Background: The Colorado Department of Local Affairs
(DOLA), through its Division of Housing (DOH) Office of
Housing Finance and Sustainability (OHFS) has created the
Transformational Affordable Housing, Homeownership, and
Workforce Housing Grant Program established by Colorado
House Bill 2022 1304 (HB22-1304), funded by a total of
$138,000,000. The aim of this program is to increase the
number of affordable housing units and the availability of
housing opportunities across Colorado to ensure everyone
has a safe, stable, and affordable place to live and thrive. The
source of funds is from the Coronavirus State and Local Fiscal
Recovery Funds (SLFRF) program, a part of the American
Rescue Plan Act (ARPA).

I. PURPOSE
The purpose of this memorandum is to provide an update on the Town of Vail’s Art in Public
Places collection, installations, programs, strategic plan, artist in residency program, and the
design development of the Artist in Residency Studio with Harry Teague Architects.

II. ARTIST IN RESIDENCY STUDIO BACKGROUND & TIMELINE
• January 2009 – As a part of their approval for the redevelopment of Manor Vail, East
West Partners committed $50,000 to be allocated towards a proposed artist in residency
studio located in the small cabin across the bridge from Manor Vail and referred to as
the “art shack”.
• November 2013 - Ford Park Master Plan adopted:
o “The Creekside area is a narrow strip of land south of Betty Ford Way and north
of Gore Creek. A few small structures (i.e. the “art shack”, an open-air picnic
shelter) are located in this area. Art in Public Places (AIPP) may pursue
remodeling or enhancing the art shack at some point in the future. AIPP
had placed permanent art installations in this area and also runs summer art
programs in this part of the Park. Art programs may include activities such as
interactive events, educational and participatory activities, and temporary art
installations. The passive use and the limited number of permanent
improvements within this area make it an excellent transition to the more natural,
undisturbed Gore Creek Preservation Sub-area.”

• December 2016 – Per the Manor Vail redevelopment agreement, the Town received
$50,000 from East West Partners to explore the benefits of a dedicated visual arts
space, investigate the possibility of renovating the existing cabin and pursue design
development of an artist in residency studio.
• December 17, 2019 – The Town Council was updated on the findings, report and
structural engineering evaluation by Harry Teague Architects.
• May 4, 2021 – Town Council directs AIPP to pursue design development as
recommended by staff after review of post structural evaluation with Harry Teague
Architects:
o “Given the expense of working within and modifying an imperfect existing
structure, with pretty much no useful components, it makes by far the most sense
from an economic standpoint to build a new structure from scratch. In addition, a
new somewhat larger building could be designed within the site parameters and
accommodate the anticipated arts uses.”
• October 2021 - $850,000 ($600,000 from RETT & $250,000 from AIPP) was allocated
and approved in the 2022 budget by the Town Council for the construction of the artist
studio space.
• February 15, 2022 – The Town Council was updated on the design and program
development of the artist in residency studio project.
• October 3, 2022 – AIPP Board approves Artist in Residency Studio design as presented
by Harry Teague Architects at monthly AIPP meeting.
• January 3, 2023 – Presentation of the proposed art studio space design as approved by
AIPP Board for the purposes of a year-round multi-disciplinary Artist in Residency Studio
by principal architect Harry Teague of Harry Teague Architects, Basalt, CO.
III. ACTION REQUESTED OF COUNCIL
Provide any feedback on the materials as presented. Approval for Town Staff and AIPP Board
to pursue the Town approval process for the construction of the Artist in Residency Studio.

