The right -of -way on all Town of Vail streets and roads is approximately 5 ft. off pavement. This ordinance will be strictly enforced by the Town of Vail Public Works Department. Persons found violating this ordinance will be given a 24 hour written notice to remove said material. In the event the person so notified does not comply with the notice within the 24 hour time specified, the Public Works Department will remove said material at the expense of person notified. The provisions of this ordinance shall not be applicable to construction, maintenance or repair projects of any street or alley or any utilities in the right -a -way. At that time, it was obvious that some standing water existed in the excavation, gravel was being placed in the bottom of the forms and that isolated soft spots existed in the excavation. The following is a timeline of application submittals and approvals. • On June 12, 2006, Mrs. Wolfe submitted a Design Review application to construct a deck addition onto Unit E. • On June 21, 2008, 1 staff approved Mrs. Wolfe's deck addition as it complied with all Town regulations. There was no subsequent Building Permit required as the proposed deck did not meet the International Building Code requirements for requiring a permit as it is only slightly higher than grade. • In mid - August, it was brought to the Town's attention that a hot tub had been installed on Mrs. Wolfe's deck without approvals. With this information in hand the Town's Code Compliance Officer contacted Mrs. Wolfe. • In late August early September I worked with Mrs. Wolfe to rectify the unapproved hot tub installation. IN these conversations I informed Mrs. Wolfe, that she must first work with her H.O.A. and obtain a letter granting approval of the hot tub in its current location prior to submitting any applications. • On September 8, 2008, Mrs. Wolfe submitted a Design Review application to maintain the hot tub on the deck which included a letter from you Mr. Wall granting approval for this hot tub. • On September 9, 2008, 1 staff approved the hot tub on the deck as it complied with all Town regulations. It was further discussed that Mrs. Wolfe's next step would be to submit for an electrical permit and Building Permit for the hot tub. At this point these applications have not been submitted. The Town will contact Mrs. Wolfe and provide her a deadline for having this applications submitted immediately. ti.Is� RECYCLED PAPER In receiving your letter Mr. Wall, I became concerned with several issues you identify in your letter. First, that you are now stating that your approval of the hot tub was one in which it appears that the proper process of The Ledges was not followed with regard to contacting other H.O.A. members to get the feedback that apparently was necessary. The Town and Mrs. Wolfe relied upon this written approval with regard to the hot tub remaining in its present location on the deck. Secondly, your letter approving of the hot tub dated September 5, 2008, identifies submittal of an application to mitigate sight and sound. The Town viewed this as a subsequent application and understanding between The Ledges H.O.A. Our goal was to get a an unapproved situation (the hot tub) approved and made safe by having the proper Electrical Permit and any appropriate Building Permit submitted. As identified above the Town will contact Mrs. Wolfe immediately to insure these steps are taken. If you feel that Mrs. Wolfe is not complying with your approval letter of September 5, 2008, 1 believe you may have recourse of civil action as suggest in your October 31, 2008, letter. However, I would like to suggest that the in my experience the method which works best in this situation would be to make the effort to communicate with each other truthfully about the problem and the needs with regard to how to mitigate that need and what time and money it will take to meet achieve the resolution. Pursuing any civil action will add time and monetary costs to the resolution of the apparent situation. From your letter it is clear you have some concerns with the noise and visual impacts of the hot tub. From my conversations Mrs. Wolfe is attempting to address those concerns and wants to be a "good neighbor ". I would like to offer any assistance I can to helping the issues to be addressed and mitigated. I am willing to meet you both on -site or have you both meet in my office. I believe we have two parties involved in this issue that with a little effort can reach an agreement which is a key ingredient to a successful win -win outcome. I view civil action as a last resort in a situation like this. Please note that I included Mrs. Wolfe on this correspondence and forwarded a copy of your October 31, 2008, letter to me. Bighorn Road Vail, Colorado 81657 Dear Warren, Andrew and Kristine Wolfe received permission on Friday, August 29, 2008, to leave a deck and hot tub in their current location, pending a plan to be submitted to the Ledges Homeowners Association and to the Town of Vail Design Review Board. The submitted plan was to mitigate sound and sight impacts causing substantial negative intrusion to the quality of life, and peace and quiet of adjacent homeowners. This permission was given by me personally and did not represent the opinion of the other HOA Board Members. The deck and hot tub were built and installed without HOA approval, Town of Vail Design Review Board approval or building permits, including electrical, plumbing and landscaping reviews. Currently an acceptable plan has not been submitted or agreed upon to remedy the disturbing impacts from the constant round the clock noise from the hot tub's motor on this deck. The Ledges Homeowners Association Board of Directors has been notified and will not approve the deck and hot tub as built in its current location without approvals or permits, nor allow it to remain indefinitely or any longer as winter approaches.
