BUILDING PERMIT ISSUANCE TIME FRAME
if this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Department review, and a review
by the Building Department, the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requiremenls. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.

that if the permit is not picked up by the expiraUon date, that I must still pay the plan check fee
and that if I fail to do so it may affect future permits that I apply for.

PUBLIC WORKS AND THE PUBLIC WAY PERMIT PROCESS
How it relates to Building Permits:
Fill out the attached check list with the Building Permit Aoplication.
If yes was answered to any of the questions then a "Public Way" permit is required. You
can pick up an application at either Community Development, located at 75 South Frontage
Road or Public Works, located at 1309 Elkhorn Drive.
Notice sign-offs for utility companies. ALL utilities must field verifr7 (locate) respective
utilities prior to signing application. Some utility companies require up to 48 hours notice to
schedule a locate.
A construction traffic control/staging plan must be prepared on a separate sheet of paper.
An approved site plan may also be used. This plan will show locations of all traffic control
devices (signs, cones, etc.) and the work zone, (area of construction, staging, etc.), This
plan will expire on November lst and will need to be resubmitted for consideration for
approval through the winter. Be aware that your resubmission for winter may be denied
depending on the location of construction.
Sketch of work being performed must be submitted indicating dimensions (length, width
and depth of work). This may be drawn on the traffic control plan or a site plan for the job.
Submit completed application to the Public Work's office for review. If required, locates will
be scheduled for the Town of Vail electricians and irrigation crew. The locates take place in
the morning, but may require up to 48 hours to perform.
The Public Work's Construction Inspector will review the application and approve or deny
the permit. You will be contacted as to the status and any requirements that may be
needed. Most permits are released within 48 hours of being received, but please allow up
to one (1) week to process.
As soon as the permit is approved, the Building Department will be notified, allowing the
"Building Permit" to be released. Please do not confuse the "Public Way Permit" with a
"Building Permit".
NOTE: The above process is for work in a public way ONLY. Public Way
Permits are valid only until November 15th. A new Public Way Permit is required
each year if work is not complete. Re-applicauon each November 15th does not
mean an automatic renewal.

DRAINAGE AND CULVERT INSPECTIONS ARE REOUIRED BY PUBLIC WORKS!
Please read and check off each of the items below:
o The Town of Vail Building Department has developed the following procedures to
ensure that new construction sites have adequately established proper drainage
from building sites along and adjacent to Town of Vail roads or streets.
o The Town of Vail Public Works Department will be required to inspect and approve
drainage adjacent to Town of Vail roads or streets and the installation of temporary
or permanent culverts at access points from the road or street onto the construction
site. Such approval must be obtained prior to any requests for inspection by the
Town of Vail Building Department for footings, temporary electrical or any other
inspection. Please call Leonard Sandoval at 479-2798 to request an inspection from
the Public Works Department. Allow a minimum of 24 hour notice.
a Also, the Town of Vail Public Works Department will be approving all final drainage
and culvert installation with resulting road patching as necessary. Such approval
must be obtained prior to any Final Certificate of Occuoancv issuance.

CODE 5-2-10: DEPOSITS ON PUBLIC WAYS PROHIBITED
o UnlaMul deposits: Subject to subsection C thereof, it is unlawful for any person to litter, track or
deposit, or ctruse to be littered, tracked or deposited, sand, gravel, rocks, mud, dirt, snow, ice, or any
other debris or material upon any street, sidewalk, alley or public place, or any portion thereof.
D Notice; Abatement: The Director of Public Works may notiff and require any person who violates or
causes another to violate the provision of subsection A hereof, or who has in the Director's employment
a person who violates or causes another to violate the same, top remove such sand, gravel, rocks, mud,
dirt, snow, ice or any other debris or material within twenty four (24) hours after receipt of said notice
by the Director of Public Works. In the event the person so notified does not comply with the notice
within the period of time herein specified, the Director of Public Works, or other authorized agent may
cause any such sand, gravel, rocks, mud, dirt, snow, ice, debris or any other material to be removed
from any street or alley at the expense of the notified.
tr Summons and Penalty: As an alternative to the notice for removal provided in subsection B above,
any person who violates or causes another to violate the same, may be issued a summons to appear
before the Municipal Court of the Town for said violations, and upon being found guilty of a violation
hereunder be punished as provided in Section 1-4-1 ofthis code.
D Notace and Penaltyr It is unlawful for any person to fail or refuse to comply with the notice of the
Director of Public Works as provided in subsection B hereof, and any such person shall, in addition to
payment of the expense of removal incuned by the Director of Public Works, as provided in subsection B
hereof, upon being found guilty of a violation hereunder, be punishable as provided in Section 1-4-1 of
this Code. (1997 Code: Ordinance 6 (1979).

