I, George Ruther, of age, under oath, do swear and affirm as follows:
1. I am the Director of Community Development for the Town of Vail, Colorado, and I have
personal knowledge of the facts in this Affidavit.
2. I personally prepared the memorandum, dated December 15, 2011, with the subject of
Arthrex, Inc. Professional Office—Vail Gateway Building Unit C-10, a true and correct copy
of which attached hereto as Exhibit A, ("Memorandum").
3. The Memorandum was prepared based upon my personal investigation and research into the
facts set forth in the Memorandum, as well as based upon the personal investigation and
research of other staff at the Town of Vail under my direction and supervision.
4. The findings in the Memorandum are true and correct based upon the investigation and
research, and constitute the position of the Town of Vail Community Development
Department on the matters set forth therein.
