RE: Placement of children at play sign in a compliant location
Dear Mr. Seidman,
The purpose of this letter is to establish the provisions by which you can display the
replacement "Caution Children Playing" sign. As discussed the Town has chosen to
replace the sign that was removed from the Town's Chamonix Lane right -of -way on April
23, 2009, which you have requested to be returned. We have chosen to replace this
sign as we did not provide you with written notice that the sign would be discarded
should you choose not to pick it up from our office. The Town believes the sign was
removed in accordance with the Town Code, specifically Section 11 -11 -1, Violations,
Vail Town Code which states the following:
A. General Violations: Any sign that is deemed by the administrator to be
erected, structurally altered, extended, moved, or otherwise utilized in violation of
any provisions of this title, is in violation of this title and shall be subject to the
procedure for removal as listed below. Any sign not maintained or kept in good
repair, as determined by the administrator, is in violation of this chapter and shall
also be subject to the procedure listed in section 11 -11 -2 of this chapter.
B. Sign Violations On Public Property. It shall be unlawful to erect or maintain
any sign in, on, over, or above any land or right of way or on any property
belonging to the Town of Vail without the express permission of the town. The
administrator may summarily abate a violation of this nature by removing and
confiscating any unauthorized sign without prior notice and may recover the
costs incurred in removing any unauthorized signs from any person who
commits, takes part in, or who assists in any such violation. However, this shall
not be deemed to apply to official government notices and notices posted by
governmental officers in the performance of their duties, government signs to
control traffic or for other regulatory purposes, or to identify streets or warn of
danger.

Any person who commits, takes part in, or who assists in any such violation, shall
be guilty of a violation of this code and be subject to the provisions of the penalty
and costs subsections (section 11 -11 -2) of this chapter.
Attached is a photograph of the location of the sign on the day it was removed from the
Town's Chamonix Lane right -of -way as it was located in the concrete pan on the
opposite side of the road from your property.
To aid you in avoiding any violations in the future staff has attached a site plan depicting
the property at 2460 Chamonix Lane upon which you reside. As can be seen the
property line of 2460 Chamonix Lane is approximately 11 feet behind the back edge of
the concrete pan. In order to be in compliance with the Town of Vail Sign Code the
"Caution Children Playing" sign needs to be located on Lot 5, Block B, Vail Das Schone
1S Filing, a minimum of 11 feet behind the concrete pan. The sign shall not be located
off of the lot upon which Unit C -4 is located and must be a minimum of 11 feet behind
the concrete pan. Furthermore, this sign shall only be erected when children are playing
or in the immediate vicinity. This sign shall not be left erected when there is no situation
warranting the message it is intended to deliver to motorists.
This letter shall serve as written notice that if the sign is found to be at any location other
than Lot 5, Block B, Vail das Schone 1 St Filing, a minimum of 11 feet behind the concrete
pan it will be confiscated as being in violation of Section 11 -11 -1, Violations, Vail Town
Code. Furthermore the sign may be discarded without notice as this letter has explained
under what parameters the sign will be in compliance.
