The Developer shall complete, in a good workmanlike manner, all impfovefnents as listed above, in accordance with all plans and specifications filed in the office of the Community Development Department, the Town of Vail, and to do all work incidental thereto according to and in compliance with the following: a. Such other designs, drawings, maps, specifications, sketches, and other matter submitted by the Developer to be approved by any of the above-referenced govemmental entities. AII said work shall be done under the inspection of, and to the satisfaction of, the Town Engineer, the Town Building Official, or other official from the Town of Vail, as affected by special districts or servico districts, as their respective interest may appear, and shall not be deemed complete until approved and accepted as completed by the Town of VaiI Community Development Department and Public Works Department. 2. To secure and guarantee performance of its obligations as set forth herein, the Developer agrees to provide security and collateral as follows: Page 1 of 3 with Developer. 3. The Developer may at any time substitute the collateral originally set forth above for another form of collateral acceptable to the Town to guarantee the faithful completion of those improvements referred to herein and the performance of the teims of this Agreement. Such acceptance by the Town of altemative collateral shall be at the Town's sole discretion. 4. The Town shall not, nor shall aniottcer or employee thereof, be Iiable or responsible for any accident, Ioss or damage happening or occurring to the work specified in this Agreernent prior to the completion and acceptance of the same, nor shall the Town, nor any officer or employqe thereof, be liable for any persons or property injured by reason of the nature of said work, but all of said Iiabilities shall and are hereby assumed by the Developer. The Developer hereby agrees to indemnify and hold harmless the Town, and any of its officers, agents and employees against any Iosses, claims, damages, or Iiabilities to which the Town or any of its officers, agents or employees may become subject to, insofar as any such Iosses, claims, damages or Iiabilities (or actions in respect thereof) that arise out of or are based upon any performance by the Developer hereunder; and the Developer shall reimburse the Town for any and all Iegal or other expenses reasonably incurred by the Town in connection with investigating or defending any such Ioss, claim, damage, liability or action. This indemnity provision shall be in addition to any other Iiability which the Developer may have. 5. It is mutually agreed that the Developer may apply to the Town and the Town shall authorize for partial release of the collateral deposited with the Town for each category of improvement at such time as such improvements are constructed in compliance with all plans and specifications as referenced hereunder and accepted by the Town. Under no condition will the amount of the collateral that is being held be reduced below the amount necessary to complete such improvements. 6. If the Town determines, at its sole discretion, that any of the improvements contemplated hereunder are not constructed in compliance with the plans and speeifications set forth in this Agreement on or before the date set forth in Paragraph 2, the Town may, but shall not be required to, redeem the Ietter of credit as necessary to complete the unfinished improvements. The Bank shall release such funds upon written request from the Town stating that the improvements have not been completed as required by this agreement. The Bank shall not require the concurrence of the developer prior to release of the funds to the Town nor shall the Bank be required to verify independently that such improvements have not been completed as required by this agreement, but shall release such funds solely upon the Town's written request. ' If the costs of completing the work exceed the amount of the deposit, the excess, together with interest at twelve percent per annum, shall be a Iien against the property and may be eollected by dvil suit or may be certified to the treasurer of Eagle County to be collected in the same manner as delinquent ad valorem taxes Ievied against such property. If the permit holder fails or refuses to complete the cleanup and Iandscaping, as defined in this chapter, such failure or refusal shall be considered a violation of the Zoning Code. 7. The Developer warrants all work and material for a period of one year after acceptanoe of all work referred to in this Agreement by the Town if such work is Iooatod on Town of Vail property or within Town of Vail right-of-way pursuant to Section 17.16.250. 8, The parties hereto mutually agree that this Agreement may be amended from time to time, provided that such amendments be in writing and executed by all parties hereto. The Mr. Chuck Ogilby 2938 South Frontage Road West Vail, CO 81657 /. Town Engineer feels that the existing culvert pipe near the entrance to your pro"perty needs to be lowered. The Town Engineer will work with you to provide an inlet on the upstrdam side of this culvert and to Iower this culvert. Contact Terri Martinez to discuss this issue further. Also, you requested to run water discharging from this culvert across the top of the road and down to the creek via a swale. The Town Engineer feels that this would present an unsafe situation and that a culvert pipe should be placed under the road. The swale on the north side of the road is fine. In preparation for a Temporary Certificate of Occupancy (TCO) on Units 1 1 and 12 and G and H, the following issues need to be resolved: Grade and gravel the cul-de-sac and pave or bond the paving for the road and the driveways serving these units. The Iandscaping for these units, as well as the spruces at the entryway and along the creek, and the Iandscaping around the guest parking Iot wiil need to be bonded. A cost estimate for these items must be developed and submitted along with a developer improvement agreement. A developer improvement agreement can be obtained from my office and I will help you complete this form. The fireplugs and sanitary sewer must be installed and accepted by