The dormer framing over the master bedroom consists of double 14" LVL's for the header beam and sloping transfer beams either aide of the dormer. The dormer valley beams consist of a single 14" LVL. The dormer ridge beam consists of a double 2x12. These framing sues meet or exceed those specified on plan and are therefore acceptable. All hangers and connections have been adequately installed. 2. In the upper floor framing , the triple 1.1-7/B" LV,L.beam that spans north-south across; the closet and bathroom wall of Bedroom 3 and the hallway by the stairs has a 3" diameter hole drilled in it at approximately 12" front the beating end in the stair wall. There Is another hole, approximately 1" in diameter that is just below and 2" away from the first hole. Review of our calculations for this beam Indicate that these holes are acceptable. 3. In the same area, the short 11-7/8" TJI joists that span east-west from the garage wall to the double 2x12 stair header beam have 3"diameter holes drilled in them at approximately 6"from the joist hangers at the stair header. These joists span approximately 3"-0° across the hallway. These holes are acceptable. Box 3451 Vail, CO 81658 Re: Preliminary Foundation Soils Assessment Lot 1, Sundial, Phase I Town of Vail, Eagle County, Colorado Project No. 94344G Dear Mike: At your request on April 29, 1994 we visited the site on Lot 1, Sundial, Phase I, in East Vail, Eagle County, Colorado, as part of the preliminary foundation soils assessment. The topography of the lot is relatively flat with few small earth berms and a debris pile. The vegetation consisted of sparse grass with some willow shrubs. The drainage, if any, appears to be to the southwest corner of the lot. Previous studies in Sundial have encountered predominantly gravelly soils, occasionally clayey, and with cobbles and boulders. These soils are typically capable of supporting net allowable soil bearing pressure of 2 , 000 psf. Also common characteristic to the Sundial lots is the high ground water table which fluctuates with the seasonal variations. This can influence greatly the construction process and the type of structure built. Basements are not recommended in high ground water areas. The above statements are general in nature and for information purposes only. Site specific investigation is recommended for each lot. The findings and recommendations of this report have been prepared in accordance with locally accepted professional engineering standards for similar conditions at this time. At your request on April 29, 1994 we visited the site on Lot 1, Sundial, Phase I, in East Vail, Eagle County, Colorado, as part of the preliminary foundation soils asessment. The topography of the lot is relatively flat with few small earth berms and a debris pile. The vegetation consisted of sparse grass with some willow shrubs. The drainage, if any, appears to be to the southwest corner of the lot. Previous studies in Sundial have encountered predominantly gravelly soils, occasionally clayey, and with cobbles and boulders. These soils are typically capable of supporting net allowable soil bearing pressure of 2, 000 psf. Also common characteristic to the Sundial lots is the high ground water table which fluctuates with the seasonal variations. This can influence greatly the construction process and the type of structure built. Basements are not recommended in high ground water areas. The above statements are general in nature and for information purposes only. Site specific investigation is recommended for each lot. The findings and recommendations of this report have been prepared in anc-.ordance with locally accepted professional engineering standards for similar conditions at this time. The Developer shall complete, in a good workmanlike manner, all improvements as listed above, in accordance with all plans and specifications filed in the office of the Community Development Department, the Town of Vail, and to do all work incidental thereto according to and in compliance with the following: a. Such other designs, drawings, maps, specifications, sketches, and other matter submitted by the Developer to be approved by any of the above-referenced governmental entities. All said work shall be done under the inspection of, and to the satisfaction of, the Town Engineer, the Town Building Official, or other official from the Town of Vail, as affected by special districts or service districts, as their respective interest may appear, and shall not be deemed complete until approved and accepted as completed by the Town of Vail Community Development Department and Public Works Department. 2. The Town shall not, nor shall any officer or employee thereof, be liable or responsible for any accident, loss or damage happening or occurring to the work specified in this Agreement prior to the completion and acceptance of the same, nor shall the Town, nor any officer or employee thereof, be liable for any persons or property injured by reason of the nature of said work, but all of said liabilities shall and are hereby assumed by the Developer. The Developer hereby agrees to indemnify and hold harmless the Town, and any of its officers, agents and employees against any losses, claims, damages, or liabilities to which the Town or any of its officers, agents or employees may become subject to, insofar as any such losses, claims, damages or liabilities (or actions in respect thereof) that arise out of or are based upon any performance by the Developer hereunder; and the Developer shall reimburse the Town for any and all legal or other expenses reasonably incurred by the Town in connection with investigating or defending any such loss, claim, damage, liability or action. This indemnity provision shall be in addition to any other liability which the Developer may have. 5. It is mutually agreed that the Developer may apply to the Town and the Town shall authorize for partial release of the collateral deposited with the Town for each category of improvement at such time as such improvements are constructed in compliance with all plans and specifications as referenced hereunder and accepted by the Town. Under no condition will the amount of the collateral that is being held be reduced below the amount necessary to complete such improvements. 