditional uses and surrounding properties in the Town at large Uses listed as
conditional uses in the various districts may be permitted subject to such conditions and
limitations as the Town may prescribe to insure that the location and operation of the
conditional uses will be in accordance with the development objectives of the Town and
will not be detrimental to other uses or properties. Where conditions cannot be devised,
to achieve these objectives, applications for Conditional Use Permits shall be denied.

Commission shall consider the following factors with respect to the proposed use:
1. Relationship and impact of the use on the development objectives of the Town.
The Community Development Department finds the proposed use to be consistent with the
development objectives of the Town of Vail. Specifically, the proposed uses address several
goals, concepts and or recommended actions identified in the Vail Land Use Plan and
referenced on the 2018 Open lands Plan Update.
Vail Land Use Plan:
1.1. Vail should continue to grow in a controlled environment, maintaining a balance between
residential, commercial and recreational uses to serve both the visitor and the
permanent resident.
2.4. The community should improve summer recreational options to improve year-round
tourism.
2.5. The community should improve non -skier recreational options to improve year-round
tourism.

The proposed conditional use will have a positive impact on recreation facilities by improving
access to the Booth Falls area in a manner that increases safety, environmental quality and
community aesthetics. The use will have minimal effects on light and air, distribution of
population, transportation facilities, utilities or schools.
The Community Development Department finds this criterion to be met.
3. Effect upon traffic with particular reference to congestion, automotive and pedestrian
safety and convenience, traffic flow and control, access, maneuverability, and removal of
snow from the street and parking areas.
The proposed conditional use will have no effect on traffic or congestion as the additional of a
permanent restroom is not anticipated to increase the use of the trailhead. The Town has been
working to address ongoing issues related to congestion including the use of the Vail Mountain
School parking facilities.
The Community Development Department finds this criterion to be met.
4. Effect upon the character of the area in which the proposed use is to be located,
including the scale and bulk of the proposed use in relation to surrounding uses.
The proposed Conditional Use Permit will have a positive impact on the character of
surrounding area. As stated previously, this proposal will improve environmental conditions and
the overall aesthetics of trailhead operation.
The Community Development Department finds this criterion to be met.
5. Such other factors and criteria as the commission deems applicable to the proposed
use.
6. The environmental impact report concerning the proposed use, if an environmental
impact report is required by Chapter 12 of this title.
An environmental impact report is not required by Chapter 12. This public project has been
designed to improve the quality of the environment in the town.
VIII. RECOMMENDATION
The Community Development Department recommends the Planning and Environmental
Commission approve, with a condition, the Conditional Use for improvements including the
installations of restrooms at the Booth Falls Trailhead, located at the terminus of Booth Falls
Drive. This recommendation is based upon the review of the criteria outlined in Section VII of
this memorandum and the evidence and testimony presented.
Should the Planning and Environmental Commission choose to approve this Conditional Use
Permit request, the Community Development Department recommends the Commission passes
the following motion:
"The Planning and Environmental Commission approves this request for a Conditional
Uses, Vail Town Code, in accordance with Title 12, Chapter 16, Conditional Use
Permits, Vail Town Code, for improvements including the installations of restrooms at

the Booth Falls Trailhead, located at terminus of Booth Falls Drive, Unplatted, Parcel #
2101-022-00-002 and setting forth details in regard thereto. (PEC21-0056)"
Should the Planning and Environmental Commission choose to approve, with a condition, this
variance request, the Community Development Department recommends the Commission
applies the following condition:
`Approval of this Conditional Use is contingent upon the applicant obtaining Town of
Vail design review approval for this proposal.
Should the Planning and Environmental Commission choose to approve this Conditional Use
Permit request, the Community Development Department recommends the Commission makes
the following findings:
"Based upon the review of the criteria outlined in Section VII of the Staff memorandum to
the Planning and Environmental Commission dated November 22, 2021 and the
evidence and testimony presented, the Planning and Environmental Commission finds:
1. The proposed Conditional Use Permit is in accordance with the purposes of
the General Use (GU) District.
2. The proposed location of the use and the conditions under which it will be
operated or maintained are not detrimental to the public health, safety, or
welfare or materially injurious to properties or improvements in the vicinity.
3. The proposed Conditional Use Permit complies with each of the applicable
provisions of Chapter 12-16, Conditional Use Permit, Vail Town Code."

