Background:
The purpose of this work session is to present certain lottery
eligibility improvements and receive direction from the Vail
Town Council regarding the ticket eligibility for community
housing lotteries. This action streamlines and clarifies the
lottery process for both lottery applicants and Town staff,
facilitates providing housing opportunities for local residents
and excellent customer service and is consistent with our
housing policy.

NEPA PROCESS AND SCHEDULE
The National Environmental Policy Act (NEPA) process is fully underway. Fieldwork is complete,
technical reports are scheduled to be completed beginning of November, and SE Group is preparing
the draft EA. A Forest Service decision is expected early 2023. The next opportunity for public
involvement is the objection period, tentatively scheduled for January/February 2023. Only those who
commented during the scoping/comment period are eligible to object to the Forest Service decision. A
summary of the scoping/comment period is provided below.
S COPING/COMMENT PERIOD SUMMARY
The public scoping/comment period for the EA opened on March 3, 2022 and closed on May 3, 2022,
for a total of 60 days. During this time, the Town of Vail, WRNF, and SE Group hosted a public open
house on April 6, 2022. A total of 21 comment submittals were received and can be viewed in the
WRNF online Public Comment Reading Room here. Eagle Summit Wilderness Alliance and Wilderness
Workshop both commented, along with Colorado Parks and Wildlife, Town of Vail, and individuals. The
majority of the comments focused on treatment units 104 and 108, specifically questioning whether unit
108 should be treated.
BUDGET
SE Group continues to be within budget since the March 2022 change order and the majority of the
remaining budget is expected to be billed in 2022, with approximately $15,000 carried over into 2023.

Subject: Booth Creek Fuels Treatment Project Update
I.Background
In 2020 the Town entered into a cooperative agreement with the United States Forest Service
(USFS) to jointly study the environmental impacts of proposed fuels treatments in the Booth
Creek area of East Vail. This area was identified as a high priority treatment area in to 2020 Vail
Community Wildfire Protection Plan (CWPP).
The Town entered into a service agreement with the SE Group to assist the USFS in completing
a National Environmental Policy Act (NEPA) review of the project area. To date the SE Group
has completed field studies of the area, helped to develop a proposed action, conducted public
scoping, and has received public comment. See Appendix A for a status update from the SE
Group.
II.Current Situation
During the spring of 2022 the USFS posted a Notice of Proposed Action (NOPA) which included
details of the proposed fuels treatment as wells as preliminary potential short and long term
impacts of the project. The public comment period was open for 60 days and a public open
house was help in the Grand View Room. Many community members attended the open house
to receive information about the project and ask questions directly to USFS staff. Since the
closing of the public comment period the SE Group has been working with USFS staff to
evaluate the comments received, finalize technical reports and begin to work on a draft
Environmental Analysis (EA). In addition to the work on traditional NEPA documents, SE group
has been working with USFS staff on a Minimum Requirement Analysis Guideline (MRDG)
which identifies and scores potential impacts of the activities on the designated wilderness
portion of this project.
It is currently anticipated that a full draft EA will be completed before the end of 2022. That draft
will be reviewed by USFS staff and released for public review in early 2023. If no objections are
filled on the EA, it is anticipated that the USFS will file a record of decision on the project in
spring of 2023.
Once a record of decision is filed for the project the USFS can begin implementation of the
proposed action. Based on the presented timelines implementation of this project may begin as
early as spring of 2023. To ensure rapid implementation of the proposed action it will be critical
that Council and the community continue to be engaged with this project and that we continue to
foster positive working relationships with the USFS.