Update of the Art in Public Places Strategic Plan,
Polices & Guidelines, and Artist in Residency
The Town of Vail’s Art in Public Places program creates a diverse and meaningful Public
Art experience to engage the community, thus contributing to the cultural vitality of Vail.
•The AIPP Program Strategic Plan, Policies and Guidelines will include the mission
statement, vision, approval process of art donations, acquisition and deaccession of
works, temporary installation policies, collection documentation and maintenance, as
well as public art inclusion in capital projects and private developments.
•It will identify the requirements, qualifications, and responsibilities for future AIPP
Board members appointed by the Town Council.
•The Strategic Plan will address both short and long-range goals and objectives over a
10-year period including implementation and funding options to achieve these goals.
•The Strategic Plan will provide framework for the cultural goals and programming of
the Artist in Residency Studio in alignment with the Ford Park Master Plan.
•The Vail Artist in Residency Program will offer a unique environment for artists
to grow, re-energize, and infuse new perspectives into their work and share with
the Vail community.
•Create an exceptional and diverse art collection
•Community engagement and outreach

SUBJECT: Housing Grant Opportunities
I. SUMMARY
The purpose of this memorandum is to present housing grant opportunities under the newly -
released Colorado HB22-1304, or the Transformational Affordable Housing, Homeownership,
and Workforce Housing Grant Program. Staff is recommending the Town of Vail submit two
letters of intent to the Colorado Department of Local Affairs (DOLA) for:
1)Timber Ridge and West Middle Creek developments; and
2)a regional partnership to pursue a land acquisition for a housing development at Traer
Creek, Planning Area D,in Avon, CO.
Staff is requesting Council’s approval to move forward with the grant application process.
II. BACKGROUND
The Colorado Department of Local Affairs (DOLA), through its Division of Housing (DOH) Office
of Housing Finance and Sustainability (OHFS) has created the Transformational Affordable
Housing, Homeownership, and Workforce Housing Grant Program established by Colorado
House Bill 2022 1304 (HB22-1304), funded by a total of $138,000,000. The aim of this program
is to increase the number of affordable housing units and the availability of housing
opportunities across Colorado to ensure everyone has a safe, stable, and affordable place to
live and thrive. The source of funds is from the Coronavirus State and Local Fiscal Recovery
Funds (SLFRF) program, a part of the American Rescue Plan Act (ARPA).
Project awards may range from a minimum of $250,000 to a maximum of $10,000,000. Eligible
uses include housing infrastructure tied to an affordable housing development, gap financing for
affordable housing developments, creation of for-sale housing/homeownership, preservation of
affordable housing, energy improvements in affordable housing projects, conversion of property
for affordable housing, and land banking. Only local governments (counties, municipalities,
special districts and Tribal governments) and non-profit community partners are eligible to
apply.
Fifty percent of funding appropriated through HB22-1304 must first be offered in rural and rural
resort communities (Eagle County is identified as “rural resort”). Based on the regional housing
needs in these areas, the DOH can fund housing for households making up to 170% of the
area median income (AMI) toward for-rent homes and up to 140% of AMI for for-sale homes.

Monthly applications may be submitted starting January 1, 2023 and thereafter until the funds
are all distributed. Awarded funds must be committed (contracted) by December 31, 2024 and
funds expended by December 31, 2026.
II. DISCUSSION
To start the application process, a letter of intent (LOI) must be sent in on the 10th of the month,
with the application due the 1st of the following month (for example, an LOI is due by February
10 for an application deadline of March 1st.
The Town of Vail has contracted with a grant-writing team (Social Impact Collaborative and
Byrne Pelofsky & Associates). They are preparing to submit two separate letters of intent for
the town, however, before we do so, staff is requesting Council’s approval to move forward
with this process understanding the town must commit to a 25% matching for any grant
funds awarded. The 25% match may be in the form of cash, financing, land value, in-
kind values, and staff time. Below is a summary of the housing development opportunities
and grant request we plan to submit:
1. Timber Ridge Redevelopment & West Middle Creek:
Town Council is currently reviewing conceptual drawings for a 100% deed-restricted,
200+ rental home development with a mix of one, two, three and four bedroom
homes at the Timber Ridge Village Apartments The success of this redevelopment
is tied directly to the relocation of the current residents living at Timber Ridge. This
redevelopment requires a demolition of the current Timber Ridge Apartments, with
96 units housing nearly 250 people. Prior to the start of construction (planned for
May 1, 2024), Town Council has directed staff and Triumph Development to
implement a displacement and relocation plan. While the new Residences at Main
Vail may provide a relocation opportunity for some residents, West Middle Creek
presents an opportunity for another 200+ for-rent housing development on town-
owned land. Staff recommends both developments be included in one application
for grant funds as completion of both developments are critical to the success of a
redevelopment of Timber Ridge.
2. Traer Creek land acquisition: Staff is in discussions with both non-profit and local
government partners for a potential land acquisition of up to 14.4 buildable acres in
Avon, CO. The land is entitled already for residential development of up to 18 units per
acre, a lower-density multi-family type of product. Both the grant consultants and staff
agree that a regional partnership opportunity should greatly increase chances of grant
funding.
II. ACTION REQUESTED OF COUNCIL
Staff is requesting Council approval to move forward with the grant application process,
understanding the town will be committed for at least a 25% match on any grant proceeds
received.

