I understand that since February L4th, you have reduced the number of signs in the windows at Vail Gear. This cooperation isappreciated. Upon examination, houever, we have found that thereare still nore than two signs. The Vail sign code pemits two window signs per business. The twosigns nay total ten square feet for the conbined area of the twosigns. In addition, no sign shall be greater than 158 of any window in which it is placed. Enclosed is the section of the Vail si-gn code which pertains to window signs. Please note that each decal (excluding decals which refer to creditcards or lrours of operation) also counts as signage. The nane ofyour shop may appear once on your windows in a size not to exceed1.5 square feet, and in addition, you nay also have two windowsigns which do not include the words, Vail Gear. DESCRIPTION OF THE REOUEST Pam Hopkins, on behalf of the La Tour Resiaurant and Fred Hibbard, has requested a major exterior alleration in the Commercial Core 2 (CC2) Zone District and a conditional use permit, to allow for a proposed building addition and the relocation of the outdoor dining deck at the Village Center Building, locaied at 122 East Meadow Drive/Block 5E, Vail Village 1st Filing. The La Tour Restaurant is located in the Village Center Building beneath the Glockenspiel. The applicant is proposing a new entry and dining room addition to the restaurant. The proposed addition will increase the existing area of the restaurant by 530 sq. ft. The improvements proposed with the addition include a new bay window on lhe west elevation of the Cleone's retail space, a 336 sq. ft. addition to the seating area of the restaurant and a new 194 sq. ft. waiting area. Addiiionally, the applicant has proposed to relocate the existing outdoor eating area to the north of the existing dining area and to reconstruct the existing planter in the plaza. The building materials used lo construct the addition are proposed to match the existing materials on the building. This includes the stucco walls and the gravel roof. The wall sign currently located above the existing front enlry will be replaced once the addition is completed. The new sign will be put back over the new front entry on a newly proposed awning. A copy ofthe plans have been attached for reference. CRITERIA TO BE USED IN EVALUATING THIS PROPOSAL The review criteria for a request of this nature are established by the Town of Vail Municipal Code. The emphasis of this review is on the proposal's compatibility with the Zoning Code, the Town of Vail Streelscape Master Plan, the Vail Village Urban Design Guide Plan, the Vail Village Design Considerations and the Vail Comprehensive Plan. A. Comoliance with the Town of Vail Zonino Gode As stated in the Zoning Code, the puryose of the CC2 Zone District is as follows: "The CC2 District is intended to provide sites for a mixture of multiple dwellings, lodges, and commercial establishmenls in a clustered, unified development. The CC2 District is intended to insure adequate light, air, open space and other amenities appropriate to the permitted types of buildings and uses and to maintain the desirable quality of the District by establishing appropriate site development standards." Additionally, the Zoning Code defines an Exterior Alteration as, in part, "the alteration of an existing building which adds or removes any enclosed floor area (and/or) the alteration of an existing building which modifies the existing roof." An exterior alteration is consider a "majo/' exterior alteration if the addition is greater than 100 square feet in size. As stated in the Zoning Code, the puryose of a conditional use permit is as follows: "ln order to provide the flexibility necessary to achieve the objectives of this Title, specified uses are permitted in certain districts subject to the granting of a conditional use permit. Because of their unusual or special characteristics, conditional uses require review and evaluation so that they f:\everyone\pec\memos\98Vatour.71 3 2 Allowable Existing 23,064 sq. ft. 15,661 sq. fl. The review process prescribed in this Chapter is intended to assure compatibility and harmonious development between conditional uses and sunounding properties and the Town at large. Uses listed as conditional uses in the various districts may be permitted subject to such conditions and limitations as the Town may prescribe to ensure that the location and operation of the conditional uses will be in accordance with development objectives of the Town and will not be detrimental to other uses or properties. Where conditions cannot be devised to achieve these objectives, applications for conditional use permits shall be denied." According to the Town of Vail Municipal Code, "an outdoor dining deck shall be permitted on the first floor or street level of buildings in the Commercial Core 2 Zone Districi subject to the issuance of a conditional use permit. STAFF RESPONSE: Upon review of the proposed major exterior alteration and conditional use permil to allow for an exterior expansion and the relocation of the existing outdoor dining deck at the La Tour Restaurant, staff believes that the proposed addition complies with the purpose