6. If the Town determines that any of the improvements contemplated herein are not constructed in compliance with the plans and specifications set forth herein by the date set forth in paragraph 2, the Town may, but shall not be required to, withdraw from the cash deposit such funds as may be necessary to complete the unfinished improvements. The Town shall release such funds upon the written request of the staff of the Community Development Department stating that the improvements have not been completed as required by the agreement. The Town shall not require the concurrence of the developer prior to the release of the funds, nor shall the Town be required to verify independently that the improvements have not been completed as required by this Agreement, but shall release such funds solely upon the request of the Community Development Department. If the costs of completing the work exceed the amount of the deposit, the excess, together with interest at twelve percent per annum, shall be a lien against the property and may be collected by civil suit or may be certified to the treasurer of Eagle County to be collected in the same manner as delinquent ad valorem taxes levied against such property. If the permit holder fails or refuses to complete the cleanup and landscaping, as defined in this chapter, such failure or refusal shall be considered a violation of the Zoning Code. 7. The Developer warrants all work and material for a period of one year after acceptance of all work referred to in this Agreement by the Town pursuant to Section 17.16.250 if such work is located on Town of Vail property or within Town of Vail right-of-way. 8. The parties hereto mutually agree that this Agreement may be amended from time to time, provided that such amendments be in writing and executed by all parties hereto. If any portion of the Common Parcel or any Improvements thereon are damaged or destroyed, such damage or destruction shall be promptly repaired and reconstructed if such repair or reconstruction is possible. To the extent that such damage or destruction to the Common Parcel is covered by insurance, the full insurance proceeds shall be used and applied to repair and reconstruct the Common Parcel. If the insurance proceeds are insufficient to repair and reconstruct the Common Parcel, any such deficiency shall be the joint expense of the Owners, without prejudice, however, to the right of either Owner to demand a larger contribution from the other Owner under any rule of law regarding such an Owner's liability for any fault for such Owner's acts. ARTICLE 3 Architectural Control 3.1 Modification of Improvements. No construction, including, without limitation, buildings, fences, walls or landscaping, other than the Improvements constructed or installed by Declarant shall be erected, placed, made or altered on either Parcel until the building plans, specifications and plot plan showing the nature, kind, shape, height, materials and location of such structure shall have been submitted to and approved in writing by the Owner of the other Parcel. The foregoing to the contrary notwithstanding, either Owner may make alterations or renovations to the interior portions of the building on his or her respective Parcel without the approval of the other Owner. 3.2 Cooperation of Other Owner. Where an Owner, in compliance with the other provisions of this Declaration, desires to build, renovate, excavate, improve, or otherwise alter the Improvements located on such Parcel, and where the Owner has obtained the written consent thereto of the other Owner as provided in this Article, the other Owner shall cooperate to the extent necessary solely to enable that Owner to obtain any required building permits or similar permit or license. Such cooperation shall not be unreasonably withheld. Any costs or expenses associated with the obtaining of a building or similar permit or license, shall be the expense of the Owner desiring said permit or license and shall not be an expense of the other Owner. The cost of exterior repairs and maintenance of the Improvements on a Parcel, including, without limitation,painting, replacement and care of roof, gutters, down spouts, exterior building surfaces, irrigation system, pavement, lawn service and snow removal, and utility services, shall be at the sole expense of the Owner of such Parcel. ARTICLE 5 Landscaping 5.1 Landscape Maintenance. Both Owners agree to bi-annually designate one of them as landscape manager for the Parcels and the Common Parcel ("Landscape Manager"). If the Owners cannot mutually agree on such designation by January 31 of each year, the existing Landscape Manager shall continue in such capacity for an additional term of two (2) years. The initial Landscape Manager shall be the Owner of Parcel 1 East. The Landscape Manager shall coordinate the landscape maintenance for the Parcels and the Common Parcel, including, without