by the Village Center Association Board of Directors on March 8,
1986. The board is pleased to advLse you that they have no
obJectlons t1 your proposed plans with the followlng restrictLons
(1) The change Ln the roof and the addition of a roof over
TCts balcony represent an exterior alteratl-on to the buLlding
and will need to be submitted to the appropriate town
authorities for aPProval. In the opinion of the board, your
proposed changes are ln overall conformity and in harmony
with the existing structure.
(2) The Association needs to be legally hetd harnless as a
result of any of the changes being proposed by you.
(3) Any impact on the Associationts insurance for the bullding
would have to be borne by you.

couple of years chosen for our meeting date. Another
Lcok at the calendar showed me that the 7th ls the fLrst
Saturday, not the second. I prefer to hold the meettng'
on the 7th unLqSs it preeenta a problem for some of ycu.

h.rrsuant to notice, a Speclal Meetlng of the Board was convened
ac 9:30 AIt{ in Apartment 3C of Bull-dlng B.
Mr. Dotson, Presldent of the AssoclatLon, chaired the meetlng
and kept the minutes. Present ln addltlon lrere Mr. Gtlliland,
Mr. McDanLel, and Mr. Hanschen. ThLs constltuted a quorum.
In addttton, Marta Cadmue and Cralg Granlund attended the
meetlng
Upon a motion made by Mr. McDanLel and seconded by Mr. llanschen
the minutes of the DLrectors'meetlngs held March 9, 1-985, at
t0:00 Alt and 5:30 PM were accepted aa subnltted.
Plans for the annual meetlng held later thls same day were
revLewed alcng with the proposed agenda.
The board then revlewed and discussed the 1985 Income and Expenses.
The report prepared by the managing agent Lndlcated our exPenses
were sLlght1y under budget but thls is misleadlng. lJe had
several- maJor expendl-tures tn Lneurance and antlfreeze whlch
were lncurred ln 1985 but were not pald frr until 1986 and
thls wllL be reflected tn the 1986 budget. The board also
reviewed the CPArs.revLew of the 1985 expenditures and made the
decision to continue the CPA revlew Ln the future. The Brandess-
Cadmus representatl-ves revlewed the Lnsurance negotlatlons 'status of delinquent assessments and the status of the agreement
wLth Fred Hibberd on BulLdlng D. The board expressed
satlsfactlon with the way all of these problem areas were being
handled. The board loas advised by the Presldent that the
Sonnenalp proJect whlch would have affected the East slde of
our property has been abandoned at teaet for the Present.
The board then revlewed the 1985 MaJor Improvement ProJects.
The palnting and recarpetlng of Bulldlng B was somewhat over the
orlglnal budget. The decislon was made last year to not heat
the driveway and lnstead we replaced a1l- the concrete Ln the
upper part of the drlveway and reposl-tLoned the parking gate.
VJe had an unplaned expenditure of about $9'OOO to replace gas
lLnes to all of our bulldlngs.

The board then revlewed the proposed budget for 1986. The new
budget represented a L7"/. increage. The maJor l-mprovement projects
for 1986 are to paLnt and recarpet as needed Bulldtng C. !{e
have already replaced the hot water heater ln Bulldlng A and the
elevator valve ln BulLdlng B. The board dLscussed our reserve
levels extensively and fel-t that even wLrh a 2O"L proposed
lncrease Ln assegsments that our reserves were minLmal. It
was felt that we want to avold any specLal assessment but that
our gral shouLd be to lncrease our reserves to approxlmately
$100,000 or 50% of annual revenue.
At last yearrs annual- meetlng there was discussion about posslbly
addltion of an eLevator in Bulldtng C and extendLng the elevator
ln Buildlng B to all 7 fl-oors. Mr. Hanschen reported on a study
made durlng last year and lt was agreed that even from a cursory
study Lt was not economical-ly feastble. Mr. Hanschen further
reported on some nen controla beLng Lnstalled on aLl three
bulldingst boilers which wt11 reduce our energy cost. Mr.
GllltLand reported on a proPosal from Heritage Cable TV. It
was agreed that Ite llere not lnterested Ln persuLng the proposal.
Mr. Dotson had deslgnated Mr. Hanschen as the necessary nomlnatlng
cosmittee to replace Mr. Dotson and Mr. Gllllland whose terms
were expl.rlng. Mr. Hanschen advlsed the board that he would put
Mr. Dotson ana Mr. GllllLandts names Ln nomLnatl-on at the annual
meetLng.
After consl-derabl-e discussl-on the 1985 results and the 1986 budget
and new assessment rates rilere unanl-mously approved.
The board reviewed and approved the combinatlon of 3C and 3D'
there being no external change or modificatlon to elther cormon
or llmited common elements.
Plans were submltted to the board for approval by the owner of lF
which would lncorporate an alr shaft lnto theLr unl.t. The air
shaft is a llml-ted common element slnce it serves only that unlt
and the board cannot l-egall-y deed that llml-ted common element