statement of the CC2 Zone District and that the addition is a major exterior alteration since the proposal adds 530 square feet of new floor area to the existing building. B. Gompliance with the Vail Village Urban Desion Guide Plan The Vail Village Urban Design Guide plan does not specifically identify improvements for the Village Center property, The only relevant sub-area element in the immediate vicinity of the proposed Village Center Building addition is the landscape element. According io the landscape element described in the Vail Village Urban Design Guide Plan, retaining walls, if proposed, should include seating opportunities and be conslructed of either concrete or rounded stone cobble with hidden mortar. The landscape element guidelines specifically indicate that wood retaining walls are strongly discouraged due to deterioralion caused by Vail's harsh climate. Cunently, a 48 sq. ft. wood-tie landscape planter exists in the plaza area north of lhe proposed addition to the La Tour Restaurant. The planter is owned and maintained by the applicant. The planter is beginning to deteriorate and show signs of age. The applicant is proposing to replace the existing 48 sq. ft. wood-tie planter at this time. On March 1 1 , 1996, the applicant applied for, and had approved, a major exterior alteration to the Gotthelf Gallery, which is immediately adjacent to the La Tour Restaurant. At that iime, the applicant did not feel that the size and scope of the proposal for the improvements to the Gotthelf Gallery justified the need to replace the planter. The applicant agreed to replace the planler when improvemenls were made to the La Tour Restaurant. f :\everyo ne\pec\memos\98Vatou r.7 1 3 STAFF RESPONSE: Staff concuned with the applicant at the time of the Gotthelf Gallery improvements and felt that the proposal, as suggested by the applicant for replacing the planter, was acceptable. Staff now believes thai the applicant needs to replace the existing planter. Staff would recommend that the planter be replaced in its approximate or exact location and that the materials used in the reconstruction of the planter be those materials proposed by the Vail Village Urban Design Guide Plan. Specifically, staff would suggest that the planter be constructed of rounded stone cobble with hidden mortar and be no more than 18" in height. The 18" height limitation will allow for the planter to be used for informal seating. C. Gomoliance with the urban design considerations for Vail Mllage and the exterior alteration criteria. 1. Urban Design Considerations. a. Pedestrianization A major objective for Vail Village is to encourage pedestrian circulation through an interconnected network of safe, pleasant pedestrian ways. Staff believes the pedestrian way to the north of the Village Center Building is already a pleasant pedestrian environment with the heated, brick paver walkways, large areas of mature landscaping, and the appropriate pedestrian scale of the building. The plans proposed by the applicant further enhance the pedestrian environment. lt is staffs opinion that the proposed addition to the La Tour Restauranl will not negatively impact, nor affect the pedestrian scale of the walkway adjacent to the Village Center Building. b. Traffic penetration The major exterior alteration at the Village Center Building will have no effect upon vehicular penetration into the Village. The proposed addition will generate an increase in the total parking requirement for the Village Center Building by 2.8 parking spaces. The increase in the parking requirement will be met by the applicant through a payment into the Town of Vail Parking Fund. Therefore, staff believes there will be no impacts to vehicular penetration into the Village as a result of this request. c. Streetscape framework According to the Vail Village Urban Design Considerations, the qualily of the walking experience should be improved when necessary, and lhe pedestrian ways should be maintained. One means of accomplishing this goal is to infill commercial store fronts. Staff believes that the proposed addition will generale commercial activity and add to the visual interest of the building without jeopardizing the walking experience or pedestrian way in the area. d. Street enclosure Generally, streel enclosure becomes an issue when each side of a slreet has buildings on it. In the case of Easi Meadow Drive in the proximity of the Village f:\everyone\pec\memos\98\latour.71 3 4 Center Building, only the south side of the street is fronted upon by a building. To the north side of East Meadow Drive, across from the La Tour Restaurant, is the inlersection of East Meadow Drive and Village Center Road. lt is staffs opinion that the addition to the La Tour Restaurant will have a positive effect on the perception of street enclosure. Staff feels the proposed addition will bring the building closer to the main pedestrian walkway, thus helping to divert the attenlion of a pedestrian back to the building's display windows. e. Street edge According to the Vail Village Urban Design Considerations, buildings in the Village should form a strong but inegular edge to the street. The resulting "jogs" in the buildings