At that meeting, the DRB heard the application by Apollo Park at Vail to add a black metal fence along the property line adjacent to The Wren. The DRB tabled the application until the September 17, 2008 meeting to allow the application to address their comments. If you wish to be on the September 17, 2008 agenda for this item, you must submit an amended application package by Wednesday September 10, 2008. If you wish to be tabled to another meeting, please inform me of your decision to do so also by September 10. The Design Review Board had several comments regarding the fence, summarized below: 1. The fence, following the property line, does not meet the standards for fencing outlined in Section 14 -10 -9, Vail Town Code, which reads, "The placement of walls and fences shall respect existing landforms and fit into land massing rather than arbitrarily follow site boundary lines. " 2. The purpose of the fence seems to be aesthetics, and the proposed fence will not screen from the Wren's walls and fencing along their parking lot. DRB members suggested that the fence be a solid fencing material to actually screen from the adjacent property. 3. The old fence was dilapidated from plows, and this fence will likely suffer the same demise. Snow storage is a major issue on this property, and it is essential that a fence not impede the ability to store snow. Please provide a site plan showing snow storage. The current requirement is to have snow storage equal or greater than 30% of the paved surface. 4. Some DRB members suggested landscaping instead of a fence, although this will be an issue if the space is used for snow storage. Snow storage areas need to be free of landscaping that will impede snow storage or that will be damaged from plows. 5. The DRB also suggested that it may be helpful to meet with the Wren and come up with a joint solution to improve both sites. Frontage Road, Vail, CO 81657 Dear Rachel: Thank you for your letter of September 8, 2008 that provided a synopsis of the Design Review Board meeting on September 3, 2008 when they heard the application by Apollo Park to add a black metal fence along the property line adjacent to The Wren. We wish to submit the following information to supplement that original application. 1. The purpose of the fence is to replace an old, broken down cedar fence that was along that property line. 2. We began discussions with Board members and the manager of The Wren in May 2008. The old fence was broken down, in part, due to them pushing snow from their parking lot into the fence. They had also dumped cinders and gravel that they used for their parking areas along the fence line which had spilled under and through the old fence and on to Apollo Park's property. 3. At our request, The Wren removed the debris from the property line and assured us that they will no longer push snow into a new fence and over the property line. A fence will become a visible indication of the stopping point to help ensure this. 4. There is also history of owners and guests from The Wren cutting through Apollo Park's property to get easy access to the village path. Since one of those owners once sued Apollo Lodge when they slipped and fell on ice, we want to discourage people from cutting through our parking lot and to our sidewalks. 5. From our property, snow is pushed to the northeast and southeast corners of the lot, as well as along the eastern property line. There is also some room for snow storage at the southwest corner of the lot. During prior winter seasons, snow was trucked away from our lot, as necessary, in order to allow for owner and guest parking. We are prepared to pay to have snow hauled away again during the 2008 -09 winter season, as necessary. 6. Because Apollo Park is an older property, and due to the fact that the Mountain View building has reduced our parking lot, there is not 30% of the paved surface designated for snow storage. We believe that we can compensate for that by hauling snow away from the property. 7. The proposed fence has two purposes. The first is to identify the property line between Apollo Park and The Wren in order to stop people from cutting through the property. The second is to break up the view of unsightly concrete walls on the western edge of The Wren's property. 8. An open, black metal fence was proposed in order to have continuity and match the look of the new fence around our pool. Secondly, if snow does get pushed against it, the snow will fall between the lines rather than break a solid wood fence. Although it will not screen the concrete walls entirely, as a solid fence would, we prefer the open look of the black metal fence that will be softened by landscaping. 9. Please see the attached correspondence from The Wren indicating that they are not opposed to the fence, and that they do not want to participate in the installation or cost. They have indicated that they have no plans to improve that side of their property. 10. The new fence will be positioned just to our side of the property line. 11. We are working with Traci Nation at SHC Nursery and Landscape Co. to finalize landscaping plans between the fence and our blacktop. Due to the fact that snow will accumulate there during the winter, there are restrictions to what plants we can hope to have survive. At this time, we are planning crab trees, and lilac shrubs, plus rock boulders with perennial wildflowers. The trees and shrubs will be large enough so anyone plowing snow can see and avoid them. Due to the time of year we are up against, the landscaping may not be installed until spring 2009. 12. The black metal fence will follow the lines indicated on the attached site plan. It will break at a group of trees and utility box that are on the property line. It will turn in at the north end of the lot and turn in to Building A at the south end. There are no existing landforms between the two properties. Hopefully this information will be helpful when reconsidering our application request. I just finished a meeting with The Wren Association Board of Directors. They are in absolute agreement not to participate in the building and funding of the Apollo Park Fence, which is to be built on the east side of Apollo Park, per our conversation on July 2, 2008. And that The Wren and Apollo Park are in agreement that the Apollo Park Fence will not be placed on The Wren Association Land, at any point. The Wren has removed any objects or property off of the Apollo Park land, per your request. The Wren Association does request that the old Light Post and Wood from the Apollo Park old fence be removed from our property as soon as possible. You had called me a year or more ago and we discussed what was happening with the construction on the old Apollo Lodge site. Apollo Park is continuing to go forward as always. Now that our land is no longer owned by Merrill Newton, we are able to make long needed improvements that he would not allow in the past. Next on our list is to tear out the fence that is between Apollo Park's property and that of The Wren. We understand that the fence is set in on to our property - it does not sit on the property line. I am told that the snow plow on your side pushes the snow up to the fence. Not surprising - it is a natural line. There is also plywood, rock and what appears to be crushed blacktop on your side that is piled up to the fence. We would request that those materials be removed as soon as possible to enable our efforts to clean up the property. As we go forward, we plan to use all of our property, as parking is at a premium. We also wanted to find out if you have any desire to have a shared fence that follows the property line between us. We have done some investigation about various possibilities for a fence or alternative barrier - and no decision has been made at this time. We first want to get the old stuff out of there and will then decide how to proceed. It appears that you do not use the property right there - other than to push snow and store 'stuff.
