The purpose of my letter is to respond to the three concerns identified in your letter as they relate to the Vail Mountain View Development. First, with regard to the lack of notice, the development application submitted and reviewed for the development of the project was a design review application. As such, the Town of Vail Design Review Board held public hearings and conducted their review in accordance with the adopted procedures for the application type. That said, I understand the concerns expressed by the Association and will consider the them in light of the development review process amendments the Town of Vail Community Development Department is currently preparing for Town Council review. Second, the Association may be correct in their belief that the Town Code is vague with regard to the interpretation of an underground parking structure. In the case of the Vail Mountain View development, the Town of Vail Design Review Board, upon a thorough and complete review of the design review application, determined that the proposed development complied with both the intent and the prescribed design guidelines within Chapter 11, Design Review, Vail Town Code. Again, the Association's concerns and input on this matter are duly noted and will also be considered as part of the development review process amendments currently underway. Third, the Association is correct in their understanding that the underground parking structure was "over-engineered" and constructed in a manner that could support a future residential building. With that in mind, any future residential development on the Vail Mountain View site will require adjacent property owner notification. While I can not obligate the Town to notice provisions beyond the legal requirements of the adopted Town Code, I will commit to place a memorandum in the Vail Mountain View s~• RECYCLED PMER
