1986-21 Amending Sections 18.22.050 and 18.39.080 Relating to Food & Beverage Cart Vending
,,~ .,. i ORDINANCE N0. 21 Series 1986 AN ORDINANCE AMENDING SECTIONS 1,8.22,054 OF THE MUNICIPAL CODE QF THE TOWN OF VAIL TO INCLUDE AS A CONDITIONAL USE FOOD AND BEVERAGE CART VENDING AND SECTION 18.39.084 QF THE MUNICIPAL CODE OF THE TOWN OF VAIL TO ADD FOOD AND BEVERAGE CART VENDING THAT MAY BE LOCATED OUTSIDE OF THE BUILDING IN THL SKI BASE/RECREATION ZONE DISTRICT. WHEREAS, Hi Ha Hotdag has submitted an application to amend Sections 18.39.D5O and 18.39.080 of the Municipal Code of the Town of Vail; and WHEREAS, under a conditional use permit process, each individual food and beverage cart vending proposal would receive a detailed review to insure its compatibility with the surrounding uses; and WHEREAS, the planning and Environmental Commission has unanimously recommended approval of this amendment to the Town Council; and WHEREAS, such amendment must be approved by the Town Council of the Town of Vail; and WHEREAS, the Vail Town Council considers that it is reasonable, appropriate, and beneficial to the Town and its citizens, inhabitants, and visitors to amend Sections 18.39.450 and 18.39.084. NOW, THEREFORE, SE IT ORDAINED BY THE TOWN COUNCIL QF THE TOWN OF VAIL, COLORADO, THAT: Section 1. Section 18.39.050, Paragraph A is hereby amended by the addition of subparagraph 11 to read as follows; 11. Food and Beverage Cart Vending Section 2. Section 18.39.080, Paragraph A is hereby amended to read as follows; A. All offices and retail sales conducted in the Ski Base/Recreation district shall be operated and conducted entirely within a building except far approved special events and food and beverage vending. Section 3. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the I Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid, Section 4. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. Section 5. The repeal or the repeal and reenactment of any provisions of the Vail Municipal Code as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under or by virtue of the provision repealed and reenacted. The repeal of any provision hereby shall not revive any provision ar any ordinance previously repealed ar superseded unless expressly stated herein, INTRODUCED, READ AND PASSED ON FIRST READING THIS 5th DAY OF August 1985, and a public hearing shall be held an this ordinance on the 5th day ' of August 1986 at 7:3fl p.m. in the Council Chambers of the ~~ Vail Municipal Building in Vail, Colorado.
