General information:
This application is required for all proposals Involving minor changes to buildings and site improvements, such as re-
roofing, painting, window additions, landscaping, fences, retaining walls, etc. Applicable Vail Town Code sections can be
reviewed on-line at www.vailgov.com under Vail Information -Town Code On-line. All projects requiring design review
must receive approval prior to submitting a building permit application. An application for Design Review cannot be
accepted until all required information is received by the Community Development Department, as outlined in the submittal
requirements. Design review approval expires one year from the date of approval, unless a building permit is issued and
construction commences.

RE: Seeking approval for a small water diversion structure at Stephens Park to
maintain aUSACE-approved wetland mitigation site
Dear Nicole:
The Eagle River Water & Sanitation District (the District) is preparing to install a
diversion structure on a small perennial tributary of Gore Creek in Vail, Colorado in order
to redirect water during high flow periods into a nearby wetland mitigation site, referred
to as the Stephens Park mitigation site. The tributary is located on the south side of the
Vail Valley and runs through Stephens Park, a Town of Vail maintained facility, before
reaching Gore Creek. The purpose of this project is to improve hydrologic conditions of
the 1.04-acres Stephens Park mitigation site, which is located on Town of Vail property
and managed by the District (Exhibits A and B).
In 1992, the District enlarged the Black Lake No. 1 reservoir, located near Vail Pass.
The wetland mitigation plan for this enlargement was approved under United States
Army Corps of Engineers (USACE) Permit No. 9560 and an Eagle County 1041 Permit
(Resolution 91-12), and involved the creation, enhancement, or restoration of wetlands
at six locations in the Gore Creek watershed, including Stephens Park. The wetland
sites must be maintained to meet the original mitigation goals. For the Stephens Park
site, this includes the establishment of suitable wetland hydrology.
For approximately the past 10 years, the site has been irrigated during the growing
season using treated water with a combination drip/sprinkler head system. Recent
inspections of the site have identified irrigation deficiencies; portions of the site are not
receiving enough water to promote true wetland hydrology. Even the areas that appear
to have saturated soil conditions during some period of the growing season are only
marginally meeting this requirement. The proposed diversion will enhance the hydrology
of the low-lying wetland mitigation site by supplementing the treated water irrigation
system to meet the original mitigation requirements. Gregg Barrie and Todd
Oppenheimer, of the Town of Vail, attended a site inspection with myself and Pete Miller,
of the District. Gregg and Todd both expressed support of the diversion concept
presented herein.
During spring flood conditions, when there are free river conditions, water will be
diverted from the above-mentioned tributary into the upper (northeast) end of the
mitigation site (see Exhibit C). The tributary will continue to deliver base flows to Gore
Creek during periods of diversion. Spring runoff water diverted into the mitigation site
will inundate and/or saturate the soil, returning to Gore Creek either via surface flow or

infiltration. The existing irrigation system will be used for the remainder of the growing
season.
Historically, the irrigation water supply for Stephens Park has been provided from the
irrigation sprinkler system that is connected to the District's domestic water supply for the
Town of Vail. The water rights for irrigation at Stephens Park are therefore included in
the District's water supply system Decree and Augmentation Plan (District Court, Water
Division No. 5, Case No. 82CW3281). The proposed diversion will only be utilized
during "free river" conditions, which typically occurs in May and June (sometimes
extending into July and August). This will allow for the use of raw water during a good
portion of the irrigation season, thus reducing the demand on the domestic treated water
supply system. There will be no changes in the area being irrigated or the overall
consumptive use, so no additional water rights will be needed.
As the attached schematic plan demonstrates, the diversion structure will be constructed
on the south side of the existing walking path, outside of the FEMA-approved 100-year
floodplain (Exhibit C). (Note that elevations on Exhibit C were derived from comparison
with the known elevation of a manhole located in the middle of the lawn, MH0930).
Water from the tributary will enter a 4-foot by 7-foot by 38-inches deep concrete vault.
The vault will be covered by metal grating for safety, while allowing overflow to spill over
the top of the structure if necessary. The vault will be buried as much as possible, with
earth piled up against the outside borders to conceal any exposed walls. The vault will
have outlets for the existing two culverts that go under the walking path, in addition to a
slightly lower elevation outlet leading to the proposed culvert. Agate will be used to
control flow into the proposed culvert, which will consist of a buried 12-inch diameter
corrugated steel pipeline that will run under a lawn and into the wetland mitigation site.
The buried pipeline will be approximately 80 feet long. Design plans are provided in
Exhibit D. Please note that Tom Kassmel, Town of Vail Engineer, indicated to me that
submittal of hand-drawn plans would be sufficient in an October 3, 2008 telephone
conversation.
Less than 12 inches of pipe will be exposed at the outfall of the conveyance route to
allow the water to enter the mitigation site. This small section at the end of the pipeline
will encroach upon the 100-year floodplain very slightly, but will not have a negative
impact on the floodplain elevation. During a 100-year flood event, some water may go
back up the pipeline, but this will be minor and will not cause any damage to private
property.
During spring flood conditions, when there are free river conditions, the gate leading to
the wetland mitigation site will be opened. Adjustments will be made to the gate level
such that base flow will be maintained through the culverts that lead to the existing
tributary. All other times of the year, the gate leading to the mitigation site will remain
closed. No information is currently available on the flow in the unnamed, perennial
tributary. A suitable calculation has been developed to enable flow measurement in the

