AN ORDINANCE ApPROVING A SPECIAL DEUELOpMENT
DISTRICT (KIVOWN AS SDCI N0. 15) AND THE DEVELQPMENT
PLAN TN ACCORpANCE WFTH CNAPTER 18.40 OF THE VATl.
MUNICIpAL CODE AND SETTING FORTH DETAILS IN REGARD THERETO.
WHEREAS, Chapter 18.40 of the Vai7 Municipal Code authorizes special
develapment districts within the Town; and
WHEREAS, Fra C. Rothgerber, Jr. and the M.B. Trust have submitted an
app1ication for special development appraval far a certain parcel of property
within tha Town known as Lots I and 2, Block 6, Vai1 Village lst Filing, to be
known as Special Development District 15; and
WNEREAS, the estabiishment of the requested SDD 15 will insure unified and
coordinated deve7apment within the Town of Vail in a manner su7ta6le for the
area in which it is situated; and
WHEREAS, the Planning and Environmenta1 Cammission has recommendecE approval of
the praposed SDD; and
WNEREAS, the i'awn Councii considers that it is reasonable, appropriate and
beneficial to the Tawn and its citizens, inhabitants and visitors to establish
said Special pevelopment District Na. 15;
NOW, THEREFORE, BE IT ORQAINED BY THE 7QWN COUNCIL DF TFIE""'TdWN 4F" VRII.,
COLQRADO TFfAT:
Sectian 1. Amendment Procedures Fulfilled Plannin Commissian Re art.
The approval pracedures prescribed in Chapter 18.40 of the Vail Municipal Code
have been fulfil1ed, and the Town Council has rece7ved the report of the
Pianning and Fnvironmental Commissinn recommending approval of the proposed
development plan for 5DD 15.

Section 2. S ecial Develo ment District 15
Special Development District 15 (SDD 15) and the development pian therefore,
are hereby approved for the development of L.ats 1 and 2, Block 6, Vail Village
First Filing, within the Town of Vail, cnnsisting of 0.7133 acres.
Section 3. Pur ase
Special Development District 15 rts established to ensure comprehenslve
development and use af an area that will be harmonious with the general
character of the Town of Vail and to promote the upgrading and redevelapment of
a property within the Town. The development is regarded as complementary to
• the Town by the Town Council and meets all design standards as set farth in
5ectian 18.40 of the Municipa1 Code. As stated in the staff inemorandum dated

April 14, 1986, there are signjficant aspects of Special Development District
15 which cannot be satisfiec#through the impositian of the standards in the
High Density Multiple Family zone district. SDD 15 is compatible with the
upgrading and redevelopment of the community while maintaining its unique
character,
5ection 4. Develapment Plan
A. The development plan for SDD 15 is approved and sMall constitute the
p1an for development within the special development district. The
development pian is comprised of thase plans submitted by Gordan Piarce,
A.I.A., Architects and Berridge Associates, Inc., l.andscape ArChitects
and consi sts ofi the fol l owi ng documents :
1. Site plan by Gardan R. Pierce dated May 6, 1986
2. Preliminary landscape plan by Berridge Assaciates, Inc. dated
March 17, 1986
3. Typ3cal floor plans by Gordon R. Pierce dated Nfarch 17, 1986
4. Elevations and sections by Gordon R. Pierce dated March 17, 1986
5. Environmental Assessment and other submittal documents.
B. 7he qeve1apment Plan sha11 adhere to the following:
Setbacks
Setbacks shall be noted as on the site p1an 1isted above.
Fiei h~t
Heights of structures shall be as indicated 'an the eievations 11'sted
abnve.