should be used as activity areas for pedestrian use (ie. galhering, resting, orienting, etc.). Staff believes that the creation of the irregularity of the proposed building addition is positive. In staff's opinion the proposed addition meets ihe goals of the Vail Village Urban Design Considerations as it relates to street edge. f. Building height The building height proposed by the applicant is in keeping with the intent of the Vail Village Urban Design Consideraiions. The heighi of the proposed addition will be significantly less than the overall height of the existing building. Staff believes that the applicant has done an excellent job of matching the scale of the addition with the scale of ihe existing building. g. Views The Vail Village Urban Design Considerations stress the importance of views in the Village area. As proposed, the addition will not encroach upon any of the established view corridors. 2. Architectural/Landscape Considerations. a. Roofs The applicant has proposed a roof form similar to the existing roof form already on the building. The new roof over the La Tour Restaurant addition will simply be an exlension of the existing roof and eave line. The existing roof surface material on the Village Center Building is gravel. When the addition to the La Tour Restaurant is compleled, the new roof over the addition will blend and match the existing roof and roof material. Staff finds that the roof forms and roof materials proposed by the applicant are in compliance wiih the architectural/landscape considerations of the Vail Village Urban Design Considerations. b. Facades The applicant has proposed that all building materials used on the addiiion will match the existing materials already on the building. The applicant is proposing to add an additional bay window to the north elevation. According to the Vail Village Urban Design Considerations, bay, bow and box windows are common window details, which add further variety and massing to facades. Such window types are t\everyone\pec\memos\98\latour.713 s encouraged. lt is the opinion of the staff that the applicant's proposal to match the existing materials on the new building facade is a positive aspect of this proposal. Staff would suggest, however, that the applicant complete the painting of the building soffits as part of the consiruction process of the proposed addition. c. Balconies No balconies are included in lhis requesl, and therefore, are not relevant to this review. d. Decks and Patios A dining deck is proposed with this fequest. The existing dining deck accommodates three to four tables. The applicant is simply proposing to relocate the deck to accommodate the new reslaurant addition. e. Accenl elements Colorful accent elements, consistenl with existing charac{er are encouraged in the Village. While the applicant is nol proposing any changes to the building where it would be possible to incorporate new accent elements, staff believes the addition, overall, will be a positive element on the building. f. Landscape elements Upon review of the site, staff finds the landscape elements on the plaza are adequale. Staff feels there is a need to replace the existing wood-tie planter located in the plaza. The existing wood tie planter is beginning to show signs of deterioration resulting in an unattractive plaza landscape elemenl. Staff feels that this proposal is of a scope large enough to require the replacement of the wood- tie planter. g. Service No additional loading and delivery services are required as a result of this request. D. Comoliance with the Town of Vail Streetscape Master Plan. The Town of Vail Streetscape Master Plan attempts to improve the functioning character of the area by adding sidewalks where none presently exist, screening parking areas, and replacing railroad tie constructed retaining walls with boulder, or stone walls. Approximately 112 ot the sub-area (which includes the Village Center) is already well landscaped. The existing raised brick walkway that is adjacent to the Village Center Commercial area is a good example of an area that is well landscaped and well appointed with site fumishings. The only improvements suggested in the master plan for the Village Center area is expanding the planter near the entrance to the parking slruclure. The plan indicates that this would better define the roadway as well as increase the overall landscaped area. f:\everyone\pec\Temos\98Uatou r.71 3 STAFF RESPONSE: Upon review of the site by staff, the improvements suggested in the Town of Vail Master Streetscape Plan have already been completed. This work was completed approximately 2-112lo 3 years ago. Therefore, no new streetscape plan improvements are proposed to be made with this application. E. Comoliance with the Vail Comprehensive Plan Several elements of the Vail Comprehensive Plan indirectly address the proposed Major exlerior alteration to the La Tour Restaurant. The relevant elements and sec{ions are listed below: 1. Land Use Plan - 4.3: "The ambiance of the Village is important to the identity of Vail and should be preserved. Scale, alpine character, small lown feeling, mountains, natural setting, intimate size, cosmopolitan feeling and environmental quality shall be maintained or enhanced." 