new culvert, based upon a simple water depth measurement taken at the end of the
culvert.
Appropriate best management practices will be employed to prevent sediment from
entering Gore Creek during construction of the diversion structure and conveyance. In
addition, construction is planned to take place in November, which is a relatively low flow
period. This will also serve to limit the mobilization of sediment. Vegetation along the
tributary is dominated by willows. Care will be exercised to impact as little vegetation as
possible; if necessary, willow cuttings will be replanted in disturbed areas. The
conveyance route is predominantly lawn, which will be reseeded after construction.
Similarly, the area where the pipeline enters the wetland mitigation site will be reseeded,
if necessary, with an appropriate native seed mix.
In a September 30, 2008 letter, the USACE approved construction of a diversion
structure and conveyance route to improve the hydrology of the mitigation site (Exhibit
E). This approval was necessary because the diversion structure will be impacting a
small area of Waters of the United States and associated wetlands, both of which are
regulated by the USACE. As you requested, I have also attached November 3, 2008
email correspondence from you regarding fee waivers and the approval process, as well
as a completed Town of Vail Application for Design Review for Minor Exterior Alterations
(Exhibits F and G).
On behalf of the District, I would like to request your authorization to proceed with the
construction of this project as a remedy to the insufficiently acting mitigation area.

Dear Becky,
Thank you for your design review application (DR608-0573) for installation of a diversion
structure and culvert at Stephen's Park, 2450 S. Frontage Road W, Vail, CO. In reviewing the
application, I have a few comments and requests, listed below.
As you read the requests, please keep in mind that the Vail Town Council appointed the Design
Review Board to review all development and redevelopment in the Town of Vail, with the
following objectives (Section 12-11-1, Vail Town Code, in part):
1. Recognize the interdependence of the public welfare and aesthetics, and to provide a
method by which this interdependence may continue to benefit its citizens and visitors.
2, Al/ow for the deve%pment of public and private property which is in harmony with the
desired character of the town as defined by the guide/ines herein provided.
3. Prevent the unnecessary destruction or blighting of the natural landscape.
4. Ensure that the architectural design, location, configuration materials, co%rs, and overa/l
treatment of built up and open spaces have been designed so that they re/ate harmonious/y
to the natural landforms and native vegetation, the towns overa// appearance, with
surrounding deve%pment and with ohicial/y approved plans or guide/ines, if any, for the
areas in which the structures are proposed to be /orated.
5. Protect neighboring property owners and users by making sure that reasonab/e provision
has been made for such matters as pedestrian and vehicular traffic, sun`ace water drainage,
sound and sight buffers, the preservation of light and air, and those aspects of design not
adequate/y covered by other regulations which may have substantial effects on neighboring
land uses.

Stephens Park to maintain a USACE-approved wetland mitigation site
Dear Tom:
As you requested in a November 13, 2008 email, I am writing to amend the letter I
submitted to the Town of Vail on November 7, 2008 to meet your requests for additional
information regarding the proposed small water diversion structure at Stephens Park.
This work is being planned by the Eagle River Water 8~ Sanitation District (ERWSD).
Please find the supplemental information below, with numbers corresponding to the
itemized requests in your November 13, 2008 email.
1. The proposed design will include burial of the culvert at least 12 inches. The only
exception will be a slight, necessary thinning of the overburden just as the culvert
reaches the outfall location within the wetland mitigation site to allow the culvert
outfall to surface.
2. We have revised our plans to incorporate a half wall at the intake, as you
requested. Please see revised plans attached as Exhibit 1. These plans should
replace (hose submitted to the Town of Vail on November 7, 2008. To
accommodate your suggested changes, the diversion box dimensions have been
increased from 7 feet long by 4 feet wide to 7.5 feet long by 4 feet wide. Also, to
clarify, the top of the grating will be approximately 0.4 feet below the elevation of
the walking path. See Exhibit 1 for additional changes and notes.
3. Information on restoration and erosion control was covered in the original
November 7, 2008 Town of Vail submittal.
4. Information on wetland plant reseeding andlor replanting was covered in the
original November 7, 2008 Town of Vail submittal.
5. Approximate limits of disturbance for the proposed project are shown on Exhibit
2.
6. Existing grading at the site will no# be modified. To ensure this, ERWSD has
agreed to complete apre- and post-construction survey of the site. Results of

the surveys will be submitted to you upon completion of the project. Please see
Exhibit 3 for an email from Peter Miller, Project Manager for the ERWSD, stating
their willingness to complete the necessary surveys.
7. Douglas Laiho, P.E., of AMEC Earth & Environmental, has provided a stamped
letter indicating that there will be no adverse impact to the floodplain from the
proposed work at Stephens Park. This letter is included as Exhibit 4. The
original stamped letter has also been mailed to you for your records.
8. Peter Miller has also agreed that the ERWSD will take responsibility for any
complications that arise from the intentional flooding of the wetland mitigation site
that this proposed project is planning (e.g., scour, weed control, etc.). He has
stated this in the email included as Exhibit 3.
9. I have also included a completed, signed Floodplain Use Permit (see Exhibit 5).
We had originally hoped to construct the diversion structure in November 2008,
but given delays and weather conditions, the work will likely be put off until the
summer of 2009. As construction plans are solidified, the ERWSD will contact
the Town with firm dates; work should only take a day or two, but no more than
seven days.

