Engineel''s (.Pub,l ic Works) review and approval , a Planning Department
review or Health Department review, and a review by the Building
Deparbnent, the estimated time for a total review may take as long
as tliree weeks.
All commercial (1arge or small)and all multi-family permits w'i1l
have to follow the above mentioned maximum requirements. Residential
and small projects should take a lesser amount of tjme. However, if
residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may
also talte the three week period.

lypical compounds which aro potontially corrosive. These

Dear Mr. Splinter:
Mr. Bud O'Halloran of O'Halloran Construction has asked me to write this letter to you listing the Town of
Vail's adopted building and fire code requirements that apply to the four water{amaged units noted above.
First of all, Building Safety & Inspection Services and the Fire Department typically take a reasonable and
corlmon serrse approach in working with building owners. We also recognize that the combination of the life
safery characteristics and use patterns ofthe units, like many units in Vail, result in an above average risk for
prope4y damage, injuries or deaths.
As you know, Vail is a resort community. Units are often rented to visitors who are not always familiar with the
use of the facilities, including how to use wood buming or gas fireplaces, where exits are located, etc. Since they
are typically here on vacation, we certainly also hope that the occupants of the units are having a good time.
However, having a good time can also lead to impaired judgment, a false sense of security, etc. Certainly, our
destination resort guests do not voluntarily assume any risks associated with their stay here.
It has been a pmctice of building safety & inspection services and the fire department to work with individual
owners and condo associations to upgrade nonconforming facilities with life safety systems improvements at
times when it is most convenient and most cost effective. Automatic fire sprinkler systems and other upgrades
may be installed more easily and less expensively, for instance, if ceilings and/or walls of units are exposed
during other construction, renovation or repair projects.
l. Existing Buildings. The Town have Vail has adopted, goingback at least since the l99l edition of the
Uniform Building Code (UBC), Appendix Chapter 34 of the UBC, entitled "Existing Structures." This adoption
includes Division I, *Life safety Requirements for Existing Buildings Other than High-rise Buildings," and
Division II,'Life safety Requirements for Existing High-rise Buiidings." The town's adoptions of the l99l
Uniform Fire Code (UFC) and the current adoption of the 1997 edition of the UFC aiso include Appendix I -A
and Appendix l-B, with the same titles and idenfical requirernents to the UBC appendices cited above. I am also
enclosing a copy ofthese code sections foryouruse.
Thus, the town has the authority, i.e., legal ability, to order ths retrofitting of life safety improvements.

Under the authority granted by the adoption of these appendices, the Town of Vail Fire Department recently
ordered the retrofitting of automatic sprinkler system, fire alarm systems and code complyjng standpipe systems
in Buildings A, B and C of Village Center.
From a cost standpoint, it is much more effective to install code upgrades during a time when construction is
already occurring for other reasons (in this instance, water damage) and the building structure is being exposed,
anyway. This is much more cost-effective than completing water damage repairs now and then tearing walls and
ceilings apart at a later date to complete life safety retrofits ordered by the town.
2.a.2.) lJnitseparation/building assembly. The dwelling unit separation requirements of Section 310.2.2
specify that walls, floors or ceilings separating dwelling units be constructed as approvbd l-hour fire-resistive
construction. Thus, if drywall and/or other components are removed or replaced in any of these parfy walls,
floors or ceilings, they must be replaced with approved l-hour fire-resistive construction. This may also relate to
electrical item #2.b.3.) below.
2.b.l.) Wiring specifications. In a similar vein, replacing nonconforming Type NM ("romex" or "rope') wiring
with metal-conduit-encased wiring is practical and cost effective for at least two reasons. With the high tumover
rate in ownership and the frequent remodels or renovations that result it is much easier to work with wiring that
is encased in conduit and can be more easily modified. In addition, the conduit-encased wiring meets the current
1999 National Electricat Code (NEC) as it has been adopted by the town and provides for a much safer
installation.
2.b.2.) Devices and boxes, GFCI. I'm assuming that this is a reference to requiring the installation of GFCI-
protected electrical outlets in locations, primarily in bathrooms and adjacent to kitchen sinks, as required in the
1999 NEC. This is also a requirement of our adopted codes and a very high value "bang for the buck" item in
terms of an improvement in life safety. Once again, in a destination resort, with visitors from all over the world
who may not be familiar with our eiectrical systems and safeguards, this is an item that could prevent future
injury claims.
2.b.3.) Light Fixtures. Light fixture upgrade requirements that could be included as a part of this project would
be limitations on recessed "can" fixtures located in ceilings that are required to be 1-hour fire-resistive
construction and limitations on light fixtures placed in clotles closets. There is a limit on the number of fxtures
that can penetrate the l-hour ceiling assembly membrane without having all of the fixtures be of an approved
type and "tented" to prevent a fire from spreading from a unit below to other units above and tle remainder of
the building. This is covered under Sec. 7 I 0 in general and Sec. 7 I 0.3 in particular of th e 1997 UBC. The
limitations on the typeand location of light fixtures that can be placed in clothes closets are contained in the
1999 NEC.

