Background: Since the last update to the Ford Park Master Plan in 2013
new ideas and planning efforts have come up that warrant a new update to
the master plan. Through the process the community will be able to discuss
and provide feedback to the Town Council on new ideas and plans for Ford
Park. The primary objectives will remain the same as in previous master
plan documents.
Staff Recommendation: Council review the list of possible master plan
update topics and direct staff to proceed with the issuance of an RFP.

Background: One partial vacancy exists on the Building & Fire Code
Appeals Board. The Town Council will interview applicants; and the
appointment will include one person who will serve as an alternate board
member (two years and 3 months remaining). Duties of the B&FC A include
hearing appeals of aggrieved parties, reviewing equivalency of alternate
building materials and methods of construction, as well as interpretations of
the town building and fire codes, among other issues. The B&FC A meets as

Background: One partial vacancy exists on the Town of Vail Planning and

the afternoon meeting. Applicants must be residents and registered voters
of the Town of Vail. The term of the appointment begins J anuary 10, 2022
and expire on March 31, 2022 (three month term). Duties of the seven-
member P E C include review and determination of requests for variances
and conditional use permits, and recommendations to Town Council on
special development districts, subdivisions, rezonings, various Town of Vail
proposed plans and other community matters per the Town Charter and
ordinances.

Subject: Updates regarding RideVail and introduction of Parking and Transit Operations
Managers
I. SUMMARY
This fall the Town has implemented a new transit technology system. The town has also
filled two new positions created to replace the former Transportation Manager role.
II. RIDEVAIL
The RideVail system replaces the former Nextbus transit operations management and
passenger information system. Following a two-week production pilot in June the
remaining hardware was installed in September and October. The new system was
formally launched on November 11.
As part of RideVail all buses are equipped with two monitors that show upcoming stops
and connection information. A free public wifi system and automated passenger
counters (APC’s) were also installed. Interior/exterior automated audible announcement
systems alert passengers of upcoming stops and public service announcements.
Three new larger format LED signs were installed along the Intown route (Covered
Bridge Eastbound, Covered Bridge Westbound, and Lionshead Village Eastbound) with
the replaced signs being reinstalled at the West Vail Mall (eastbound and westbound)
and new westbound Lionshead Transit Center bus shelters.
All outlying bus stop signs have been replaced with new signs that include a QR code
for easy access to real time bus information without having to download an app. LCD
displays are currently in development for both the Vail Transportation Center and
Lionshead Transit Center that will show departure times for both Town of Vail and ECO
Transit buses.
Passengers can now access system wide real time information through a number of
different platforms. The RideVail information portal (ride.vailgov.com) provides bus

locations, arrival predictions, crowding levels, and service alerts. It is available in both
desktop and mobile formats. The service alert and real time bus map are also directly
embedded into the Bus Information section of vailgov.com. The Town’s real time
information is now available in transit industry standard format (GTFS) so that trip
planning apps such as Google Maps can ingest and display it.
Finally, Bus Supervisors have improved dispatching and reporting capabilities. For each
bus in service supervisors can see the current driver, crowding level, trip name, bus
location, and schedule adherence. With the installation of APC’s, much more granular
boarding and exit information is now available through the RideVail reporting
functionality.
III. NEW OPERATIONS MANAGERS
Following the retirement of long time Transportation Manager, Mike Rose the duties of
the Transportation Manager role has been split into two separate positions: Parking
Operations Manager and Transit Operations Manager. Since Mike took over the role of
both Transit and Parking in the 1990’s both operations have grown significantly with
increased regulations, enhanced and expanded service and nearly year-round parking
operations. The past expansions as well as looking ahead it was time to have sperate
division heads run each division.
The Town is happy to announce that it has hired two former supervisors from within the
town for the new manager roles. Stephanie Kashiwa is the new Parking Operations
Manager and Jordan Winters is the new Transit Operations Manager.

