General Information: This application is required for all proposals involving the addlition of any 11CRI
net floor area and/or gross residential floor area (GRFA). This also includes proposals for'residential 250 additions' and
'interior conversions'. Applicable Vail Town Code sections can be found at www.vailgov.com under Vail Information -
Town Code Online. All projects requiring design review must receive approval prior to submitting a building permit ap-
plication. An application for Design Review cannot be accepted until all required information is received by the Commu-
nity Development Department, as outlined in the submittal requirements. The project may also need to be reviewed by
the Town Council and/or the Planning and Environmental Commission. Design review approval expires one year from
the date of approval, unless a building permit is issued and construction commences.

I have been notified that you are designing an addition at the above referenced property
involving an addition of approximately 385 square feet to each unit. Additional Tap Fees
may be due to Eagle River Water & Sanitation District, however I don't believe that will be
the case on this project.
Please supply the following to the District within 30 days after the Design Review Board
approval so that we may ascertain if additional tap fees are indeed due:
• Copy of the floor plans for the addition in AutoCad - dwg file
Copy of the Eagle County Building Permit.
For your review, the District's current Rules and Regulations are accessible on our website
at erwsd.org.
I have also attached a New Account Checklist to help guide you through the paperwork for the additions. I will
need the floor & site plans e-mailed in AutoCAD to me for measurements (we cannot measure from the pdfs
that you e-mailed), and the Residential Assessment form completed & returned to me along with a copy of the
building permit. We will continue to stay in touch throughout the project so that if you have any questions, I will
be familiar enough with the project to answer any questions or put you in contact with someone here at the
District that can.

Scope of work:
One story and basement to be added to the back of both units on the North side of the
town homes.
As per Community Development Department memorandum dated 05/14/2007 each unit
is allowed to add 616 sq. ft GRFA per unit.
Main floor in this case is 352 sq. ft.
Lower floor to add 35.2 sq. ft. = 10% of exposed wall of lower floor.
Total area added per unit is 387.2 sq. ft.
Color scheme
Roofing and siding to match existing.
Window trim to match existing.

Scope of work Unit # 3
All windows and doors to be replaced with the same, type, size and color, upgraded to
current trends and high energy efficiency.
North side addition
• new window configuration for the main level
• prefab window well at the basement level
• new window to replace the egress window into the window well
New addition to be 16'x 22'at main level and extending the basement to the same size to
support the new structure.
Replace wooden deck w/ new stone patio, min 10' deep.

SUBJECT: A request for a recommendation to the Vail Town Council for a zone district
boundary amendment, pursuant to Section 12-3-7, Amendments, Vail Town
Code, to allow for a rezoning from Two-Family Primary/Secondary District

1. SUMMARY
The applicant, Capstone Townhome Association, represented by Marc Levam,
President of the H.OA, has submitted a development review application to the Town
of Vail Community Development Department to allow for the rezoning of Lot 21,
Buffehr Creek Subdivision, from Two-Family Primary/Secondary District (P/S) to Low
Density Multiple Family District (LDMF). The applicant has submitted the application
in anticipation of the desire to perform several small residential additions to the
y existing units and ossible new itched roof. Staff is recommending that the

of the applicant's development review application.
It. DESCRIPTION OF REQUEST
The applicant, Capstone Townhome Association, represented by Marc Levam,
President of the H.OA, has submitted a development review application to the Town
of Vail Community Development Department. The purpose of the application is to
amend the Official Zoning Map of the Town of Vail whereby Lot 21, Buffehr Creek
Subdivision, is rezoned from Two-Family Primary/Secondary District (P/S) to Low
Density Multiple Family District (LDMF). According to the applicant the rezoning is
intended to facilitate the renovation and additions many of the owners are
contemplating for their units and possibly a new pitched roof to alleviate leak
problems associated with the flat roof.
There are currently six (6) dwelling units located upon Lot 21 of the Buffehr Creek
Subdivision, which is four (4) additional dwelling units than permitted on the property
according to the Two-family Primary/Secondary District. As this property is legally
nonconforming, the limits as.to what can be done on the property are severely

restricted. Any change to the units on the property, other than regular maintenance,
requires one or more variances for density, Gross Residential Floor Area (GRFA),
setbacks, depending on which unit and what is being proposed.
The proposed rezoning of Lot 21 to Low Density Multiple-Family District would result
in a maximum of seven (7) dwelling units on the lot and the ability to have total of
16,970 square feet of GRFA for the six existing units. There is currently 13,272
feet that could be split amongst the

The Capstone Condominiums were granted a Certificate of Occupancy on December
1. 1978, under Eagle County jurisdiction for six (6) dwelling units and were zoned
Residential Multiple Family.
On January 29, 1986, the Capstone Condominiums was annexed into the Town of
Vail by Ordinance No. 1, Series of 1986. At that time the property was rezoned to
Two-Family Primary/Secondary District, which made the property legally non-
conforming.
On June 8, 1987, Staff recommended denial of a density variance for Unit 2 to
enclose a deck which added 79 square feet of GRFA to a project which was already
over on number of units and GRFA for the lot. Staff cited that it would be a grant of
special privilege. as no hardship was present. By a vote of 3-1-0 the Planning and
Environmental Commission approved the density variance request for Unit 2.
On July 7, 1987, the Town Council heard an appeal (called up by Council Member)
on the Planning and Environmental Commission approval of a density approval for
Unit 2 of the Capstone Condominiums. A motion was made to uphold the Planning
and Environmental Commission approval and by a vote of 2-2-0 the motion failed
and resulted in the overturning of the Planning and Environmental Commission
approval.
There have been several applications for new windows, retaining walls, and roof
replacements since the 1987 applications.
IV. ROLES OF THE REVIEWING BODIES

The Planning and Environmental Commission is advisory to the Town Council. The
