This Commitment is preliminary to the issuance of such policy or policies of title insurance and all liability and obligations hereunder shall cease and terminate six months after the effective date hereof or when the policy or policies committed for shall issue,whichever first occurs,provided that the failure to issue such policy or policies is not the fault of the Company. CONDITIONS AND STIPULATIONS 1. The term"mortgage",when used herein,shall include deed of trust,trust deed,or other security instrument. 2. If the proposed Insured has or acquires actual knowledge of any defect,lien,encumbrance,adverse claim or other matter affecting the estate or interest or mortgage thereon covered by this Commitment other than those shown in Schedule B hereof,and shall fail to disclose such knowledge to the Company in writing,the Company shall be relieved from liability for any loss or damage resulting from any act of reliance hereon to the extent the Company is prejudiced by failure of the proposed Insured to so disclose such knowledge. If the proposed Insured shall disclose such knowledge to the Company,or if the Company otherwise acquires actual knowledge of any such defect, lien,encumbrance,adverse claim or other matter,the Company at its option may amend Schedule B of this Commitment accordingly,but such amendment shall not relieve the Company from liability previously incurred pursuant to paragraph 3 of these Conditions and Stipulations. 3. Liability of the Company under this Commitment shall be only to the named proposed Insured and such parties included under the definition of Insured in the form of policy or policies committed for and only for actual loss incurred in reliance hereon in undertaking in good faith(a)to comply with the requirements hereof or(b)to eliminate exceptions shown in Schedule B,or(c)to acquire or create the estate or interest or mortgage thereon covered by this Commitment. In no event shall such liability exceed the amount stated in Schedule A for the policy or policies committed for and such liability is subject to the insuring provisions and the Conditions and Stipulations and the exclusions from Coverage of the form of policy or policies committed for in favor of the proposed Insured which are hereby incorporated by reference and made a part of this Commitment except as expressly modified herein. 4. Any action or actions or rights of action that the proposed Insured may have or may bring against the Company arising out of the status of the title to the estate or interest or the status of the mortgage thereon covered by this Commitment must be based on and are subject to the provisions of this Commitment. STANDARD EXCEPTIONS In addition to the matters contained in the Conditions and Stipulations and Exclusions from Coverage above referred to,this Commitment is also subject to the following: 1. Rights or claims of parties in possession not shown by the public records. 2. Easements, or claims of easements, not shown by the public records. 3. Discrepancies, conflicts in boundary lines, shortage in area, encroachments, and any facts which a correct survey and inspection of the premises would disclose and which are not shown by the public records. 4. FINAL SITE PLAN After a building permit has been issued, and when the project is underway, the following will be required before any building receives a framing inspection from the Building Department: Two copies of a certified improvement survey showing: A. Building locations with ties to property corners, i.e. distances and angles. B. Building dimensions to the nearest tenth of a foot. C. All utility service lines, as-builts, showing size of lines, type of material used, and exact locations. D. Drainage as-builts. E. Basis of bearing to tie to section corner. F. All property pins are to be either found or set and stated on map. G. All easements. H. Building floor elevations and all roof ridge elevations with existing and proposed grades shown underneath. V. CONCEPTUAL DESIGN REVIEW 1. Submittal recruirements: The owner or authorized agent of any project requiring design approval as prescribed by this chapter may submit plans for conceptual review by the Design Review Board to the Department of Community Development. The purpose of a conceptual review shall be to give the applicant a basic understanding with respect to the design concept and the compatibility of a proposal with the Design Guidelines contained within this chapter. This procedure is recommended mainly for those applications of a higher impact tha-a single-family and two-family residences although projects of that nature shall not be excluded from the opportunity to request a conceptual design review. The following information shall be submitted for a - conceptual review: a. A conceptual site and landscape plan at a minimum scale of one inch equals twenty feet; b. Conceptual elevations and exterior materials and a description of the character of the proposed structure or structures; c. Sufficient information to show that the proposal complies with the development standards of the zone district in which the project is to be located (i.e. 'GRFA, site coverage calculations, number of parking spaces, etc. ) ; d. Completed application form; e. Planning and Environmental Commission and or Town Council approval if required. 