What is your work history from the last five (5) years?
I have been active on the West Vail Master Plan citizen committee. I was a neighborhood advocate for the
new West Vail Multi Family zone district. I am the sole proprietor of Ascential Properties L.L.C. And JB
Construction and Design L.L.C. Ascential Properties provides management services for 7 long term rental
units I own in Vail Co and an 11 unit apartment complex in Wheat Ridge Co. I also own JB Construction
and Design LLC as sole proprietor. JB construction and design was incorporated in 9/21. Since this time, I
have worked on various construction sites in the Vail Valley. Since I am in the design, planning and
approval stages of my Chamonix ln project most of my work is unpaid. When (hopefully this year)
construction begins I will be working at least 30 hours a week during construction. Along with my property
management duties. I also worked In Saipan for a total of 7 weeks for a volunteer group under the FEMA
umbrella rebuilding homes destroyed by typhoons.

Why are you interested in serving on this board?
I want to keep our town vibrant and sustainable. Many of the homes and buildings in Vail are now
reaching the end of their useful life and are becoming expensive to heat, maintain, do not have proper
egress, and have many design deficiencies and are built with highly combustible materials. There is an
opportunity now to encourage new development to use more energy efficient, fire resistant, and eco
friendly designs.

• What unique and particular qualifications do you bring to the position? Please provide
specific examples.
I served on several HOA's that had multi million dollar construction defect lawsuits.The board had to
oversee and manage years of litigation and then manage the years long repair process. I have owned
various properties in West Vail since 1996. I was a member of the WVMP community advisory committee.
The WVMP community advisory committee formulated the the master plan that was adopted by town
council. I was a member of the Chamonix Parcel community advisory committee. This committee led by
Scott Hunn The plan that this committee sent to and was approved by town council called for 58 units to
be built on the Chamonix parcel.
What is your experience serving on other Boards?
I was a member of the WVMP community advisory committee. The WVMP community advisory

culture of mutual respect that makes progress possible. We must rise above the fray and reach beyond
comfort zones and be capable of working closely with those with whom we do not always agree. I have
this experience from the many and various boards and committees that I have served on.
What do you see as the primary role of this Board?
To be a voice of moderation. Being on this board is an act of service to the public, not just to those who
share your views but to all the residents of Vail.
What do you believe is the largest obstacle facing this Board in 2024?
Maintaining a realistic approach to enacting new rules and regulations regarding sustainability and
greenhouse gas emissions.

Vail is a small community, and everyone seems to know each other in one form or another.
Please describe your abilities to act in a quasi-judicial role and provide at least one example
where you had to make an unpopular decision on an issue based upon a set of criteria or
other certain considerations.
Being on the board and president of the HOA I had to make many decisions that were unpopular with my
neighbors. Most of these examples would be design issues with their home such as paint colors, fences,
additions, special assessments and parking issues to name a few.

To Whom It May Concern:
The reason I am interested in becoming a member of the PEC is that I want to keep our town
vibrant and sustainable. Many of the homes and public buildings in Vail are now reaching the
end of their useful life and are becoming expensive to heat, maintain, do not have proper
egress, and have many design deficiencies and are built with highly combus�ble materials.
There is an opportunity now to encourage new development to use more energy efficient, fire
resistant, and eco-friendly designs. There are also many new opportuni�es to adopt greenhouse
gas emission public policies. These new programs will increase the already high cost of building
and add to the already extremely complicated, �me consuming and expensive permi�ng
process. We need to come up with a program that works for Vail. This is why I want to become a
member of the PEC.

Why are you interested in serving on this board?
I love Vail. I have never enjoyed living somewhere as much as Vail. I remember traveling to Vail from
Minnesota as a teenager to ski in the winter. I moved to the Vail Valley part time in 2005 (as soon as I
could) after I began my career as a lawyer in Chicago. I moved to Vail full time in 2019 to help my son
chase his dream of one day being on the US Ski Team. During and after the pandemic, I observed that
interest in living in Vail increased dramatically. Combined with the increased capacity of the Vail Ski Area,
we are at an important point in the continued development of Vail. Because of my love of Vail, I would like
to have an active role in the protection of the Vail area and, if possible, have a voice in the sustainable
development of Vail. I would like to use my time to assist in helping to ensure that new developments and
re-developments in Vail maintain the beauty and grandeur of Vail, and do not cheapen the experience for
Town residents and visitors alike.