if this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Department review, and a review
by the Building Department the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.

PUBLIC WORI(S AND THE PUBLIC WAY PERMIT PROCESS
How it relates to Building Permits:
Fill out the attached check list with the Buildinq Permit Aoolication.
If yes was answered to any of the questions then a "Public Way" permit is required. You
can pick up an application at either Community Development, located at 75 South Frontage
Road or Public Works. located at 1309 Elkhorn Drive.
Notice sign-offs for utility companies. ALL utilities must field verify (locate) respective
utiliUes prior to signing application. Some utility companies require up to 48 hours notice to
schedule a locate.
A construction traffic control/staging plan must be prepared on a separate sheet of paper.
An approved site plan may also be used, This plan will show locations of all traffic control
devices (signs, cones, etc.) and the work zone, (area of construction, staging, etc.). This
plan will expire on November lst and will need to be resubmitted for consideration for
approval through the winter. Be aware that your resubmission for winter may be denied
depending on the location of construction.
Sketch of work being performed must be submitted indicating dimensions (length, width
and depth of work). This may be drawn on the traffic control plan or a site plan for the job.
Submit completed application to the Public Work's office for review. If required, locates will
be scheduled for the Town of Vail electricians and irrigation crew. The locates take place in
the morning, but may require up to 48 hours to peform.
The Public Work's Construction Inspector will review the application and approve or deny
the permit. You will be contacted as to the status and any requirements that may be
needed. Most permits are released within 48 hours of being received, but please allow up
to one (1) week to process,
As soon as the permit is approved, the Building Department will be notified, allowing the
"Building Permit" to be released. Please do not confuse the "Public Way Permit" with a
"Building Permit".
NOTE: The above process is for work in a public way ONLY. Public Way
Permits are valid only until November fsth. A new Public Way Permit is required
each year if work is not complete. Re-application each November 15th does not
mean an automatic renewal.

o The Town of Vail Building Department has developed the following procedures to
ensure that new construction sites have adequately established proper drainage
from building sites along and adjacent to Town of Vail roads or streets.
o The Town of Vail Public Works Department will be required to inspect and approve
drainage adjacent to Town of Vail roads or streets and the installation of temporary
or permanent culverts at access points from the road or street onto the construction
site. Such approval must be obtained prior to any requests for inspection by the
Town of Vail Building Department for footings, temporary electrical or any other
inspection. Please call Leonard Sandoval at479-2198 to request an inspection from
the Public WorK Department. Allow a minimum of 24 hour notice.
n Also, the Town of Vail Public Works Depaftment will be approving all final drainage

e Unlawful deposits: Subject to subsection C thereof, it is unlawful for any person to litter, track or
deposit, or cause to be littered, tracked or deposited, sand, gravel, rock, mud, dift, snow, ice, or any
other debris or material upon any street, sidewalk, alley or public place, or any portion thereof.
o Notice; Abatement: The Director of Public Works may notify and require any person who violates or
causes another to violate the provision of subsection A hereof, or who has in the Director's employment
a person who violates or causes another to violate the same, top remove such sand, gravel, rocks, mud.
dirt, snow, ice or any other debris or material within twenty four (24) hours after receipt of said notice
by the Director of Public Works. In the event the person so notified does not comply with the notice
within the period of time herein specified, the Director of Public Works, or other authorized agent, may
cause any such sand, gravel, rocks, mud, dirt, snow, ice, debris or any other material to be removed
frorn any street or alley at the expense of the notified.
o Summons and Penalty: As an alternative to the notice for removal provided in subsection B above,
any person who violates or causes another to violate the same, may be issued a summons to appear
before the Municipal Couft of the Town for said violations, and upon being found guilty of a violation
hereunder be punished as provided in Section 1-4-1 of this code.