Subject:Endorsement to apply for Community Wildfire Defense Grant
I.Background
In 2020 Vail adopted its first Community Wildfire Protection Plan (CWPP). This CWPP
provides the framework and priority for measurably reducing wildfire risk across the
community and surrounding USFS lands. Since 2020 Vail Fire and Emergency
Services (VFES) have been aggressively implementing the plan through strategic
partnerships with the United States Forest Service (USFS), Colorado Parks and
Wildlife, Eagle County, Vail Resorts and the Vail Community. Vail Has taken
measurable steps towards reducing risk and tangible results can be observed
throughout the community.
II.Current Situation
The 2021 Infrastructure Investment and Jobs Act provides new funding for a number of
infrastructure projects including wildfire risk reduction. As a result of the Infrastructure
Bill funding, the USFS has developed the Community Wildfire Defense Grant program
to support at risk communities with wildfire mitigation programs. The grant funds are
available for communities to develop CWPPs, as well as significant funding for
communities to implement CWPPs that have already been developed. The
implementation funds can be used for outreach and education, code development and
enforcement, fuels mitigation projects and equipment purchase. The implementation
grants have a maximum ask of $10M with a 25% match and a 5-year performance
period.
VFES sees significant potential to utilize these funds to implement the CWPP more
rapidly by supporting existing programs, developing additional programs, and expediting
fuels mitigation projects identified in the CWPP on non-federal lands. VFES
recommends that a grant application be prepared that includes funding for a Wildland
Urban Interface (WUI) Specialist position, completion of 90 acres of fuels reduction work
on non-federal land and the purchase of right of way mowing and prescribed fire
equipment. The 5 years of funding would support the salary and benefits of a full time
WUI Specialist position. The position would support existing programs such as the Fire
Free Five Community Assistance Program, expanded outreach and education including
the business community and short-term rentals and implementation of existing WUI

development codes. The proposed fuels treatment areas include TOV, Vail Resorts
and private lands throughout the community. The mowing and prescribed fire equipment
would be utilized by existing staffing to implement high priority projects throughout the
community.
VFES proposes a budget of $500k for staffing, $315k for fuels projects and $250k for
equipment for a total ask of $1,065,000. The 25% match ($266,250) that the town
would be required to meet would be met through existing allocations to the department
budget in the RETT budget.
III.Question for Council
Does Council endorse Vail Fire and Emergency Services in developing and
submitting a grant application for the Community Wildfire Defense Grant?

Re: Review of Community Housing Lottery Ticket Eligibility Improvements
I. Purpose
The purpose of this memorandum is to present certain lottery eligibility improvements and
receive direction from the Vail Town Council regarding the ticket eligibility for community
housing lotteries.
This memorandum outlines the current eligibility to receive lottery tickets, challenges in
process, and makes recommendations for improvements.
This action streamlines and clarifies the lottery process for both lottery applicants and Town
staff and facilitates providing housing opportunities for local residents and excellent customer
service. These improvements are also consistent with housing policy statement #7 adopted by
Resolution No. 30, Series 2018 that states:
“#7 People Promote Community – We ensure opportunity and access to the Town’s
housing programs and initiatives through a clear, equitable, and easy to administer
process for housing selection.”

II. Background
The Town of Vail Housing department recently held two community housing lotteries for a
Chamonix Vail townhome and a Pitkin Creek Park condominium. Forty-eight qualified
applications were received for the Chamonix Vail townhome and eight for the Pitkin Creek Park
condominium. The lottery process was challenging for both applicants and town staff mainly
due to the fact that the verification of eligibility can be ambiguous and can be subject to
interpretations. Ambiguity and uncertainty regarding interpretations creates a lack of credibility
and integrity of the lottery process.
Based on feedback received from applicants and key learnings from the last community lottery
process, Town staff is proposing improvements to the community housing lottery process,
which includes:
1. Simplifying the application form and making it readily available online and streamline
the process
2. Revising the lottery ticket eligibility criteria to eliminate ambiguity and interpretations
3. Requiring less but more specific documentation for verification in increase credibility
4. Clearly defining acceptable verification documentation for employees, self-employed
and business owners to increase integrity
5. Requiring the homebuyer education class to be completed before applying to the
lottery to enhance education about the process
6. Moving from a bingo-style drawing system to a more efficient digital drawing system
7. Enhancing the frequently asked questions document to include key learnings from
recent lotteries to better inform lottery participants
8. Improving upon the instruction section of the online application form to increase
clarity, and
9. Providing an automated post-submittal notification email to close the communications
loop.
The Town of Vail Employee Housing Guidelines dated July 4, 2018, require completion of a
homebuyer education class within six months of the resale lottery drawing date.
III. Lottery Ticket Eligibility
• The Town of Vail currently awards a total of up to five tickets for public housing lotteries
as follows:

