As we have discussed, further information is necessary to review this item before it can be heard by the Town Council. The following items will be necessary to proceed with the application. 1. Survey of the property showing existing conditions and parking. 2. List of names and addresses of adjacent property owners. 3. The owners original written approval. 4. A copy of the ninety-nine year lease agreement between Sandstone 70 and The Printery owners. After discussing this item with Larry Eskwith, our Town Attorney, I have determined that the date that the Printery ceased to conduct business on the property will be considered the date for the discontinuance of use. The date of bankruptcy settlement will not be the date of discontinuance. This is very important in that when a legal nonconforming use is discontinued for a period of more than one year, it is no longer considered a legal nonconforming use and the standard zoning is applicable. We checked our files on the Printery Building relative to conditional uses, and found that it is possible to have another use in the Printery Building if the Town Council deems the new use to be similar to the approved Printery use . This procedure is described in the letter to Anna Marie Mueller dated July 16, 1991 . The files reveal the following: 1 . On May 9, 1974, the Planning Commission heard the request for a conditional use for the Printery Building. The application states: "to convert present dormitory units and studio apartment to professional office for graphics, design and lithographic services. This was approved. 2 . We can find no memo to the Planning Commission meeting, but did find a memo to the Town Council and Town Council minutes . 3 . At the time the Printery began doing business, the property on which it was located was zoned Medium Density Multiple Family which allowed offices as conditional uses. The Printery received a conditional use permit to operate as an office. The zoning code was changed in Ordinance # 37 of 1980, and offices were removed as conditional uses . The Printery then became a nonconforming use. 4 . A nonconforming use may not be enlarged. A nonconforming use cannot be changed to another nonconforming use unless permission has been granted by the Town Council . Prior to granting permission, the Town Council shall determine that the proposed use does not substantially differ from the existing nonconforming use. Enclosed are the papers from the Printery file which relate to this subject along with a list of zoning actions . I want to emphasize that you could quite possibly have another non- conforming use in the Printery Building as long as the Council gives their approval . Furthermore, the Printery building can be used for residential use, and if you wished to have an office in the residence, you could apply for a home occupation license. Zoning information is as follows : Zone : Medium Density Multi-Family (please see MDMF zone district enclosed) Lot size: 6, 641 sq ft (This is based on information you gave us . The Printery moved out of this location approximately three months ago . At the - - time the Printery began doing business, the property on which it was located was zoned Medium Density Multiple Family which allowed offices as conditional uses. The Printery received a conditional use permit to operate as an office . The zoning code was changed in 1980 and offices were removed as conditional uses . The Printery then became a nonconforming use . A nonconforming use may not be enlarged. Therefore, a second floor .. may not be added to the Printery Building in its present use. According to the Vail zoning code, Section 18 . 64 .080, a nonconforming use cannot be changed to another nonconforming use unless permission has been granted by the Town Council. Prior to granting permission, the Town Council shall determine that the proposed use does not substantially differ from the existing t . nonconforming use. If you wish, you may apply to the Town Council for a determination of whether of not an interior design service and shop is a use that does not substantially differ from the Printery. V MEMORANDUM TO: TOWN COUNCIL FROM: PLANNING COMMISSION RE: CONDITIONAL USE PERMIT REQUEST - LOU PARKER - SANDSTONE STAFF HOUSE - THE PRINTERY . DATE: JUNE 4, 1974 At its May 9, 1974 meeting, the Planning Commission unanimously approved the Conditional Use Permit request for Lou Parker to establish a printing business and office in the Sandstone Staff House. The Commission found that the Conditional Use Permit could be granted based on the following findings, in accordance with Section 18.600 of the zoning ordinance: -- (1) That the proposed location of the use is in accord with the purposes of this ordinance and the purposes of the district in which the site is located; (2) That the proposed location of the use and the conditions under which it would be operated or maintained will not be detrimental to the public ' health, safety, or welfare, or materially injurious to properties or improvements