I. PURPOSE
The purpose of this agenda item is to introduce the Town Council to the Ford Park
Master Plan Update process and review the current list of possible topics for
consideration in the update. Staff is requesting Town Council add any additional topics it
would like to have considered in the updated master plan. Staff is requesting the Town
Council provide direction to continue with the process.
II. BACKGROUND
The current guiding document for Ford Park decision making is the 2013 Gerald R. Ford
Master Plan adopted by the Town Council in November 2013. The primary impetus for
the 2013 update was to allow evaluation of and provide guidance for the proposed Betty
Ford Alpine Garden Education Center. One year prior to this document the 2012 Update
to the Ford Park Management Plan was done to acknowledge improvements proposed
for the Park that were initiated when Vail voters approved re-allocating a portion of the
Convention Center Funds to Ford Park.
While the current document was intended to provide guidance for a 10-year period new
ideas and planning efforts have come up that warrant a new update to the master plan.
Through the process the community will be able to discuss and provide feedback to the
Town Council on new ideas and plans for Ford Park. The primary objectives will remain
the same as in previous master plan documents. These include:
• Incorporate key elements of previously completed plans for Ford Park into one
document, specifically those guiding principles that have successfully shaped the
development of the Park from its inception,
• Establish clear expectations for the future use, development and management of
the Park,
• Protect the Park from over-use and over-development.
• Define effective tools for decision-making regarding the future of the Park, and
Provide a single, comprehensive document to serve as the master plan for the
Park.

III. CURRENT LIST OF MASTER PLAN UPDATE TOPICS
The following list is comprised of topics and ideas that have been garnered by Staff
through various conversations and meetings on Ford Park. These topics and ideas
warrant scrutiny through a public master plan update process before including or
excluding them in the guiding master plan document for Ford Park.
As a ground rule for the master plan update Staff suggests all listed topics be presented
and discussed through the public process of developing the updated master plan. The
Town Council always has the final approval authority on the topics that will be included in
the master plan update.
These topics will be incorporated into a Request for Proposals, RFP, to begin the process
of hiring a consultant team to assist Staff in the completion of the master plan update.
1. Parking and Traffic
a. Parking lot management and policy opportunities with new equipment
installation for year-round and special event operations.
b. Soccer Field parking lot operations and configuration (esp. consideration to
VNC use)
c. Illegal and unapproved parking in ADA Spaces near GRF Amphitheater.
d. Golf cart and loading and delivery parking along West Betty Ford Way for
the Betty Ford Alpine Garden Education Center.
e. Parking lot entry reconfiguration to improve traffic flow and motorist safety.
f. Park through-traffic control and management.
g. Reevaluate possibility of Ford Park shuttle service or autonomous shuttle.
2. Special Events and Winter Programming
a. Experiencing higher level of winter special events which will require
management decisions and potential physical modifications to be
accommodated.
b. Potential for expanded winter programming by Vail Nature Center, Alpine
Gardens and Vail Rec which will have implications for maintenance
activities and parking management.
3. Betty Ford Alpine Gardens
a. Garden expansion sites and accompanying maintenance agreements.
b. Garden perimeter fencing for special event security and closure and
possible future admission fee operations.
4. Vail Recreation District
a. Tennis to Pickleball court conversions.
b. Indoor tennis/pickleball court facility. (gymnasium is currently a prohibited
use)
c. Administrative office expansion.
d. Sport Field conversion to artificial turf.
e. Soccer Field lot expanded restroom/maintenance facility.

a. Remove VNC from the Gore Creek Preservation Sub-Area and establish it
as a separate Sub-Area within Ford Park to allow for enhanced operations
and maintenance.