limitation, irrigation, mowing, trimming, planting, replacements and other services normal and customary in the preservation, care, maintenance and repair of landscaping. The Landscape Manager shall employ outside contractors to perform such services and each Owner shall be liable for one-half (1/2) of the costs so incurred, which shall be paid in full within thirty (30) days of receipt by an Owner of an invoice therefor. The Landscape Manager shall prepare a budget prior to March 1 of each year and submit it to the other Owner for approval. In the event that the parties are unable to agree upon the amount of the budget for a particular year within thirty (30) days of delivery of such budget, the amount of the budget for such year shall be an amount not to exceed one-hundred ten percent (110%) of the budget for the prior year. The annual landscape maintenance budget for the year commencing April 1, 1995 and ending March 31, 1996 shall be a total of One Thousand Dollars ($1,000.00) (Five Hundred Dollars ($500.00) per Parcel). ARTICLE 6 Use Restrictions 6.1 Residential Use. The Improvements shall be used for residential purposes only, provided that a home office is allowed to the extent such a business is in compliance with any applicable zoning laws. No business shall be operated from either Parcel that would make such Parcel qualify as a "place of public accommodation" as defined in the Americans with Disabilities Act (42 U.S.C. § 12101 et seq.). No structures of a temporary character, recreational vehicle, camper, trailer, tent, garage or out-building shall be used on any portion of either of the Parcels or the Common Parcel at any time as a residence, either temporarily or permanently. No animals, livestock, or poultry of any kind shall be raised, bred or kept on either of the Parcels or the Common Parcel, except that dogs, cats or other household pets may be kept on a Parcel provided that they are not kept, bred or maintained for any commercial purposes and provided further that they do not unreasonably interfere with the quiet enjoyment of the other Parcel by its Owner. 6.3 Signs. No advertising signs (except one of not more than five (5) square feet "For Rent" or "For Sale" per lot), billboards, unsightly objects, or nuisances shall be erected, placed or permitted to remain on the Parcels or the Common Parcel, nor shall either Parcel or the Common Parcel be used in any way or for any purpose which may endanger the health, or unreasonably disturb either Owner. 6.4 Trash Removal. All rubbish, trash or garbage shall be regularly removed from each Parcel at the expense of the Owner of such Parcel and shall not be allowed to accumulate thereon or on the Common Parcel. 6.5 Utilities. All utilities, fixtures and equipment installed on or within a Parcel, commencing at a point where the utility lines, pipes, wires, conduits or systems enter the Parcel shall be maintained and kept in repair by the Owner thereof. An Owner shall do no act nor any work that will impair any easement or hereditament or do any act or allow any condition to exist which will adversely affect any other Parcel or any other Owner. ARTICLE 7 Easements 7.1 Blanket Easement for Utilities and Access. There is hereby created a blanket easement upon, across, over and under the Common Parcel for the benefit of all of the Parcels and the Improvements situated thereon for: (i) vehicular and pedestrian ingress and egress, including, without limitation, for replacing, repairing and maintaining driveways and landscaping and for snow removal; and (ii) installation, replacing, repairing and maintaining all utility lines and facilities, including, without limitation, water, sewer, gas, telephone, cable television and electricity. Said blanket easement includes utility services not presently available to the Parcels which may be reasonably required or desirable in the future. ARTICLE 8 General Provisions 8.1 Severability. Invalidation of any one of these covenants, restrictions, or agreements by judgment or court order shall in no way affect any other provisions hereof which shall remain in full force and effect. The Town shall not, nor shall any officer or employee thereof, be liable or responsible for any accident, loss or damage happening or occurring to the work specified in this Agreement prior to the completion and acceptance of the same, nor shall the Town, nor any officer or employee thereof, be liable for any persons or property injured by reason of the nature of said work, but all of said liabilities shall and are hereby assumed by the Developer. The Developer hereby agrees to indemnify and hold harmless the Town, and any of its officers, agents and employees against any losses, claims, damages, or liabilities to which the Town or any of its officers, agents or employees may become subject to, insofar as any such losses, claims, damages or liabilities (or actions in respect thereof) that arise out of or are based upon any performance by the Developer hereunder; and the Developer shall reimburse the Town for any and all legal or other expenses reasonably incurred by the Town in connection with investigating or defending any such loss, claim, damage, liability or action. This indemnity provision shall be in addition to any other liability which the Developer may have. 5. It is mutually agreed that the Developer may apply to the Town and the Town shall authorize for partial release of the collateral deposited with the Town for each category of improvement at such time as such improvements are constructed in compliance with all plans and specifications as referenced hereunder and accepted by the Town. Under no condition will the amount of the collateral that is being held be reduced below the amount necessary to complete such improvements. 