(PEC07-0031) Applicant: Vail Resorts, represented by Jay Peterson Planner: Bill Gibson SUMMARY The applicant, Vail Resorts, represented by Jay Peterson, is requesting a conditional use permit pursuant to Section 12-7H-3, Permitted and Conditional Uses; First Floor or Street Levei, Vail Town Code, to allow for a "temporary busrness office" located at 450 East Lionshead Circle (Treetops commercial building)/Lot 6, Vail Lionshead Filing 1. This conditional use permit request will allow for the extension of the January 24,2005, conditional use permit approval for Vail Resort's temporary business offices currently occupying the first-floor of the Treetops commercial building. This 2005 conditional use permif approval is scheduled to expire on January 24, 2008. The applicant, Vail Resorts, is proposing to extend this approval for three exlra years until January 24' 2011. The applicant, Vail Resorts, is also requesting to eliminate any ties between the expiration ol this conditional use permit and the issuance of a temporary or final Certificate of Occupancy of for the Arrabelle or the North Day Lot. Based upon Staff's review of the criteria outlined in Section Vll of this memorandum and the evidence and testimony presented, the Community Development Department recommends approval, with conditions, of this request subject to the findings and condilions noted in Section Vlll of this memorandum. DESCRIPTION OF THE REQUEST This conditional use permit request will allow for lhe extension of the January 24,2005, conditional use permit approval for Vail Resort's temporary business offices currently occupying the first-floor of the Treetops commercial building. This 2005 conditional use permii a[proval is scheduled to expire on January 24, 2008. The applicant, Vail Resorts, is proposing to extend this approval until January 24,2011. Pursuant to Section 12-2-2, Definitions, Vail Town Code, a "temporary business office"is an "office for the conduct of generalbusrness and service activities for a duration of time not to exceed three (3) years." Therefore, the Planning and Environmental Commission required that the January 24,2005, conditional use permit approval expires on January 24,2008. |il. The January 24,2005, conditional use permit approval allowed the conversion of former vacant, firsf floor retail spaces within lhe Treetops commercial building into a temporary business office for employees directly related to Vail Resorts' operation of Vail Mountain; administration, snowmaliing, mountain operations, ski school, marketing, and other similar positions. As stated in 2005, it was the applicant's intention Jor.these business office ubes to be permanently located within the Arrabelle and/or a North Day Lot office building. Theref6re, the Plinning and Environmental Commission required that the January, 24,2005, conditional use permit will expire upon the issuance o-f a temporary or tinat C6rtificate of Occupancy lor the Lionshead Core Site Hotel (i.e. Anabelle) or the North Day Lot otfice nuiiOing, should either event occur prior to January 24, 2008' The applicant, Vail Besorts, is requesting to eliminate these ties between the expiration of the t6rirporary business office conditional use permit and the issuance of a temporary or final Gertificate of Occupancy of for the Arrabelle or the North Day Lot. A vicinity map (Attachment A) and the minutes of the January 24, 2005, Planning and Environmental Commission hearing (Attachment B) have been attached for relerence. BACKGROUND On November 16, 2004, the Vail Town Council adopted Ordinance No' 26, Series of 2004, to allow "Iemporary Business Offices" on the first-floor of buildings within the Lionshead Mixed Use 1 District. The purpose of this'ordinance is to allow existing Lionshead area office uses, which are displaced by the construclion activilies ol redevelopment projects, to be temporarily relocated within the Lionshead area. On January 4, 2005, the Planning and Environmental Commission granted approval, with conditions, of a conditional use permit for Vail Resort's temporary business offices currenlly occupying the first-floor of the Treetops commercial building. The following is a list of th'e condiiion! approved by the Planning and Environmental Commission in 2005: "This conditianal use permit for a temporary business office, located at 450 East Lionshead circle (Treetops commercialbuilding), shall become valid on April1,2005. This conditional use permit for a temporary business office, located at 450 East Llonshead circle (Treetops commercial buitding), shall be valid until January 24, 2008, subject to an annual review, on or before January 1" of each year, by the itlanning and Environmental Commission to verify comptiance with the conditions of approval. Vail Resorts shall submit appiications to the Town of Vail Department of Community Development in accordance with the Department of Community Development's submittal deadlines for each annual review. Qn any date prior to January 24, 2008, this conditional use permit for a temporary business office, tocated at 450 East Lionshead Circle (Treetops corimercial buitding), shalt expire upon the issuance of a temporary or final Certificate of Occupancy for the Lionshead Core Site (The Arrabelle at Vail Square) or the North Day Lot office building, whichever occurs first. This conditional use permit for a temporary business office, located at 450 East Lionshead Circle (Treetops commercial building), shall only allow for a temporary buslness office use as defined by Ordinance No' 26, Series of 2004." 