c. Facility and program enhancements as outlined for consideration in
previously completed Phase 0, 1, 2, and 3 Planning Efforts by Hopkins
Architecture.
6. Vail Valley Foundation
a. Determine what, if any, improvements/modifications are anticipated for the
Gerald R Ford Amphitheater.
7. Eagle River Water and Sanitation District
a. Resolution of location and development of Adjudicated Well Site and
Treatment/Pump System.
b. Improvements to Raw Water intake structure and operations.
c. Efforts to reduce water consumption through appropriate landscape
treatments and evaluation of expanded installations of artificial turf.
8. Park Maintenance
a. Identification of under-maintained areas of Ford Park and design of
appropriate landscape solutions to improve appearance.
b. Consideration of dedicated Ford Park Maintenance Staff to manage and
maintain portions of Ford Park and reduce overlap and redundancy of
maintenance functions.
c. Identify areas for enhancement of Gore Creek Riparian Areas and
appropriate access points.
9. Improvements to TOV Facilities
a. Art in Public Spaces – Art Space
b. Consideration of enhancement to or replacement of Lower Bench Picnic
Shelter
c. Playground Area Safety Improvements and Upgrades
d. Betty Ford Way
i. completion of concrete unit paver treatment to West Access Gate

IV. NEXT STEPS
With the Town Council’s direction, an RFP to hire a consultant team for the Ford Park
Master Plan Update will be issued on or about January 10, 2022 with proposals being

returned on or about February 10, 2022. Proposals will be evaluated perspective
consultant teams will be interviewed, if necessary, and staff will return to Town Council at
the March 1, 2022 meeting with a request to award a consultant contract. The public and
board process will commence following that award and the Ford Park Master Plan
Update is expected to be completed and presented to the Town Council for adoption in
July or August 2022.
V. BUDGET INFORMATION
The funding for the Ford Park Master Plan Update is included in the 2022 Real Estate
Transfer Tax capital budget. The budgeted amount is $150K.
VI. STAFF RECOMMENDATION
Staff recommends that the Council review the included list of possible master plan update
topics and consider any items that should be added.
VII. ACTION REQUESTED BY COUNCIL
Staff requests feedback from the Council regarding the final list of possible Ford Park
Master Plan Update topics and direction to proceed with the issuance of an RFP.

BOARD OF APPEALS
The provisions contained in this appendix are not mandatory unless specifically referenced in the
adopting ordinance.
User notes:
About this appendix: Appendix B provides criteria for Board of Appeals members. Also
provided are procedures by which the Board of
Appeals should conduct its business.
Code development reminder: Code change proposals to this appendix will be considered by
the Administrative Code Development
Committee during the 2022 (Group B) Code Development Cycle.
SECTION B101
GENERAL
[A] B101.1 Scope. A board of appeals shall be established within the jurisdiction for the purpose of
hearing applications for modification of the requirements of this code pursuant to the provisions of
Section 113. The board shall be established and operated in accordance with this section, and shall be
authorized to hear evidence from appellants and the building official pertaining to the application and
intent of this code for the purpose of issuing orders pursuant to these provisions.
[A] B101.2 Application for appeal. Any person shall have the right to appeal a decision of the building
official to the board. An application for appeal shall be based on a claim that the intent of this code or
the rules legally adopted hereunder have been incorrectly interpreted, the provisions of this code do not
fully apply or an equally good or better form of construction is proposed. The application shall be filed
on a form obtained from the building official within 20 days after the notice was served.
[A] B101.2.1 Limitation of authority. The board shall not have authority to waive requirements of this
code or interpret the administration of this code.
[A] B101.2.2 Stays of enforcement. Appeals of notice and orders, other than Imminent Danger notices,
shall stay the enforcement of the notice and order until the appeal is heard by the board.
[A] B101.3 Membership of board. The board shall consist of five voting members appointed by the
chief appointing authority of the jurisdiction. Each member shall serve for [INSERT NUMBER OF
YEARS] years or until a successor has been appointed. The board members’ terms shall be staggered at
intervals, so as to provide continuity. The building official shall be an ex officio member of said board
but shall not vote on any matter before the board.