6. If the Town determines that any of the improvements contemplated herein are not constructed in compliance with the plans and specifications set forth herein by the date set forth in paragraph 2, the Town may, but shall not be required to, withdraw from the cash deposit such funds as may be necessary to complete the unfinished improvements. The Town shall release such funds upon the written request of the staff of the Community Development Department stating that the improvements have not been completed as required by the agreement. The Town shall not require the concurrence of the developer prior to the release of the funds, nor shall the Town be required to verify independently that the improvements have not been completed as required by this Agreement, but shall release such funds solely upon the request of the Community Development Department. If the costs of completing the work exceed the amount of the deposit, the excess, together with interest at twelve percent per annum, shall be a lien against the property and may be collected by civil suit or may be certified to the treasurer of Eagle County to be collected in the same manner as delinquent ad valorem taxes levied against such property. If the permit holder fails or refuses to complete the cleanup and landscaping, as defined in this chapter, such failure or refusal shall be considered a violation of the Zoning Code. 7. The Developer warrants all work and material for a period of one year after acceptance of all work referred to in this Agreement by the Town pursuant to Section 17.16.250 if such work is located on Town of Vail property or within Town of Vail right-of-way. 8. The parties hereto mutually agree that this Agreement may be amended from time to time, provided that such amendments be in writing and executed by all parties hereto. ARTICLE 2 Common Parcel 2.1 Maintenance of Common Parcel. The cost of maintenance to and repair of any portion of the Common Parcel shall be a joint expense of the Owners. 2.2 Damage to Common Parcel. If any portion of the Common Parcel or any Improvements thereon are damaged or destroyed, such damage or destruction shall be promptly repaired and reconstructed if such repair or reconstruction is possible. To the extent that such damage or destruction to the Common Parcel is covered by insurance, the full insurance proceeds shall be used and applied to repair and reconstruct the Common Parcel. If the insurance proceeds are insufficient to repair and reconstruct the Common Parcel, any such deficiency shall be the joint expense of the Owners, without prejudice, however, to the right of either Owner to demand a larger contribution from the other Owner under any rule of law regarding such an Owner's liability for any fault for such Owner's acts. ARTICLE 3 Architectural Control 3.1 Modification of Improvements. No construction, including, without limitation, buildings, fences, walls or landscaping, other than the Improvements constructed or installed by Declarant shall be erected, placed, made or altered on either Parcel until the building plans, specifications and plot plan showing the nature, kind, shape, height, materials and location of such structure shall have been submitted to and approved in writing by the Owner of the other Parcel. The foregoing to the contrary notwithstanding, either Owner may make alterations or renovations to the interior portions of the building on his or her respective Parcel without the approval of the other Owner. 3.2 Cooperation of Other Owner. Where an Owner, in compliance with the other provisions of this Declaration, desires to build, renovate, excavate, improve, or otherwise alter the Improvements located on such Parcel, and where the Owner has obtained the written consent thereto of the other Owner as provided in this Article, the other Owner shall cooperate to the extent necessary solely to enable that Owner to obtain any required building permits or similar permit or license. The cost of exterior repairs and maintenance of the Improvements on a Parcel, including, without limitation, painting, replacement and care of roof, gutters, down spouts, exterior building surfaces, irrigation system, pavement, lawn service and snow removal, and utility services, shall be at the sole expense of the Owner of such Parcel. ARTICLE 5 Landscaping 5.1 Landscape Maintenance. Both Owners agree to bi-annually designate one of them as landscape manager for the Parcels and the Common Parcel ("Landscape Manager"). If the Owners cannot mutually agree on such designation by January 31 of each year, the existing Landscape Manager shall continue in such capacity for an additional term of two (2) years. The initial Landscape Manager shall be the Owner of Parcel 1 East. The Landscape Manager shall coordinate the landscape maintenance for the Parcels and the Common Parcel, including, without limitation, irrigation, mowing, trimming, planting, replacements and other services normal and customary in the preservation, care, maintenance and repair of landscaping. The Landscape Manager shall employ outside contractors to perform such services and each Owner shall be liable for one-half (1/2) of the costs so incurred, which shall be paid in full within thirty (30) days of receipt by an Owner of an invoice therefor. The Landscape Manager shall prepare a budget prior to March 1 of each year and submit it to the other Owner for approval. In the event that the parties