in the vicinity; • (3) That the proposed use will comply with each of the applicable provisions of this ordinance. The Commission is also in receipt of a letter from the Sandstone Condominium Association indicating that they do not object to the requested use. ML/nmm June 4, 1974 ,, Page 4 C-\ Regarding a request by Mery Lapin for a time extension for a variance previously granted to Crossroads East, it was explained that the variance was initiated at the Town' s request. Councilman Staufer stated that if this time ex- tension is granted, the zoning ordinance should be amended. He recommended that instead Mr. Lapin should re-apply for the variance after its expiration, and if there is no significant change in the Master Plan at that time, the variance would again be granted. Mr. Minger instructed his staff to send such a letter to Mery Lapin. Councilman Donovan moved that the matter be handled in accordance with Mr. Minger' s in- structions . Mayor Dobson stated that the variance request will be approved at a later date if there is no significant change which would affect the public good. With regard to a request by Lou Parker for a Conditional Use Permit to allow the Sandstone Staff House to be used as offices for The Printery, the zoning administrator stated that there were no objections by the surrounding neighbors . Councilman Donovan moved to grant the Conditional Use Permit; Councilman (` White seconded the motion; the vote was unanimous in favor; and the motion carried. With regard to a request for a parking exemption to allow expansion of the Covered Bridge Store , Mayor Dobson stepped down and Mayor Pro Tem White presided over this portion of the meeting. Mr. Dobson requested an exemption of three spaces for enlargement of the building to be used as office , storage and retail space. The Covered Bridge Store is presently a non-conforming building with regard to parking. According to Mayor Pro Tem White , the precedent has been set with variances granted to the Red Lion , Slifer and Company, and Manfred Schober. Councilman Donovan moved to grant the exemption; Councilman White seconded the motion; the vote was unanimous in favor and the exemption was granted. Mr. Minger stated the administration policy that all signs which are not official regulatory signs shall in future be submitted to the Design Review Board for their approval. A member of the audience, Mr. Robert Buterbaugh, asked that there be an ordinance restricting cigarette smoking at Town Council meetings. Since there was no further business, the meeting was adjourned , at 10 : 40 P.M. The Local Liquor Licensing Authority was then convened at 10 : 45 P.M. With regard to a request for a Beer, Wine and Liquor License from Lothar and Lieselotte Klaschik for the Hansel and Gretel Restaurant to be located in the Sunbird Lodge at Lionshead, the Mayor asked if the application were in order. The Town Clerk and Chief of Police reported that requirements had been fulfilled. Stewart Brown, representing the Klaschiks , submitted petitions of approximately 115 names as Exhibit A to indicate the needs of the neighborhood. The applicant states that most of the work performed is silk screening which creates no dust or noise and that most signs are silk screened directly on customers windows on site. No traffic is generated as customers do not come to the shop. The Planning Commission must make the following findings before granting the amendment to the Conditional Use Permit: 1 . ) That the proposed location of the use and in accordance with the purpose of this Title and the purposes of the District in which the site is located. 2.) A set of plans along with a model were presented for Commission review. The applicant asks for a 31/2-foot variance which is caused by the height of the house. The Commission was in agreement that to keep trees, and to minimize cuts and retaining walls, requests for setback variances of this type are valid. The Motion was made by Gerry White for approval of the request for a Setback Variance and distance between buildings for the Thomas Residence on Lot 2, Block 1 , Vail Village 13th Filing in accordance with the memorandum as issued by the Department of Community Development. Seconded by Scott Hopman. There was no discussion and this Motion was unanimously approved. The next item on the agenda: GORE CREEK FLOOD PLAIN. After discussion by the Commission, a Motion was made by Gerry White to accept the study done by Hydro-Triad on the Gore Creek Flood Plain dated January 1978 and amend the comprehensive maps and plans, in accordance with the memorandum issued by the Department of Community Development. Gart Garage front setback variance, Lot 12, Block 7, Vail Village 1st Peter presented the memo and said that there still remains basically no hardship, and that there was not much change from the first memo sub- mitted for the October 13 meeting, recommending denial. Jerry Gart explained that there were only 2 units in the building, not 3, and that he was using it as a single