[A] B101.3.1 Qualifications. The board shall consist of five individuals, who are qualified by
experience and training to pass on matters pertaining to building construction and are not employees of
the jurisdiction.
[A] B101.3.2 Alternate members. The chief appointing authority is authorized to appoint two alternate
members who shall be called by the board chairperson to hear appeals during the absence or
disqualification of a member. Alternate members shall possess the qualifications required for board
membership, and shall be appointed for the same term or until a successor has been appointed.
[A] B101.3.3 Vacancies. Vacancies shall be filled for an unexpired term in the same manner in which
original appointments are required to be made.
[A] B101.3.4 Chairperson. The board shall annually select one of its members to serve as chairperson.
[A] B101.3.5 Secretary. The chief appointing authority shall designate a qualified clerk to serve as
secretary to the board. The secretary shall file a detailed record of all proceedings, which shall set forth
the reasons for the board’s decision, the vote of each member, the absence of a member and any failure
of a member to vote.
[A] B101.3.6 Conflict of interest. A member with any personal, professional or financial interest in a
matter before the board shall declare such interest and refrain from participating in discussions,
deliberations and voting on such matters.
[A] B101.3.7 Compensation of members. Compensation of members shall be determined by law.
[A] B101.3.8 Removal from the board. A member shall be removed from the board prior to the end of
their term
only for cause. Any member with continued absence from regular meeting of the board may be removed
at the discretion of the chief appointing authority.
[A] B101.4 Rules and procedures. The board shall establish policies and procedures necessary to carry
out its duties consistent with the provisions of this code and applicable state law. The procedures shall
not require compliance with strict rules of evidence, but shall mandate that only relevant information be
presented.
[A] B101.5 Notice of meeting. The board shall meet upon notice from the chairperson, within 10 days
of the filing of an appeal or at stated periodic intervals.
[A] B101.5.1 Open hearing. All hearings before the board shall be open to the public. The appellant,
the appellant’s representative, the building official and any person whose interests are affected shall be
given an opportunity to be heard.
B101.5.2 Quorum. Three members of the board shall constitute a quorum.
[A] B101.5.3 Postponed hearing. When five members are not present to hear an appeal, either the
appellant or the appellant’s representative shall have the right to request a postponement of the hearing.

[A] B101.6 Legal counsel. The jurisdiction shall furnish legal counsel to the board to provide members
with general legal advice concerning matters before them for consideration. Members shall be
represented by legal counsel at the jurisdiction’s expense in all matters arising from service within the
scope of their duties.
[A] B101.7 Board decision. The board shall only modify or reverse the decision of the building official
by a concurring vote of three or more members.
[A] B101.7.1 Resolution. The decision of the board shall be by resolution. Every decision shall be
promptly filed in writing in the office of the building official within three days and shall be open to the
public for inspection. A certified copy shall be furnished to the appellant or the appellant’s
representative and to the building official.
[A] B101.7.2 Administration. The building official shall take immediate action in accordance with the
decision of the board.
[A] B101.8 Court review. Any person, whether or not a previous party of the appeal, shall have the
right to apply to the appropriate court for a writ of certiorari to correct errors of law. Application for
review shall be made in the manner and time required by law following the filing of the decision in the
office of the chief administrative officer.

Dear C.J.,
I am writing to let you know of my interest in becoming a member of the B&FCAB. My good friend Kyle Webb
informed me of his involvement on this board and urged me to apply. I have been designing mechanical systems
for custom homes (and a few commercial buildings) in the Vail Valley and Town of Vail over the last 18 years, but
I hope to concentrate more and more on projects within our community in the future. I have really enjoyed forming