amended, the officer shall require the vehicle to be removed or cause it to be removed and placed in
storage in the nearest garage or other place of safety designated or maintained by this Municipality, and
the charges for towing and storage of such vehicle shall be charged to the owner of the vehicle in

Time Reouirements
The Design Review Board meeE on the 1st and 3rd Wednesdays of each month, A complete application
form and all accompanlng material must be accepted by the Community Development Depaftment prior
to applicauon deadlines. A schedule of DRB nreetings and arsociated application deadlines may be found
on the World Wide Web at htto:#ci.vail.co.us/commdev/olannino/drb/meetings/default.htm For a new
residential development, the applietion deadline is typically 3.5 weeks prior b a Design Reriew Board
hearing.
Review Criteria
The proposal will be reviewed for compliance with the Design Guidelines as set forth in TiUe 12, Chapter
11 (Design Review) and Title 14 (Development Standards) of the Municipal Code.
Reouirements for orooefties located in hazard areas
If a propefi is located in or adjacent to a mapped hazard area (i.e. snow avalanche, rocKall, debris flow,
floodplain, wefland, poor soils, etc.), the Community Development Department may require a site€pecific
geological investigation. If a site-specific geological investigation determines that the subject property is
located in a geologically sensiuve area, the property owner(s) must sign an amdavit recognizing the
hazard report prior to the issuance of a building permit. ApplicanE are strongly encouraged b consult
with Community Development staff prior to submitting a DRB application to determine the relationship of
the property to all mapped hazards.
Reouired Plan Sheet Format
For all surveys, site plans, landscape plans and other site improvement plans, all of the following must be
shown,
1. Plan sheet size must be 24"x 35". For large p$ecb, larger plan size may be allowed'2. Scale. The minimurn scale is 1"=20'. All plans must be at the same scale.
3. Graphic bar scale.4. North arow.5. TiUe bloclq project name, project address and legal description.5. Indication of plan preparer, address and phone number.

Desion Review Board Meetinq Reouirenrents
For new construction and additions, the applicant must sbke and tape the project site b indicateproperty lines, proposed buildings and building comers. All trees to be removed must be taped. The
apPlicant must ensure that staking done during the winter is not buried by snow. All site tapings and
staking must be completed prior to the day of the DRB meeting.
Applicants who fail b appear before the Design Review Board on their scheduled nreeting date and who
have not asked in advance that discussion on their item be postponed, will have their iEms remord
from the DRB agenda until such time as the item has been republished.
If the DRB approves the applicaUon with conditions or modificaUons, all condiUons of approval must be
resolved prior to the issuance of a building permit.
Staff Aooroval
The Administrator (a member of the planning staff) may review and approve Design Review applications,
apprcve with certain modificauons, deny the application, or refer the application to the Design Review
Board for a decbion. All staff approvals are reviewed by the Design Rryiew Board and any stafr decision
is subject to final approval by the DRB.
Additional Review and Fees
Ifthis application requires a separate review by any local, state or Federal agency other than the Town of
Vail, the application fee shall be increased by $200.00. Enmples of such review, may include, but are
not limited to: Colorado Department of Highway Access Permits, Army Corps of Engineers 404, etc.
The applicant shall be responsible for paying any publishing fees in o<cess of 50% of the appliotion fee.
It at the applicant's request, any matter is postponed for hearing, causing the matter to be re-published,
then the entire fee for such re.publication shall be paid by the applicant.
Applications deemed by tie Community Development Department to have design, land use or other
issues, which may have a significant impact on the community, may require review by octernal
consultants in addition to Town staff. Should a determinaUon be made by Town sbff that an external
consultant is needed, the Community Development Department may hire the consultanl The
Department shall estimate the arnount of money necessary to pay the consultant and this amount shall
be forwarded to the Town b'y the applicant at the time of filing an application, The applicant shall pay
expenses incurred by the Town in e\cess of the amount forwarded by the application b the Town within
30 days of notificaUon by the Town. Any o(cess funds will be returned to the applicant upon review
completion.