1. 2. 3. tv. On April 8, 2005, the Town of Vail Building Division issued temporary Cerlificates of Occupancy for these temporary business office uses. The applicant, Vail Resorts, has not submitted applications for the annual review of the 2005 conditional use permit, and therefore has not complied with the requirements of condition #2. APPLICABLE PLANNING DOCUMENTS A. Title 1?,Zoning Regulations, Vail Town Code CHAPTER 12-1, TITLE, PURPOSE AND APPLICABILITY (in part) Section 1 2-1 -2: PurPose: A. General: These regulations are enacted for the purpose of promoting the health, safety, morals, and general welfare of the Town, and to promote the coordinated and harmonious development of the Town in a manner that will conserve and enhance its natural environment and its established character as a resort and residential community of high quality. B. Specific: These regulations are intended to achieve the following more specific purposes: 1. To provide for adequate light, air, sanitation, drainage, and public f acilities. 2. To secure safety from fire, panic, flood, avalanche, accumulation ot snow, and other dangerous conditions' 3. To promote safe and efficient pedestrian and vehicular traffic circulation and to lessen congestion in the streets- 4. To promote adequate and appropriately located oft-street parking and loading facilities. 5. To conserue and maintain established community qualities and economic values. 6. To encourage a harmonious, convenient, workable relationship among land uses, consistent with Municipal development obiectives. 7. To prevent excessive population densities and overcrowding of the Iand with structures. 8. To safeguard and enhance the appearance of the Town. 9. To conserve and protect wildlife, streams, woods, hillsides, and other desirable natural features. 10. To assure adequate open space, recreation opportunities, and other amenities and facilities conducive to desired living quarters. 11. To otherwise provide for the growth of an orderly and viable community. CHAPTER 12-2, DEFINITIONS (in part) Section 1 2-2-2: Definitions OFFICE, TEMPORARY BUS/NESS; An office for the conduct of general busrness and service activities for a duration of time not to exceed three (3) years, subject to an annual review by the Planning and Environmental Commission to verify the applicant's compliance with the conditions of approval, to accommodate the displacement of an existing office in the Town of Vail due to redevelopment for insurance agents, brokers, secretarial or stenographic services, or otfices for general bUsrness activities and tranSactions, where storage, sale, or display o1 merchandise on the premises occupies |ess than ten percini U0"/") of tie ftoor area. A temporary busrness office shall not include 'offices o)f reai estates agents. The appticant shall demonstrate to the Planning and Environmental Commission that an existing retail business ,s nof involuntarity displaced by a Temporary Business Office' ARTICLE 12-7jtz LIONSHEAD MIXED USE 1 (LMU'I) DISTRICT (in part) Section I 2-7H-1 : PurPose: The Lionshead Mixed IJse 1 District is intended to provide sites for a mixture of multipte-famity dwettings, todges, hotels, fractionalfee clubs, time shares, lodge dweiting uiits, reitaurants, offices, skier services, and commercial estabtihments in a clustered, unified development. Lionshead Mixed Use 1 District, in accordance with the Lionshead Redevelopment Master Plan, is intended to ensure adequate light, afr, open space and other amenities appropriate to the permitted types of buitdings and uses and to maintain the d6siriUe qualities 'of the Disirict by establishing appropriafe. gtfe. deve.lopment standards. This District is meant to encourage and provide incentives for redevelopment in accordance with the Lionshead Redevelopment Master Plan- This Zoie District was specificatty developed to provide incentives for propertigg to redevelop. The uttimite goat of these incentives is to create an economically vibrant lodging, housing, aid commercial core area' The incentives in this Zone District inctude increases in altowable gross residential floor area, building height' and density over the previously estabtished zoninq !n. tle Lionshead Redevetopment Master Plin study area. The primary goal of the incentives is to create economic conditions favorable to inducing