This application is for all changes to approved plans prior to Certificate of Occupancy. An Application for Design Review cannot be
accepted until all required information is received by the Community Development Department. Design review approval lapses unless
a building permit is issued and construction commences within one year of the approval.

Dear Warren:
The Architect requests that the Town of Vail Design Review Board, or planning staff on behalf of the
Board, consider and accept the following requested Changes to Approved Plans for the
aforementioned property.
The requested changes include the following as illustrated on the plans, elevations and perspectives
included herein:
West Elevation.
• Reduce the width of both stone columns supporting the second floor deck & roof.
• Eliminate large circular light fixtures on 3 columns and substitute a smaller fixture with a
downlight.
• Extend northmost column up to include a new "chimney" form mirroring the south column &
chimney.
• Modify ground level railing to match grade, sloping down from south to north.
• Modify glass entry door at south-west corner, first floor.
• Modify storefront window system from 3 glass panels to 4 panels.
• Add stone planter above stairway to basement tenant at south-west corner grade level
entrance.
• Modify supporting wood corbels at several locations.
• Narrow deck at North-west corner of second floor and extend stone on elevator shaft
enclosure. Modify top of elevator shaft.
• Eliminate sign panels pending comprehensive sign plan for the building and individual tenant
sign requests.
South Elevation.
• Modify stone columns supporting second floor deck and roof/chimney by introducing an
arched opening at deck level.

my unit.
The HOA had approved the original location of the ski lockers. In a meeting July 3, 2008
with Jeff Selby, Margo Swain and myself, Mr. Selby ask that to relocate the lockers. This
request was denied. The town should not have over rode the actions of the HOA at the
request of the developer.

The issues are:
1. That the new locations for the ski lockers will prevent me from any expansion of
my unit.
2. There was no approval by the HOA to this relocation of the ski lockers.
3. That the September 29, 2007 Rucksack Condominium Association Resolution
that approved Selby's project indicated in paragraph lc that the HOA needed to
approve all changes. There was no approval.

Submittal Requirement #1
The new location of the ski lockers will prevent me from exercising my right to expand
my unit.
The HOA had approved the original location of the ski lockers. In a meeting July 3, 2008
with Jeff Selby, Margo Swain and myself, Mr. Selby ask that to relocate the lockers. This
request was denied. The town should not have over rode the actions of the HOA at the
request of the developer.
Submittal Requirement #2
I am unaware of any town codes that are involved.
The issues are:
1. That the new locations for the ski lockers will prevent me from any expansion of
my unit.
2. There was no approval by the HOA to this relocation of the ski lockers.
3. That the September 29, 2007 Rucksack Condominium Association Resolution
that approved Selby's project indicated in paragraph lc that the HOA needed to
approve all changes. There was no approval.

Bill- Unfortunately I cannot extend the appeals period, as it is clearly stated in the Vail Town Code, and would be rejected
from the Town Council agenda because of the submittal date. As for the sprinkling issue, I understand that you will be able
to use your units during the year that they are not sprinklered. I will confirm this with fire and get back to you. Mike- Can
you confirm whether the residential units in Rucksack will be able to use their units prior to installation of sprinkler systems?

Rachel,
Since I was not notified of your decision until the conversation we had
on the 25 of November. I ask you to reconsider. If you read the document
that Mr. Selby used to get town approval for the project you will see
that he is required to notify and receive approval for all changes. This
was not done.
In addition I am requesting that I am notified of any and all
actions concerning this project. I have just learned that the town is
allowing Mr. Selby 1 year to sprinkle the Ri and R2 units. This is
unacceptable to me and Margo Mullally. There should be not issuance of a
TCO until this is complete. We are being deprived from using our units
while he pushes his project forward.

Bill- The staff approval became final at the November 19, 2008 Design
Review Board meeting. Appeals must be filed within 20 days of that
decision becoming final. Unfortunately, it is too late to file the
appeal, as the decision was made final 22 days ago. Please let me know
