Pursuant to your request, I am enclosing with this correspondence two copies of a newly revised site plan, as well as two duplicate copies of the floorplan and elevations which were originally submitted to you on October 4, 1994 and which continue to reflect all changes to date. I am also enclosing a letter to Chuck Seldmann dated October 20, 1994 which accompanied a transmittal of two sets of engineered and stamped structural drawings. These structural drawings contained all of the changes which have been made to date and so Pm assuming that they will satisfy your request for two sets of the structural drawings. All design changes were staff approved and mitigation is required for the loss of willows due to the intrusion beyond the limits of disturbance as shown on the revised plans. In order to complete the processing of these changes, I need one copy of Sheets Al, A2, and A3 (last revised September 27, 1994). The changes to the building need to be reflected in the structural drawings. I need two copies of revised structural sheets reflecting all changes. In response to your November 9, 1994 letter, I need additional information to review this request. As we discussed in a meeting on November 15th, the site plan needs to be revised to reflect changes to proposed grades and additional earth berm areas. The landscaping mitigation required due to previous changes to the approved plans (see October 27, 1994) should be reflected on the revised site plan. I cannot assess and approve your changes to the height of the unit without this information. Since you are already under construction, it is imperative that you submit this information as soon as possible. Continue construction on the proposed unit at your own risk. There is no guarantee that the changes requested will be approved. These changes may need to go back to the Design Review Board (DRB) since there appears to be a significant change in the volume of the unit. As usual, I need two sets of plans Id reflecting all of the proposed changes. This would include site plan, floor plans, elevation and structural drawings. The garage slab will now be at an elevation of 8,034'. If we are to proceed with the walls and 6:12 roof slope as designated in the elevations,the southern roof ridge will approach an elevation of 8,063' and the nog theily roof ridge elevation will approach an elevation of 8,066'. Based on the undisturbed site elevation of 8,033', the ridges will each be within the 33' requirement. Please contact me immediately if you find that these ridge heights would be unacceptable and the roof slope can be lessened to full within the previously approved limitations. As you can see, staff ensured that all of the development standards have been met. Staff verified that the development complied with the standards when an Improvement Location Certificate (ILC) was reviewed on August 24, 1994. If you would like to review the ILC, please stop by the office. Regarding your suggestion to eliminate single family homes as an allowed use in the Residential Cluster zone district, it will be important to hear the Planning and Environmental Commission's (PEC) discussion on the topic. I want to point out that if we are to change the Zoning Code for Residential Cluster (RC), I think it would be appropriate to look at the Low- Density Multi Family (LDMF) and Medium-Density Multi Family (MDMF) sections also. What I found was troubling, and makes me think that another zoning analysis may need to be done before Lauterbach is allowed to pull a permit for the second house. It should be noted that the lot for both houses totals almost exactly 15,000 square feet, which is the minimum allowed for development under that zoning district. To paraphrase relevant parts of the ordinance: 18.14.010 Purpose. "The residential cluster district is intended to provide sites for...at a density not exceeding six dwelling units per acre." So far so good. No violation (barely). "The residential cluster is intended to ensure adequate light, air, privacg and open space for each dwelling...and to maintain the desirable residential qualities of the district by establishing appropriate site development standards." Two huge houses with minimum setbacks would seem to violate this condition. They philosophically far overpower both the size of the lot and the neighborhood. 18.14.060 Setbacks 20' front, 15' rear and side. From my measurement, these are encroached. Remember, he doesn't own to the front street. 18.14.090 Density Control Maximum GRFA for the total site is 3,750. There is no 425 or other addition of s.f. noted in this zone district. Is each house 1,875 s.f.? 18.14.110 Coverage Maximum coverage is 25%, which on this site is only 3,750 s.f. If one considers the house footprint plus the garage extension, do both houses fit within this requirement? 18.14.140 Landscaping 60% required, which is 9,000 s.f. on this site. When one considers a net of 11,250 after building (if the 25% coverage requirement is not violated), will a total of 2,250 s.f. be adequate for driveways, mechanical, and walks? I have also attached a highlighted copy of the letter to the developer from the COE, noting that the data used for the waiver evidently derived from the developer. The subject lot is being considered for development by a local developer, and was recently staked for the Design Review Board to view the outline of a proposed building on the site. Residents of the neighborhood which surrounds the subject site strongly oppose any development on the site; we request that the proposed development be disapproved and we request that the Town of Vail enter into negotiations to acquire the site for open space to be used as a neighborhood pocket park. (1) There is a strong likelihood that much or all of the site is Wetlands, in accordance with Section 404 of 33 USC Section 1344. There is evidence of hydric soils and much of the lot is covered with hydrophytic vegetation. Mr. Mike Claffey of the Army Corps of Engineers viewed the site during the fall of 1993, concluded that the potential of Wetlands existed and advised that a second visit to the site would be made in the late spring or early summer of 1994 to make a final determination of the existence or non existence of Wetlands and/or whether a prior owner had destroyed Wetlands. This second visit has not yet occurred, therefore any development on the site would precede and therefore be in violation of any ruling made by the Army Corps of Engineers. If a 404 permit is issued for the subject property, it is the intent of the neighborhood to challenge such issuance with the Environmental Protection Agency, in accordance with Section 404 (c), wherein the EPA, after hearings, may overturn a 404 permit issued by the Corp of Engineers, for specified circumstances. (2) Our neighborhood petitioned the town to acquire the subject property, to be used for open space, in accordance with petitions delivered on about 12 August 1993. The neighborhood has heard nothing from the town in this regard, however we have noted that another neighborhood has petitioned for a property to be purchased by the town and the town has ordered an appraisal of the property for possible acquisition through purchase or condemnation. We believe the Town of' Vail has an obligation to treat each neighborhood equally, and we respectfully request that all activities and negotiations which are occurring at the other neighborhood be equally manifested in our neighborhood. I responded that it has been my understanding for many years that this lot cannot. ever._be built upon. because of an agreement by the developer of Sundial and the town, to allow construction of the non conforming duplex at 5034-35 Prima Court and separate lot lA for resale. Zoning is currently Residential Cluster District. I therefore have two requests: First, I would appreciate it if the Sundial fi l p can hp pulled out to verify that the subject lot cannot be built upon . Secondly, it is my request that the Council be approached to make part of the subject lot a pocket park. The area is badly designed and very congested and to place a small pocket park in the area would relieve some of the visual conj esti on and improve the area environmentally. We realize that the process of acquiring property by the town is in it ' s early stages, however there is considerable interest in developing the subject property, and we feel that if it is not acquired by the town shortly, it will be acquired by a developer and developed. Our neighborhood is a group of townhomes, duplexes and single family residences which are in a near circle around the subject property. (Please see the attached map) . Because of this and the fact an overburdened private road services many of the properties, the subject parcel is a focal point, and should remain open space or become a small park. We also suspect part of the property is wetlands, and may require a Corps of Engineers 404 Permit for development. If you will agree to allow this parcel to remain open, we will maintain it according to standards set by the town . It should be noted that we have brought this property to the attention of the Community Development Department, and they have been notably helpful and very supportive. The reason we bring it to you directly, is we are afraid that the Town of Vail and therefore we will lose the opportunity, if negotiations for acquisition are not instituted immediately.