2. Vail Mllage Master Plan - 2.4 Objective: "Encourage the development of a variety of commercial activities that are compatible with exisling land uses." 2.4.1 Policy: "Commercial infill development consistent with established horizontal zoning regulations shall be encouraged to provide activity generators, accessible green spaces, public plazas, and streetscape improvemenls to lhe pedestrian network throughout the Village." STAFF RESPONSE: Staff believes the applicant's proposal seeks to achieve each of the objectives and policies listed above. tV. CRITERIA AND FINDINGS FOR A CONDITIONAL USE PERMIT Upon review of Chapter 16 of the Zoning Regulations, the Community Development Department recommends approval of the conditional use permit request to allow for allow for a restaurant expansion and an outdoor dining deck, located at the Village Center Building (La Tour), based upon the following factors: A CONSIDERATION OF FAGTORS: '1. Relationship and impact of the use on the development objectives of the Town. f:\everyone\pec\memos\98\atour.71 3 Staff believes the applicant's proposal is in concert with the Town developmeni objectives and will have minimal, if any, negative impacts on existing or potential uses in the sunounding area. 2. The effect of the use on light and air, distribution of population, transportation facilities, utilities, schools, parks and recreation facilities, and other public facilities needs. Staff believes that the proposal will have minimal negative impacts on the above-described criteria. As discussed in the previous crileria, staff believes the greatest impact of the applicant's proposal will be on parking. However, staff believes that the parking impact can be successfully mitigated. 3. Effect upon traffic with particular reference to congestion, automotive and pedestrian safety and convenience, traffic flow and control, access, maneuverability, and removal of snow from the street and parking arcas. Staff believes there will be minimal, if any, negative impacts on the above- described criteria 4. Effect upon the character ofthe area in which the proposed use is to be located, including the scale and bulk of the proposed use in rclation to surrounding uses. Staff believes that the proposal has many positive asPects and thal the characler of the area will be enhanced as a result of the proposed improvements. B. FINDINGS The Planning and Environmental Commission shall make lhe following findings before granting a conditional use permit: 1. That the proposed location of the use is in accordance with the purposes of the conditional use permit section of the zoning code and the purposes of the district in which the site is located. 2. That the proposed localion of the use and the conditions under which it would be operated or maintained would not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvemenls in the vicinity. 3. STAFF RECOMMENDATION The Community Development Department recommendations approval of the proposed major exterior alteralion to the Village Cenler Building and the conditional use permit to allow for an addition to the La Tour Restaurant. The recommendalion for the approval of the major exterior alteration and conditional use permit requests is based upon the positive effect the proposal will have on the sunounding uses in the area, and the lack of negative effects lhe proposal will have on the Town of Vail in general. Siaff finds the applicant's requests comply with lhe crileria outlined for a request of this nature in the Zoning Code, the Town of Vail Streetscape Master Plan, the Vail Village Design Considerations, and the Vail Comprehensive Plan. Furlhermore, staff believes the major exterior alteration proposed by the applicant is supported by the Town's goals and objectives. Should the PEC choose to approve the applicant's request for a major exterior alteration and the conditional use permit, the slaff would recommend the following findings: 1. That the major exterior alteration is in compliance and is compatible with the Town of Vail Zoning Code, the Town of Vail Streetscape Master Plan, the Vail Village Urban Design Guide Plan, the Vail Village Urban Design Considerations and the Vail Comprehensive Plan. 2. That the proposed location of the dining deck is in accordance with the purposes of the conditional use permit section of the zoning code and the purposes of the Commercial Core 2 Zone District. 3. That the proposed location of the outdoor dining deck and the conditions under which it would be operated or maintained would not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity of lhe La Tour Restauranl. 