1. SUMMARY
The purpose of this agenda item is to update the Vail Town Council on progress made by the
Redevelopment Committee since the earlier update on December 6.
This update will focus on the following topics:

2. BACKGROUND
Program and Uses
• The Committee contains to focus on Proposed Option C, as revised, in keeping with the
direction instructed by the Vail Town Council. Revised Option C contains the following
key elements:
o Six buildings total (Buildings A – F)
o 236 homes with 468 bedrooms
o 278 total parking spaces (198 podium parking spaces and 80 surface parking
spaces) for a parking ratio of 1.18 spaces per home
o An added 40 parking spaces along Lions Ridge Loop with pedestrian access
o Mix of studio,1, 2, 3, & 4 bedroom apartments
o Roof top outdoor areas
o Estimated price tag of $112M - $115M budget
o Alternate option for an additional building in the area of the CDOT right of way
A seventh building (Building G)
36 additional homes with 69 additional bedrooms
Mix of 2 & 3 bedroom apartments
38 additional podium parking spaces
• A phased approach to development is being explored though it appears the added cost,
time, and logistics of phased development makes it prohibitive.

Development Agreement
• The Committee has discussed draft development deal terms in an effort to provide a
basic framework for the redevelopment of the Timber Ridge Village Apartments.
• Draft development deal terms:
o Construction start May 1, 2024.
o Town retains fee title ownership of the land and Triumph owns and operates the
improvements for the term of the ground lease.
o Ground lease of 50 to 100 years with annual lease payments. (TBD)
o Consideration for lifecycle/redevelopment of the improvements.
o Town of Vail approval shall be required for any request for refinancing.
o Rental lease rates and terms to be discussed and approved by mutual consent to
establish a baseline for future financial considerations.
o Triumph shall prepare total development budget and business plan and shared
freely with the Town on an open book basis.
o The Town and Triumph shall mutually agree to the program and uses.
o The Town and Triumph shall be co-applicants on all development applications
o The approved development plan shall limit all residential uses to 100% deed
restricted homes.
o The Town of Vail shall obtain intellectual rights to all design and planning
documents, including financial analysis and reporting.
o The Town and Triumph to share 50%/50% in all civil design, architectural design,
entitlement process and construction cost estimating with no staff time charged
by either party.
o Triumph shall finance the development with financial participation from the Town.
Next Steps
The following next steps are proposed to advance the redevelopment of the Timber Ridge
Village Apartments:
• Meet with representatives from CDOT to explore the opportunity of acquiring a
portion of the ROW immediately adjacent to the redevelopment site.
• Advance the civil design of the site based upon the proposed program and uses.
• Prepare a draft development budget and pro forma based upon the proposed
program and uses and current construction cost assumptions for presentation on
February 7.
• Integrate the findings of the geotechnical study into the overall site plan design.
• Meet with the VEAC and VLHA on January 10 to gain initial feedback on the
proposed program and uses.
• Meet with representatives from the Public Works and Fire Department to gain initial
feedback on the site plan design.
• Explore the opportunity to reduce the width of the 40-foot wide utility easement along
the North Frontage Road.
• Identify potential grant and loan funding sources and partnership opportunities.
• Continue to advance the draft terms of a development agreement.
• Update the Timber Ridge Village Apartments redevelopment schedule to reflect
current progress and direct the critical path of actions and decision-making.
• Engage in a more detailed discussion regarding development deal terms on
February 7.
• Continue discussions regarding transportation and mobility solutions to allow for a
reduce on-site parking obligation.