street or upon any place within this Municipality in such a manner as to constitute a violation of any

be abandoned under the conditions prescribed by Colorado Revised Statutes section 42-4-1102, as
amended, the officer shall require the vehicle to be removed or cause it to be removed and placed in
storage in the nearest garage or other place of safety designated or maintained by this Municipality, and
the charges for towing and storage of such vehicle shall be charged to the owner of the vehicle in
addition to a ten dollar ($10) impoundment charge, (Ord. 2(1968) ! 3: Ord. 28(1981) 5 1)

For new construction and additions, the applicant must stake and tape the project site to indicate
property lines, proposed buildings and building corners. All trees to be removed must be taped. The
applicant must ensure that staking done during the winter is not buried by snow. All site tapings and
staking must be completed prior to the day of the DRB meeting.
The applicant, or their representative, shall be present at the Design Review Board Hearing. Applicants
who fail to appear before the Design Review Board on their scheduled meeting date and who have not
asked in advance that discussion on their item be postponed, will have their items removed from the DRB
agenda until such time as the item has been republished.
If the DRB approves the application with conditions or modiflcations, all conditions of approval must be
resolved prior to the issuance of a building permit.
Staff Aporoval
The Administrator (a member of the planning staff) may review and approve Design Review applications,
approve with certain modifications, deny the application, or refer the application to the Design Review
Board for a decision. All staff approvals are reviewed by the Design Review Board and any staff decision

Thank you for submitting an application for a new exterior projecting/hanging sign on the north frontage of the Eye
Pieces shop on Meadow Drive. The size and the type of the proposed sign are within the regulations stated in
Title 11. However, the support structures, design, and placement of the sign in relation to other signs within the
Village Center will be reviewed at the next Design Review Board hearing on November 5, 2003, to ensure
compliance with the sign program for that building. lt seems that Village Center is applying for revisions to the
sign program currently in place for the entire building, which will largely dictate what is allowed at your location.
The Design Review Board will visit the location on that day and will make a decision at the 3pm public hearing as
to the approval, approval with conditions, or denial of the application.
The meeting will be held at the Council Chambers in the Town of Vail Municipal Building at 75 S. Frontage Road.
To get to the Chambers, exit l-70 westbound at Exit 176, heading south under the bridge, then west at the main
roundabout. Turn right at the second possible driveway into the large pa*ing lot. The Chambers is located off of
the main corridor of the building located on the east side of the parking lot.

Review Criteria
The proposal will be reviewed for compliance with the Design Guidelines as set fotth in T'itle 12 (Zoning
Regulations) and litle 14 (Development Standards) of the Town of Vail Municipal Code.
Desiqn Review Board Meetinq Requirements
For new construction and additions, the applicant must stake and tape the project site to indicate
property lines, proposed buildings and building corners. All trees to be removed must be taped, The
applicant must ensure that staking done during the winter is not buried by snow. All site tapings and
staking must be completed prior to the day of the DRB meeting.
The applicant, or their representative, shall be present at the Design Review Board Headng. Applicants
who fail to appear before the Design Review Board on their scheduled meeting date and who have not
asked in advance that discussion on their item be postponed, will have their items removed from the DRB
agenda until such time as the item has been republished.
If the DRB approves the application with conditions or modifications, all conditions of approval must be
resolved prior to the issuance of a building permit.

SUBJECT PROPERTY
The Village Center Commercial Condominiums, Building D, is located at 122
East Meadow Drive/Lot K, Block 5E, Vail Village First Filing.
PLANING AND ENVIRONMENTAL COMMISSION JURISDICTION
Pursuant to Section 12-3-38-1, Appeal of Administrative Actions; Authority, Vail
Town Code, the Planning and Environmental Commission has the authority to
hear and decide appeals from any decision, determination or interpretation by
any Town of Vail administrative official with respect to the provisions of the
Zoning Code.
PROCEDURAL CRITERIA FOR APPEALS
Pursuant to Sections 12-3-38-2 and 1 2-3-38-3, Appeal of Administrative Actions;
Initiation and Procedures, Vail Town Code, there are three basic criteria for an
appeal: 1) standing of the appellant; 2) adequacy of the notice of appeal; and 3)
timeliness of the notice of appeal.
A. Standinq of the Appellant
The appellant has standing to appeal the administrative decision related
to the staff determination that the commercial tenant space in question
within the Village Center Commercial Condominiums, located on the "first
floor or street level" of the building, as defined by Sections 12-7C-3 and
12-78-3, Permitted and Conditional Uses; First Floor or Street Level, Vail
Town Code.