4. That the proposed outdoor dining deck complies with each of the applicable provisions of the conditional use permit section of the zoning code as ouilined in Section lV of this memorandum. Should the PEC choose to approve the applicant's request for a major exterior alteration and the conditional use permit to allow for an addition to the La Tour Restaurant, the staff would recommend that the approval carry with it the following conditions: 1. The only relavant sub-area element in the immediate vicinity of the proposed Village Center Building addition is the landscape element. According to the landscape element described in the Vail Village Urban Design Guide Plan, retaining walls, if proposed' should include seating opportunities and be constructed of either concrete or rounded stone cobble with hidden mortar. The Landscape Element guidelines specifically indicate that wood retaining walls are strongly discouraged due to deterioration caused by Vail's harsh climate. Currently a 48 sq. ft. wood-tie landscape planter exists in the plaza area northeast of the proposed addition to Gonhelf's Gallery. The planter is owned and maintained by the applicant. The planter is beginning to deteriorate and show signs of age. The applicant is not proposing to replace the existing 48 sq. ft. wood-tie planter at this time. The applicant feels that the size and scope of this proposal does not justily the need to replace the planter. The applicant has agreed to replace the planter when improvements are made to La Tour Restaurant. STAFF RESPONSE: Statf concurs with the applicant and feels that the agreement suggested by the 1. applicant is acceptable. Compliance with the urban design considerations for Vail Village and the extgrior alteration criteria. Urban Design Considerations. a. Pedestrianization A major objective for Vail Village is to encourage pedestrian circulation through an interconnected network of safe, pleasant pedestrian ways. Statf believes the pedestrian way to the north of the Village Center Building is already a pleasant pedestrian environment with the heated, brick paver walkways, large areas of mature landscaping, and fie appropriate pedestrian scale ol he building. Traffic penetration The Major Exterior Alteration at the Village Cenler Building wil! have no effect upon vehicular penefation into the Village. The proposed addition will.generate an increase in the total parking requirement for fr|e Village Center Building by 0.437 ol a parking space. The increase in tre parking requkementwillbe met by the applicaht through a payment into the Town of Vail Parking Fund- Therefore, staff ailieves there will be no irnpacts to vehicular penetration into the Village as a result of this request. c. Streetscape framework According to t|e Vail Village Urban Design Considerations, the quality of the walking experience should be improved when necessary, and the pedestrian ways shouldbe maintained. One means of accomplishing this goal is to infill commercial store fronts. Staff believes ftat the proposed addition will generate commercial aclivaty and add to the visual interest of the building without jeopardizing the walking experience ot pedesfrian way in the area. d. Street enclosure Generally, street enclosure becomes an issue when each side of a street has buildings on it. In the case of East Meadow Drive in the proximity of the Village Center Building, only the souilt side of the street is fronted upon by a building. To the north side ol East Meadow Drive, across fiom Gotthelf's Gallery, is the intersection of East Meadow Drive and Village Genter Road. lt is staff's opinion that the addition to Gotthelf's Gallery will have a positive effect on he perception of street enclosure. Statf feels the proposed addition will bring the buiEing closer to the main pedestrian walkway, thus helping to divert the attention of a pedestrian back to the building's display windows. e. Street edge According to the Vail Village Urban Design Considerations, buildings in the Village stroutd form a strong but inegirlar edge to the street The resulting'jogs'in the buildings should be used as activity areas for pedestrian use (ie. gathering, resting, orienting, etc.). Staff believes that he creation ol the irreguladty ol the proposed building addition is positive. Statf also believes that he proposed addition willprovide additionalvisual interest for pedestrians by increasing the opportunity lor window shopping. In statfs opinion the proposed addition meets the goals of the Vail Village Urban Design Considerations as it relates to street edge. f. Building height The building height proposed by the applicant is in keeping with the intent of the Vail Village Urban Design Considerations. The height of the propo-sed addition will be significantly lesslhan the overall height of the existing building. Staff believesihat tne ippticant has done an excellent job of matching the scale of the addition with the scale of the existing building. g. Views The Vail Vitlage Urban Design Considerations stress the importance of views in the Village area. As proposed, the addition will not encroach upon any of the established view corridors. In addition, the staff believes that the proposed exterior alteration will not obstruct the views to the windows or entrances of other retail stores on the plaza. Arch itectural/Landscape Considerations. a. Roofs The applicant has proposed a roof form simitar to the existing roof lorm already on the building. The new roof over tre gallery addition will simply be an extension of the existing roof and eave line. The existing roof surface material on the Village Center Building is gravel. When the addition to Gotthefi's Gallery is completed, the new roof over the