Staff provided a recap of the Town Council feedback on the funding amounts for kick it 3v3, Farm to
Table Dinners, and Summer Vail Art Workshop. CSE discussed the initial funding recommendations and
the process used to determine those amounts and is recommended keeping the allocations as is.
Kick it 3v3 - The estimated economic impact of the tournament and the benefits received is in line with
the funding allocation. The tournament is significantly smaller and shorter than other tournaments
receiving a similar funding amount. The funding presentation also indicated that a portion of the funding
is used to subisidize the entry fee for a number of teams from each regional tournament. The CSE
believes that Vail, and the "National Championship" stature of the tournament should stand on its own as
a draw for teams and shouldn't need subsidies to get teams to come.
Farm to Table - The CSE is very fond of the event for its PR and marketing appeal though the reach is
very minimal with only 260 estimated attendees in 2023. The funding amount of $5000 represents a per
plate subsidy of approximately $20. CSE would prefer that the event producer find additional
sponsorship, or raise ticket pricing to cover the costs of event production. As the event is targeted at a
very high end demographic and sells out every seating, CSE believes that the ticket pricing could be
raised if needed to cover costs.
SummerVail Art Workshop - The CSE is supportive of the programming proposed by SummerVail in
collaboration with the Corning Musem of Glass, and as such recommended one of the largest funding

allocations in the E&E category at $25,000. The CSE is open to reviewing a second request in the spring
cycle from this event producer, though would recommend maintaining the funding amount of $25,000 at
this time. The event producer over the last 3 years has had 3 very different requests for their signature
event, and has been successful overall but has lacked some of the marketing and operational success
that is expected of an event producer requesting significant funding. While the Corning Museum
opportunity for 2023 is very appealing, it would be a single year program and would leave the
SummerVail event back at square one in 2024.

Subject: Welcome Centers and Community Host Program Winter Update
I. BACKGROUND
The Town of Vail operates the Vail Village and Lionshead Welcome Centers which are open
daily 9am-5pm. The Welcome Centers assist over 100,000 guests and locals each year. The
guest service operations also include management of the Community Host and Trail Host
programs. This winter season’s Welcome Center staff and hosts totals 42 ambassadors.
II. COMMUNITY HOSTS
The Community Hosts are stationed in the villages to assist our guests with wayfinding, daily
events and activities, while imparting a welcoming atmosphere. There are 34 hosts for the
2022/2023 winter season, 7* of whom are new to the program this winter:

In return for their service, hosts can receive an Epic Volunteer Ski Pass, or a Visa Gift Card with
a value of $700. Volunteers are on the street daily from Friday, December 16th through Sunday,
April 2nd. Two shifts per day, 9am-1pm and 12pm-4pm.
The annual kick-off meeting at the Vail Golf Club & Nordic Center was December 6th. The hosts
found the meeting to be informative and said they left with an increased knowledge of both town 71
and mountain happenings. The host holiday get-together was on Tuesday, December 13th which
was a great way for hosts to get to know each other and staff in a casual atmosphere.
III. Facility Update
The Welcome Centers new interpretive exhibits will be completed at the end of January. The
goal of the new displays is to engage and educate visitors on Vail’s outdoor recreation,
environmental sustainability practices, culture and history. Themes include diversity and inclusion
in the outdoors, indigenous peoples and coexisting with wildlife. These themes align with the
Destination Stewardship Plan. Other additions are digital screens that display DiscoverVail and a
calendar of events, large trail maps, photos of the Back Bowls and Gore Range, new paint,
carpet and furniture.
IV. Welcome Center Staff
The Welcome Centers are open daily 9am-5pm, 365 days a year. The staff is seasoned with an
extensive knowledge of Vail and the surrounding areas.