Upper Eagle Valley. A condominium plat and a common area maintenance agreement should be submitted. The plans you provided were simply copies of the plans submitted for Units 11 and 12. They have our approval stamps and notes and cannot be used for Units 13 gpd 14. It is my understanding that the overall site plan for the project is still accurate and^pflsite work will conform to its representations. Exploratory soil test pits have been excavated and the soil samples subjected to laboratory tests. The data has been carefully analyzed in t,he light of the project inforrnation provided by t1te client, 14r. Chuck Ogilby. The resutts of our exploration and analysis indicate that conven tional spread footings and/or continuous wa11 footings appear to be the most sui'tabte type of foundation for the support of the proposed buildings, Net allowable soil pressures on the order of 3000 to 4000 psf may be used at depths of 4 feet below the final grade if the procedures speeified in this report are followed. Ground water conditions are not expected to cause any difficult-ies; however, these conditions wi11 be discussed in more detail in this report. The upper soils are suitable for the support of crawl space floor slabs. Recommendations for the preparation of the subgrade are also included. Chuck Ogilby. Authorization to perforttt this i-nvestigation was in the form of a verba1 agreement on November 22r 1978, between Mr. Chuck Ogilby and Richards Engineering. Scope The scope of this geotechnical investigation included a review of geological maps of the area and a review of geologic and related litera- turea a reconnaissance of the invnediate site, the subsurface exploration, field and laboratory testing, and an engineering analysis and evaluation of the foundation materials. The primary purpose of this preliminary subsurface exploration was to determine the various soi1 profile coraponents and the engineering characteristics of the materials encountered. A secondary purpose was to provide information to the design engineers and architects which could be used to formulate preliminary design crtter;a, and to aid in t,he development of a final design. General The recommendations subntitted are based on the available soil infor- mation and the preliminary design details furnished by the client for the proposed strueture. The apparent ground water leve1 was recorded in each test pit after completion. After completion of the field testing prograln, tJ:e test pits were backfilled with excavated soi1. Sarnpling Procedures Three exploratory test pits were excavated with a Case 580C backhoe. Each test pit was excavated to a depth of l2 feet. Modified House1 pene trometer tests were attempted at intervals of 2.5 feet; however, the existence of numerous col:bles and boulders in test Pits rrP-I and TP-2 precluded penetration tests in several instances. The inflow of water in test Pit TP-3 also hampered attempts to gain penetration values. Samples of subsurface materials were taken at 2.5 foot intervals either by hand sampling or split-spoon sampling techniques. The modified Housel penetrometer is a soi1 sampling device having a 16.75 poupd drop hammer with a drop distance of 24 inches. A standard split-spoon sampler (l-3/8 inch inside dial[leter, 2 inch outside dia- tneter) is driven into the soil witJ: the drop hammer. :'he number of blows required to drive the sampler three successive increments of 6 inches is recorded and this data is correlated to Standard Penetration Values (ASTM D-1452 and D-1586). These values indicate the, relative density and comparative consistency of the soils, thereby providing a basis for estimating the relative strength and compressibility of the soil pro- file components. I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I,ABORATORY IN\rESTIGATION In addition to the field investigation, a supplemental labt>ratory investigation was conducted to ascertain additional pertinen( engineering charaeteristics necessary in a,nalyzing the behavior of the proposed struc- tures. The laboratory testing program included visual classification by a soils engineer as we11 as tJte procedures listed below. All phases of the Iaboratory investigation were conducted in accordance with applicable ASTM specifications. Representative samples of tlte soils were placed in sarnple Jars, and are now stored in our laboratory for further analysis if desired. Unless otherwise notified, a11 samples will be disposed of after 60 days. Moisture Content A portion of each sample is weighed, oven-dried at 105'C, and reweighed to obtain the weight of water. The moisture content is the ratio of the weight of water to the weight of the dry soi1, expressed as a percentage. Composition The composition of granular materials is obtained by passing a known weight of dried material through a set of sieves, ranging from a 3/4 inch sieve to a No. 200 u.S. standard sieve. This procedure is in accordance with ASTM D-422. Where a knowledge of the distribution of particles smaller than a No. 200 sieve is required, a Hydrometer Analysis, described in the second part of the ASTM D-422 procedure, is performed, fulfilling a complete mechanical analysis. Atterberg Limits The water contents corresponding to the transition from the liquid state to t.he plastic state and finatty to a solid state usually differ for clays having different physical properties in the remolded state, and are approximately equal for clays having similar physical properties. oo I I ntererore, these limiting water eontents, tJte Atterberg t,imits, serve asi usefu1 index properties for the classification of clays. I I I I I I I I I I I I I I I I I I I SUBSURFACE CONDITIONS Genera1 5oi1 Descriptiop The subscils im the vicinity of test Pits rP-l and TP-2 are fairly uniform. A typical soil profile for this area consists of upper layer of topsoil (brown clayey silt, some organic material) with an under- lying stratum of brown coarse to fine sand and coarse to fine gravel with numerous cobbles and boulders. This stratum extends the ful: depth of the test pits_ Subsoils encountered in test Pit rP-3 were markedly different from those described above. These sul:soils consisted of dark brown clayey silts to a depfit of approximately 