Dear Mr. Staufer;
On March 3, 2009, David Rhoades, Fire Inspector, and I had occasion to be on site to conduct an
inspection in the vicinity of the overhead door for passenger vehicles in the parking garage of what has been
referred to as Phase 3 of the Vail Village Inn (WI). While on site, the door from the loading dock to the alley
behveen the Vail Plaza Hotel and the Vail Village Inn Condorrainium Association (VVI) building was found io
be electrically tied in with the overhead door into the WI garage. When one door opened, so did the other.
As a result, I observed what appeared to be an unmarked pedestrian door imnzediately adjacent to the
overhead door for the Vail Plaza Hotel. No exit sign was found over the pedestrian door from the loading
dock to the alley.
The overhead door for the Vail Village Inn and the overhead door for the Vail Plaza Hotel are not
lined up to provide the full width for a passenger car to travel through. I walked into the loading doek of the
Vail Plaza Hotel a distance to turn and get a perspective to see if the net opening seemed reasonable. While
turning to assess the net opening, I observed an Exit sign over another set of doors inside the Receivircg area
and another one over a single door. The single door had a paper sign taped to it which indicated the door was
not an exit.
In addition, I observed the overhead door for the WI had been installed on the exterior of the wall of
the WI parking garage. The door controls, rriotor housing, and safery features were inaccessible from the
garage. The door was intended for interior use.
I also noticed a pedestrian door just south of the new overhead door. This door is marked as an exit
and appears to be the second exit from the garage at that leve� The door opens into an alley way.
� The alley way runs approximately south along the exterior of the garage wall. At the end of the
garage wall, we found a"pinch point" where the exit width of the alley is approximately 33 inches wide.

Given there currently exists an exit door from the Vail Plaza Hotel and an exit door from the Vail
Village Inn exiting into this narrow alley, it appears the alley is too narrow to meet minimum requirerrcercts
under the Building Code.
As I followed the path from the WI garage exit through the alley, I noticed there is a ramp down to
the next level of the plaza. The ramp appears to be on Vail Plaza Hotel property. No handicapped accessible
ramp currently exists on WI property.
I also observed that the steps on the WI plaza are severely worn. The toe tread is worn away for most
of the wooded timbers. I observed stairs that were not equipped with handrails, loose pavers that present a
trip� �hazard, and pooling of water from snow rr�elt, indicating settling of the pavers and poor drainage.
I did not find a handicapped accessible route from the WI plaza to East Meadow Drive.
As a result, I contacted Chief Buildi�zg Official Martin Haberle and asked for his assistance in
assessing not only the code violations associated with the WI overhead door but also the apparent lack of
legal pedestrian exiting from both the Vail Plaza Loading Dock and the VI garage.
On March 4, 2009, I accompanied Martin Haberle and Nicole Peterson, a planner from the Town of
Vail Department of Community Development to the site. During our visit, a member of the Vail Plaza Hotel
engineering staff greeted us and escorted us to the receiving area and showed us where the double doors lead
and where the single door lead.
We also walked through the WI garage (the overhead door was found open) to the secortd pedestrian
exit onto the plaza. �
We reviewed the approved plans for permit B04-0252, the base permit for the Vail Plaza Hotel, and
found several discrepancies between what was approved and what was built, both in relation to the alley and .
the exiting from the loading dock.
The property line between the Vail Plaza Hotel and the WI presents significant challenges with
respect to resolving the code violations. The close proximity of the Vail Plaza Hotel and the WI suggests
both properties will need to work together to resolve the issues. � Vail Village Inn's exit door frorrl the garage
appears to open onto the adjacent property.
It will be neeessary to involve a registered or licensed design professional. There is not a prescriptive
solution reasonably available. I suggest any solution will be performance basec�
Due to the nature of the violations, specifically failure to build according to the approved plans, a
notice has been placed on the building permitprohibiting a Certificate of Occupancy urttil such time as the
violations have been resolved. The exiting pattern in the loading dock does not appear to be so nzuch a design
issue as it relates to the original design but an operator caused problem or at least aggravated by the operator.

Under the Town of Vail Municipal Code, Title 10, Chapter 1, Section 10-1-2 B, International Fire
Code, Chapter 10, Means of Egress, Sections 1003, 1005,1006,1011,1013 —1015,1017 —1018,1023, and
1027, pursuant to IFC Chapter 1, Adrriinistration, Sections 107,109 and 110, Vail Plaza Hotel aka Daymer
Corp. NV, is hereby ordered to:
1. Present to the Town of Vail Building Department and Vail Fire & Emergency Services a plan
developed by a registered Fire Protection Engineer and/or licensed Architect, showing a code
compliant exit plan from the Vail Village Inn parking garage, including trave[ distances, occupant �
loads, door placement and door swing, the required fire rating of the door, exit lighting and related
elements, within 30 days of this notice. Plans shall be stamped.
2. A Town of Vail Building Permit will be required for relocations or changes to the building or

components thereof.
Once a permit has been issued, work shall commence immediately thereafter and shall be corrlpleted
within 1 S working days of the date the permit was approved
Within 60 (si.xty) days of receipt of this rtotice, present to the Town of Vail Building Departinent and
Vail Fire & Emergency Services a plan developed by a registered Fire Protection Engineer andlor
licensed Architect, showing a code corrlpliant or performance based design/plan to provide adequate
exit width through the alley to a public way. In that the access to a public way will require travel on
and through adjacentproperty, such plart shall indicate the limits of Vail Village Inn's (et.al.) property
line and identify any easements or elements requiring a joint agreement or other legal instrurrient(s)
necessary to accomplish the goa� Copies of such executed agreements and easements shall be
subinitted with the plan.
S. In the event no easements or agreements can be executed within 60 (sixty) days of receipt of this
notice, Vail Village Inn, Irtc. et. al. shall sub�nit an alternate plan to meet the intent of the Building
Code and Fire Code as adopted by the Town of Vail. Such plan should reflect solutions that can
actually be executed without participation of adjacerct property owner(s).
6. Submit a detailedplan indicating deviations frorrt approvedplans and identify rerr�edies that comply
with the intent of the originally approved plans for review by the Department of Corrcrrtunity
Development. Proposed changes to the approved plans are subject to review as determined by the
Department of Community Development.
Failure to subnzit plans in compliance with either Item 4 or S as listed above, may result in remedies
provided under law, including but not lirrtited to the issuance of a Summons to Appear in the Town of Vail
Municipal Court and/or the revocation of any Temporary Certificate of Occupancy.