Dear Town Council Members
I would like to express my interest in applying for the Planning and Environmental Commission
(PEC). I believe that I have the time, knowledge and passion for our community to serve on this
board. As Vail continues to evolve as a resort community, we will need to adjust and innovate
to secure our natural resources and maintain a responsible and thriving community.
The PEC plays a vital role for the Town of Vail. As a council member, I saw first-hand the time
and effort given by current members. It is a difficult role that requires the fortitude to stick to
the Town of Vail’s codes, regardless of the political and community pressure that might exist. I
believe that over the last eight years, I have proven my ability to respect and follow the Vail
Town Code.
As a resident of Vail for over twenty-five years, I recognize the importance of having a balanced
board of individuals from all facets of life in our town. It is one of the reasons, our Town Council
continues to succeed. My experience as a homeowner, business owner, volunteer and full-time
resident provides me with a unique perspective on Vail. A universal approach is often necessary
to see beyond one tree and recognize the importance of the entire forest.
As a council member, I saw the immediate and lasting effects of the PEC’s decisions. The recent
West Vail Master Plan is a great example of how the PEC can set the course for Vail’s future.
While only a plan, there were immediate zoning recommendations that will benefit our
neighborhoods. West Vail now has a direction that will hopefully be applied to future
redevelopment in City Market and West Vail Mall area. The West Vail Master Plan will benefit
residents, second homeowners and visitors.
I hope to be appointed to the PEC because I enjoy serving the Vail community. Vail is where I
choose to live, work and raise a family. Our community will face many challenges in the future.
The struggle between responsible development and maintaining our natural habitat will
continue to require innovation and respect. Council policy changes will help the PEC navigate
the future.

My name is Bergen Tjossem. I am interested in filling the vacancy on the Town of Vail’s Planning
and Environmental Commission. It would be an honor to serve on this important commission in the town
where I was born, raised, and currently reside.
I have watched our town grow and change for nearly 30 years into the thriving destination and
community that it is now. With this change comes challenges - housing and parking shortages,
plummeting wildlife populations, and tension between local industry and community. Fortunately, these
challenges are surmountable with balanced and pragmatic approaches to planning, zoning, regulation, and
discussion. My vision for the Town of Vail’s future is one of balance, and I believe I have the skills and
background to galvanize that harmony in our community.
I am currently employed full time with the Eagle Valley Land Trust, a 501(c)(3) nonprofit
organization dedicated to protecting open space in Eagle County. We protect 38 parcels via conservation
easements throughout the county, including several owned by the Town of Vail. EVLT is a strict
non-advocate - we do not pressure landowners in any way to conserve their land. Instead, we provide
landowners the tools and expertise to protect their land if they choose. Our nuanced and careful approach
has proven successful nationwide, since it allows our organization to build landowner relationships that
often result in conservation outcomes or at the very least, mitigation.
Before returning to Vail to work with the Eagle Valley Land Trust, I completed a Master ’s degree
in Conservation Leadership within the Human Dimensions of Natural Resources department of the
Warner College of Natural Resources at Colorado State University. This progressive program, while
focused on conserving natural resources, took a fundamentally “human” approach to protecting land and
open spaces within our community. It helped shape and bolster my vision of balance while providing me
the tools to be an effective leader, facilitator, planner, and conflict mitigator.
In addition to my professional and educational experiences in conservation, I have also worked
with key stakeholders in the Town of Vail. I, like every other member of my family, have worked for Vail
Resorts - for me that was Gold Peak Ski School, summer trail crew, various retail stores, and as an intern
with VR’s Environmental Department. I briefly interned with Kristen Bertuglia with the Town of Vail’s
Environmental Sustainability Department, and I have keenly followed the Town’s commitment to

2.2.A request for the review of a variance from Section 12-6D-9 Site Coverage,
Vail Town Code, in accordance with the provisions of Section 12-17-1,
Variances, Vail Town Code, to allow for site coverage in excess of twenty
percent (20%), located at 2437 Garmisch Drive/Lot 12, Block H, Vail Das

