Peterson My name is Michael E. herman and I live at 343 Beaver Dam Road, Vail, CO. 81657 We ,like Nancy Byers, are concerned with the basement additions to the duplexes at 332 Beaver Dam Road. One concern is the possible damage to the pond on the property as any construction work below the water level could cause irreversible damage. The other concern is the feasibility of the project. Our home is opposite the duplex and about 50 feet above the 332 beaver dam road property. In 2001 we put on a modest 200 sq foot spa room below our house, which is built above the ground, on stilts. Upon excavation we immediately hit wet land water. The completion of the job required an elaborate pumping system and building the room like a concrete bunker. The pumps have to run all day for 24 hours. If the pump fails the water pressure would build up and tilt the house, or crack the walls. This required us to add a diesel electric generator to insure that pumps would work. It also required us to build a separate mechanical room, which had to be ventilated, to support the diesel generator. The cost of the 200 foot addition (excluding the mechanical room) was over $250,000! Therefore considering the possible damage to the pond, and the difficulty of building , we question the wisdom of adding a basement. Since our lot lines all intersect in the pond our houses surround (along with Michael Herman at 343 Beaver Dam Road), I am very concerne about this proposed project. I consider the pond to be our greatest asset, as well as our greatest liability. Because of its vulnerability and constant maintenance, we four owners formed a legal and registered "Beaver Dam Pond Conservance Association" on July 16, 2005 for protection of the pond, which all owners must adhere to. Since I have been a permanent resident for 20 years on the pond, I am aware of many potential problems and am worried about further excavating so close to the pond. Water is constantly entering the pond under the Herman house. There are two outlets for the water from the pond, one on each side of the subject duplex, which from time to time get blocked (beavers, muskrats, debris etc.) and unless noticed within 24 hours, will potentially floc our homes, the duplex being the most vulnerable. I have actually seen water flood over both patios and up to the houses, because the outlet were blocked. Because the proposed basements will be below the pond water level, I am asking for a thorough engineering soils report testing several area the duplex property for water content and types of soils before this application goes before DRB. Not only am I concerned about the pond, 1 also the structure of the duplex itself. Since I will be out of town for the DRB meeting August 6, I am asking Terrill Samura, a landscaper who has been in charge of maintaining caring for the pond to appear for me. He will be able to answer any questions you have regarding the pond.