private redevelopment consistent with the Lionshead Redevelopment Master Plan. Additianally, the incentives are created to hetp finance public off-site improvements adiacent to redevelopment projects. With any development/redevelopment proposal taking advantaile of ihe'incentives created herein, the following amenities will be evaluated: streetscape improvements, pedestrian/bicycle acqess, public plaza redevelopment, public aft, roadway improvements, and similar improvements. section 12-7H-3: Permifted and conditional uses; First Floor or street Level: A. Definition: The "first floor" or "street leve!" shall be defined as that floor of the buitding that is located at grade or dtreet level along a pedestrianway' C. Conditional lJses: The fottowing uses shall be permitted on the first floor or street level ftoOr within a structure, subiect to issuance of a conditional use permit in accordance with the provisions of chapter 16 of this title: Barbershops, beauty shops and beauty parlors' Conference facilities and meeting rooms. TemPorary Business Olfice Additional uses determined to be similar to conditional uses described in this subsection, in accordance with the provisions of section 12-3-4 of this title. chaprer 12-16: CONDITIONAL USES PERMITS (in part) Section 1 2-1 6-l : Purpose; Limitations In order to provide the flexibility necessary to achieve the objectives of this title, specified uses are permifted in certain districts subiect to the granting of a conditional use permit. Because of their unusual or special characteristics, conditional uses require review so that they may be located properly with respect to the purposes of this title and with respect to their effects on surrounding properties. The review process prescribed in this chapter is intended to assure compatibitity and harmonious development between conditional uses and surrounding properties in the Town at large. Uses listed as conditional uses in the various districts may be permitted subject to such conditions and limitations as the Town may prescribe to insure that the location and operation of the conditional uses witl be in accordance with the development objectives of the Town and witl not be detrimental to other uses or properties. Where conditions cannot be devised, to achieve these objectives, applications for conditional use permits shall be denied. B. Lionshead Redevelopment Master Plan The Treetop building is also governed by the development objectives as stated in the Lionshead Redevelopment Masler Plan. Of the six Policy Objectives outlined in the Lionshead Redevelopment Master Plan, staff has identified the following objective as applicable to this proposal: 2.3.1 Renewal and Redeveloqment Lionshead can and should be renewed and redevelopment to become a warmer, more vibrant environment for guests and residents. Lionshead needs an appealing and coherent identity, a sense of place, a personality, a purpose, and an improved aesthetic character. 2.3.2 Vitalitv and Amenities We must seize the opportunity to enhance guest experience and community interaction through expanded and additional activities and amenities such as performing art venues, conference facilities, ice rinks, streetscape, paks and other recreatia nal im provem e nts. V. ZONING ANALYSIS Zoning:Lionshead Mixed Use 1 District Land Use Plan Designation: Lionshead Redevelopment Master Plan Area Current Land Use: Temporary Business Office Development Standard Parkino Reouired 14.6 spaces Prooosed 21 .13 spaces (no change) vt. As this conditional use permit request only affects the use of an existing tenant space and does not propose any exterior changes to the existing building; this conditional use permit proposal does not alter the existing lot area and site dimensions, setbacks, building height and bulk, density, gross residential floor area (GRFA)' site coverage' or landsciping and site development. The only development standard. affected, other than use, is iar[ing. This proposal increases the parking demand for.this..tenant space from 12.5 to'14.6 fiarking ipaces. The existing Treetops commercialbuilding currently has surplus parking, and if'tfris proposal is approved, the Treetops commercial building will still exceed its minimum parking requirement by 6.53 parking spaces. Relationship and impact of the use on the development obiectives of the Town. Staff does not believe the proposed extension of lhe conditional use permit for "temporary busrness offbe' uses on the first floor of the Treetops building until 20i 1 is i:onsistent with the intent, purpose, or standards of sections 12- 2-2 and 12-7H-3, Vail Town Gode' ordinance No. 26, Series of 2004, was the legislation that allowed existing Lionshead area office uses, which are displaced by the construction activities of redevelopment projects, to be temporarily relocated within the Lionshead area. stafl believes the purpose of ordinance No. 26 was lo allow only for the ,temporary" relocation