HomeMy WebLinkAbout1986-15 Amending the Town's Police and Fire Pension Plan Document ~ ORDINANCE iVO. 15 Seriss of 1986 AN ORDTNRNCE ANiENDING THE TOWN'S POLTCE AND FIRE PENSION PLAN ppCEJMENT SUBJECT TO APpRQVAL BY SIxTY- F'IVE PERCENT (65%) QF 7HE TOWN'S POLTCE AND FIREMEN AND SETTING F'ORTH DETAILS TN REI.ATION THERETO. WHERERS, the Town Council has adapted a Police and Firemen's pension Pian, the effective date of which was January 1, 1983 and has adopted a first and second amendment to said p7an, the effective dates of whieh were September 20, 1983 and May 2, 1984, respectively; and WWEREAS, the Town Council has adopted a third amendment, the effective date of which was December 12, 1984; and WHEREAS, the Police and Fire employees of the Town of Vail now wish ta amend the Police and Fire Employees' Pension P]an afourth time as set farth in the amenctment attacMed hereto ancf incorporated by reference; and . WHEREAS, such amendment must be approved by the Town Council of the Town of Vaii. NOW, THEREFaRE, be it ordained by the Town Council of the Town of Vail, Caiarado, that. Section 1. The fourth amendment to the Police and Fire Employees` Pensian plan dacument which is attached hereto and incorporated herein by reference is hereby appraved 6y the 7own Cauncil subject to the approval of sixty°five percent (65%) of the police and fire employees of the Town of Vail. Section 2. If any part, section, subsection, sentence, clause, or phrase of this ordinance is far any reasan held to be invalid, such decision sha11 not affect the validity of the remaining portions of t}11S ordinance; and the 7own Council hereby declares it would have passed this ordinance, and each part, section, subsectian, sentence, clause or phrase thereof, regardless of the fact that any ane or more parts, sectiorts, subsectians, sentences, clauses or phrases be declared invalid. Seetion 3. i The Town Counci7 hereby finds, determines and declares that this nrdinance is necessary and praper for the health, safety artd welfare of the Town of Uail and the inhabitants thereaf. • . • ~ , . , . Sectinn 4. 7he repeal or the repeal and reenactment of any provision of the Vail Municipal Code as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any vio1ation that occurred prior ta tha effective date heraaf, any prosecution commenced, nor any other action or proceedings as cnmmenced under or by virtue of the pravision repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provisian ar any ordinance previous1y repealed or superseded unless expressly stated herein. TOW'N OF VAI L POLICE AND FIRE EMPLOYEES' PENSION PLAN THIS AMENDMENT is made by Tawn of Vail (herexnaftar referred ta as the "Enployer" ) . WHEREAS, the Employer adopted the• Town of VaiJ. PoJ.ice and Fire Employees' Pensian Plan (hereinafter referred to as the "Plan" effective January 1, 1983; and WHEREAB, the Plan provides at Section 8.1 as folYows: "The Ernployer rnay amend, modify or terminate the Plan upon approval of such amendment, modifi- cation or terma.nation by 65$ of the active Partici- pants. , and WHEREAS, the Employer previously amended the Plan in certain techni.cal respects and now desires to further amend the Plan to revise the vesting schedule and to reflect recent federal legislatian; . NOW, THEREF4RE, the Employer does hereby amend the . Plan in the £ollowing particul.ars- ARTICLE I Section 4.1 of the Plan (Pa9e 8) is hereby amended by addzng the fol.lowing parag raph to the end of such Section: ~ ~ °The cantribution provided above for any employee ; shal].' be reduced by the amount of taxes paid by the ~ Employer on behalf of such employee pursuant to the ~ I Federal Social Security Act or any amendment G thereto. Such contribution rec3uctian shall be effective at the same time as any such payroll tax mandated by the Social Security Act or any amend- ment thereto becomES effective." ARTICLE SI 5ection 5.2 of the P1an (page 15) is hereby amended to read in its entirety as follows: ~ "6.2 Vestin Schedule ' ~ (a) Far Em lo ees Hired Betore Jul 1, 1986. F In the case of a Participant whose date ~ of employment is priar to July 1, 1986, stxch Participant's vested percentage in En?ployer contributions made on his behalf - pursuant to Sectian 4.1 at any ti.me sha12 be detenma.ned accarding ta the fo17.owing schedule, based upon his years of service: Years of Service Vested Percentage Less than I 0 $ 1 77.5% 2 85 % 3 92.5% 4 or more 100 % (b) For Em lo ees Ighose Date of Em 1o ent is After June 30, 1986. In the case bf a Participant whose date of emplayment zs after June 30, 1986, such Partkcipant's vested percentage in Em- ployer contributions made on hi.s behalf - pursuant to Section 4.1 at any time shall ~ ~ ~ -2- . . . ~ ~ ' be determined according to the following schedule, based-upon his years af servi.ce: Years of Service Vested Percentage Less than 1 p% 1 20% Z 40% 3 sa% 4 80% 5 ar more 100% (c) I,aZ-pff. Notwithstanding the schedules of vesting set forth in paragraphs (a) and (b) above, any employee who is lazd off by the by the Ci.ty Manager prior to the time at which he has completed at least one year of service, such empl.ayee sha11 be con- sidered to have ane year of service far vesting purposes at the time hc terminates employment as a resuZt of such Iay off. (d) Death or Attainment of Normal Rctirement Age. The vested percentage of a Partici- pant sha.ll be 100% in the event the Par- ticipant dies or attains his normal re- tirement age while still emp3.oyed by the