Planner Roy gives a short presentation about the application. Staff is
recommending denial of the application based on the findings in the staff
memo.
Pratt asks a clarifying question about site coverage and have we granted
any variances like this before in town?
Roy says that the P E C has not granted any variances for this type of
request that he is aware of.
Michael Hazard represents the applicant. He says his client is under
contract on the property. He asks if the Commission will consider the
hardship of constructing a home on this narrow and steep lot. There is a
41% slope on the lot. At the front setback the grad is 16-20 feet above the
road. W hen you consider this, you’re relegated to driving into the grade with
the driveway.
Hazard mentions the neighboring properties. He wants to gain some
leniency from the strict interpretation of the code and reiterates the
dimensions in the front setback. He compares the dimensions of their lot to
the average of the 17 sites in the area and says it is a difficult site. He wants
to honor the intent of site coverage by limiting the visibility of the house.
Gillette asks about the guidelines for granting a variance.
Roy notes the first two criteria and Perez lists the third.
Gillette says a variance here warrants considerations. He asks how many
sites in this zone district are this steep?
Roy doesn’t know the exact number but says it’s a significant amount.
Phillips asks what accommodations the applicant is proposing. He says
you’re asking for a 22% increase in site coverage, but you haven’t reduced

the structure to accommodate the parking garage. He says it would help
your case if you did that. There isn’t a real hardship if you’re not making
accommodations, you’re pushed right to your setbacks.
Hazard says we’re not asking for more GRFA, we’re hoping the additional
site coverage is buried in the front to try and respect the intent of site
coverage by limiting the visual impact.
Phillips says you’ve maxed out your GRFA without providing for the rest of
the structure.
Hazard says the request for the addition is the parking in the front, which will
be buried.
Perez says you don’t have a setback for the parking because of the steep
grade. She asks about the parking numbers as it relates to site coverage.
She says the commission has to look at the criteria strictly, everyone in that
area has a steep slope.
Hazard says the grade from the edge of the street is an unusual situation not
shared by as many other sites.
Perez says what you’re calling a unique site we would call a special
privilege. Staff report indicates that the application doesn’t meet criteria one
or two.
Phillips doesn’t agree that it is a truly unique site. He says people have built
within these requirements and that it’s really difficult to grant this variance.
The board can attest to the difficulty of building on some of the last unbuilt
lots in town. He says you’re not showing a lot of give on the applicant’s side
to ask for this variance and mentions the hardscape in the proposal.
Hazard says the hardscape is within regulations.
Gillette says it’s a tough lot and we have a variance process for a reason.
We’d like to see that you’re doing everything you can to comply with
regulations, a little give on your end would go a long way.
Roy says site coverage has been the limiting factor for development on
some of these smaller lots.
Hazard didn’t say it was going to be easy.
Kjesbo says this would definitely be a grant of privilege, he doesn’t see a
hardship and you have to design to the town criteria.
Pratt agrees with Kjesbo and says that approving additional site coverage is
a grant of special privilege. I t’s an unusual site, but that’s just part of the
design process, he can’t justify granting this.
Kurz agrees with fellow commissioners. He says we don’t want to set a
precedent of special privilege. He also doesn’t want to leave the impression
that reducing the problem would improve it.
Pratt says it's not a give and take situation; it would be a grant of special
privilege.

