Riggs, Appeal of Administrative Decision -' Vail Meadows Avalanche Plans for the proposed Riggs remodel and addition were submitted by Jim Morter for the Design Review Board's approval on July 8, 1976, A preliminary zoning check was performed' and it wasdeterminedthatLot23,Yalr:-MeadowsFilingNo.lliespartially withintheVailMeadowsAvalanchepath.Pursuanttotheprovisions of Section 16.200 (5) which states: l'AnEnvironmentallmpactReportshallbesubmitted to ine zoning Administrator for any proiect which such a report is required by federal or ;;;;; law, or fbr anv project which the Zoning lo'i.,i't"atordeterminesmaysignificantlychange the environment, either during construction or an a continuing'basis, in one or more of the following respects:,..Potentiatly results in ;;;i;;;#, la-nd'slide , siltation, settlement 'ir".O, or other land'form change or hazard to the applicant health and safetY.,," was informed that he must prepare a detailed avalanche given, which approval is report before zoning approval could be requi-red Prior to Design Review' An on-site inspection earlier thj-s spring by Art Mears of McDowell,Scott&CoxindicatedthatthewatertankownedbyGore ValleyWaterDistrictislocatedina"high]nazard'areaandcouldbe Page Two Riggs rupturedbytheimpactofanavalanche,thusreleasingS00'000 galtons of water further endangering people and property in the vail Meadowsavalanchearea,Artstronglyrecommendedthatnoimprove- mentsbeallowedwithintheavalancheareauntilfurtherstudy is completed and defense structures provided to protect the water t ank. Tocomplicatemattersfurther,thenecessarydetailedpre- timinary report has been prepared for George Rau who also owns an avalanche endangered 1ot; however, Mr' Rau refuses to make the report publ-ic until such time as other property oqtners impacted by the avalanche agree to share in the cost of the report ($2,500)' Mr. Rau did provide me with a copy of the report for my use with the absolute understanding that no copies would be made or circulated until such time as an agreement on cost-sharing has been reached' He has suggested that the Town of Vail reimburse him for a llrtion of the cost of the report The o.nlrr*."t of community Development would recommend this approach since the Town of va.il will need the report's contents to pursue actiononthepartoftheGoreValleylYaterDistricttoprotect the water tank, The detailed report which cannot become a part of the public record indicates that about l/3 of the Riggs 1ot is in the avalanche path (approximately * in high lnazard' and * in moderate nazard) and that the existing residence on Lot 23 could be impacted' FlowintheVailMeadowsAva]anchepathisestimatedatll5feet deep with velocities over 112 miles per hour' The annual recurrence Page Three Riggs probability of the designated avaranche is estimated at between r% and 27o, and, tree analysis indicated that avalanches reached the water tank Tocation betrveen 1g60 and lgZO. The applicant argues that the decision to deny zoning approval should be reversed based on the following information, and we feel that they are invalid for the following reasons: 1, the proposed new construction is not located on that portion of the site where the avalanche hazard exists; The information and maps contained in the reports do not indicate the precise locition of the existing residence nor have specific engineering studies been prepared.indicating specific siting and d.esigns for "oy ,i"u"ture within the avalanche zone, 2. the proposed new construction is situated on the opposite site of_ the existing structure from the direction oi tne avalanche: If an avalanche were to strike the existing residence at f]ow depths indicated. and with impacl of over 600 pounds per square foot, the house p.1us the new add.ition would be destroyed as a normal structure is designed to withstand no more than 50 or 60 pounds per square foot of pressure. 3' the proposed new garage and storage area are non-occupied space, and constitute no threat to health or safety; could pe in .n" *113ff :; 3i:?I;""";l;**1.;oll';":l;:";:*S?li.o even though they are not habitable space. 4. the proposed enlargement of the living room is simply an enlargement of an existing space, and constitutes no additional threat to health or safety; - This statement is correct, but additional property could be destroyed, 5. by converting the home from duplex to single-famiry, &Dy hazard that does exist is reduced from two families'to one. This statement is also true; however, the enlarged space would be capable of accommodating as many or more guests regardless of whether it is occupies by one or'two families. Page Four .