B. Adequacv ofthe Notice ofthe Appeal

The application for this appeal was filed by the property owner Fred
Hibberd. The application has been determined to be complete by the
Community Development Department.
C. Timeliness of the Notice of Appeal
The Administrative Section of the Town's Zoning Code (12-3-38-3,
Procedures) states the following:
"A written notice of appeal must be filed with the Administrator or
with the department rendering the decision, determination or
interpretation within twenty (20) calendar days of the decision
becoming final. lf the last day for filing an appeal falls on a
Saturday, Sunday, or a Town-observed holiday, the last day for
filing an appeal shall be extended to the next busrness day. The
Administratofs decision shall become final at the next Planning
and Environmental Commission meeting (or in the case of deslgn
related decision, the next Design Review Board meeting) following
the Administratofs decision, unless the decision is called up and
modified by the Board or Commission."
The applicant submitted a complete appeal application within the twenty
(20) day requirement.
NATURE OF THE APPEALS
On December 5, 2003, Fred Hibberd, submitted a formal appeals form to the
Town of Vail Community Development Department. The nature of the appeal is
generally described below.
The appellant is appealing the following staff interpretation:
1) lt was determined by Staff that the appellant's commercial tenant space in
question in the Village Center Commercial Condominiums, Building D, (formerly
Overland & Express Travel Agency) is located on the 'Tirst floor or street level" of
the building, and therefore, is regulated by Section 12-7C-3, as further regulated
by Section 12-78-3, Vail Town Code, which states:
"PERMITTED AND CONDITIONAL USES; F/RSr FLOOR OR STREET
LEVEL:
A. Definition: The 'first floof' or'street level" shall be defined as that
floor of the building that is located at grade or street level.
B. Permitted Uses; Ihe following uses sha// be permitted on the first
floor or street level within a structure:
1. Retail sfores and establishments, including the following:
Apparel stores.
Art supply stores and galleries.
Ba keies and confection e rie s.
Eooksfores.
Camera stores and photographic studios.
Candy stores.
Chinaware and glassware sfores.
Delbafessens and specialty food sfores.
Drugstores and pharmacies.
F/onsfs.
Glftshops.
Hobby sfores.
Jewelry stores.
Leather goods stores.
Luggage sfores.
Music and record sfores.
Newssfands and tobacco sfores.
Spofting goods stores.
Stationery stores.
Ticket and travel agencies.

2. Eating and drinking establishments, including the following:
Bakeries and delicatessens with food service, restricted to preparation of
products specifically for sale on the premises.

Coffee shops.
Fountains and sandwich shops.

3. Lodges.
4. Additional uses determined to be similar to permifted uses described in
subsection 81 and 82 of this Section, in accordance with the provisions of
Secfion 12-3-4 of this Title so long as they do not encourage vehicular
traffic.
C. Conditional Uses: Ihe following uses sha// be permitted on the
first floor or street level floor within a structure, subiect to issuance of a
conditional use permit in accordance with the provisions of Chapter 16 of
this Title:
Banks and financial institutions.
Barbershops, beauty shops and beauty parlors.
Ho u se ho ld appl ia n ce sfores.
Liguor stores.
Outdoor patios.
Radio and fV sfores and repair shops."
Staff determined that the commercial tenant space is located on the "first floor or
street level" of the building. Pursuant to Title 12, Zoning Regulations, the