o One ticket for a complete application
o One ticket for current Vail residents
o One ticket for residents living in Vail for 5 or more years
o One ticket for current employment in Vail
o One ticket for 5 years or greater employment in Vail
IV. Challenges
• The verification of the five years or greater employment and residency in Vail is an
ambiguous and discretionary process that affects the credibility and integrity of the
lottery process. Some of the documentation provided with applications could be open
to more than one interpretation. This has resulted in applicants disagreeing with the
number of lottery tickets awarded to them in the most recent public lottery.
• A significant amount of staff time is spent answering home loan finance related
questions rather than lottery process and application questions.
Opportunities exist to improve on the lottery process and eliminate the challenges
identified.
V. Suggestions from the Community
This section includes lottery ticket suggestions received from applicants of the most recent
community housing lottery:
• Issue a lottery ticket for currently residing in a deed-restricted home in Vail
• Issue a lottery ticket for currently owning real estate in Vail
• Issue a lottery ticket for not owning real estate in Vail
• Not allowing current homeowners, deed-restricted or otherwise, to apply to the lottery
VI. Suggestions from the Vail Local Housing Authority
This section includes lottery ticket suggestions and questions shared by the Vail Local Housing
Authority members:
• Issue a lottery ticket for prior, unsuccessful participation in Town of Vail housing
lotteries
• Do not require a homebuyer education class as the required mortgage lender pre-
qualification letter is sufficient

• Agree with having only three lottery tickets, one for a complete application, one for
living in Vail and one for working in Vail, at the time of the lottery drawing
• Eliminate notarization of documents
• What is the value of the granting of preference for longevity of residency and
employment in Vail?
• What are the potential benefits of a one application, one ticket lottery?
VII. Recommendations
• Include only lottery ticket criteria that is clear, precise, and can be quickly and easily
verifiable, without doubt.
• Have a total of three lottery tickets awarded for each community lottery, including the
following:
o One ticket for a complete application
Verification:
• An online application will be created in Laserfiche Forms in a way
that the application can only be t once it is 100% complete
o One ticket for current Vail residents
Verification:
• For renters, lease agreement (current and fully executed) or
notarized landlord affidavit
• For homeowners, Eagle County property record card
o One ticket for current employment in Vail
Verification:
• For W-2 employees, most recent paystub showing name of Vail
employer and proof of 30+ worked hours a week or 60+ hours in a
2-week period; If the paycheck comes from an out of state
address but the applicant is working at a business location in Vail,
a complete Letter of Employment Verification needs to be
provided by the employer, on company letterhead (including start
date, hours worked per week, location of work and position)
• For business owners, require the business Certificate of Fact of
Good Standing, a notarized affidavit stating average number of
hours worked in a week and physical presence in Vail.
• Require the homebuyer education class to be completed before applying to the
community lottery.

I.SUMMARY
One of the most frequent and reoccurring complaints the police department receives is noise from
tractor trailers on I-70. Several solutions have been attempted over the years, but none have
provided a consistent solution. In the past several years, a company based in England has
developed technology that uses cameras and sound meters to detect and document noise
violations.
II.BACKGROUND
In 2021, the Vail Police Department became aware of of technology currently being used in Royal
Borough of Kensington and Chelsea, London, England, to address noise violations. The
company, Intelligent Instruments, is based out of Southampton and has developed this
technology to specifically address excessive vehicle noise.
We spoke to Rueben Peckham, who is the director and principal consultant of Intelligent
Instruments. Rueben said Intelligent Instruments is a company that produces noise “trap”
cameras that are developed, manufactured, and sold in Chelsea. The system uses multiple
cameras to monitor an area. When the sound meter detects a noise louder than a certain decibel
(programmed into the system), the cameras record the vehicle information front and back.
At the time we spoke with Rueben, Intelligent Instruments had a limited presence in the US
market. They anticipate that they will eventually have a technical crew based in the U.S. as they
increase market share stateside. Since that time, Miami Beach has implemented this system and
has reported some success. We have contacted Miami Beach and are waiting for the correct
person to speak with about the system.
III.CURRENT STATUS
While there is opportunity to bring this technology to Vail, there are several challenges to
overcome. The current noise ordinance would need to be modified to include this technology as
an enforcement tool. As with red light cameras, there is a legal challenge to mailing tickets without
being able to identify the driver. This has been overcome by several jurisdictions in Colorado.
We are researching how this was done and if we can replicate that here.