Employer. " ARTICLE ZII Articl.e VII of the P1an (pages 17 through 22) is here}ay amended by adding the following 5ections tn the enc3 of svch Artzcle: "7.7 Reauired Distribution Comrnencement Date. Distribution of a Participant's interest must begin no 1ater than the April 1 of the calen- dar year following the calendar year in which takes place the 1ater of the date the Parti.ci- pant attains the age of seventy and one-half (70-1/2) or the date the Participant retzres. -3- t The limitations of this 5ection shall not appZy to a distribution made pursuant to a designation made by a Partica.pant before January 1, 1984 as to the method of distri- bution ar a distribution which commences ; before the first p3.an year beginning after December 31, 1984." ~ 7.8 Limitatian on Duration of Pa ents. Whenever an amount becomes distributable ta a Participant, such amaunt shall be distributed over a period not exceeding the Ionger of (i) the langer af the life or the life expectancy _ of the Participant, or (ii) the longer af the joxnt lives or the joint life expectiancies of the Participant and an individual designated as a beneficiary by the Participant. To the extent distributian is made after the Parti-- cipant attains the age of seventy and one-ha1.f (70-1/2), if not paid in alump sum, the dis- tribution mvst be made in sub5tantial.ly equal ( periodic installments at least annually over the period prescribed in th,i.s svbsection sub- f ject to acce3.eratian of payment at the elec- tion of the Participant or benefi.ciary. The present value of the benefi'ts payable so1e1X to the Parti.cipant under any elected method must exceed fifty percent (50%) of the total benefits payable to the Participant and his beneficiaries, unless distxibution is in the form of a quali£ied joint and survivor annuity. If distribution is made pursuant to a de5ignation made by a Participant before ' January 1, 1984 as to the method of di.stribu- tion, or if distribution commences prior ta the P1an Year beginning after December 31, 1984, the limitations of this subsECtion and subsection (d) of this Section sha11 not apply if the present value of payments to the garti- cipant exceeds fifty percent (50%) of the tatal payments to the Participant anc3 his beneficiaries. F ~ -4-- ~ ~ 7.9 S ecial Rules for Distributions After the Participant's Death. (a) Distributions Commencing Pxior to Death. It distribution of a Participant` s inter- . est had commenced prior to thE Partici.- pant's death in accordance with Section 7.9, the remaining interest of the Farti- cipant sha1l be di.stributed at least as rapidJ.y as under the method of distribu- tion bezng used as of the date ot his death. (b) Distra.butions Commencing After Death, It ' distribution of a Partica.pant' s interest did nat commence prior to hzs death, the entire interest of the Parti.cipant shall be da.stributEd within five (S) years after the death of the Participant, pro- vic3ed that a distribution commencing within one (1) year after the Partici- pant's death to ar for the benefit of a designated beneficiary over the longer of the life or the life expectancy of the designated beneficiary will be treated as having been di.stributed wa.thin such five (5) year period. If the surviving spouse of the Participant is the designated beneticiary, distribution is not required to commence un til the date an which the Participant would have attained the age of seventy and one-half (70-1/2) and if distribution had not commenced as of the date o£ death of such surv3ving spause, the provisians ot this paragraph shall, be applied as if such spouse weze the Par- ticipant. (c) Beneficiaries. If a Participant shou3.d die after receivi.ng some part, but nat all, of his account, the remaining baI- ance thexeof sha11 be distributed to hi.s benefzciary in manner determined pur- suant to this 5ection 7.10. 3f the bene-- f ic iary of the Partic ipant shou3.d die, cease ta exist or da.sclaim his interest -5- prior ta the cnmpletion of distribution ' of the Parta.czpant's interest, the remai.ning distribution shall be made to the contingent beneficiary designated by the Participant, if any. If any con- tingent beneficiary shou3.d die, cease to exist or disclaim his interest, distribu- tian of the remainder of the Partici-- pant's interest shall be made to the next contingent beneficiary. In the event there is not a beneficiary or contingent berieticxary designatecl by the Participant to receive distribution ot the Partici- pant's interest, the Parti,cipant's inter- est sha1l be distributed in a manner determined puzsuant to this 5ection 7.10 to the reczpient deterznined pursuant ta ArticZe VF above." ARTZCLE Iv Section 8.8 of the P1an tpage 26? is hereby amended by adding the following paragraph to the end of such Section: "The preceding paragraph of this Section sha1S not apply to the creation, assignment or ~ recognition of a rxght to any benefit payable with respect to a Parta.cipant pursuant to a Qualified Domestic ReZations Order under Code Section 414(p). Di.stribution may be made pur- suant to such an order at any time on or after the date which is ten (10) years before the Participant's norma2 retirement age. The „ Administrator sha11 establish such reasonable pzocedures as are necessary to detexmine the qualified status of domestic relations orders and to administer distributions under such qualified orders." °ARTICLE V The amendment to the Plan set forth in Article I ~ above shall be effective as of April 1, 1986.