• What unique and particular qualifications do you bring to the position? Please provide
specific examples.
Twenty-five years practicing as a lawyer. Twelve years of HOA Board experience in Beaver Creek (600
owners, $10M annual budget). I understand that work on the PEC involves the application of rules to
particular sets of facts. That is what my job as a lawyer has involved for 25 years. I also understand that
work on the PEC can involve making exceptions or changes to rules to suit particular facts. Again, that is
the role of a lawyer–to argue that exceptions to rules or changes to rules should be made in particular
circumstances. I have served on committees at both my law firm and for my Beaver Creek HOA. That
experience has helped me to understand the proper role of committees to a primary governing body, and
best practices in connection with the same.
What is your experience serving on other Boards?
I served on the Board of a Beaver Creek HOA (600 owners, $10M annual budget) for twelve years,
including as President and Treasurer. I have served on the Board at my law firm since 2007 (sixteen
years). I have served on the Board of Visitors for the Astronomy Department at the University of
Wisconsin-Madison since 2009.
What skills and experiences do you have to advance the mission of the Board?
My experience as a lawyer will help me apply rules to particular applications, proposals, or sets of facts
that come before the PEC. My experience as a lawyer will also help me to (a) spot issues that may not be
readily apparent, and (b) make sure the PEC “dots all the Is” and “crosses all the Ts” with respect to its
work. Also, I have been involved in hiring (via a committee) for over 15 years. In that capacity, we
consider the applications of potential candidates and evaluate them against criteria that have been
objectively set in advance. My experience on an extensive HOA will prove to be helpful, for multiple
reasons. First, we established objective criteria and policies for many decisions made by the HOA Board
(as required by Colorado law, which was significantly updated/revised while I was on the Board). We then
applied those criteria to many decisions regarding individual owners, without fear or favor. Instead of “one
off” decisions, I would always try to make sure the criteria was considered and applied consistently, lest
our Board be considered to be inconsistent or not in compliance with its own standards and criteria.
Second, I have personally witnessed the difficulty in hiring people who live far away from Vail or Beaver
Creek to provide physical labor in a resort community. On that HOA Board, we had hiring and
transportation issues for such employees and we even worked with the neighboring hotel in an attempt to
transform existing space into possible workforce housing (an effort that ultimately proved unsuccessful).
What do you see as the primary role of this Board?
I see the primary role of the PEC as (1) providing recommendations (including Plans) to the Town Council
regarding physical development of, and improvements to, the Town and to assess the environmental
impact of such recommendations and other options, including by applying existing zoning ordinances and
regulations or suggesting recommended changes thereto, (2) deciding individual planning applications
and related applications, including development plans and variance requests, and (3) deciding appeals
over which the Board has jurisdiction. By "environmental impact," I mean not only the expected impact on
the natural environment, but also the "fit" of developments within Vail's natural beauty, as well as the
beauty of existing developments within the Town of Vail.
What do you believe is the largest obstacle facing this Board in 2024?
In general, updating or implementing the portions of the West Vail Master Plan that will most greatly
benefit the Town of Vail and its residents, either through recommendations to the Town Council or in
ruling on individual applications. More specifically, assuming that the current Housing (H) Zone District is
amended to create a new Housing Two (H-2) Zone District, using the PEC's best efforts to ensure that
new properties in West Vail improve the ability for newly planned, multi-unit housing to accommodate
Vail's workforce without sacrificing aesthetics or the look and feel of the Town of Vail.

Do you have any conflicts of interest that may arise due to your employment, personal

I do not believe that I have any conflicts. Nevertheless, out of an abundance of caution, I answered yes to
this question because I am a landlord within the Town of Vail for a duplex. We typically rent the duplex to
long-term tenants, but at times we will rent it to short term guests. I therefore have a short term rental
license for the duplex. I actually believe that my experience in being a landlord, and in renting to short-
term guests from time to time, will prove to be an asset if I am asked to serve on the Board.