In addition to the challenge of driver identification, nonpayment is also a problem we are trying to
solve. If a driver fails to or refuses to pay the fine, there is no system in place to ensure payment.
We are researching the feasibility of nonpayment affecting the driver’s ability to register their
vehicle until fines are paid.
Operationally, the system needs a main power supply which could be mounted on a
lamppost. The system will run on 110 v 250 Hz A/C. This could be a challenge in the area we
receive most of our noise complaints. The cameras will also need to be modified to identify license
plates in a low/no light environment.
Each system has a standalone cost of approximately $15,000. If we purchase more than one,
they can reduce each unit cost by 10%. I would anticipate requiring a minimum of two systems
to monitor both locations we receive complaints from. There is also a monthly service charge for
use of the webserver, software, and remote support which is estimated at $250 per unit. There
is also an option to lease for approximately $3,500 per month (first unit- and discount again by
10% for 2+) and includes all service fees. The lease is a three-month minimum contract.
Intelligent Instruments can assist us remotely in the sale, implementation and installation of their
cameras and provide maintenance remotely, as needed. All settings within the system can be
updated through a remote connection.
IV.NEXT STEPS
We are in the process of researching the possibility of implementing this system. We will return
to Town Council in the near future as we move forward in addressing the challenges and
potentially seek approval for funding and implementation.

4.1. VLHA 101: 2027 Strategic Housing Plan

In reference to www.vailgov.com the document was summarized. It was created in 2017,
addresses solutions to Vail housing challenges and is a 15 page document to be clear,
concise and very specific to goal to achieve.
Three part approach to 1) Goal 2) Means 3) Method

• Goal – airing 1,000 incremental new deed restrictions by 2027 vs. create 1000 new
units; referenced graphic of how the 1,000 number was set using 2016 numbers
7709 homes, 1,753 occupied, 4,768 unoccupied
o Dated in 2017: Since 2010, nearly 90% of homes for sale in Vail were sold to
Unoccupied Homeowners, approximately 10% were sold to Occupied
Homeowner
• Means – Town of Vail initially used housing mitigation funds, development impact
fees and capital project dollars; since then, the local sales tax was increased to ½ of
1% which generates an additional source of revenue.
o Additionally, the Town Council and the Housing Authority adopted 10
housing policies noted in Resolution No. 20, Series 2018
• Method – The decision making process was refined to get the housing results we
wanted to see. The new structure include:
o Singular in mission and focused
o Empowering and results oriented
o Nimble
o Adaptive within the dynamic real estate market
o Consistent and predictable
o Timely within Town’s development review process
• One of the reasons for the results have come from granting agency to the VLHA to
act on the town’s behalf when it comes to a variety of housing related issues, like
Vail InDEED review and approvals. This VLHA is very collaborative with local
government and helps to create the results we are seeing
• 2022 Budget includes some funding to update the 2027 Strategic Housing Plan
• Progress has been made through singular residential deed restrictions but it is
acknowledged that opportunities exist around larger projects like Residences at
Main Vail, Timber Ridge and perhaps West Middle Creek
• Consider the guideline to meet employee housing for 30% of the work force and it is
somewhere written in code and determine if that is the number we want to reach
• Consider the increase of jobs in Vail, those that exist throughout Eagle County and
down valley
• Weigh in parking needs and reasoning behind how deed restriction opportunities in
the past were missed and what could we do differently to gain more future success
• Discussion ensued around ways to increase housing in the Town of Vail, piloting
transportation solutions, micro transportation options and addressing challenges.
• Action steps and opportunities discussed:
o Get creative about the transportation policy and solutions
o Explore parking requirement code create more space for living space,
transportation vans, use of TOV transfer tax, length of DRB/PEC processes
which can be cost prohibitive to developers and
o Town of Vail Transfer Tax Usage – wishing it could be used to purchase
housing instead of overpriced land
o Consideration of off-site parking at a down valley location
o Discussion of benchmarks, the why and how we got there with the 2027
Strategic Housing Plan and take a closer look at action steps to proactively
set new benchmarks by backing into them
o Adapting deed restrictions to fit the needs of a remote worker that offices in
the county and is an area rep for an out of town company
o Plan a VLHA work session around having the difficult conversation around
solving and addresses the discussed issues.
• Looking back: 40
o Look to the past for some of the missed opportunities to see what we can do
for the future
o Looking back, the Lionshead Redevelopment Master Plan – an outcome was
a changed development review process so that we could add that 2nd
homeowner density but we seem reluctant to do that for permanent residents
and opportunities
o We have applications that don’t make it to the planning commission hearing
before they get tabled because of the opposition that is happening before the
application is presented
• Looking forward:
o We don’t have a housing problem, we have a development opportunity to
work with the private sector
o Identify the trends, set new benchmarks, acknowledge accountability, identify
the end goal
o Start with a work session with VLHA and provide additional background text
and data to help with the tactics to get us there
o If the goal is to keep the lights on, last time around, now, we are looking to
bring the 2018 value propositions to life
o Lean into the ways in which we could get to the goal and The World Class
Community that is Vail, through a linear framework
o Considering add benchmark of housing type and mapping out the
progression goal of resident housing
o Use housing as the secret sauce in the community to help solve the variety
of problems as the talent, recruitment and retention will follow the housing
4.2. VLHA - Town Council August 2,2022 Joint Meeting Recap Memo

