HomeMy WebLinkAbout1986-17 Defining when a Dog Constitutes a Nuisance and Setting Forth Penalties for the Owner of A Dog Which Constitutes a Nuisance; Expanding Leash Laws js ORDINANCE N0. 17 Series of 1985 AN ORDINANCE DEFINING WHEN A DOG CONSTITUTES A NUISANCE AND SETTING FORTH PENALTIES FOR THE OWNER OF A DOG WHICH CONSTITUTES A NUISANCE; EXPANDING THE AREAS WITHIN THE TOWN ON WHICH THE LEASH LAW IS IN EFFECT ANA SETTING FORTN DETAILS IN REGARD THERETO. WHEREAS, the Town Council is concerned that dog waste causes unsanitary, dangerous and offensive conditions within the Town; and WHEREAS, the Town Council believes the safety of the citizens of the Town will be enhanced if owners are required to keep dogs on leashes on the parks and bikepaths within the Town. NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Town of Vail, Colorado, as follows: Section 1. Section 6.04.020 Definitions of the Municipal Code of the Town of Vail is hereby amended by the addition of paragraph K to read as follows: K. Nuisance A dng shall be considered a nuisance if it soils, defiles or defecates on private property ether than the owner's or on public walks and recreation areas unless such waste is immediately removed and properly disposed of by the owner. Section 2. Section 6.04.190 Running at Large subparagraph A of the Municipal Code of the Town of Vail is hereby amended to read as follows: A. It is unlawful for the owner or keeper of a dog to permit his dog to run at large on any bikepath or public park located within the Town ar on any area located within the Town and described in Exhibit A as attached to and made a part of the ordinance codified in this Section and which can be found an file in the Office of the Town Clerk. Section 3. Chapter 6.04 Dog Regulations of the Municipal Code of the Town of Vail is hereby amended by the addition of Section 6.04.195 Nuisance - Owner Responsibility to read as follows: 6.04.195 Nuisance - Owner Responsibility No dog shall be allowed to cause a nuisance. The owner of every dog sha11 be held responsible should his dog cause a nuisance. ~.~ . ~.~ .. ,, ~~ . 5ectian 4. Section 6.04.203 Athletic Fields - Dogs Prohibited is hereby amended to read as follows: 6,04.203 Athletic Fields and Golf Courses - Dogs Prohibited It is unlawful for the owner ar keeper of a dog to allow his dog to be on or within one hundred (100) feet of any athletic field or golf course within the Tawn while any athletic event or activity is in progress, except that a dog may be within one hundred (100) feet of an athletic field or gnlf course while any athletic event or activity is in progress, if the dog is nn a public road or right-of-way. Section 5. Section 6.04.340 Violation - Penalty of the Municipal Code of the Tnwn of Vail subparagraph B is hereby amended to read as follows: B. Every person convicted of a violation of Section 6.04.190, 6.04.195, 6.04.200A, 6.04.201 and 6.04.300 shall have a minimum fine, part of which can be suspended, imposed against him according to the fallowing schedule. First cnnvictinn Second conviction $25.00 $50.00 Third and each subsequent conviction $75.00 Section 6. If any part, section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any.nne or~more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 7. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. Section 8. The repeal or the repeal and reenactment of any provision of the Vail Municipal Code as provided in this ordinance shalt not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nnr any other action or proceedings as commenced under ar by virtue of the provision repealed or repealed and reenacted. The repeal of any -2- i 1 f rr-, i provision hereby shall nat revive any provision or any ordinance previously repealed ar superseded unless expressly stated herein.