of business offices. In 2004, it was determined that a business office use is considered temporary in nature, only if that use is not conducted for more than three years. lt was determined that a time period of three years can adequately accommodate temporary otfice ielocations necessary to facilitate redevelopment projects in Lionshead, and that longer durations of time may have negative impacts to the pedestrian retail chiracter of Lionshead. Therefore, Staff does not recommend approval of the applicant's request to extend the approval of the 2005 conditional use permit from 2008 until 2011. The intent of Ordinance No. 26 is that once redevelopment construclion activities are completed, a business office will return to its original location/development site. The purpose ol Ordinance No. 26 is not to allow for the permanent or quasi-permanenl relocalion of a business use to a location not generally allowed by the zoning standards of the Lionshead Mixed Use 1 District. While there are no approved redevelopment plans for the North Day Lot, it is anticipated that portions of the Arrabelle project will be obtaining temporary certificates of occupancy prior to the original January 4. 24,2008, expiration of the 2005 conditional use permit. Therefore, Staff does not recommend approval of the applicant's request to eliminale ties between the 2005 conditional use permit and the occupancy of the Arrabelle proiect' While the applicant received conditional use permit approval for the "temporary business office" on the first floor of the Treetops commercial building on January 24, 2005, the applicant did not obtain approval of a lemporary certificate of occupancy to begin operation of the temporary business use until April 8, 2005. Therefore, Staff recommends the Planning and Environmental Commission approve an extension of the 2005 conditional use permit approval until April 8, 2008 (i.e. three years from the original date of occupancy). Staff recommends that the Planning and Environmental Commission maintain the original condition of approval that the 2005 conditional use permit shall expire upon the issuance of a temporary or final certificate of occupancy for the Arrabelle project, should that event occur prior to AprilS, 2008. The effect of the use on light and air, distribution of population, transportation facilities, utilities, schools, parks and recreation facilities, and other public facilities needs. Staff does not believe this proposal will have a significant negative effecl on the above criteria in comparison to existing conditions. Elfect upon traffic with particular reference to congestion, automotive and pedestrian safety and convenience, traffic flow and control, access, maneuverability, and removal of snow lrom the street and parking areas. As this proposal exceeds the minimum parking standards of the Vail Town Code, Staff does not believe this proposal will have a significant negative effect on the above criteria in comparison to existing conditions. Etfect upon the character of the area in which the proposed use is to be located, including the scale and bulk ol the proposed use in relation to surrounding uses. This proposal does not involve any exterior changes to the existing Treetops commercial building. Should the 2005 conditional use permit expire within three years of the original occupancy of the temporary business office, Staff does not believe this proposal will have a significant negative effect on the above criteria in comparison to existing conditions. However, should the approval of this temporary business office be extended beyond three year, contrary to the time limits prescribed by the Vail Town Code, Staff believes this office use on the first floor may begin to have negative affects upon the pedestrian retail character of the Lionshead area. VIII. STAFFRECOMMENDATION Should the Planning and Environmental Commission choose to approve this conditional use permit application with the timelines requested by the applicant, the Department of Community Development recommends the Commission also fonrards a recommendation to the Town Council for an amendment to the definition of a'temporary busrness office"as prescribed by Section 12-2-2, Definitions, Vail Town Code' Otherwise, the Department ol Community Development recommends the Planning and Environmental Commission approves, with conditions, this conditional use permit request to allow for the proposed "temporary business officed', located at 450 East Lionshead Circle (Treetops commercial building). DESCRIPTION OF THE REQUEST Vail Resorts is requesting a conditional use permit to allow for the conversion of existing vacant retail space on the second-story of the Treetops commercial building into business offices. These new offices will occupy 2,000 sq. ft. of the existing 2,710 sq. ft. total second floor area, and will be accessed through the existing first floor vestibule. These business offices will be