As noted in our phone conversation, Section 405.1 of the Town's adopted mechanical code (2003 ICC) does not allow ventilation ducts to be located any closer than 10 -feet from a property boundary and therefore does not allow such a duct to cross over a property boundary. As you are aware, the existing Mountain Haus building is located at, or possibly beyond, its southern property boundaries. The proposed air exhaust extension does not comply with the setback requirements of the Town's adopted mechanical code and can not be approved as proposed. As per our conversation the Mountain Haus would like to extend the air exhaust duct behind the Mountain Haus adjacent to first floor unit 108 southward approximately 22 feet. We would prefer to conceal the duct underground, but if that is not possible we could also run the duct above ground and surround it with plantings to hide it from view. We are asking to extend this duct due to complaints from hotel guests and owners in residential units adjacent to the current exhaust area. The purpose of the duct is to exhaust air from unit 1, The George, in the lower level of the building, that air has some level of cigarette smoke from the activities of the George's operation which we need to exhaust further from the building. 1 have attached a drawing and photographs showing the area. We would like to undertake this project at the earliest possible time and appreciate the Town Staff and Council's consideration. One of the items we would like to do and which is an integral part of our remodel plan (i.e. new larger windows in the master bedroom) requires the approval of the homeowners association. We intend doing the new window in September /October and the rest of the remodel will be done in April, 2006. The item we would like approval on is to put additional windows in the master bedroom, similar to what was previously done in unit #106. These additional windows, together with the other extensive upgrades which we will make, will result in our unit being significantly upgraded, to the benefit of both ourselves and our fellow home owners. The benefits to the HOA of allowing us to move forward with this project are listed below: • The market value of our unit will be higher as a result of the upgrade; increasing the market value on our unit will automatically increase the value of all of the other units in the building; • Our unit will become more desirable as a rental, helping to make our building more competitive with other high end properties in Vail Village The specifics of what we would like to do are as follows: 1. Remove the current windows in the master bedroom and replace them with a large fixed glass (46" wide) with a smaller opening window on each side (24" each). Enclosed are photographs as well as a sketch showing the "before" and "after" view of the outside of our unit. 2. After the new windows are installed, there will be approx 49" of brick to the right of the new windows (looking from the outside). 3. The window configuration we have chosen is similar to the windows in in the #112 stack, another first floor unit. 4. We had considered using a window configuration the same as unit #558 or #446, but that configuration would only have given us an additional 28" of window space and we are unwilling to go to the expense of doing the project just to get a minimal amount of extra window space. 38 -2- The work will be done according to Town of Vail code and with all necessary permits/approvals. We have hired a structural engineer (Ms. Kim McGee) to confirm that what we wish to do is structurally sound. We will provide a copy of a letter from Ms. McGee as soon as we have it. The exterior of the windows will be done so as to be consistent with the current exterior of the building and in compliance with any reasonable requests of the HOA. Since unit #106 has already done something similar to what we are asking to do, and since we are copying a similar window configuration to unit #112, we do not believe that the exterior appearance will be harmed at all by what we are asking to do.
