HomeMy WebLinkAbout1986-24 Amending Ordinance No. 29, Series 1977, Section 8, Special Provisions C2 ORDINANCE N0. 24 Series of 1986 AN ORDINANCE AMENDING ORDINANCE N0. 29, SERIES OF 1977, SECTION 8, SPECIAL PROVISIONS Cz, OF THE MUNICIPAL COOS OF THE TOWN OF VAIL TO EHCLUDE THE REQUIREMENT FOR A TOT LOT AND TO INCLUDE A REVISED SECTION 8 C 2 OF THE MUNICIPAL CODE OF THE TOWN OF VAIL TO ADD A RECREATION AMENITIES FUND CONTRIBUTION OF TEN THOUSAND DOLLARS. WHEREAS, U.A.P. No. 3, Incorporated, owners of the Simba Run project, have submitted an application to amend Ordinance 29 of 1977 of the Municipal Code of the Town of Uail to exclude the requirement for a tot int and to substitute a cash contribution which will be earmarked for general recreation improvements which will benefit the entire community; and WHEREAS, the planning and Environmental Commission has unanimously recommended approval of this amendment to the Town Council, and WHEREAS, such amendment must be approved by the Town Council of the Tawn of Vail; and WHEREAS, the Vail Town Council considers that it is reasonable, appropriate, and beneficial to the Tawn and its citizens, inhabitants, and visitors to amend Ordinance 29, Series of 1977. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF UAIL, COLORADO, THAT: Section 1. Ordinance 29 of 1977, Section 8 C 2 is hereby repealed and reenacted with amendment to read as follows: 8C2 Recreation amenities fund contribution of $10,000 to be used for general recreational improvements by the Tawn of Vail. Section 2. If any part, section, subsection, sentence, clause ar phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or mare parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 3. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Tnwn of Uail and the inhabitants thereof. .r! Section 4. The repeal or the repeal and reenactment of any provisions of the Vail Municipal Code as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any ether action or proceeding as commenced under or by virtue of the provision repealed and reenacted. The repeal of any provision hereby shall not revive any provisian or any ordinance previously repealed or superseded unless expressly stated herein. INTRODUCED, READ AND PASSED ON FIRST READING THIS 2nd DAY OF September 1986, and a public hearing shall be held on this ordinance an the 2nd day of September 1985 at 7:30 p.m. in the Council Chambers of the Vail Municipal Building in Vail, Colorado.