addition willblend and match the existing roof and rool material. Statl finds that the roof forms and roof materials proposed by the applicant are in compliance with the architectural/landscape considerations of the Vail Village Urban Design Considerations. b. Facades The applicant has proposed that all building materials used on the addition will match the existing materials already on the building. The applicant is proposing to add an additional bay window to the north elevation. According to fte Vail Village Ulban Design Considerations, bay, bow and box windows are common window details, which add further variety and massing to facades. Such window types are encouraged. lt is the opinion of the staff that the applicant's proposal to match the existing materials on the new building facade, as well as add a bay window to the north elevation, are positive aspects of this proposal. Staff would suggest, however, that the applicant complete the painting of the building soffits as part of the-construction process ol lhe proposed addition. c. Balconies No balconies are included in this request, and therefore, are not relevant to this review. o d. Decks and Patios No decks or patios are proposed with this request, and therefore, are not relevant to this review. e. Accent elements Colorful accent elements, consistent with existing character are encouraged in the Village. While the applicant is not proposing any changes to the building where it wouE be possible to incorporate new accent elements, statf believes the addition' overall, will be a positive element on the building. f. Landscape elements Upon review of the site, statf finds the landscape elements on the plaza are adequate. Staff teels there rnay be a need to replace the existing wood-tie planter located in the plaza, in he future. The existing wood tie planter is beginning o show signs of deterioration resulting in an unattrac{ive plaza landscape element. Staff does not feel that this proposal is of a scope large enough to requhe the replacement of the wood-tie planter. g. Service No additional loading and delivery services are required as a result of this request. Compliance with tha Town of Vall Strcetscaoe llartar Plan. The Town of Vail Streetscape Master Plan attempts to improve the functioning character of the area by adding sidewalks where none presenfly exist, screening parking areas, and replacing railroad tie constructed retaining walls with boulder, or stone walls. Approximately 1/2 ot the sub-area (which includes he Village Center) is already well landscaped. The existing raised brick walkway that is adjacent to the Village Center Commercial area is a good example ol an area that is well landscaped and well appointed with site furnishings. The only improvements suggested in the master plan for the Village Center area is expanding the planter near the entrance to the parking structure. The plan indicates that this would better define the roadway as well as increase the overall landscaped area. STAFF RESFONSE: Upon review of the site by staff, the improvements suggested in the Town of Vail Master Streetscape Plan have already been completed. This woft was completed approximately 1-1l2to 2 years ago. Therefore, no new streetscape plan improvements are proposed to be made witt this application. E.Compliance with the Vall Comprehensive Plan Serreral elements of the Vail Comprehensive Plan indirectly address the proposed Major Exterior Alteration to Gotthelf's Gallery. The relevant elements and sections are listed below: 1. Land Use Plan - 4.3:"Theambianceofthevi||ageisimportanttotheidentityo|Vail and should be preserved. Scale, alpine character, small towl leeling, mountains, natural setting, intimate size, cosmopolitan feeling and environmental quality shall be maintained or enhanced." 2. Vail Vlllage Master Plan - 2.4 Objective: "Encourage fte development of a variery of commercialactivities fiat are compatible with existing land uses" 2.4.1 Policy: "Commercial infill development consistent with established horizontal zoning regulations shall be encouraged to provide activity generators, accessible green spaces, public plazas, and streetscape improvements to the pedestrian network throughout the village." STAFF RESFONSE: Staff believes the applicant's proposal seeks to achieve each of the objectives and policies listed above. STAFF RECOMMENDATION The Community Development Department recommendations approval of the proposed Major Exterior Alteration to the Village Center Building to allow lor an addition to Gotthelf's Gallery. The recommendation for the approval of the Major Exterior Alteration request is based upon the positive etfect the proposal will have on the surrounding uses in the area, and the lack of negative effects the proposalwill have on the Town of Vail in general. Staff finds the applicant's Major Exterior Alteration request complies with the criteria outlined for a request of this nature in the Zoning Code, the Town of Vail Streetscapb Masler Plan, the Vail Villbge Design Considerations, and the Vail Comprehensive Plan. Furthermore, statf believes the Major Exteriol Alteration proposed by the applicant is supported by the Town's goals and objectives.