SECTION 16000 - ELECTRICAL
PART I - GENERAL
1.O1SI]MMARY
A. Certain labor, materials, and equipment may be fumished under other sections of these
specifications, by Utility Companies or by the Owner. When this is the case, the extent, sowce,
and description of these items will be as indicated on the drawings or as described in the
specifications.
1.02 CODES AND REQUIREMENTS
A. Work under this Section shall comply with the requirements of General and Supplemental
Conditions of the Specification, along with all supplements and amendments thereto, as
published by the Architect.
B. The complete design and installation shall comply with local and state ordinances and codes,
the latest edition, supplements and interpretation of the National Electrical Code of the National
Board of Fire Underwriters, and with the requirements of the local Power, Telephone, and Cable
Television companies furnishing services to this installation. Applicable codes, ordinances,
standards and statutes take precedence where they are more stringent or conflict with the
drawings and specifi cations.
It is the sole responsibility of the Contractor to supply fixtures and trim that comply with
applicable codes and to notifu the Architect ofany discrepancy before submitting a bid.
C. Standards for Material and Workmanship - All material shall be new, and shall conform with
applicable standards of the Underwriters Laboratories, Inc., unless otherwise indicated.
Workmanship and neat appearance of the installation shall be on the same level of importance as
it's electrical and mechanical efficiency. Materials which are defective or damaged during the
course of the installation shall be repaired or replaced in a manner meeting the approval of the
Architect and at no additional cost to the Owner. In acceptance of, or the rejection ofthe
installation by the Owner or his Agents, no allowances shall be made for lack of skill on the part
ofthe installer.
D. Work Included - All materials and labor necessary for a complete and workable electrical ,
system, including smoke detectors, as shown on the drawings and indicated herein. Drawing(for
the Electrical Work are not intended to describe a complete electrical system; omission of minor
items obviously necessary to accomplish the above intent shall not relieve the Electrical
Contractor (hereinafter referred to as Conhactor) from furnishing and installing the same.

1.03 WARRANTY
A. The Contractor shall provide for the Owner a 18 months (from the date of Final Acceptance)
warmnty of all electrical equipment and systems provided under this Contract, except for
incandescent and fluorescent lamps and fuses. All defective equipment or materials which appear
during the Warranty period shall be replaced or repaired by the Contractor in a timely manner at
no expense to the Owner,
1.04 DRAWINGS AND SPECIFICATIONS
A. The drawings are diagrammatic and indicate general arrangement of electrical devices.
Locations are approximate, except where indicated, and shall be subject to minor modifications
as directed by the Architect. Approval of locations must be obtained prior to rough-in. Where
minor inconsistencies occur between the Electrical Drawings and the Architectural Drawings, the
Architectural Drawings shall take precedence in all cases.
B. Refer to architectwal, structural, and mechanical drawings as part of this set, and be
responsible for all information contained therein as affects the electrical work.
C. Instructions such as "provide ..." shall mean "Contractor shall be responsible for the
fumishing and installation of completion in every respect."
I.O5 CONSTRUCTION POWER AIID LIGTITING
A. It is the responsibility of the Contractor to arrange for and provide construction power and
lighting, as required. Energy costs will be paid by the General Contractor. All temporary
facilities shall be properly grounded, shall comply with the requirements of the National Electric
Code, OSHA and of the serving utility and shall have ground-fault protection.
B. Temporary Power only available at common area outlets. No power useage inside
private units.
l.OTTRENCHING
A. Be responsible for trenching and backfill for electrical work. Backfill shall be done in
accordance with Architectural specification. Contractor shall be responsible for new and
existing bwied utilities.

PART II - PRODUCTS
2.01-2.05 NOT USED
2.06 LIGHTING FIXTURES
A. Provide new frxtures and lamps as indicated on the plans and described herein. Fixtures shall
be fumished, pre-wired and shall be securely fastened in place in an approved manner. Fixtures
exposed to weather, moisture and cold temperatures shall be suitable for such conditions.
Provide necessary supports and structural members required. All ballasts shall be internally
protected by use of two intemal temperatlre-sensitive, non resisting protectors, G.E.
Watt-Miser Class "P" or equal. Ballast shall be Advanced Rel 3P electronic ballast.
B. Proper lamps shall be provided for fixtures and shall bear the label of G.E. or acceptable
equal. Incandescent lamps shall be rated for l25V operation except as noted. All fixtures, lamps,
and lenses shall be cleaned and free ofdust and debris, before Final Acceptance by the Owner.
C. Contractor shall furnish as part of this Contract a25oh coverage of every lamp type specified.
Contractor shall also furnish to the Owner a complete list of lamp types and the nearest
distributor's name, address and phone. Provide (5) extra globes for any light fixture with
globes. Provide (2) extra Type A light fixture.