family home. He added that there had been a garage, but that the driveway was too steep and the garage had been changed into the secondary unit. Mr. Gart described neighbors on either side of his house who were closer to the street than his requested garage would be. He felt that the garage would add to the appearance of the house while hiding the trash. Jim Morgan moved to approve the variance, and John Perkins seconded it. Peter Patten explained that there was no memo, and that the letters received frcm the Sandstone 70 condominium association, and from Vail Guides, and copies of the original Planning minutes and memo explained the problem. He added that excessive vehicles and not adhering to the original agreement by Vail Guides not to store any vehicles there, seemed to be the major problem. Jim Rea, owner of Vail Guides, Inc. , addressed the Commission to point out that until he received a copy of the letter from Sandstone 70 to the Planning Commission, he had not been aware of any problem. He admitted that sometimes there had been too many vehicles, and that he planned to modify the employee manual and make clear that this is not to happen again. He explained that drivers park to come in to get their instructions perhaps 10-15 minutes. Bill Pierce, President of Sandstone 70 Condos read from the letters and minutes that Peter referred to, adding that the vehicles block the South access. He stated that Sandstone's agreement eith the Printery Building was that 9 parking spaces was for the Printery from 8-5. Ted Martin, an owner in Sandstone and a Vail fireman stated that the number of vehicles from Vail Guides presented a problem with fire access. • Dan Corcoran added that some of 'the Vail Guide vehicles had been observed parking on the Frontage Road as well. Several commission members suggested that the two parties should get together to try to solve the problem themselves. He referred to the memo, reiterating that much study had been done and much deliberation went into the hazard ordinance (see memo) . i Vail has received much praise from the Colorado Geological Survey concerning this or - \ dinance which was well researched. 1 (::)Ni) The second point is the concern with downzoning. Luke purchased his property in 1966 when it was in the County, and then he could have 28 units on lots 2 3. Now it is zoned for a total of 6 units on lots 2 $ 3. This is the issue: progressive ordinance is inevitable. Peter asked for denial . Bill Luke spoke about the site plan that was approved in 1973 by the County for 12 units for lot 3, and added that the soil report for 1973 was "clean". He explained that the Town of Vail did road improvement which resulted in huge boulders being placed on his property. Now with Town zoning, 5 units could be built on lot 2, and one on lot .3. The commission members discussed changing the zoning, and asked Peter more questions about the hazard zoning. 'Mr. Luke reiterated that the boulders had changed the grade. He asked to have the request tabled until he could bring in the survey made before the road work, and one made after. Roger moved that this item be tabled, seconded by . Vote was in favor of tabling, unanimous vote, 7-0. 7. Landmarc setback variance, Lot 7, Block 1, Gore,Creek' Park. Peter Patten presented the memo, described the background, recommended approval. Rick Baldec of Mountain High Enterprises explained that the gas line had been located, . but the size had not been known. Peter said the gas company would really like to see 10' distance from the house. He went on to repeat that the alternatives are worse. They are: move the gas line redesign the house Rick mentioned that the gas company wanted someone from their office on the site at- : „ all times when work is underway. He explained that the gas line is not in the center of the right of way. The deck would be in the flood plain if the house was moved, i but that was all. The Printery --------moved out of this location approximately three months ago. At the -- -- time the Printery began doing business, the property on which it was located was zoned Medium Density Multiple Family which allowed offices as conditional uses. The Printery received a conditional use permit to operate as an office. The zoning code was changed in 1980 and offices were removed as conditional uses. The Printery then became a nonconforming use. A nonconforming use may not be enlarged. Therefore, a second floor may not be added to the Printery Building in its present use. • According to the Vail zoning code, Section 18 .64 .080, a • nonconforming use cannot be changed to another nonconforming use unless permission has been granted by the Town Council. Prior to granting permission, the Town Council shall determine that the .. proposed use does not substantially differ from the existing - ; nonconforming use. If you ,wish, you may apply to the Town Council for a determination of whether of not an interior design service and shop is a use that does not substantially differ from the Printery.