allowable uses on the 'Tirst floor or street level" of a building in the Commercial
Core 2 zone district are prescribed in Section 12-7C-3, Vail Town Code. The
appellant wishes to use the tenant space as a real estate office (ie, professional
offices, buslness offices and studios). According to Section 12-7C-3, Vail Town
Code, "professional ofiices, business offices and studios" shall only be allowed
on the "basement or garden leve!", "second floor", or lhe "above second floor"
fevefs of a building in the Commercial Core 2 zone district.
The commercial tenant space in question is a multi-level space with two floors
connected by an interior staircase. The total floor area of the two levels is
approximately 700 square feet in size. A total of 200 square feet of floor area
exists on the upper level of the space. Currently, access to the commercial
tenant space is provided at two locations. Access to the upper floor is located on
the east side of the building across from the Austria Haus parking garage with a
second access provided to the lower level on the south side of the building
across from the enhance to the Village Center Condominiums, Building A. Staff
has determined that the upper level of the space is "first floor or street level" and
that the lower level of the space is "basement level or garden level". Staffs
determination is based upon 1) the physical location of lhe spaces relative to the
level of the street, 2) the configuration of the building; and 3) the location of the
access to the spaces.
Upon review of Title 12, Zoning Regulations, the terms, 'first floor or street level",
"second floof, or "above second floof'are not defined. However, the term
"basement or garden level" is defined as,
'that floor of the building that is entirely or substantially below grade."
The appellant's statement as to the specific nature of the appeal is attached
(attachment A).
REQUIRED ACTION
Uphold/Overturn/Modify the administrative interpretation.
Section 12-3-38-5, Findings, details the requirements for action taken by the
Planning and Environmental Commission as follows:
"The Planning and Environmental Commission (or the Design Review
Board in the case of design guidelines) shall on all appeals make speciftc
findings of fact based directly on the pafticular evidence presented to it.
These findings of fact must support conclusions that the standards and
conditions imposed by the requirements of this Title have or have not
been met."
STAFF REGOMMENDATION
The Community Development Department recommends that the Planning and
Environmental Commission upholds the administrative interpretation
determining that a commercial tenant space within the Village Center
vt.
Commercial Condominiums, Building D, is on the "first floot'' or "street level" of

PUBLIC WORKS AND THE PUBLIC WAY PERMIT PROCESS
How it relates to Building Permits:
Fill out the attached check list with the Building Permit Application,
If yes was answered to any of the questions then a "Public Way" permit is required. You
can pick up an application at either Community Development, located at 75 South Frontage
Road or Public Works, located at 1309 Elkhorn Drive.
Notice sign-offs for utility companies. ALL utilities must field verify (locate) respective
utilities prior to signing application. Some utility companies require up to 48 hours notice to
schedule a locate.
A construction traffic control/staging plan must be prepared on a separate sheet of paper.
An approved site plan may also be used. This plan will show locations of all traffic control
devices (signs, cones, etc.) and the work zone, (area of construction, staging, etc.). This
plan will expire on November lst and will need to be resubmitted for consideration for
approval through the winter. Be aware that your resubmission for winter may be denied
depending on the location of construction.
Sketch of work being performed must be submitted indicating dimensions (length, width
and depth of work). This may be drawn on the traffic control plan or a site plan for the job.
Submit completed application to the Public Work's office for review. If required, locates will
be scheduled for the Town of Vail electricians and irrigation crew. The locates take place in
the morning, but may require up to 48 hours to pedorm.
> The Public Work's Construction Inspector will review the application and approve or deny
the permit. You will be contacted as to the status and any requirements that may be
needed. Most permits are released within 48 hours of being received, but please allow up
to one (1) week to process.
As soon as the permit is approved, the Building Department will be notified, allowing the
"Building Permit" to be released. Please do not confuse the "Public Way Permit" with a
"Building Permit".
NOTE: The above pnrcess is for work in a public way ONLY. Public Way
Permits are valid only until November 15th. A new Public Way Permit is required
each year if work is not complete. Re-application each November 15th does not
mean an automatic renewal,

BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Department review, and a review
by the Building Department the estimated time for a total review will take as long as three (3)
weeKs.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible,

ensure that new construction sites have adequately established proper drainage
from building sites along and adjacent to Town of Vail roads or streets.
s The Town of Vail Public Works Department will be required to inspect and approve

or permanent culvefts at access points from the road or street onto the construction
site. Such approval must be obtained prior to any requests for inspection by the
Town of Vail Building Depaftment for footings, temporary electrical or any other

the Public Works Depaftment. Allow a minimum of 24 hour notice.