Coverage I
Site coverage shall be an indicated on the site plan listed abovee
Landscaping
The area of the site ta be landscaped shall be as indicated on the
preliminary landscape plan. A detailed landscape plan shall be
submitted to the Design Review Baard for their appraval. The
DRB-approved final landscape pian shall represent the landscaping
requirements.
Parfci n and Laadi n
Parking and loading shall be provided as indicated on the site plan and
' flaar plans as listed above. In no case shall the parking provided on
site be less than 29 spaces underground with 4 surface spaces pravided
for loading and delivery.
Section 5. Density
Rpproval of this development pian shall parmit twelve (12) dwelling units,
includ9ng one manager's unit, consisting of 21,482 square feet of grqss
residential flnar area. As detailed on f7nor plans and elevatians submitted by
Gordon R. Pierce, dated iNarch 17, 1988, the grass floor araa as approved
cansists of 26,699 square feet.
Section 6. Uses
Permitted, conditional and accessory uses shall be as set forth in the High
Density Multiple Family zone district. _
Section 7. Use Restrictions Related tn the Mana er's Unit
The manager's unit, unit no. 12, shall be restricted ta employee housing as per
Section 18.13,080 B.10 a-d of the Town of Vail Municipal Gode.
Section 8. Amendments
Amendments to the approved development plan which do not change its substance
may be approved hy the Planning and Environmental Commissian at a regularly
scheduled pub1ic hearing in accordance with the provisions of 5ection
18.66.060. Amendments which do change the substance ofi the development plan
shall be required to bE approved by 7own Council after the above procedure has
been followed. T'he Cammunity Development Department shall determine what
constitutes a changa in the substance of the development plan.

Section 9. Expiratio_n_
The applicant must begin canstruction of the special development district within
18 months from the time of its final apprflval, and continue diligently toward
the campletion of the prnject. If the applicant does not begin and diligently
wark toward the campletion of the special develapment district or any stage of
the specjal develapment district within the time limits imposed by the preceding
subsection, the Planning and Enviranmenta1 Commission shall review the special
development district. They shall recnmmend tn the Town Council that either the
approval of the special development district be extended, that the approvai of
the specia1 development district be revoked, or that the special development
district be amended.

Sectian 10. Conditions of Appravals for S ecial pevelo ment District.l5
The applicant, ar his successor in interest, agrees to contribute $4,904 toward
the canstruction of a bike pathway from Vai1 Road to W111ow Bridge Road in the
farm of an unconditional letter of credit from a financial institution and in a
form acceptable to the Town Attorney. No building permit sha11 be issued for
the construction of any improvements far Special Development District 15 until
such letter of credit has been filed with the Town. Said letter of credit shall
be released and the applicant's obligation to contribute said funds shall
terminate if canstruction is not commenced on the bike pathway within five (5)
years from the date hereof.
Section 11. If any part, sectian, subsectian, sentence, clause or phrase of this ardinance
is for any reason held to be invalid, such decisian sha11 not affect the
validity of the remaining partions af this ordinance; and the Town Cauncil
hereby declares it wau1d have passed this ordinance, and each part, section,
subsectian, sentence, clause or phrasa thereof, regard1ess of the fact that any
one ar more parts, sections, subsections, sentences, clauses or phrases be
declared invalid.
Section 12.
The Town Council'hereby finds, determines and declares that this ordinance is
necessary and praper for the hea1th, safety and welfare of the Town of Vail and
the inhabitants therenf.

Section 13.
The repeal or the repeal and reenactment of any provisians of the Vail
Municipal Code as pravided in this ardinance shall not affect any right which
has accrued, any duty imposed, any vioiation that occurred prior to the
effectiue date hereof, any prosacution commenced, nor any other action or
proceeding as commenced under or by virtue of the provision repealed and
reenacted. The repeal of any pravision hereby sha11 not revive any provision ~

or any ordinance previously repealed ar superseded unless express1y stated
herein.
INTRODUCED, READ AND PASSED ON FIRST READING THIS 6th DAY OF May
: 1986, and a public hearing shall be held on this ardinance on the 6th day
of May_ 1986 at 7:30 p.m. in the Council Chambers of the
Uail Municipal Building in Vai1, Colorado.