Please describe your abilities to act in a quasi-judicial role and provide at least one example
where you had to make an unpopular decision on an issue based upon a set of criteria or
other certain considerations.
I am very able to act in a quasi-judicial role based on my 25 years of experience as a practicing lawyer. In
my experience as a lawyer, I am very accustomed to, and adept at, separating personal feelings from
professional judgments. I am very accustomed to avoiding improper, ex parte communications between
decision-makers and those who have business before, or otherwise appear before, decision-makers. I
have had to make an unpopular decision several times. One example that sticks out is when the HOA
Board chose appliances for an HOA in Beaver Creek while I was on the HOA Board. At a basic level,
there were Level 1, 2 and 3 appliances, with 3 being the highest price and highest quality. Level 3 was
going to be the original choice (brand standard) when the building was built in about 2000-2001. At the
last minute, the brand standard for the management company was lowered, such that Level 2 was the
standard. So Level 2 was installed at the time of construction. By the time of a refurbishment, it was no
longer required to comply with the brand standard for our management company. Our Board was 4-1
against me to move to Level 1 during a refurbishment. I did my homework, I learned the background of
the original decision, and I gave forceful explanations as to why we should move to Level 3, as was
originally intended. Ultimately, my objections caused a typically 2 hour meeting to go 5 hours and we
ultimately compromised (during that meeting) on Level 2, with a 5-0 decision.

I typically make my own schedule. I will have good availability on the second and fourth Mondays of the
Month. I do teach a class online in the evenings on Mondays from January to April (which I typically teach
remotely). Because I teach remotely from Vail, this does not present a direct conflict with my availability
for PEC meetings. In the unlikely event that a conflict ever did arise, I could have one of my partners
teach the class.

SUBJECT:Dobson Ice Arena Remodel Project Schematic Design Update
I.SUMMARY
The purpose of this item is to:
Provide Town Council with the Schematic Design update, including review of the
plans that have evolved from the Conceptual Design program level.
Provide Town Council with an update on Construction Manager/General Contractor
(CM/GC) selection process to date.
Review the project budget with Owners Representative.
Update the Town Council on next steps regarding the project.
II.BACKGROUND
On July 18, at the joint meeting of the Vail Recreation District (VRD) and Vail Town
Council, project design elements, budget, and funding were discussed.
The project team and staff returned to the Vail Town Council on August 4, 2023, to
address concerns as well as provide solutions to issue brought forward. At this meeting,
the Vail Town Council directed staff regarding the program elements component of the
conceptual design of the Dobson Arena Project, and set an overall project budget of
$55,391,124.
On August 18, 2023, the Vail Town Council awarded a design contract to Populous
Architects for the Dobson Arena Remodel project. The first phase of the design scope was
to develop the conceptual design program into a schematic design package for the project.
On October 18, 2023, the Town of Vail issued a Request for Qualifications for CM/GC
(Construction Management/General Contractor) services for the Dobson Arena Remodel
Project.
On November 17, 2023, the Town shortlisted the RFQ responders to four General
Contractors:

Schematic design is the process of working through all the various design disciplines and
developing a set of plans based on dimensions and specifications and codes to ensure the
program elements and spaces agreed to be included during the conceptual design phase
fit together and can be built. The schematic design lays out rooms and spaces in much
greater detail to ensure the project is sound both in function and form regarding codes,
building assemblages, and the expectation of overall building’s program performance.
On November 21, the design team presented to the Recreation Subcommittee in detail, to
review progress of the schematic design package. The Recreation Subcommittee, which
includes two Town Council members and two Vail Recreation Board members, agreed the
project is delivering on what was approved at the conceptual level.
The design team, owners’ representative team, and staff from the Vail Recreation District
and the Town have been working over the last 3 months in progressing the design as part
of the schematic design process and are at a point to report back to the Town Council
regarding this effort.
III.DOBSON ICE ARENA REMODEL PROJECT APPROVED CONCEPTUAL DESIGN
PROGRAM COMPONENTS
The program for Dobson includes:
New roof structure
New Mechanical, Electrical and Plumbing Systems
Six New Locker Rooms and Two Official Locker Rooms to address equity issues.
Code-required restroom fixture counts to meet the capacity of the arena.
New south entry
New west Main entry
New second floor lounge/concession flex space
New skate rental shop
New south side seating
Completion of the Concourse around the whole ice service
New Mezzanine Level to include fixed and standing room only view space.
Plaza and streetscape improvements
Loading Dock and Storage improvements
In the end, the arena and the amenities will greatly enhance the user experiences, from
those who use the arena on a daily basis to the community members, guests, and visiting
spectators who attend the many games, concerts, and special events held at the arena.