Pursuant to notice, a Speclal Meeting of the Board was convenedat 9:30 AI'l in Apartment 3C of Butlding B.
Mr. Dotson, President of the AssocLatLon, chal-red the meetLng
and kept the minutes. Present in addltlon were Mr. Gilliland,
Mr. McDanLel, and Mr. Hanschen. Thls constltuted a quorum.
In addltlon, Marta Cadmus and Cralg Granlund attended the
neettng.
Upon a mntlon made by Mr. McDanlel and seconded by Mr. Hanschen
the minutes of the Directorsr meetLngs held March 9, 1985, at
10:00 AIl and 5:30 PM lrere accepted as submitted.
Plans for the annual meetLng held later thl-s same day were
revLewed alcng wLth the proposed agenda.
The board then reviewed and discussed the 1985 Income and Expenses.
The report prepared by the managlng agent lndl-cated our exPenseg
were sllghtly under budget but this is misteading. We had
several maJor expendltures ln lnsurance and antlfreeze whlch
were lncurred in 1985 but were not pald frr untll 1986 and
thls w111 be reflected Ln the L986 budget. The board also
reviewed the CPA|s.revlelv of the 1985 expendLtures and made the
decislon to continue the CPA revlew Ln the future. The Brandess-
Cadnus representatives revlewed the ineurance negotlations'
staEus of delinquent assessments and the status of the agreement
wlth Fred Hibberd on BuiLding D. The board expreesed
satisfactton wlth the way a1l- of these problem areae were belng
handled. The board was advlsed by the PresLdent that the
Sonnenalp proJect whlch would have affected the East slde of
our property has been abandoned at least for the Present.
The board then revlewed the 1985 MaJor Inprovement Projects.
The paLntLng and recarpettng of Bulldtng B was somewhat over the
orlglnal budget, The declsion was made last year to not heat
the driveway and lnstead we replaced all the concrete ln the
upper part of the drLveway and reposltioned the parking gate.
I{e had an unplaned expenditure of about $91000 to replace gas
lines to aLl of our bulldlngs.

The board then revLewed the proposed budget for I-986. The new
budget represented a L7% increase. The major lmprovement projects
for L986 are to palnt and recarpet as needed Buildtng C. We
have already replaced the hot water heater ln Bulldlng A and the
elevator valve ln Bullding B. The board dLscussed our reserve
levels extenslvely and felt that even wLth a 20% proposed
increase ln assessments that our reserves htere minlmal . It
was felt that we lrant to avoid any speclal assessment but that
our graL shoul-d be to lncrease our reserves to approxl-mately
$100,000 or 50% of annuat revenue.
At last yearrs annual meetlng there was discussion about possibly
addltion of an elevator in Bullding C and extending the elevator
ln Buildtng B to aLL 7 floors. Mr. Hanschen reported on a study
made during last year and lt was agreed that even from a cursory
study Lt was not economlcally feaslble. Mr. Hanschen further
reported on some new controls belng installed on all three
bull-dings' boilers which w111 reduce our energy cost. Mr.
GtlLtland reported on a ProPosal from Herltage Cable TV. It
was agreed that we ltere not Lnterested ln persuing the proposal.
Mr. Dotson had deslgnated Mr. Hanschen as the necessary nominatLng
cormnlttee to repl-ace Mr. Dotson and Mr. G|ll-l-land whose termg
were explrlng. Mr. Hanschen advlsed the board that he would put
Mr. Dotson and Mr. Gtlltlandts names ln nomination at the annual
meetlng.
After considerabLe dlscussl-on the l-985 results and the 1986 budget
and new assessment rates rflere unanLmousl-y approved.
The board reviewed and approved the comblnatlon of 3C and 3D'
there being no externat change or modifl-cati-on to either contrnon
or llmlted common elements.
Plans were subml-tted to the board for approval by the owner of lF
whlch would incorporate an alr shaft lnto thelr unit. The alr
shaft ls a llml-ted common element slnce l-t serves only that unlt
and the board cannot legalJ-y deed that limited common element
to lF. However, the board has no obJection to lF usl-ng the space

as they proposed as long as the Assoclatlon ls LegaL1y held harmless
as a result of any of the proposed changes. In addltlon, any
lmpact on Dur lnsurance would be borne by unlt 1-F.
The board also revlewed plans for the connectlng of units 6C and7C. Architectual drawLngs showing a change in the roof as well
as a cover over 7C balcony were revLewed. After conslderable
discussion and an on-slte revlew the board approved the proposed
plans subJect to the same Lega1 and lnsurance restrlctlons as
dLscussed above for unit lF.
There belng no further busLness the meetlng was adJourned at l-:30 PM.