A. If the bidder proposed to substitute equipment of manufacturers other than those specified, he
shall submit written requests to the Architect ten days prior to bid date. Directly opposite each
item substituted, he shall indicate the total amount per item or group of items which he will add
or deduct from his base bid if his proposal is accepted. Failure to fumish such an itemized list
will interpreted to mean that bidder agrees to provide equipment of the specified
manufacturer(s). The itemized list shall include the mane of proposed manufacturer and the
model or catalognumber of each proposed item. In addition, the bidder shall attach catalog
date, prints, diagrarns, specifications, etc., as necessary to per the General Contractor/Architect to
evaluate the proposed substitution properly. A proposed substitution will not affect the
determination of low bidder.
B. Where the specifications and drawings state the equipment shall manufactured by one specific
manufacturer "or acceptable equal", the Contractor shall, at his discretion submit proposals in the
form of shop drawings for altemative equipment that is equal to that offered by the specified
manufacturer. The General Contractor/Architect reserves the riglrt to disapprove this altemative
equipment if, in his/trer opinion, it is not acceptable in quality durability, appearance, strength,
performance, design, physical, dimensions and arrangement to the equipment offered by the
specifi ed manufacturer.
C. Where a Contractor proposed to use an item of each equipment other than specified or detailed
on the drawings, that is acceptpble to the General Contractor/Architect and that
requires redesign of the structure, partitions, foundations, piping, wiring, or any other part of the
mechanical, electrical, or architectural layout, then such redesign, new drawings, and detailing
required for it shall be prepared by the Contractor without extra compensation. Similarly, when a
quantity and arrangement different from that specified or indicated on the drawings the
Contractor shall provide all ductwork, piping, structural electrical wiring and any other additional
equipment required without extra compensation.
PART III - EXECUTION
3.01 COORDINATION
A. Coordinate all work with that of the other contractors on the job, and also with that of the
Owner, in order that there will be no delay in the proper installation and completion of the work.
Any cost for extra work or materials resulting from lack of coordination of work performed '
under this section shall be borne by the Contractor.
3.02 DAMAGE TO OTIMRWORK

A. Use every precaution to protect the work of others, and be responsible for all damage to other
wort caused by work of or through the neglect of worhnen under this Section of the
Specifications.
3.03 CUTTING AND PATCHING
A. Carefully lay out all work in advance and where cutting, channeling, chasing, or drilling of
floors, walls, partitions, ceilings, or other surfaces is necessary for the proper installation,
support, or anchorage of raceways, outlets, or other electrical equipment, carefully perform this
work, and any damage to the building, piping, equipment, or any defaced finish, plaster,
woodwork or metalwork shall be repaired by skilled mechanics of the trades involved, at no
additional cost to the Owner. Do no cutting, channeling chasing or drilling, welding of structural
members of the building, etc., without first obtaining permission from the Architect. If
permission is granted, perform this work in a manner approved by the Architect. No holes shall
be drilled in rafters unless specifically approved by the Architect.

3.09 GENERAL
A. The entire electrical system shall be left in a first class workable operating condition and work
shall be complete.
3.10 CLEAN - UP
A. Remove materials, scrap, etc., relative to the electrical installation and leave the premises in a
clean, orderly condition. Any costs to the Owner for cleanup of the site will be charged against
the Contractor.
B. Clean electrical equipment and materials of foreigrr matter. Clean light fixtures using only 7
methods and materials as recommended by the manufacturer.
3.TI LABELING
A. Provide labels and neatly typed directory cards for panelboard, fire alarm system (if

applicable), and any special systems installed. Label mechanical equipment, disconnects and
starters, etc. indicate the general area and type of electrical load served by each circuit. Work
shall not be considered Substantially Complete until these conditions have been met.
3.12 ACCEPTANCE DEMONSTRATION
A. Upon completion of the work, at a time to be designated by the Architect, the Contractor shall
demonstate to the Owner, the operation of the entire electrical installation, including any special
systems provided under this Contract. Provide instruction manuals for equipment installed under
this Contract.
3.13 TEMPORARYWIRING
A. Remove temporary wiring, outlets, etc., when job is complete.
3.14 AS BUILT ELECTRICAL DRAWINGS
A. Deliver as built electrical drawings to Architect after completion of the work and prior to
final acceptance as outlined in Section 01000.