2 . Procedure: Upon receipt of an application for conceptual design review, the Department of Community Development shall review the submitted materials for general compliance with the appropriate requirements of the zoning code. If the proposal is in basic compliance with the zoning code requirements, the project shall be forwarded to the DRB for conceptual review. If the application is not generally in compliance with zoning code requirements, the application and submittal materials shall be returned to the applicant with a written explanation of the Department of Community Development's findings. The DRB shall review the application and supporting material that has been submitted for a conceptual review in order to determine whether or not the project generally complies with the design guidelines. No vote of the DRB will be required unless requested by the applicant. The property owner or his representative shall be present at the DRB hearing. J B. Exterior surfacing materials and colors shall be specified and submitted for review on the materials list (attached) . Color chips, siding samples etc. , should be presented at the Design Review Board meeting. F. Zone check list (attached) must be completed if project is zoned Single-Family, Primary/Secondary or Duplex. G. The Zoning Administrator and/or DRB may require the submission of additional plans, drawings, specifications, samples and other materials (including a model) if deemed necessary to determine whether a project will comply with Design Guidelines. II. 7INOR ALTERATIONS TO THE EXTERIOR OF BUILDINGS. Photos or sketches that clearly indicate what is proposed and the location (site plan) of the proposal may be submitted in lieu of the more formal requirements given above, as long as they provide all important specifications for the proposal including colors and materials to be used. I do understand that you had a conversation with Mike Mollica recently, (8/13/91) concerning this issue and that correspondence with the adjacent homeowners association is still in progress . As you have already been notified, the bar drain as designed is not approved without an acceptable means for disposing surface water created by the pumping of ground water from your site to the adjoining property owners . Be it also known that the perimeter drain as installed has no point for daylight and as such has no slope for drainage as these systems are normally installed. The furnace equipment being installed in the crawl spaces of these units will have to be protected from ground water exposure in some manner acceptable to the inspector assigned. Be it also advised that a Soils Report on the Sundial project has of this date not been received by the Town of Vail Building Department . Such Soils Report must be received and approved prior to requesting a frame inspection on this project. Box 412 Avon, CO 81620 Re: Foundation Excavation Inspection Parcel 4, Sundial Phase I Project No. 91411G Dear Mr. Haney, As you have requested, on August 19, 1991 I inspected the soil conditions on Parcel 4, Sundial Phase I in the Town of Vail. The residence is under construction. The foundation is complete and backfilled and framing of the structure in progress. In the crawl space the interior footings seem to be placed on undisturbed native soils consisting of clayey sand and gravel with cobbles. The ground surface in the crawl space was very moist. Review of the official maps and the Ordinance No. 5 for the Town of Vail do not classify the lot as lying within a geologically sensitive area. The parcel is located on a high stable gravel covered terrace above the physiographic flood plain of Gore Creek, according to the Geologic Mapping for Eagle County, Colorado prepared by Charles S. Robinson & Associates, Inc. , dated 1975. The site drains northerly, westerly and southwesterly from the building at gentle slopes of less than 5 percent. There was a sudden drop trom. the back' of the building towards the back lot •. line, indicating fill. Near the westerly lot line there was an open trench with standing water in it. The trench was about 6 feet wide at the end near the street extending for about 40 feet toward the back of the lot where it widened to about 10 feet. The water was about 2 feet deep at the narrow end and about 3 feet at the wide end. There was. a sump pump at the wide end. The soil profile exposed in the excavated trench was composed of approximately 4 feet of fill material consisting of clayey sand and gravel with cobbles, underlain by layered stream sediments. The material excavated from the trench was piled along the trench and consisted of sand, gravel, cobbles and boulders of about 2.5 feet diameter. In soils as permeable as the stream terrace deposits standing water would indicate a groundwater table. The foundation walls were water proofed, as exposed on the north face of the building, with asphalt coating and lined with polyethylene moisture barrier covered with washed gravel. According to the architect Steven Richards there is a trench excavated on the east and southeast side of the building approximately 15 feet away from the building where a perforated drain pipe is laid in a bed of gravel that is supposed to divert the water from the building into the open trench on the west side of the building. The types of soils on which the building of Parcel 4 is supported generally do not exhibit hydroconsolidation potential and their bearing capacity is in the 2000 psf range. One problem at the present and in the future would be the high ground water table. The seasonal fluctuations can introduce water into the CreNaA5Paqe and ;possibly under the-ggarage slab The soils are permeable enough that the water should recede as fast as it