CODE 5-2-10: DEPOSITS ON PUBLIC WAYS PROTIIBITED
o Unlawful deposits: Subject to subsection C thereof, it is unlawful for any person to litter, track or
deposit, or cause to be littered, tracked or deposited, sand, gravel, rocks, mud, dift, snow, ice, or any
other debris or material upon any street, sidewalk, alley or public place, or any portion thereof.
tr Notice; Abatement: The Director of Public Works may notiry and require any person who violates or
causes another to violate the provision of subsection A hereof, or who has in the Director's employment
a person who violates or causes another to violate the same, top remove such sand, gravel, rocks, mud,
dirt, snow, ice or any other debris or material within twenty four (24) hours after receipt of said notice
by the Director of Public Works. In the event the person so notified does not comply with the notice
within the period of time herein specified, the Director of Public Works, or other authorized agent, may
cause any such sand, gravel, rocks, mud, dirt, snow, ice, debris or any other material to be removed
from any street or alley at the expense of the notified.
u Summons and Penalty: As an alternative to the notice for removal provided in subsection B above,
any person who violates or causes another to violate the same, may be issued a summons to appear
before the Municipal Court of the Town for said violations, and upon being found guilty of a violation
hereunder be punished as provided in Section 14-1 of this code.
o Notice and Penalty: It is unlawful for any person to fail or refuse to comply with the notice of the
Director of Public Works as provided in subsection B hereof, and any such person shall, in addition to
payment of the expense of removal incurred by the Director of Public Works, as provided in subsection B
hereof, upon being found guilty of a violation hereunder, be punishable as provided in Section 1-4-1 of
this Code. (1997 Code: Ordinance 5 (1979).

D No person shall park any vehicle upon a street or at any other place within this Municipality in such a
manner or under such conditions as to interfere with the free movement of vehicular traffic or proper

street or upon any place within this Municipality in such a manner as to constitute a violation of any
section of this Article, or left unattended for a period of twenty four (24) hours or more and presumed to
be abandoned under the conditions prescribed by Colorado Revised Statutes section 424-1102, as
amended, the officer shall require the vehicle to be removed or cause it to be removed and placed in
storage in the nearest garage or other place of safety designated or maintained by this Municipality, and
the charges for towing and storage of such vehicle shall be charged to the owner of the vehicle in

Council approved $28K in the 2002 Pubtic Works budget to install a fiber optic light system
on the large tree at Checkpoint Charlie. (Fiber optic lights woutd allow the color of the tree
lights to be changed by switching colored filters (e.g. the tree could be red for St. Valentine's
Day; green for St. Patrick's Day; or red/white/blue for the Fourth of Juty), making it a year-
round attraction.) Unfortunately, the bid that was received to install the lights was
approximately 50% higher than budget, so an alternative was proposed by Public Works:
install the lights on a smaller tree with Public Works personnel assisting in the installation.
This approach would allow Public Works to evaluate whether they could do the installation
on the larger tree themselves and perhaps bring the project back within budget It would also
permit a better estimate of the number of lights needed to get the desired visual effect.
Several locations were considered for the pilot tree, but all were eventually rejected for
various reasons.
Proposal
At a meeting with Fred Hibbard, owner of the Viltage Center commercial properties, and
most of the Village Center business owners, the topic of removing four large trees in front of
Pismo/Pazzoslla Tour was discussed. These once.small trees have become overgrown and
now block several storefronts. I proposed moving the trees to another location in Town, if
possible, or otherwise just removing them and installing one smaller tree in their place on
which the fiber optic lights would be installed. Some of the vacated space could be used as a
stage or seating for street performances. Everyone agreed this was desirable and supported
the proposal. Since the trees are located on Town of Vail property (Fred Hibbard assures me
that this is the case), staff advised that Council would have to give its permission for this
proposal to be reviewed by the DRB before it could start through the process.
Request
Permission is being requested from Council to allow the proposed project to be reviewed by
the DRB. Granting this permission does not m€an that Council is approving the request to
install the new tree and fiber optic lights. The project would still have to be reviewed and
approved by the DRB' and Council will still have its normal right to review their decision.

I am concerned that a separation is really needed on ilem 4. I think this is often abused but I am not lamiliar
with this application.
I am very concerned with the lree removal proposal at Village Center. I noticed on Sunday that the "row" really
screens the cars, buses, Frontage Road, large pavement area etc from the pedestrian area. The trees do not
block access or the view of the commercial area. They make a very nice backdrop to the little plaza like area
there.
I know the plan is to put liber optics on a replacemenl tree however the consultants for the Village Streetscape
said that fiber optics are cold and not Vail.
Just food for thought as a citizen, not a councilperson.