PUBLIC WORKS AND THE PUBLIC WAY PERMIT PROCESS
How it relates to Building Permits:
Fill out the attached check list with the Buildinq Permit Application.
If yes was answered to any of the questions then a "Public Way" permit is required. You
can pick up an application at either Community Development, located at 75 South Frontage
Road or Public Works, located at 1309 Elkhorn Drive.
Notice sign-offs for utility companies. ALL utilities must field verifli (locate) respective
utilities prior to signing application. Some utility companies require up to 48 hours notice to
schedule a locate.
A construction traffic control/staging plan must be prepared on a separate sheet of paper.
An approved site plan may also be used. This plan will show locations of all traffic control
devices (signs, cones, etc.) and the work zone, (area of construction, staging, etc.). This
plan will expire on November 1st and will need to be resubmitted for consideration for
approval through the winter. Be aware that your resubmission for winter may be denied
depending on the location of construction.
Sketch of work being performed must be submitted indicating dimensions (length, width
and depth of work). This may be drawn on the traffic control plan or a site plan for the job.
Submit completed application to the Public Work's office for review. If required, locates will
be scheduled for the Town of Vail electricians and irrigation crew. The locates take place in
the morning, but may require up to 48 hours to perform.
The Public Work's Construction Inspector will review the application and approve or deny
the permit. You will be contacted as to the status and any requirements that may be .
needed. Most permits are released within 48 hours of being received, but please allow up
to one (1) week to process.
As soon as the permit is approved, the Building Depaftment will be notified, allowing the
"Building Permit" to be released. Please do not confuse the "Public Way Permit" with a
"Building Permit".
NOTE: The above pnocess is for work in a public way ONLY. Public Way
Permits"are valid only until November 15th. A new Public Way Permit is required
each year if work is not aomplete. Re-application each November 15th does not
mean an automatic renewal.

BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Depaftment review or Health Department review, and a review
by the Building Department, the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.

that if the permit is not picked up by the expiration date, that I must still pay the plan check fee

o Unlawful deposits: Subject to subsection C thereof, it is unlawful for any person to litter, track or
deposit, or cause to be littered, tracked or deposited, sand, gravel, rocks, mud, dirt, snow, ice, or any
other debris or material upon any street, sidewalk, alley or public place, or any portion thereof.
o Notice; Abatement: The Director of Public Works may notify and require any person who violates or
causes another to violate the provision of subsection A hereof, or who has in the Director's employment
a person who violates or causes another to violate the same, top remove such sand, gravel, rocks, mud,
dirt, snow, ice or any other debris or material within twenty four (24) hours after receipt of said notice
by the Director of Public Works. In the event the person so notified does not comply with the notice
within the period of time herein specified, the Director of Public Works, or other authorized agent, may
c.luse any such sand, gravel, rocks, mud, dirt, snow, ice, debris or any other material to be removed
from any street or alley at the expense of the notified.
o Summons and Penalty: As an alternative to the notice for removal provided in subsection B above,
any person who violates or causes another to violate the same, may be issued a summons to appear
before the Municipal Court of the Town for said violations, and upon being found guilty of a violation
hereunder be punished as provided in Section 1-4-1 of this code.
D Notice and Penalty: It is unlawful for any person to fail or refuse to comply with the notice of the
Director of Public Works as provided in subsection B hereof, and any such person shall, in addition to
payment of the expense of removal incurred by the Director of Public Works, as provided in subsection B
hereof, upon being found guilty of a violation hereunder, be punishable as provided in Section t4-L of
this Code. (1997 Code: Ordinance 6 (1979).
CODES 7-3A-I AND 7-3A-3: PARKING OBSTRUCTING TRAFFIC & IMPOUNDMENT AUTHORIZED
o No person shall park any vehicle upon a street or at any other place within this Municipality in such a
manner or under such conditions as to intedere with the free movement of vehicular traffic or proper
street or highway maintenance, (Ord, 2(1968) 5 1)
o Whenever any police officer finds a vehicle attended or unattended, standing upon any portion of a
street or upon any place within this Municipality in such a manner as to constitute a violation of any
seqtion of this Article, or left unattended for a period of twenty four (24) hours or more and presumed to
be abandoned under the conditions prescribed by Colorado Revised Statutes section 42-4-1102, as
amended, the officer shall require the vehicle to be removed or cause it to be removed and placed in
storage in the nearest garage or other place of safety designated or maintained by this Municipality, and
the charges for towing and storage of such vehicle shall be charged to the owner of the vehicle in
addition to a ten dollar ($10) impoundment charge. (Ord, 2(1968) g 3: Ord. 28(1981) S 1)