3. 15th Annual Vail Winterfest 2021/22
Illuminated Ice Installation - Olive Moya & Paul Wertin with Jake from Alpine Ice
• Finalized concepts for Winterfest installation ice sculptures are presented by Paul (sketches attached).
Olive is pleased with how the shapes and forms are being interpreted. She thinks the color will be nice,
as well as the use of texture to delineate the shapes. Molly comments that while lighting is important,
the installation is also enjoyed during the day.
• Paul discusses the layout of the ice sculptures throughout the Promenade.
Opening of 15th Annual Vail Winterfest
December 19th (4:30 – 6pm International Bridge - lights go on at 5:15).
The event will be a gathering on the International Bridge versus a lantern walk as in the past. This will allow
people to enjoy the event at their leisure with social distancing versus a mass gathering. Music, hot
chocolate, glow sticks, interactive characters. Olive will also be present with Paul. The Board likes the
direction of keeping the opening a celebration of art and light.
• Lantern Workshop at Vail Public Library – Noon – 4:00 p.m.
o Three one-hour timed workshops - 30 lantern makers per time (noon -1; 1:30 – 2:30; 3:00 –
4:00)
o Olive will create some templates for painting or cutting tissue on the lanterns. Olive will also
paint some very large lanterns for display.
o Virtual instruction will be available via Alpine Arts Center
• Decorating International Bridge – Molly will have the PW crews install the bistro lights again and
display colorful lanterns to accompany Olive’s painted lanterns.
Complimentary Lantern Kits
• Distribution will be first come first serve and only 200 distributed at Vail Village Welcome Center.
• Kathy suggests having the lanterns a week prior for the availability at the Welcome Centers. Molly can
have them available by Dec 12th.
4. Proposed sculpture donation & locations discussion for Vail Village.
The AIPP Board officially motions to accept the donation of three sculptures from the collection of
Vicki and Kent Logan to the Town of Vail’s public art collection: Jason Middlebrook We are all building
nests; Nathan Mabry Two Vessels (Unpacked); Brad Kahlahmer Waqui Totem
• The Board would like a formal announcement this winter with an article about the donation in
the Vail daily. Molly will reach out to the Daily.

• The Board evaluates the proposed locations for the three sculptures: The Board agrees that
the Middlebrook would work very well in the central bed of the stairs. The work is all inclusive,
visually interesting, and would be a nice welcome and exit to Vail Village. This location would
allow the work to be viewed from many vantage points. It would also be protected within
planter bed.
• Molly asks the Board to look at the Gore Creek Drive planter as a possible location for the
Kahlahmer.
• Molly suggests the location west of the parking structure for the Mabry. It will have a n ice
connection in proximity to the Lawrence Weiner work already donated by the Logans . They are
both contemplative works. The work would also be looking towards the mountain which would
be a connection to the natural environment.
5. Strategic Vision Plan for AIPP.
• Review of Chapter 25 online code (attached)
• Kathy comments this code is more geared towards the private developers. This is where we
would want to discuss placement decisions for the developers of their public art.
• The RFP will be issued after the New Year.
6. Coordinator Updates.
• Upcoming meeting Dec 6 – Gore Valley Trail Interpretive Installation presentation by Pete
Wadden. Kathy asks which other Boards have reviewed the plan and if there has been public
input? The Board asks to review the presentation in advance of the meeting.
• The Board will begin to look at Summer 2022 artists and possible mural locations in the
January meeting. (skate park and vents on LH structure).
• Ad placed in Vail Valley Magazine
• Winter brochure is in production
• Articles in Vail Beaver Creek Magazine & Covered Bridge Magazine
• Pinecone sculpture installed at Clubhouse

SUBJECT: Short-Term Rental Study Information Update
I. SUMMARY
In September of 2021, staff contracted with RRC Associates and Economic & Planning
Systems Inc. (EPS) to conduct a study in order to better understand the town’s short-term
rental (STR) inventory and its impacts on the community. The three major objectives of this
study are to characterize and map all STRs within town boundaries which includes
summarizing economic data related to STRs; to further define Dispersed STRs (DSTR),
rentals that directly impact the available long-term housing and neighborhood character, and;
to consider tools to mitigate the impacts of STRs.
The purpose of this memo is to provide a progress update on the study.
II. BACKGROUND
Ordinance No. 15, Series 2017 established licensing regulations on short-term rental
properties in Vail. Prior to adopting the ordinance, the town hired research consultants to
help identify community issues and concerns and provide analysis of similar regulations in
peer resort areas. Multiple public meetings were hosted, and a large amount of public input
was gathered and reported back to Council. When Town Council first implemented a
registration process, life safety expectations, and good neighbor guidelines in 2018, the
short-term rental market was considered a lodging option for guests needing limited
regulations surrounding life safety and livability in neighborhoods and to level the playing field
with traditional lodging properties. It was also considered an important option for primary
residents in earning enough income to afford their mortgage.
The original ordinance was updated at the end of 2018. Below is a summary of the town’s
current STR registration fees and policies:

