It is the Red Lion Condominium AssociatioA's w Iderstanding that you wish to erect a staging area located in theഀ
pocket park between the Rucksack Building and t he Red Lion Building. 'ഀ
The Association approves the staging as you have outlined with certain understandings:ഀ
I ) There will be access to our commercial te;;asht, The Ski Bar, and their business signage and awning willഀ
not be obstructed from the public view,ഀ
2) There will be easy access for the residents, d unit above The Ski Bar,ഀ
3) If any damage occurs to our propeM or to. 'ants' business during the construction/staging process,ഀ
Highland Builders will be held liable, andഀ
4) All conditions of staging have been apprex ed by the Town of,Vail. _ഀ

286 Bridge Street, Inc. approves the following Staging Agreement:ഀ
1) Highland Builders Corp. will provide a 4'-0 access to all commercial andഀ
residential tenants, invitees and licensees at the A & D Building, 286 Bridgeഀ
Street, Vail, CO ("A & D Building) at all times during the construction.ഀ
2) If any damage occurs to A & D Building property or the property of an A & Dഀ
tenant during the construction / staging process, Highland Builders will be heldഀ
liable and Highland Builders will indemnify the damaged party. Highlandഀ
Builders will liable and will indemnify and hold harmless 286 Bridge Street,ഀ
Inc. for any personal injury that may occur in the staging area during theഀ
construction. Highland Builders shall also list 286 Bridge Street Inc. as a co-ഀ
insured on its builders risk insurance policy.ഀ
3) All conditions of staging will be approved by the Town of Vail and the Fireഀ
Department for all emergency exits.ഀ
4) No overnight staging. Staging will be used for only temporary drop off andഀ
delivery to the Bridge St. Building. No construction shall occur in the stagingഀ
area.ഀ
5) Staging will only occur through September 1, 2008.ഀ
6) 4' tall traffic barricade will be placed 4' from the A & D Building.ഀ
7) North East corner tree will be remove and replaced at no expense to the 286ഀ
Bridge Street, Inc. by the same type of tree and a tree of equal or greater size.ഀ
8) Highland Builder's Corp. shall be allowed to construct or modify the followingഀ
items which are set forth on the building permit set of plans.ഀ
a) A gate between the A&D Building and the Burton Snowboard Shop.ഀ
b) The gutters and downspouts on the A&D Building which currently flowഀ
unto the roof of the Burton Snowboard Shop.ഀ
c) A bathroom vent on the A&D Building.ഀ
d) A reduction in length of a stone wall up to 4 feet in length located on theഀ
southeast corner of the A&D Building.ഀ
9) Highland Builders agrees to discuss with 286 Bridge Street, Inc. the mostഀ
efficient manner to accomplish the matters set forth in paragraph 8 herein.ഀ