Comment 3 Notes:
Please refer to the following annotated aerial photograph that provides a schematic of
the proposed diversion structure and culvert at Stephens Park. There is no new
landscaping planned for the proposed project. Avery limited area of disturbance will be
impacted, as demarked by the dashed orange line. The grassy area that will be
disturbed will be reseeded after construction and watered as necessary. In addition, any
disturbance to the walking paths will be repaired to meet existing standards. No
significant grading changes are proposed.
Willows (Salix spp.) are the dominant vegetation at the proposed diversion structure site
and the outfall location within the wetland mitigation site. No damage to trees is
anticipated. Areas where willows are damaged will be replanted with willow cuttings and
watered as necessary after construction. A wetland seed mix will also be added to
impacted areas as needed.

additional water may have on the area, specifically with regard to any scour at the outfall into the creek at
the bridge and the Towns ability to do typical weed management." Would you agree to this?
Steve is out today, but I will have him get necessary revisions and an engineer-stamped letter indicating
their will be no signifcant impact on the floodplain to Tom early next week. I apologize for the delay in
netting this permitting together. I am not sure wha# conditions are like up in Vail, but it looks like this may
gave to wait until next year to start construction. I will keep you up to date on any information I get from
the Town.

RE: Floodplain impacts from the Proposed Stephens Park Diversion Structure
Dear Tom:
I have reviewed the plans submitted to the Tawn of Vail for the Stephens Park diversion
structure to support hydrology in a United States Army Corps of Engineers-approved
wetland mitigation site. These plans were presented to the Town by AMEC Earth &
Environmental on November 7, 2008, on behalf of the Eagle River Water & Sanitation
District. There are no material ground surface modifications associated with this
proposed work.
The only above ground component of the project within the floodplain would be a section
of 12-inch diameter corrugated steel pipe, less than 12 inches in Length. This
component is too small to reasonably be considered a floodplain change that would be
reflected on a hydraulic model of this area. This insignificant feature will have no
measurable effect on the floodplain or water surface elevations in this area. The small
diversion project proposed at Stephens Park by the Eagle River Water & Sanitation
District will not change the flood conveyance characteristics of the floodplain.

grating planned for the diversion structure will have 1 inch by 3 inch openings and will
generally look like that pictured below.

Image of the Waterman CL-10 Canal Gate that is proposed for the Stephens Park
diversion structure. Almost this entire device will be out of sight below the ground
surface. Approximately 1 inch of the steel frame at the top and then the small wheel will
be exposed above the surface of the concrete. In addition, a lock will be placed on the
wheel to prevent unauthorized opening of the canal gate.
Example of a trash gate that will be used to prevent trash, people, and other objects
from entering the diversion structure's east end. The gate pictured below is much larger
than the one that will be needed for the 14 inch by 3 foot gate needed for the diversion
structure.

Dear Mr. Kassmel:ഀ
The Eagle River Water & Sanitation District (the District) recently installed a diversionഀ
structure on a small perennial tributary of Gore Creek in Vail, Colorado in order toഀ
redirect water during high flow periods into a nearby wetland mitigation site, referred toഀ
as the Stephens Park mitigation site. The tributary is located on the south side of theഀ
Vail Valley and runs through Stephens Park, a Town of Vail maintained facility, beforeഀ
reaching Gore Creek. The purpose of this project is to improve hydrologic conditions ofഀ
the 1.04-acres Stephens Park mitigation site, which is located on Town of Vail propertyഀ
and managed by the District (Exhibits A and B).ഀ
The Town of Vail Floodplain Permit issued for this project (FLD08-0003) requires a preഀ
and post construction survey to show that no change in grade has occurred within theഀ
floodplain. To meet this requirement, AMEC Earth & Environmental surveyed theഀ
ground surface elevation profile along the length of the culvert before and after theഀ
culvert and diversion structure were installed. Exhibit D shows the results of the pre andഀ
post construction surveys (see Exhibit C for orientation and approximate stationഀ
locations). Exhibit E graphically displays the pre and post construction survey results.ഀ
Note the location of the FEMA 100-year floodplain elevation on the chart. Only thoseഀ
survey points below this elevation are relevant. The majority of area impacted by theഀ
culvert installation and the entirety of the area impacted by the diversion structureഀ
installation reside outside of the FEMA 100-year floodplain boundary (see Exhibit C).ഀ
The survey results show that little or no change in grade has occurred as a result of theഀ
installation of the diversion structure and culvert. As such AMEC does not expect anyഀ
change to the FEMA 100-year floodplain boundary nor to the 100-year flood velocities inഀ
the area.ഀ
