RECORi~EFt 1~ VAIL RIDGE TO THE TOWiV OF VAIL, AND SETTING FORTH DETAiL.S IN REGARD THERETO. QC~ ~~ 4 ~~ ~ ~~~ WHEREAS, at least ten (lO} percent of the qualified electors who are resident in and landowners of the area proposed to be annexed, which area is situated in a county of less than twenty five thousand (25,000) inhabitants filed the petition for an annexation election with the Town Clerk of the Town of Vail, Colorado which was referred to the Town Caunci] of the Town of Vail an July 15, 1986, in accordance with Section 31-12-107(2), C.R.S., as amended; and WHEREAS, the Tawn Council of the Tawn of Vail received said petition from the Town Clerk an July 15, 1986 and by Resolution No. 19, Series of 1986, adopted at its regular meeting on Juiy 15, 1986 found the same to be in substantial compliance with Section 31--12-507{~), C.R.S., as amended and further found that the Town Council of the Town of Vail had the necessary jurisdiction to commence proceedings far an annexation election regarding said area; and ~lHEREAS, as directed by Resolution No. 19, Series of 1986, and in accordance with Section 31-12-108, C.R.S., as amended, the Town Clerk of the Town of Vail, Colorado gave notice of a public hearing to be held on the petition for an annexation electinn to determine if the petition complied with Sections 31-12-104 and 31-12-105, C.R.S., as amended, to establish whether or not said area was eligible far annexation under the Municipal Annexation Act of 1965, as amended; and WHEREAS, on August 19, 1986, the Tnwn Council of the Tawn of Vail, Colorado held a public hearing in accordance with Section 31--12--109, C.R.S., as amended, to determine if the area proposed to be annexed met the applicable requirements of Sections 31-12-104 and 31-12-105, C.R.S., as amended, and is considered eligible for annexation; and WHEREAS, after the completion of said hearing and on the basis of competent evidence presented in said hearing the Town Council determined that the applicable provisions of the Municipal Annexation Act of 1965, as amended, had been met and that an annexation election was required under Section 31--12-107(2}, C.R.S., as amended; and WHEREAS, the Town pursuant to Resolution Na. 21, Series of 1986, and Section 31--12-1.12(3}, C.R.S., as amended, petitioned the gistrict Court in and for Eagle ~ . • County to hold an annexation election in accordance with the applicable provisions of Section 3i-12-1I2, C.R.S., as amended; and WHEREAS, the Court entered an order for an annexation election directing that the election be held on September 30, 198, and appointing three (3} Election Commissioners to call and hold the election; and WHEREAS, the annexation plat which was approved by Resolution No. 21, Series of 1986, is incorporated by reference herein and made a part hereof; and WHEREAS, an election was duly called by the Election Commissioners to be held an the 30th day of September, I98b between the hours of 7:OQ a,m. and 7:00 p.m. at a polling place situated at the Warren residence in the Vail Ridge area proposed to be annexed described in Exhibit A hereof; the notice of the election was published in the Vail Trail, a newspaper having a general circulation in the area proposed to be annexed once a week for four (4} weeks and was posted at the polling place said first publication and posting occurring more than four {4} weeks preceding the election; and WHEREAS, in the annexation election held on the 30th day of September, 1986, seventy two (72) proper ballots were cast by those qualified to vote in said election of which there were seventy one (7I} votes for annexation and one (1.) vote against annexation, as indicated in the certificate of election results which is incorporated by reference herein and made a part hereof; and WHEREAS, on the 1st day of October, 1986, the District Court entered an order authorizing the Town to annex without special terms or conditions the area proposed to be annexed as set forth in Exhibit A attached hereto. NOW, THEREFORE, SE IT ORDAINED by the Town Council of the Town of Vaii, Colorado, as follows: Section I. Annexation of the Area Commonly Known as Vail Ridge to the Town. In accordance with the order of the District Court entered in Civil Action Na. 86 CV 428 on the 7th day of October, 1986, the Town of Vail, Colorado hereby annexes without special terms or conditions the area commonly known as Vail Ridge, County of Eagle, State of Colorado, described in Exhibit A hereof. Section 2. Annexation Costs. All costs and expenses connected with the annexation election shall be paid by the Tawn of Vaii, Colorado. _2- s ~ . • Section 3. Filing Copies of the Annexation Plat and Annexing Ordinance. R. A copy of the annexation map with the original of this annexation ordinance shall be filed in the Office of the Town Clerk of the Town of Uail. 6. The Town Clerk shall file for recording two {2) certified copies of this annexation ordinance and a map of the area annexed containing a legal description of such area with the County Clerk and Recorder of Eagle County, Colorado. C. The County Clerk and Recorder of Eagle County shall be directed to file one (1) certified cagy of the annexation ordinance and map with the Division of Local Government of the Department of Local Affairs. Section 4. Within ninety {90) days after the effective date hereof, the Town of Vaii, Colorado shall impose zoning on the annexed area in accordance with Chapter 18.68 of the Municipal Code of the Town of Vail, Colorado. Section 5. This annexation shall take effect in accordance with the Charter of the Town of Vail and the Statutes of the State of Colorado. INTRODUCED, READ AND APPROVED ON FIRST READING THIS 7th day of October 1986, and a public hearing shall be held on this Ordinance on the 7th day of October , 1986 at 7:30 p.m, in the Council Chambers of the Uail Municipal Building, Uail, Colorado.
