SUBJECT: Request to proceed through the development review process with a proposal toഀ

1. SUMMARYഀ
The applicants are requesting permission to proceed through the development reviewഀ
process with a proposal to construct private improvements on the Town of Vail owned Goreഀ
Creek Promenade, located adjacent to the existing Bell Tower Building at 207 Gore Creekഀ
Drive. As the property owner, the Town Council may approve, approve with conditions, orഀ
deny the Applicant's request for property owner authorization to proceed through the Town'sഀ
development review process. Pursuant to Section III of this memorandum, Staffഀ
recommends denial of this request.ഀ
11. DESCRIPTION OF REQUESTഀ
The applicants are requesting permission to proceed through the development reviewഀ
process with an application to construct a second-floor deck that encroaches onto the Townഀ
of Vail owned Gore Creek Promenade on the north side of the Bell Tower Building, locatedഀ
at 207 Gore Creek Drive.ഀ
The proposed new deck will be accessible from three separate second-floor rooms on theഀ
northeast side of the existing Bell Tower Building. The deck consists of two primary deckഀ
areas with a three and one-half foot wide (3'-6") connection combining the new deck areasഀ
into a single deck. At the connection point of the primary deck areas, approximately threeഀ
(3) square feet of the proposed deck extends beyond the property boundary onto the Townഀ
of Vail owned Gore Creek promenade.ഀ
The applicant's request (Attachment A) and the proposed architectural plans (Attachment B)ഀ
have all been attached for reference.ഀ
III. STAFF RECOMMENDATIONഀ
The close proximity of the existing Bell Tower Building to the property boundaries constrainsഀ
the expansion of this existing building. The Council has acknowledged this situation andഀ
previously allowed the existing Bell Tower building to encroach into the Town owned Goreഀ
Creek Drive right-of-way to the south and the Gore Creek Promenade adjacent to theഀ
Children's Fountain to the east to allow expansions to the building in keeping with the goalsഀ
of the Vail Village Master Plan and Design Guidelines.ഀ
Staff believes the proposed second story deck, or decks, can be designed and constructed,ഀ
in conformance with the guidelines of the Vail Village Master Plan and the Town's designഀ
guidelines, on the north side of the Bell Tower Building without encroachments across theഀ
property boundary onto public property. Therefore, Staff recommends the Vail Townഀ
Council, as the owner of the Gore Creek Promenade adjacent to the existing Bell Towerഀ
Building at 207 Gore Creek Drive, denies the Applicant's request to proceed through theഀ
development review process.ഀ
Please be advised that should the Town Council choose to approve this request, such anഀ
approval would not constitute an explicit approval of the proposed improvements. Anyഀ
approval of this request will only grant the Applicant property owner authorization to proceedഀ
through the Town's development review process.ഀ

Thank you for the opportunity to present a letter requesting an Encroachment Agreement between the Bell Towerഀ
Second Floor Remodel and the Town of Vail.ഀ
We have previously submitted to the DRB a plan for proposed improvements to the second floor deck. To makeഀ
this deck viable, it must connect to the existing second floor deck currently in place. To connect these decks, we areഀ
requesting the Town allow a small portion of the connecting walkway to cross the property line. We believe thisഀ
would occur approximately 15'-20' above the existing grade. The property below is a planting bed directly,ഀ
adjacent to a public stair. We believe that the use of this land will remain as such for the foreseeable future andഀ
therefore granting this request would likely result in no additional burden on the Town.ഀ