STR Professionally Managed (no on-site manager) - $10 per year
STR Professionally Managed (24/7 on-site manager) - $5 per year

Short-Term Rental Policies per Ordinance No. 19, Series 2018
Deed restricted employee housing units are not allowed to short-term rent.
Designation of a local representative that resides within a 60-minute distance of
the STR property and is available 24/7. The named representative must provide proof
of distance through a driver’s license, vehicle registration, or lease.
Property owners or property managers must provide a notarized affidavit that
they have specified safety measures in place such as smoke detectors, carbon
monoxide detectors, fire extinguishers, and that advertised occupancy limits comply
with town code. The affidavit also validates the owner’s or property manager’s
agreement to comply with all town regulations and specifically mentions trash, parking,
exterior lights, and noise.
The property owner or property manager must provide proof of written notice to an
adjoining residential dwelling unit if the rental is located within a duplex.
Signed acknowledgment of “Good Neighbor Guidelines”.
Advertisements of the rental must include the STR registration number immediately
following the rental description.
All sales and lodging taxes must be remitted timely, for each property (not on a lump
sum basis). As of October 1st, 2020, online marketplace facilitators are now collecting
and remitting bookings made through their websites.
Complaints (such as noise, trash, parking, etc.) will be directed to the local
agent. The representative must resolve the issue within 60 minutes (30 minutes
between 11pm and 7am). The town’s code enforcement or police may become
involved if the property is not registered, or if the complaint is not resolved.
Enforcement action will be taken on unregistered properties and if complaints are not
resolved according to town code.
Four violations may result in revocation of the STR registration for that property.
Once revoked, the license may not be renewed for two years. If a duplex unit, written
consent from the neighboring unit must be obtained prior to renewing after revocation.
Violation of any provisions of the STR ordinance is decriminalized, but punishable by the
following fine schedule:
III. UPDATE ON CURRENT SHORT-TERM RENTAL STUDY
Staff is continuing to work with EPS and RRC to complete the STR study, with an anticipated
completion date in February 2022. A formal interim update is anticipated to be scheduled for
the January 4th council meeting.

The first phase of this study has focused primarily on analyzing the current STR property
inventory within the town summarizing information such as occupancy rates, rental location,
owner location, and rooms rented. While the study has not yet been completed, some notable
trends have begun to emerge.
As of December 7th, 2021, there were 2,454 registered STRs within the Town of Vail. The
number of STR units has increased approximately 9.8% or 231 units from a 2017 baseline
rental by owner study. The initial phase of the study indicates that STR units outside of the
core Villages are making up a larger percentage of STR within the town than in prior years. Of
the 2,454 current registrations, 62.1% are located in resort adjacent areas Vail Village,
Lionshead Village, and Cascade Village. The other 37.9% of registrations are located in the
outlying neighborhoods of West Vail, Sandstone, and East Vail. More data showing the shifts
in STR locations will be provided in this study.
Staff estimates there are an additional 129 unregistered units for a total of 2,583 STR units.
The majority of unregistered units are timeshare units which are difficult to enforce due to the
challenges of finding owners not listed by the county assessor and matching them to the
advertised week and specific unit.
At the January 4th meeting, Council can expect analysis and updates on the following
study updates:
STR data by location
Seasonal occupancy rates, more data on the usage of STR properties by primary and
second homeowners.
Economic characteristics of STRs
Guest spending and economic impacts of STRs
Home value trends
Utilization of registered STRs
Identification of STR properties that would otherwise be attainable to locals for long-term
housing
The January 4th Town Council discussion of these items will be presented by Economic
Planning Systems, RRC & Associates and town staff.