V.NEXT STEPS
If the Town Council can provide direction regarding the schematic design program, this
then completes the schematic design phase. If there are concerns or items which still need
to be addressed, once we have the schematic design package competitively priced in the
market, we will return to the Town Council with reconciled pricing to move forward with
selection of the Construction Manager/General Contractor, as well if the project would
need to be adjusted relative to the budget.
The design team will further research and work through minor design details which have
been identified, but will not dive deeply into the design development phase, which will
include the entitlement process of Planning and Environmental Commission and Design
Review Board submittals and review, until the project budget and schedule has been
tested in the market.
The project design team met December 4, 2023, with the Art in Public Places Board to
introduce the project to the board and begin to discuss Public Art opportunities with the
project.
The project team intent is to return to the Town Council in the February time frame to
report out the pricing results, seek guidance in the final Construction Manager/General
Contractor recommendation for award, and seek approval to move to the Design
Development and Entitlement phase.
VI.ACTION REQUESTED
Request the Town Council to confirm the schematic design continues to meet the
design objectives outlined at conceptual level, and these objectives continue to
drive the overall design program.
Request the Town Council approve issuance of a Request for Proposal to the four
shortlisted General Contractors in regards to providing CM/GC services for the
Dobson Arena Remodel Project as presented in the Schematic Design update.

The Vision
Dobson Arena has evolved over the years from a pond, to a pond with stands to an
ice/events arena that has seen relatively minor updates over the years.
The Dobson Arena is a key component to the fabric of the Vail Community hosting a
rapidly growing sports community anchored by Ice Hockey as well as an event space for
key community events for over 40 years.
The facility is in dire need of an upgrade to bring the Mechanical, Electrical and Plumbing
up to code and current sustainable performance requirements
The facility must be able to function well for the next 50 years offering improved access,
bathrooms and amenities for patrons and the facility must be upgraded structurally to
ensure a responsible lasting update.As well, this plan must consider that the Dobson
will serve the community well into the future.

4.0% General Sales Tax
Upon receipt of all sales tax returns, October collections are estimated to be
$1,645,645, down (4.9)% from last year and up 3.4% from the amended budget.
YTD collections of $34,081,438 are up 2.4% from this time last year and up 2.7%
from the amended budget. Inflation as measured by the consumer price index was
up 3.2% for the 12-months ending October 2023. The annual amended budget
totals $40.1 million.
0.5% Housing Fund Sales Tax
Upon receipt of all sales tax returns, October collections of the 0.5% housing sales
tax are estimated to be $197,617, up down (4.7%) from last year and up 3.6% from
the amended budget. YTD collections of $4,132,649 are up 2.0% from this time
last year and up 2.6% from the amended budget. The 2023 amended budget for
the housing fund sales tax totals $4.9 million.
Real Estate Transfer Tax (RETT)
RETT collections through November 27 total $7,448,984, down (20.0)% from this
time last year. The 2023 RETT proposed amended budget totals $7,600,000.
Construction Use Tax
Use Tax collections through November 27 total $2,105,451 compared to
$1,978,061 from this time last year. The 2023 proposed amended budget totals
$2,200,000.
Lift Tax
2023 YTD lift tax collections through October total $5,076,951, down (1.8)% or
$(91,838) from the same time last year. The 2023 amended budget totals
$6,234,550.
Parking Passes
Early season parking pass sale revenue through November 27 totals $1,007,045,
down (11.3)% or $(128,175) from this time last year. A total of 1,103 passes have
been sold this year. A detailed breakout of 2023/24 passes sold by type is provided
in the chart below:

The Vail Business Review breaks down the 4.5% sales tax collected for the month of
September and year to date through third quarter 2023. The 4.5% sales tax includes
the town’s general 4% sales tax and the 0.5% housing sales tax supported by Town of
Vail voters during the November 2021 election, effective January 1, 2022. The housing
sales tax sunsets on December 31, 2051.
September 4.5% sales tax was up from the prior year 2.7%. Retail increased 3.9%,
lodging decreased (0.9%), food and beverage increased 4.8%, and utilities/other
increased 3.4%. Excluding the out-of-town category, sales tax for the month of
September was up 0.5% compared to prior year.
January through September (YTD through Q3) 4.5% sales tax was up from the prior
year 2.8%. Retail increased 2.3%, lodging increased 1.2%, food and beverage
increased 4.1%, and utilities/other increased 12.1%. Excluding the out-of-town category,
sales tax for January through September was up 2.6% compared to prior year.
