RECITALS A. This Fourth Amendment is to that certain Condominium Declaration for Liftside Condominiums dated December 20, 1994, and recorded in the Office of the Clerk and Recorder of Eagle County, Colorado, on December 22, 1994, in Book 657 at Page 809, under Reception No. 553841, Amendment to Condominium Declaration for Liftside Condominiums recorded in the Office of the Clerk and Recorder of Eagle County, Colorado on November 30, 2006 under Reception No. 200632476, Second Amendment to Condominium Declaration for Liftside Condominiums recorded in the Office of the Clerk and Recorder of Eagle County, Colorado on September 17, 2007 under Reception No. 200724625, and Third Amendment to Condominium Declaration for Liftside Condominiums recorded in the Office of the Clerk and Recorder of Eagle County, Colorado on July 3, 2008 under Reception No. 200814020 (the "Declaration "). Any capitalized term used herein without separate definition shall have the meaning ascribed to such term in the Declaration. B. Pursuant to Section 3.12 of the Declaration, the Board of Directors shall be authorized to approve a request for Conversion of a Special Common Element into a Unit. Upon approval of the Board of Directors, the President of the Board and the Owner are entitled to execute and record in the Office of the Clerk and Recorder of Eagle County, Colorado the amendments to the Declaration and the Map that effect the Conversion. C. The Owners of Unit B-51 have requested that certain areas identified on the Map as Limited Common Element — Unfinished Attic Space appurtenant to Unit B -51 (which are Special Common Element — Unit B -51 pursuant to the Declaration) be converted into and included in the boundary of Unit B-51 and the Board of Directors has approved the Conversion. The Owners of Unit C -32 have requested that certain areas identified on the Map as Special Common Element — Unit C -32 be converted into and included in the boundary of Unit C -32 and the Board of Directors has approved the Conversion. NOW, THEREFORE, the Declaration is hereby amended as follows: 1. The amended condominium map for Liftside Condominiums (the "Fourth Amended Map ") identified as "Fourth Amendment to the Condominium Map of Liftside Condominiums" by Eagle Valley Surveying, Inc., Job No. 38.25 is hereby approved. The Amended Map shall be recorded in the Office of the Clerk and Recorder of Eagle County, Colorado. 2. Exhibit B is hereby revised by deleting Exhibit B in its entirety and replacing it with a new Exhibit B, attached and made a part of the Declaration by this reference, showing the new Sharing Ratio of all Units. 3. Except as herein expressly amended and modified hereby, all the terns and provisions of the Declaration remain unchanged and in full force and effect. 4. In case of any conflict between the terms of this Fourth Amendment and the Declaration, the provisions hereof shall prevail. Capitalized terms herein, unless otherwise defined, shall have the same meaning as set forth in the Declaration.
