AN ORDINANCE AMENDING CHAPTER 6.08 "LIVESTOCK ON PUBLIC STREETS"
OF THE MUNICIPAL CODE OF THE TOWN OF VAIL; PROVIDING A DEFINITION
OF HORSE DRAWN VEHICLE; RESTRICTING THE USE OR OCCUPANCY OF PUBLIC
STREETS WITHIN THE TOWN OF VAIL BY LIVESTOCK OR HORSE DRAWN VEHICLES
AND SETTING FORTH CERTAIN EXCEPTIONS TO SAID RESTRICTIONS.
WHEREAS, the Town Council would like visitors, guests and residents of the Tawn
of Vail to enjoy rides an horse drawn vehicles throughout the public streets of the
Town of Vail under certain circumstances; and
WHEREAS, the Town Council further believes that such service would add to the
ambiance of the Town.
NOW, TIlEREFORE, be it ordained ty the Town Council of the Town of Vail, Colorado
as follows:
Section 1.
Section 6.08.010 "Definitions" of the Municipal Code of the Tawn of Vail is
hereby amended by the addition of paragraph D to read as follows:
6.08.01.0 Definitions '
D. Horse drawn vehicle means any vehicle which is operated or pulled by a
horse or horses which may be hired far the transportation of passengers.
Section 2.
Section 6.08.020 "Restrictions" is hereby repealed and reenacted with amendments
to read as follows:
6.08.020 Restrictions
It is unlawful for any person whether acting as owner, principle, agent,
employee, lessee or permittee to operate ar cause to be operated any horse drawn
vehicle upon the public streets of the Town of Vaii ar to allow livdstock to use or
occupy the public streets of the Town of Vail without having first attained a permit
therefor. Nothing contained in this Section shall prohibit the grantees of any
Valid livestOCk easement from using the easement within the town limits of the Town
of Vail,
Section 3.
Section 6.0$.040 "Exceptions" of the Municipal Code of the Town of Vail,
Colorado is hereby repealed and reenacted with amendments to read as follows:
6.08.040 Exceptions
The Town Council by resolution may approve the issuance of a permit for the
operation of horse drawn vehicles upon the public streets and right-of-ways within

the Town subject to whatever conditions, regulations and restrictions the Town
Council deems necessary to protect the public health, safety and welfare. In
addition, the Town Council or the Town Manager may from time to time permit
livestock to use ar occupy any of the public streets within the Tawn".for parades ar
special events upon such terms and conditions, regulations and restrictions as the
Town Gauncil deems necessary to protect the health, safety and welfare of the
inhabitants of the Town.
Section 4.
If any part, section, subsection, sentence, clause, or phrase of this ordinance
is far any reason held to be invalid, such decision shall not affect the validity of
the remaining portions of this ordinance; and the Town Council hereby declares it
would have passed this ordinance, and each part, section, subsection, sentence,
clause or phrase thereof, regardless of the fact that any one or more parts,
sections, subsections, sentences, clauses or phrases be declared invalid.
Section 5.
The Tawn Council hereby finds, determines and declares that this ordinance is
necessary and proper for the health, safety and welfare of the Tawn of Vail and the
inhabitants thereof.
Section 6.
The repeal or the repeal and reenactment of any provision of the Vail Municipal
Cade as provided in this ordinance shall not affect any right which has accrued, any
duty imposed, any violation that occurred prior to the effective date hereof, any
prosecution commenced, nor any other action or proceedings as commenced under or by
virtue of the provision repealed or repealed and reenacted. The~~repeal of any
provision hereby shall not revive any provision ar any ordinance previously repealed
or superseded unless expressly stated herein.

March ,..1986, at 7:3U p.m. in the Council Chambers of the Vail Municipal
Building, Vail, Colorado.