4.0% Sales Tax
Upon receipt of all sales tax returns, November collections are estimated to be
$1,847,235 down (1.8)% from last year and down (1.8)% compared to amended
budget. November collections are up 46.6% from 2019. Year to date collections of
$34,964,772 are up 21.4% from prior year and up 39.8% from 2019. Compared to
amended budget, collections are up 1.4%. Inflation as measured by the consumer
price index was up 6.0% for November. The annual budget totals $39.95 million.
0.5% Housing Fund Sales Tax
Upon receipt of all sales tax returns, November collections of the 0.5% housing
sales tax are estimated to be $212,842 and the YTD total collections are estimated
to be $4,246,255. The 2022 amended budget for the housing fund sales tax totals
$4.8 million.
Real Estate Transfer Tax (RETT)
RETT collections through December 27 total $9,528,656 down (28.7)% from this
time last year. The 2022 amended RETT budget totals $9,707,414.
Construction Use Tax
Use Tax collections through December 28 total $2,083,865 compared to
$3,682,745 from this time last year. 2021 collections were significantly higher due
to several large single-family residential projects and an interior hotel renovation.
The 2022 amended budget totals $1,965,000.
Lift Tax
2022 YTD lift tax collections total $5,424,419 up 18.2% or $836,584 from the same
time last year.
Daily Parking Sales
Daily sales from the parking structures from November through December 26 total
approximately $1,354,872, up $110,162, or 8.9% from this time last year.
Parking Pass Revenue
Pass sales for the 22/23 ski season (November through December 28) total
$1,419,484 up $236,652 or 20.0% from prior winter season. A detailed chart of
approximate passes sold by type is shown below. 21/22 ski season numbers
represent passes sold or used throughout the entire prior ski season.

sold is estimated based on the number of individual Value Cards scanned in the
parking structures during the entire 2021/2022 winter season.
Value cards in prior seasons we often used in conjunction with other passes, such
as the Blue, to utilize discount parking in the structures on days that the parker’s
other pass did not grant access. This year, discounted parking is included with
employee and business passes, reducing the need for multiple passes. Staff
estimates that at least of portion of the decrease in Local passes purchased this
season is due to this.
Summary
Across all funds, year-to-date total revenue of $81.7 million is down (0.9)% from
amended budget and up 4.1% from prior year. Excluding the new 0.5% housing
sales tax, total revenue is flat with prior year. Revenues are tracking slightly down
from budget due to construction permitting and fees as well as interest revenues.

The Vail Business Review breaks down the four percent sales tax collected for the
month of October and Summer season - May through October.
Overall, October sales tax decreased (7.6%) from prior year with retail decreasing
(14.9%), lodging decreasing (11.4%), food and beverage increasing 8.8%, and
utilities/other increasing 1.9%. Excluding the out-of-town category, sales tax for the
month of October was up 1.2% compared to prior year.
Summer Season May through October resulted in an overall 3.0% increase from the
prior year. Retail increased 3.9%, lodging remained flat, food and beverage increased
3.9% and utilities and other increased 8.8%. Excluding the out-of-town category, sales
tax for May through October increased 3.9%.

•On January 1st, 2022, Town of Vail sales tax increased from 4.0% to 4.5% on all items except food for
home consumption. 2022 results in this report only include the 4.0% sales tax collected on all
items for accuracy of comparison to prior years.
•Overall, May through October 2022 4.0% sales tax collections were up 3.0% from the prior year.
• May through October 2022 retail sales increased 3.9%, lodging remained flat, food and beverage
increased 3.9% and utilities and other increased 8.8%.

Short-term rentals decreased (9.2)% from prior year and hotels and lodges increased 4.4%.
• Short-term rental sales tax collection numbers include online marketplace facilitators like Airbnb and
VRBO. Revenue collections from facilitators may include some hotels and lodges. Facilitators first began
collecting and remitting sales taxes on behalf of individual owners in October of 2020.