Project Narrative

The Town of Vail Department of Public Works is proposing to install a permanent restroom
facility to be located at the Booth Lake Trailhead on Booth Falls Road. The proposed restroom
would be constructed on town -owned land, connected to public utilities and open seasonally.
This project requires a Conditional Use Permit from the Planning and Zoning Commission.
Background

Proposed Restroom
The Department of Public Works is proposing to install a prefabricated restroom structure.
Prefabricated indicates that the building will be built off-site, delivered, and placed with a crane.
The facility will be connected to public electric, water and sewer service and will include the
following facilities:
One building, sized 10'x 18', 180 sf
Two unisex restroom units
o ADA compliant and will include a toilet, urinal and sink in each unit
o One of the units will include a changing table
o Wall -mounted bottle filler
o Mechanical room with mop sink and a heater to extend the shoulder seasons
o Architecture includes board and batten siding, a standing -seam roof and natural
color finishes.
• Site work will include bicycle parking and trash/recycling cans
Building Operations
The proposed restroom will be operated in the same manner as most other Town of Vail park
restrooms in that they will open on a seasonal basis. In a typical year, the town's park
restrooms are opened as weather allows in late April/early May. They are cleaned daily by a
vendor hired by the town. They will be closed for the season by mid-October. As with all town
parks, a temporary portable toilet can be placed at the trailhead thru the winter as needed.
Lighting
Each restroom unit will have an obscured window to allow light into the room during the day.
Each room will also include a light fixture and exhaust fan. The town is proposing to install an
exterior, dark sky -compliant light fixture. This light will be on a timer, operating from dusk until
10 pm as a safety feature but will turn off for the duration of the night. The restrooms will be
open 24 hours during the season.
Parking Lot and Trailhead Operations
In 2021 the Booth Lake trailhead parking lot was closed to parking from approximately June 15 -
September 9. This was done to reduce vehicular traffic on Booth Falls Road and to hopefully
disperse some hiker traffic to other trails. Hikers were asked to park at Vail Mountain School
when available, or to park at the Vail Village parking structure and take a bus to the area. Hotel
shuttles were asked to drop guests at the bus stop at the south end of Booth Falls Road.
The East Vail Trails Discussion Group, which includes representatives from the USFS, Vail
Resorts, Vail Mountain School, Vail Valley Mountain Trails Alliance, Town of Vail and others is
currently reviewing last summer's operations and developing recommendations for 2022 to
present to the Vail Town Council. Operations at the parking lot will likely be modified over the
next several years as the group continues to look for ways to improve user experience at this
heavily used trailhead.
Proposed Schedule
Pending approvals, the restroom building will be constructed off-site during January -April. Site
work will begin on or about May 1. It is anticipated the facility will be opened to the public
around July 1. Portable facilities will be placed as needed until the new restroom is open.

Vail Town Code, to add an exemption to allow vaults for car lift systems to be
excluded from the GRFA calculation and setting forth details in regard

Planner Roy introduces item and discussed the history of the application at
the PEC. He talks about the concerns of the board at previous meetings. He
says the applicants have proposed a couple of changes and talks about the
proposed code language.
Dominic Mauriello and Kyle Webb are present for the applicants. Mauriello
introduces the 300 square foot limitation and the calculations which factored
into this figure.
Webb says it's a scissor lift, OSHA requires an access panel outside the
footprint of the lift as well as hoses and pumps outside the footprint. He says
this factored into the calculations previously mentioned.
Kurz asks for questions from the board.
Phillips asks if they can be serviced from above with the only access being
within the garage as the language proposes?
Webb says that is true in conversations with four manufacturers.
Kurz says the square footage language and two vehicles per dwelling unit
seems like a reasonable solution. It will get cars off driveways or parking
areas which is a community benefit. He is in favor. He asks if there is
additional comment?
Perez is pleased to see the changes addressed previous comments from the
board.
There is no public input.
Gillette joins (virtually).
Rollie Kjesbo moved to recommend approval to Town Council. Henry Pratt
seconded the motion and it passed (6-0).

