1986-10 Imposing Zoning Districts on Parcels of Property in the Recently Re-Annexed West Vail Area
-i oRDINANCE ~o Series of 1986 AN ORDINANCE IMPOSING ZONING DISTRICTS ON PARCELS OF PROPERTY IN THE RECENTLY RE-ANNEXED WEST HAIL AREA; ACCEPTING A PRIOR APPROVAL OF T}iE EAGLE COl1NTY COMMISSIONERS RELATING THERETO; SPECIFYING AMENDMENT PROCEDURES FOR SAID PRIOR APPROVAL AND SETTING FORTH CONDITIONS RE- LATING THERETO; AMENDING THE OFFICIAL ZONING MAP FOR THE TOWN OF VAIL; AND SETTING FORTH DETAILS IN RELATION THERETO. WHEREAS, the Town of Vail, Colorado, recently re-annexed a portion of the West Vail area, County of Eagle, State of Colorado, effective on January 29, 1986 as depicted in the attached Exhibit A; and WHEREAS, Chapter 1$.68 of the Municipal Code of the Town of Uai1 sets forth procedures for the imposition of zoning districts on recently annexed areas; and WHEREAS, Section 3]-12-115 (S} CRS, 1973, as amended, requires the Town to bring the newly annexed area under its zoning ordinance within 90 (ninety) days after the effective date of annexation; and WHEREAS, because of certain actions taken by and approvals of the Eagle County Commissioners relating to the Vail Commons proposal, the Town Council is of the opinion that the zoning designation for this parcel should recognize said conditions; and WHEREA5, the Planning and Environmental Commission of the Town of Vail has considered the zoning to be imposed on the re-annexed area at a public hearing and has made a recommendation to the Town Council to adopt zoning as proposed in this ordinance; and WHEREAS, the Town Council considers that it is in the interest of the public health, safety and welfare to so zone said property; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, THAT: Section 1. Procedures Fulfilled The procedures far the determination of the zoning districts to be imposed an the recently re-annexed West Vail area as set forth in Chapter 18.68 of the Vail Municipal Code have been fulfilled. ~ K ` • ~ ; , Section 2. Imposition of Zonina on an Unolati;ed Six Acre Parcel Cnmmonl.v Referred to as the Site for the Vail Commons Pro.iect, a. The Vail Commons parcel shall be developed in accordance with the prior agreement, approvals and actions of the Eagle County Commissioners. b. The documents and instruments relating to the prior County approval far this project are presently on file in the Department of Community Development of the Town of Vail and said approval is hereby accepted and approved by the Town of Vail. c. The project will be required to comply with Section 18.54 Design Review Guidelines of the Vail Municipal Code prior to the issuance of a building permit. d. The Community Development Department may issue staff approvals for minor changes in the site design or other minor aspects of the plan. These proposed changes may be approved as presented, approved with conditions or denied by the staff with an appeal within 10 days of the staff decision to the Planning and Environmental Commission. For major changes such as a redesign of a major part of the site, changes of use, density control, height or other development standards, a Planning and Environmental Commission review shall be required. The procedures for changes shall be in accordance with Chapter 18.66 of the Vail Municipal Code. Section 3. The remainder of the re-annexed area shall be zoned as depicted on~the attached Exhibit A. Section 4. As provided in Section 18.08.030 of the Vail Municipal Code, the zoning administrator is hereby directed to promptly modify and amend the Official Zoning Map to indicate the zoning specified herein. r -2- 1 ~ ~' °~ ~ ~ ~ Section 5. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, Section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 6• The Tawn Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Tawn of Vail and the inhabitants thereof. Section 7. The repeal or the repeal and reenactment of any provisions of the Vail Municipal Code as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action ar proceeding as commenced under or by virtue of the provision repealed and reenacted. The repeal of any provision hereby shall not revive any provision ar any ordinance previously repealed or superseded unless expressly stated herein. INTRODUCED, READ AND PASSED ON FIRST READING THIS 18th DAY OF March 1986, and a public hearing shall be held on this ordinance on the 18th day of March , 1986 at 7:30 p.m. in the Council Chambers of the Vail Municipal Building in Vail, Colorado.
