Staff is requesting that the DRB make a determination that the roof material proposed for theഀ
additions complies with Section 14-10-5 Building Materials and Design, Vail Town Code.ഀ
14-10-5(F)(1)(b):ഀ
F. All structures shall have class A roof assemblies or shall have class A roof covering materials, asഀ
defined by the adopted building code. The use of concrete tile, slate, metal, asphalt shingle, fiberglassഀ
shingle, and built up tar and gravel roofing may be permitted. Metal roofing, when permitted, shall notഀ
reflect direct sunlight onto an adjacent property and shall be surfaced with a low gloss finish or beഀ
capable of weathering to a dull finish. Metal roofing, when permitted, shall be of a heavy gauge andഀ
designed to provide visual relief to the roof surface (including, but not limited to, a standing seam).ഀ
1. Nonconforming Structures: All structures that do not have a class A roof assembly or class A roofഀ
covering material, or structures with wood shake or wood shingles shall come into compliance asഀ
follows:ഀ
b. Additions: All additions affecting roof area shall trigger compliance of the roof structure of a single-ഀ
family dwelling, a side of a two-family dwelling, or the entire multiple-family dwelling, except for aഀ
onetime exemption of up to five hundred (500) square feet of GRFA, occurring after February 6, 2007,ഀ
where any addition of roof area does not share a plane or ridge with the nonconforming roof, and mayഀ
only share a valley. The additional roof area shall conform to roofing regulations, and shall be deemedഀ
compatible by the design review board.ഀ
If the DRB finds that the proposed standing-seam metal (aspen bronze color) is compatible with theഀ
existing wood shakes Staff recommends that the DRB make the following motion/ findings:ഀ

"The DRB finds that the proposed standing-seam metal (aspen bronze color) is compatibleഀ
with the existing wood shakes and is conforming to the roofing regulations with the followingഀ
findings:"ഀ
Findings: (14-10-5.F.3) Roofing Material: The use of any roofing material, including those notഀ
specifically identified by this section, shall only be permitted, unless otherwise prohibited byഀ
this code, where the design review board finds:ഀ
a. That the proposed material is satisfactory in general appearance, quality over time,ഀ
architectural style, design, color, and texture; andഀ
b. That the use of the proposed material complies with the intent of the provisions ofഀ
this code; andഀ
c. That the use of the proposed material is compatible with the structure, site,ഀ
surrounding structures, and overall character of the town of Vail, andഀ
d. That the material is noncombustible or aids in the prevention of fires.ഀ

1. DEFINITIONSഀ
(a) "Mortgage" means mortgage, deed of trust or other security instrument.ഀ
(b) "Public Records" means title records that give constructive notice of matters affecting the title according to state lawഀ
where the land is located.ഀ
(c) "Land" means the land or condominium unit described in Schedule A and any improvements on the land which are realഀ
property-ഀ
2. INTERVENING DEFECTSഀ
The Company hereby insures against loss or damage by reason of there being recorded any deeds, mortgages, lis pendens, liensഀ
or other title encumbrances which first appear in the public records subsequent to the effective Date of Commitment, but prior toഀ
the effective Date of Policy. "Public records" as used herein means those records in which under statutes deeds, mortgages,ഀ
judgment liens or lis pendens must be recorded in order to impart constructive notice to purchasers of the land for value withoutഀ
knowledge.ഀ
The Company does not insure against such loss or damage if the existence of such deeds, mortgages, lis pendens, liens or otherഀ
title encumbrances is actually known to the proposed insured prior to or at the time of closing. The closing is defined herein asഀ
being the time of the execution and delivery to the proposed of the documents creating the interest of the proposed insure.ഀ
EXISTING DEFECTSഀ
If any defects, liens or encumbrances existing at Commitment Date are not shown in Schedule B, we may amend Schedule B toഀ
show them. If we do amend Schedule B to show these defects, liens or encumbrances, we shall be liable to you according toഀ
Paragraph 4 below unless you knew of this information and did not tell us about it in writing.ഀ
4. LIMITATION OF OUR LIABILITYഀ
Our only obligation is to issue to you the Policy referred to in this Commitment, when you have met its Requirements. If we haveഀ
any liability to you for any loss you incur because of an error in this Commitment our liability will be limited to your actual lossഀ
caused by your relying on this Commitment when you acted in good faith to:ഀ

• eliminate with our written consent any Exceptions shown in Schedule B - Section 2.ഀ