Productive joint session leads us to finalize a recap memo and present to the Town Council.
Currently seeking any edits from VLHA to identify the action items to present and gather
Town Council feedback.
4.3. VLHA and TOV Housing Communications Snapshot
Presenter: Kristin Kenney Williams
Follow-up to the previous VLHA meeting, and hearing from the Town Council, how can we
enhance communications not only what is Housing achieving but also to prioritize reaching
our contingency and work force with how they can get involved with the programs.
Ideation exists but if we generally agree on buckets to get it in as a shared document with
opportunities from messaging, communications and toolkits, catered to who are our
audiences.
Mechanics of how to maneuver through SharePoint will be provided.

Front Range talking about potential grant funding initiatives across the state of 41
Colorado. Possibility to put support towards the possible ballot initiative.

• 2023 Draft Strategic Operating Plan & Budget (60 minutes), All Partners and Board
Discussion for use of additional $220,000: Based on the options presented, Liana
had new recommendation to Increase storytelling video content
$85,000 invested in 2022 but nothing towards media relating to
storytelling videos. What could we enhance? Shorter versions of videos
and enhanced content plan for distribution. Ultimately, goal to drive
occupancy in FIT and group sales as a for content plan. $100,000 more
could go to content creation and the rest to content plan and media
specific to distribution of videos based on plan.
Add executive summary what these are.
Consumer Journey: Change “dreaming / considering” to include “pre-booking”
Town Council presentation direction: Like working vs. non-working dollars as
representation for Town Council presentation. Consumer Journey is too abstract
for those who aren’t involved in the day to day.
Other Business
Esmarie: Request to discuss appointment of someone as the new Groups
representative with Scott gone.

Enclosed is the investment report with balances as of June 30, 2022.
The estimated average yield for the pooled cash fund is 0.86%. As of 06/30/2022
the Treasury yield curves for 3 months, 6 months, and 1 year are 1.72%, 2.51%,
and 2.80% respectively.
Our investment mix follows the policy objectives of safety, liquidity, and yield in that order.

TOWN OF VAIL MEMORANDUM
US Treasury yields have continued to increase. In June the Federal Reserve
made the fourth interest rate hike of the year bringing the federal funds rate to
between 2.25 and 2.50, where it was at its most recent high in the summer of
2019 before the pandemic. The latest inflation report, reported that CPI rose 8.3%
in August from the same month a year ago. As a reaction, US stocks tumbled
and bond yields jumped. The Federal Reserve is expected to continue to lift the
policy rate higher to combat inflation in September.
In June the Town transferred $10M to First Western Trust. These funds were invested into
FHLB callable agencies and Freddie Mac K-bonds with an approximate yield of 3.3% over
2.96 years. These types of bonds fall within the authorized security types identified within the
Town's Investment policy. There were no other changes to investment products or banking