temporary in nature, as they will be occupied by Vail Resort's construction management personnel during construction of the Lionshead Core Site development (i.e. Arrabelle) and will be removed upon the issuance of a final certificate of occupancy for the Arrabelle. There are no exterior building renovations associated with this proposal. There is no Design Review Board proposal related to the request. A vicinity map (Attachment A), the applicant's request (Attachment B), and architectural floor plans (Attachment C) have been attached for reference. l[.BACKGROUND On November 16, 2004, the Vail Town Council adopted Ordinance No. 26, Series of 2004, to allow "Temporary Business Offices" on the first-floor of buildings within the Lionshead Mixed Use 1 zone district. The purpose of this ordinance is to allow existing Lionshead area office uses, which are displaced by the construction of redevelopment projects, to be temporarily relocated within the Lionshead area. ln January of 2005, the Planning and Environmental Commission approved a conditional use permit to allow Vail Resort's to relocate mountain operations offices from the Gondola Building to the first- floor of the Treetops Commercial Building. REVIEWING BOARD ROLES Order of Review: Generally, conditional use permit applications will be reviewed by the Planning and Environmental Commission, and then any accompanying design review application will be reviewed by the Design Review Board. Planning and Environmental Gommission: The Planning and Environmental Commission is responsible for final approval, approval with modifications, or denial of a conditional use permit application, in accordance with Chapter 12-16, Conditional Use Permits, Vail Town Code. Design Review Board: The Design Review Board has no review authority over a conditional use permit application. However, the Design Review Board is responsible for the final approval, approval with modifications, or denial of any accompanying design review application. Town Council: The Town Council has the authority to hear and decide appeals from any decision, determination, or interpretation by the Planning and Environmenlal Commission and/or Design Review Board. The Town Council may also call up a decision of the Planning and Environmental Commission and/or Design Review Board. Staff: The Town Staff facilitates the application review process. Lionshead Mixed Use 1 District, in accordance with the Lionshead Redevelopment Master Plan, is intended to ensure adequate light, air, open space and other amenities appropriate to the permitted types of buildings and uses and to maintain the desirable qualities of the District by establishing appropriate site development sfandards. This District is meant to encourage and provide incentives for redevelopment in accordance with the Lionshead Redevelopment Master Plan. This Zone District was specifically developed to provide incentives for propefties to redevelop. The ultimate goal of these incentives is to create an economically vibrant lodging, housing, and commercial core area. The incentives in this Zone District include rncreases in allowable gross resldential floor area, building height, and density over the previously established zoning in the Lionshead Redevelopment Master Plan study area. The primary goal of the incentives is to create economic conditions favorable to inducing private redevelopment consisfent with the Lionshead Redevelopment Master Plan. Additionally, the incentives are created to help finance public off-site improvements adjacent to redevelopment projects. The applicant is requesting approval of a conditional use permit for a business office on the second floor in Lionshead, consistent with the standards of the Lionshead Mixed Use 1 zone district. Although not applied to this application, the Town of Vail recently adopted Ordinance No. 26, Series of 2004, which allows for the temporary relocation of business office uses to the first floor of buildings within Lionshead. The Lionshead Mixed Use 1 zone district standards previously did not allow otfice uses on the first floor; however, the Town of Vail determined that the approval of new and relocated office uses within Lionshead will be necessary to facilitate redevelopment construction. Staff believes the applicant's proposed temporary construction management office on the second floor of the Treetops building not only complies with the Town's zoning regulations, but it also furthers the Town's objective of redeveloping Lionshead. 