are unable to agree upon the amount of the budget for a particular year within thirty (30) days of delivery of such budget, the amount of the budget for such year shall be an amount not to exceed one-hundred ten percent (110%) of the budget for the prior year. The annual landscape maintenance budget for the year commencing April 1, 1995 and ending March 31, 1996 shall be a total of One Thousand Dollars ($1,000.00) (Five Hundred Dollars ($500.00) per Parcel). ARTICLE 6 Use Restrictions 6.1 Residential Use. The Improvements shall be used for residential purposes only, provided that a home office is allowed to the extent such a business is in compliance with any applicable zoning laws. No business shall be operated from either Parcel that would make such Parcel qualify as a "place of public accommodation" as defined in the Americans with Disabilities Act (42 U.S.C. § 12101 et seq.). No structures of a temporary character, recreational vehicle, camper, trailer, tent, garage or out-building shall be used on any portion of either of the Parcels or the Common Parcel at any time as a residence, either temporarily or r permanently. No boats, snowmobiles,jet skis, recreational vehicles, campers, trailers or trucks or utility vehicles larger than three-quarter ton pickup trucks or three-quarter ton utility vehicles SWA 1686-003 02/22/95 4:04pm Doc.43158.01 - 3 - 558523 B-662 P-496 03/03/95 04 : 44P PG 3 OF 7 shall be permitted to be parked overnight on either Parcel or the Common Parcel unless fully enclosed in a garage. 6.2 Animals. No animals, livestock, or poultry of any kind shall be raised, bred or kept on either of the Parcels or the Common Parcel, except that dogs, cats or other household pets may be kept on a Parcel provided that they are not kept, bred or maintained for any commercial purposes and provided further that they do not unreasonably interfere with the quiet enjoyment of the other Parcel by its Owner. 6.3 Signs. No advertising signs (except one of not more than five (5) square feet "For Rent" or "For Sale" per lot), billboards, unsightly objects, or nuisances shall be erected, placed or permitted to remain on the Parcels or the Common Parcel, nor shall either Parcel or the Common Parcel be used in any way or for any purpose which may endanger the health, or unreasonably disturb either Owner. 6.4 Trash Removal. All rubbish, trash or garbage shall be regularly removed from each Parcel at the expense of the Owner of such Parcel and shall not be allowed to accumulate thereon or on the Common Parcel. 6.5 Utilities. All utilities, fixtures and equipment installed on or within a Parcel, commencing at a point where the utility lines, pipes, wires, conduits or systems enter the Parcel shall be maintained and kept in repair by the Owner thereof. An Owner shall do no act nor any work that will impair any easement or hereditament or do any act or allow any condition to exist which will adversely affect any other Parcel or any other Owner. ARTICLE 7 Easements 7.1 Blanket Easement for Utilities and Access. There is hereby created a blanket easement upon, across, over and under the Common Parcel for the benefit of all of the Parcels and the Improvements situated thereon for: (i) vehicular and pedestrian ingress and egress, including, without limitation, for replacing, repairing and maintaining driveways and landscaping and for snow removal; and (ii) installation, replacing, repairing and maintaining all utility lines and facilities, including, without limitation, water, sewer, gas, telephone, cable television and electricity. Said blanket easement includes utility services not presently available to the Parcels which may be reasonably required or desirable in the future. ARTICLE 8 General Provisions 8.1 Severability. Invalidation of any one of these covenants, restrictions, or agreements by judgment or court order shall in no way affect any other provisions hereof which ;`y shall remain in full force and effect. The covenants and restrictions of this Declaration shall run with and bind the land and shall inure to the benefit of and be enforceable by the Owner of each Parcel subject to this Declaration, their respective legal representatives, heirs, successors, and assigns for a term of thirty (30) years from the date this Declaration is recorded, after which time said covenants shall be automatically extended for successive periods of ten (10) years, unless terminated pursuant to a recorded written instrument executed by both Owners. The covenants and restrictions of this Declaration may be amended or revoked by an instrument which specifically refers to this Declaration and which is signed by each of the then existing Owners and all holders of first deeds of trust or mortgages. Any amendment made must be properly recorded at the office of the Clerk and Recorder of Eagle County, Colorado. 8.3 Colorado Common Interest Ownership Act. As of the date of this Declaration, Declarant does not elect to accept the provisions of the Colorado Common Interest Ownership Act (C.R.S. § 38-33.3-101 et seq.). 8.4 Applicable Law. This Declaration shall be interpreted and construed in accordance with the laws of the State of Colorado. 8.5 Singular and Plural. The singular wherever used herein shall be construed to mean the plural when applicable and the necessary grammatical changes required to make the provisions hereof apply either to corporations or individuals, men or women, shall in all cases be assumed as though in each case fully expressed. 8.6 Titles. The section headings and titles are for convenience and are not a part of this Declaration.