comes in. A granular mat (-3/4 inch, less than 5 percent passing No. 200 sieve) should be provided below the floor slabs. This should be a minimum of four inches in thickness and compacted. The purpose of this granular mat is to provide a capillary break between the subgrade and the slab. at or moisture„in the crawl space can have 'deteriorating effect on the /exposed wood of the subflooring. We recommend that youonsider taking some measure to protect the expczied wood structure, in the crawl space. If it is determined that the negligence of either owner was the cause of said damage or destruction,such negligent party shall bear the entire cost of repair or reconstruction. If the owner of the damaged improvements does not commence repair or reconstruction within thirty(30)days from the date that the damage occurs.the other owner may do so provided,however, that such repair or reconstruction shall not be undertaken without prior notice to any holder of the first deed of trust encumbering the improvements damaged or destroyed,and further, provided that such beneficiary of said deed of trust may. by reasonable notice,refuse to consent to such repair or replacement. Should any owner fail or refuse to pay his proportionate share of the cost of repair or replacement, the other owner may make payments and shall be entitled to have a mechanic's lien on the premises of the party so failing to pay for the amount of such defaulting party's share of the repair or replacement cost, with interest at the rate of 18% per annum, costs, and reasonable attorney's fees. 11.Each owner shall obtain and maintain at all times insurance against loss or damage by fire and such other hazards as are generally covered in the area under standard extended coverage provision, for at least the full insurable replacement cost of the improvements on the subject property owned thereby. Proof of such insurance shall be supplied by each owner upon the reasonable request of the other owner. The insurance shall provide that it cannot be cancelled by either the insured or the insurance company until written notice has been sent to the other owner. Each owner may obtain whatever additional insurance he so desires. Each owner may, at any time two years or longer after the most recent appraisal,demand of the other owner an appraisal of the improvements for insurance purposes. or at the option of the other owner,a comparative market analysis from a qualified real estate broker,and the parties shall share the costs thereof equally. The other party shall not be required to share the cost of the appraisal if the demanding party is intending to use the appraisal to facilitate the sale of his property. 12.The owners of each unit shall be individually responsible for the upkeep of the appearance of the yard and other outside facilities located on their respective parcels. However,the owners shall from time to time mutually undertake such landscaping and general outdoor improvements as they mutually and unanimously deem proper for the harmonious improvement of both parcels in a common theme. The owner of one parcel shall not unreasonably damage the value of the other parcel such as by shoddy upkeep outside,and both owners shall make reasonable efforts to preserve a harmonious common appearance of the building and the grounds. In the event the owner of one parcel shall not reasonably undertake to keep up the general appearance of his parcel, the other parcel owner may enter upon said parcel for the purpose of preserving the upkeep of said parcel and may hold the other owner liable for the reasonable costs and expenses incurred in such upkeep. The owner entering upon the other's parcel to maintain the upkeep and general appearance of said parcel shall be entitled to have a mechanic's lien on the premises of the other party for the amount of the reasonable cost of said upkeep, with, with interest at a rate of 18% per annum. costs.and reasonable attorney's fees. 13. A mutual easement for the location, installation,maintenance. repair and removal of utility facilities(including, but not limited to, systems, lines, pipes, tanks, metering and distribution devices for water, sewer,electricity, telephone and cable television) is hereby granted. together with the right of ingress and egress therefore,on,above,over and through the subject property and the improvements constructed thereon, subject to the obligation to restore as nearly as possible said subject property and improvements. All maintenance and repair with respect to said utilities shall be accomplished at the expense of the owner requiring said maintenance and repair. If both owners require maintenance and repair the expense shall be borne equally by both owners. 14.The lots shall have a common driveway,and there is granted hereby a non-exclusive easement for ingress and egress purposes over and across those portions of such parcels noted as the driveway on the plat. No owner shall hinder nor permit his guest to hinder reasonable access by the other owner and his guest to the building and parking areas and. further, no owner shall take or prevent his guest to take more than one-half of the parking spaces provided without the consent of the other owner. It is presumed that snowplowing will be occasionally required.Each owner,at his option, shall be responsible for snowplowing his half of the driveway. Other maintenance,repair or improvement of such parking and access facilities may be required from time to time,and the same shall be undertaken upon the unanimous agreement of the owners who shall share all expenses equally. 