You have the option to proceed forward with this application and request a "final" review at a future Design Review Board public hearing. However, please be aware that the Board clearly indicated that had the conceptual review been a final review, the Board would have voted 5 -0 to deny this application. Based upon our recent conversations, it is my understanding that you understand the input from the Board and do not intend to further pursue this application at this time. Therefore, the Town of Vail will consider design review application #DRB07 -0025 a "conceptual" review and the Town of Vail will refund the submitted $300 design review application fee. We have found that mischievous guests are able to access the roof of the canopy via unit 335's balcony (note footprint pictures attached), and would like to place safety glass around the balcony to prevent possible access to the roof structure. The 335 balcony is located low on the building and behind the canopy; therefore, the balcony is relatively out -of -sight from the exterior of the building (note exterior view pictures attached). The balcony's glass will match the look of the glass roofing on the canopy, coordinating the visual ascetics of the installation. Applicant addresses the matters set forth in the application as follows: 1. Relationship and impact of the use on development objectives of the Town. Safety glass will have no effect on the development objectives of the Town. 2. Effect of the use on light and air, distribution of population, transportation facilities, utilities, schools, parks and recreation facilities, and other public facilities and public needs. There is no effect on any of the items listed above. 3. Effect upon traffic, with particular reference to congestion, automotive and pedestrian safety and convenience, traffic flow and control, access, maneuverability, and removal of snow from streets and parking areas. There is no effect on traffic. 4. Effect upon the character of the area in which the proposed use is to be located, including the scale and bulk of the proposed use in relation to surrounding uses. This safety glass installation will be mostly unnoticed, yet from the angles it can be seen, the balcony glass will further integrate the building into the roofing glass currently on the north entrance canopy and provide a common theme. The glass installation has no affect on the bulk of the building. Following our conversation, Mr. Hawkins requested that I prepare this letter to you outlining my thoughts on this issue. As you know from long years of ownership at the Mountain Maus, you are the sole owners of your condominium unit, which is the individual air space within the perimeter walls of unit 335 and the right to the exclusive use of the balcony outside of the unit, which is a limited common element. According to the Mountain Haus Declaration, limited common elements are part of the general common cicmcnts owned jointly by all of the owners of the units at the Mountain Haus. The general common elements consist of the building (other than the individually owned units within the building), the land on which the building sits, landscaping, central utility systems and all other parts of the property in common use. Therefore, the balcony outside of your unit is a limited common element, part of the general common elements, and owned by all of the owners jointly, even though you as the owner of unii 335 have the right to the exclusive use of the balcony. In the event that a guest is injured on the balcony outside of your unit, this injury would be an obligation of the all of the owners making up the Association as a whole, and not your individual obligation. That being said, anyone with a $91.00 filing fee can file suit against any party. Therefore, no one can guarantee that you would not be named as a party in any litigation arising out of such an accident, but only that the damages would be an obligation of all owners, and not an individual obligation on your part. There might be some exceptions to this general rule, but such exceptions would arise out of your individual acts, negligence or willful misconduct. For example, if Don broke the balcony railing and instead of fixing it, hid the damage, and if a guest leaned on the balcony and it gave way, Don might be individually liable for the resulting injuries. Steve informed me that it would be relatively easy for someone to climb over the railing of your balcony and onto the roof of the new entrance. 'Therefore, I suggested that the Association obtain and post a sign advising that there is to be no climbing on the balcony railing. I suggested that Steve work with you to determine the type of sign, the size of the sign and where it should be mounted. It might also make sense for this sign to be in English and Spanish. In this way, we will have put parties on notice of the possible danger of climbing on the balcony railing. 1 hope that this letter responds fully to your inquiry to Steve.