2. The construction management team is in need of office space in close proximity to the Arrabelle. This proposal involves the use of a portion of the mezzanine/second level of the Treetops Building for these offices. As prescribed by the LHMU-l zone district, "Business or Professional Offices" are permitted above ground level subject to the issuance of a conditional use permit. Background on the Treetops Building The development of the Anabelle will necessitate the removal of the Gondola Building and in doing so the removal of approximately 14,000 square feet of office space, This existing oflice space is utilized by VR employees directly related to the operation of Vail Mountain. ln order to replace a portion of this office space a Conditional Use request for temporary of{ices on the first level of the Treetops building was approved by the Town this past winter. Zoning Considerations The proposed use will not involve any changes to the exterior of the building. The purpose of this ordinance is to allow existing Lionshead area office uses, which are displaced by the construction of redevelopment projects, to be temporarily relocated within the Lionshead area. REVIEWING BOARD ROLES Order of Review: Generally, applications will be reviewed first by the PEC for acceptabili$ of use and then by the DRB for compliance of proposed buildings and site planning. Planninq and Environmental Commission: The PECis responsrb/e for final approval, approval with modifications, or denial of CUP. Desiqn Review Board: The DRB has NO review authority on a CUP, but must review any accompanying DRB application. Town Council: Actions of DRB or PEC maybe appealed to the Town Council or by the Town Council. Town Council evaluates whether or not the PEC or DRB erred with approvals or denials and can uphold, uphold with modifications, or overturn the board's decision. Staff does not believe this proposal will have a significant negative effect on the above criteria in comparison to existing conditions. As this proposal exceeds the minimum parking standards of the Vail Town Code, Staff does not believe this proposal will have a significant negative eff€ct on the above criteria in comparison to existing conditions. 4. When the amount of light reflected onto the photodiode reaches the sensitivity setting, the smoke sampling rate increases. Three (3) successive smoke sensings above the sensitivity setting are required to sound an alarm. This design has superior protection against false alarms caused by dust, insects, RF and ambienf light. A confirmed alarm causes the normally flashing power indicator LED to light continuously and the alarm relay to operate. A trouble indication is automatically displayed by flashing the LED every second. This meets NFPA 72 field sensitivity testing requirements. An internal 85 dB horn (available in "S" models) emits a temporal 3 when the detector alarms and a steady tone when power polarity is reversed. The proprietary optical sensing chamber is field replaceable, allowing quick and easy cleaning and maintenance. Models with auxiliary relays are approved for releasing service. DESCRIPTION SPECIFICATIONS INSTALLATION CAUTIONS ELECTRICAL RATINGS LISTINGS AND APPROVALS Description The Series 600 heat detector is attractive, durable and features a combination rate-of-rise and fixed temperature operation. The heat detectors are available in 135oF (57oC) or 200oF (94oC) temperature ratings. Rate-of-Rise The rate-of-rise function detects heat quickly by responding to a rapid temperature increase. The pneumatic element responds to a rapid rise in temperature, approximately 15'F (8"C) per minute, when the air expands faster within the sealed chamber than it can escape through the calibrated vent. The increase in preessure depresses the diaphragm, causing the electrical contacts to close the circuit. Rate-of-rise units have a wide spacing allowance of 50 foot centers. See Specilication Table for details. Fixed TemDerature The fixed temperature function reacts to heat by responding to a specific temperalure setling. The element is constructed of a fusible alloy, which fuses at the fixed temperature setting of either 135oF (57'C) or 200oF (94"C). When activated, the external heat collector drops away to provide quick visual conflrmation that the element has operated. Low Profile The units protrude only 1-3/8 inches from the ceiling surface with a junction box mounting. The pleasantly contoured, all-white finished design conforms aesthetically to most ceilings. OPERATION The BG-12 manual pull stations provide a textured finger- hold area that includes Braille text. ln addition to PUSH lN and PULL DOWN text, there are arrows indicating how lo operate the station, provided for non-English-speaking oersons. Pushing in and then pulling down on the handle activates the normally-open alarm switch. Once latched in the down Dosition, the word "ACTIVATED' appears at the top in bright yellow, with a portion of the handle protruding at the bottom as a visible flag. Resetting the station is simple: insert the key or hex (model dependent), twist one quar- terturn, then open the station's front cover, causing the spring-loaded operation handle to return to its original position. The alarm switch can then be reset to its normal (non-alarm) position manually (by hand) or by closing the station's fronl cover, which automatically resets the switch.