15.The easements and restrictions hereby created are and shall be perpetual and construeed as covenants running with the land and each and every person accepting by deed or otherwise any portion of the above described premises shall be deemed to have accepted such premises with the understanding that he is bound hereby and entitled to the benefit hereof,all to the same extent as though he had signed this instrument. The undersigned,in executing and delivering deeds to the above described premises may provide,by reference, in said conveyances, that the same are subject to the terms,conditions.reservations, restrictions and covenants herein contained,and may designate the book and page of the records in which this instrument is recorded. 16.These easements and restrictions may be amended or revoked only upon the recording of any instrument duly executed and acknowledged by all the then record owners of the subject premises. 17.If any provision of this instrument or any section, sentence, clause, phrase, or work,or the application thereof in any circumstance, is held invalid, the validity of the remainder of this instrument and of the application of any such provision,section, sentence,clause.phrase.or word in any other circumstance shall not be affected thereby. 18.Ownership of these units may he by any number of entities.but for all purposes herein there shall be deemed to be only two "owners", the owner of A Unit and the owner of B Unit. I do understand that you had a conversation with Mike Mollica recently, (8/13/91) concerning this issue and that correspondence with the adjacent homeowners association is still in progress . As you have already been notified, the bar drain as designed is not approved without an acceptable means for disposing surface water created by the pumping of ground water from your site to the adjoining property owners . Be it also known that the perimeter drain as installed has no point for daylight and as such has no slope for drainage as these systems are normally installed. The furnace equipment being installed in the crawl spaces of these units will have to be protected from ground water exposure in some manner acceptable to the inspector assigned. Be it also advised that a Soils Report on the Sundial project has of this date not been received by the Town of Vail Building Department . Such Soils Report must be received and approved prior to requesting a frame inspection on this project . To Whom It May Concern: After the excavation and placement of the footings for the duplex on the above-referenced parcel, free water from the mountain runoff began to migrate into the foundation and along the southeast side. To prevent over wetting and future migration of the water table into the site we have installed a bar drain along the east and south of the residence with a perforated drain system to carry the water to a dry well catch basin and sump pump. This will carry any migrating water away and down hill from the building. We are not installing a perimeter drain system as any water that might pass the bar drain could be dispersed around the entire house. Rather, we are placing granular soils and waterproofing around the foundation to keep any wetted soils away from the house. Please advise us of any comments you may have. Frontage Road Vail, CO 81657 Dear Mike, This letter is to follow up our conversation concerning M & H Development's project on Parcel 4, of Sundial Subdivision, Phase I, located in the Town of Vail. We propose the following solution to the Town and M & H' s concern involving the ground water on the site. A. Already installed on the site is a perimeter drain that runs around the footings of the entire structure. B. A drain system has already been installed along the stem walls of the foundation. C. A sump pump will be installed along the south corner of each unit. This will be installed at the approximate level of the footings of this project. D. Visqueen will be used to cover the ground within the foundation area. E. An additional air duct off the furnace will be added to the crawl space of the southeast unit. F. A perimeter drain approximately 2 feet below the footings for the structure has already been installed. This is 5 to 15 feet outside the foundation area and functions to move water around the structure. Enclosed are photographs of the site after the excavation had been completed. You will note that the ditch that surrounds the building site, which is where the perimeter drain has been installed, is considerably deeper than the building site. Our pumps this past spring and summer were pumping out of this location which is considerably lower than is necessary. The sump pumps will make it far less necessary for water to be pumped from the subsurface area. The exterior drain for each sump pump will be on the surface of the lot. There should be time for this water to percolate into the ground before leaving the site. This will be accomplished with the understanding that a TCO would be issued this fall upon completion of the structure. During the spring and early summer of 1992 the Town of Vail and M & H Develop- ment Company will review the actual workings of these two sump pumps to verify that they are functioning as expected. If the Town of Vail feels additional work should be accomplished, M & H under- stands said work will have to be accomplished by M & H Developement before a final Certificate of Occupancy will be issued on the pro- ject.