2.2. A request for review of a Conditional Use Permit, pursuant to Section 12- 10 min.
16, Conditional Use Permits, Vail Town Code, to allow for the expansion of
an outdoor dining patio, located at 168 Gore Creek Drive Unit 142/Lot 1,
Lodge Subdivision, and setting forth details in regard thereto. (PEC21-
0027)
Applicant: Charley Viola (Yama Sushi)

This Conditional Use Permit approval is contingent upon the applicant
obtaining Town of Vail approval of an associated design review
application.
The applicant shall operate the outdoor patio in a manner generally
consistent with the approved site plan included as an attachment to
this November 8, 2021 memorandum.
Planning Manager Jonathan Spence introduces the history of the
application, and the ongoing formalization of outdoor dining footprints. He
talks about the town's task force which reviewed the applications.
Spence talks about the details of the Yama application, and asks if there are
questions.
Pratt asks about the plan in the materials. He noticed the barrier goes into
the ground in sleeves and asks why that is.
Spence says that was in response to a previous town policy and will be
subject to a future Design Review Board process without the sleeves.
There is no public input.
Rollie Kjesbo moved to approve with conditions. Karen Perez seconded the
motion and it passed (7-0).
2.3. A request for review of a Conditional Use Permit, pursuant to Section 12- 10 min.
16, Conditional Use Permits, Vail Town Code, to allow for the installation of
an outdoor dining patio, located at 228 Bridge Street Unit B/Lot A Block 5,
Vail Village Filing 1, and setting forth details in regard thereto. (PEC21-
0037)
Applicant: Drew Riley (Russell's)

1. Prior to submitting for the required DRB, the plan will be modified to
have the outdoor seating limited to two tables replacing the existing
bench and one table in front of the garden. (Total of 3 tables)
2. The outdoor seating barricade, to be reviewed by the DRB, shall not
be placed more than two feet from the face of the wall (not the recess
where the bench is).
3. All tables, chairs and barriers shall be completely removed every
evening and not stored against the wall.
Spence references the previous application before the PEC on Oct. 22nd.
He references a photo with the proposed location for a barrier. Staff and
task force are recommending approval with attached conditions.
Pratt says the site plans proposes to store barriers outside at night.
Spence says the conditions address this; the tables will be stored indoors.
Phillips asks if this is only for the summer.
Spence confirms.
There is no public input.
Perez says it is better than what was previously proposed but has a problem
with it near the covered bridge location. Pratt concurs.
Rollie Kjesbo moved to approve with conditions. Reid Phillips seconded the
motion and it passed (5-2).

4. 1 nformational Update
4.1. Update to the Planning and Environmental Commission on the status of the
Gore Creek Spill report.

Watershed Education Coordinator Wadden says he doesn't have a lot of
new information. Three state agencies are investigating: Colorado Parks
and Wildlife (CPW ), the Colorado Department of Agriculture, and the
Colorado Department of Public Health and the Environment (CDPHE). We
should have something from CPW by the end of the year and CDPHE has
undertaken statewide investigation of Vail Resorts' snowmaking operations.
Phillips asks what authority the PEC has with this incident. He says he
understands that there is a report that was authored by Vail Resorts, he
wants to see if the PEC can get a copy of the report sent to Eagle River
Water and Sanitation District and CDPHE.
Wadden says the report is publicly available.
Phillips says there were protocol and operational problems. He would like
the board to view the report before the ne)d meeting. He asks what the
PEC's authority is to ask for representation to this committee to address
questions. Can we ask for that?
Spence says you could certainly request that. If there was a conditional
use permit attached to it in town, that would be the framework for
discussion, but this occurred outside of the town. He will consult with town
staff on this issue.
Perez asks if the issue will go to the joint -environmental council.
Spence asks for clarification.
Kurz clarifies the Open Space Committee.
Spence says they're not tasked with this.
Wadden says Town Council will be briefed.
Perez asks for a summary of the Vail Resorts report.
Wadden says he is not comfortable sharing from memory but happy to
share the document. His department is waiting for state agencies to make
their final reports.
Pratt asks about another incident involving yellow paint.
Wadden says the hospital parking lot was being re -striped during
Halloween weekend. The contractor hired by the hospital spilled or dumped
a half gallon of paint into the storm drain. Thanks to observations by a Vail
Town Council member, they got out there with a vacuum truck before too
much was discharged to the creek.
Pratt asks about the citation and what it meant.
Wadden says the Police and Fire Department were present. The
police took statements and Environmental Sustainability submitted
spill reports to CDPHE. The hospital will be billed for the vacuum
truck operations, staff time, and equipment.
Kurz thanks Seibert for his service on the PEC and wishes him luck
moving forward.
Spence says there will be one more PEC meeting with Seibert
present.

passed (7-0).