6 feet. Below this layer is a seam of coarse to medium sand underlain by a straturn of brown eoarse to fine sand and coarse to fine gravel. This stratum extends t1te entire depth of tJte pit. The stratification of the soils, as shown on the accompanying 1ogs, represents the soil conditions in the actua1 test pit locations, and variations may occur between the test pits. Lines of demarcation repre sent the approximate boundaries between the soil tvnesr but the transition may be gradua1. Ground Water Observations Ground water was encountered on1y in trest Pit TP-3 at a depth of 7 feet. Moist soit conditions were encountered in TP-l at a depth of about 8 feet, It should be noted that the permeability of th€, soils, seasonal variations, temperature and reeent rainfall conditions may influence tJ:e vzater levels at other times. I I I I I I I I I I I I I I I I l0 I I I I I I FOUNDATION DlSCUSSlON AND RECOMMENDATIONS Project Description It is understood that the proposed condominium complex wiliL consist of six four-unit buildings located south of Gore Creek. The buildings will be of log construction with a four-foot deep crawl space. The finished elevation of the building site will be within approxi- mately one foot of t1:e existinq qrade. No estimates were available for wall loads at the time this report was prepared. For the purposes of this report it has been assumed that total wa11 loads will be on the order of 4 Jcips peg linea1 foot. When design data has been generated for this project, the soils engineer should be informed if tlte actual loads are exrected to substantially vary from this estimate. The project information presented above was provided I:y the client. Foundation Recommendations Various foundation types have been considered for suppor( of the proposed buildings; however, considering the proposed structures and the in situ soils, conventional spread footings and/or continuous wa11 footings or any corttbination of t.hese foundation types is recommended. In the vicinity of 'rest Pits 'm-t and TP-2, it is recortunended that net allowable soi1 bearing pressures on 1Jte order of 3000 to 4000 psf be used for dimensioning foundations founded at depths of 4 feet or mote below t.he existing grade. In the area of test Pit TP-3, the character of tJte soils d:tffers significantly from those found in tP-l and TP-2, to avoid significant settlement and to provide reasonable bearing capacity, it is recommended that the compressible soils encountered be removed to the depth of the underlying sands and gravels. I I I I I I I I I I I I I I I I ll The excavation can then be backfilled with a setect, c:ean, granular soil placed in layers of not more than 8 inches. Lifts should be com pacted widt a l0 ton vibratory in order to increase tdte density of the underlying sands and gravels. Eaclt 1ift should be compacted to a rnini- mum density of 95 percent of maximum density achieved by following nsm Procedure D-1557. The area of the compacted fi11 must extend beyond the footings for a distance at least equal to the thiclmess of the fi11 between the bottom of th€ foundation and the underlying undis- turbed soils, :f this procedure is fo11owed, it is expected that the fitl wi11 be capable of supporting loads of up to 3000 pounds per square foot. A qualified soils engineer should be engaged to inspect the placement of engineered fill if the above procedure is adopted. In order to avoid the effects of slight differential movetttents that may occur due to variations in the characters of the supporting soils or variations in seasonal rttoisture contents, it is recommended that all continuous footings be suitably reinforced to make them as rigid as possible. The effects of seasona: variation in rttoisture content and the effects of frost act-ion would be alleviated if tJte foundations were founded at depths of at least 48 inches below the finished grade. Tota1 and differential settlement between footings would a1so be mini:ttized. l2 I I I I I I I I I I I I I I I I CONSTRUCTION CONSIDERATIONS Site Preparation Excessively organie topsoi1 generatty undergoes ltigh volume ehanges when subjected to loads. This is detrimental to the behavior of pavementsp floor slabs, structural fills and shallow foundations placed upon them. Therefore, it is recommended that excessively organic topsoils be sttipped frorn the area of 'rP-l mtd TP-2 to depths of approxi-mately lO to l2 incttes and wasted or stoclcpiled for later use. All material excavated for crawl spaces in the vicinity of TP-3 should be stoclcpiled for later landscaping use. Floor Slabs Prior to the plaeing of concrete floors for the crawl spaces or paverttents on this site, the subgrade should be proof rolled until a minirttum density of 95 percent of the ntaxirttum density by ASTM Procedure -D-698 has been achieved. Areas not meeting this criteria should be excavated and backfilled widt clean, compacted soil. The floor s1ab should be suitably reinforced to malce it as rigid as possible, and proper joints should be provided at the junctions of the slab and t,he foundation wat:s, so that the floor slab will act independently of structural portions of the building. Ground Water secause of fite relatively low ground water tevet, no difficulty during excavation and construction of the proposed shallow foundations in the area of TP-l and TP-2 is anticipated. novrever, in the area of 'rP-3, if foundation excavations are extended to the depth of the ground water table it is anticipated that a gravity drainage system, sump pumps, or other conventional devzatering procedures may be required in order to place the first 1ift of fill material. A granular mat should be placed beneatJt the crawl space floor s1ab, I I I I I I l3 I I I I I I I I I I I I I I I I I I the wall excavations should be backfilled with a freely draining matertat, with proper drainage away from the subsurface structure. This is to prevent the formation of excessive hydraulic uplift forces and hydro- static latera1 forces on the crawl space floor and watts, respectively. This drainage system should not be open to surface water. Thus, the upper part of the exterior backfi11 material should consist of rela- tively impermeable material. While ground water was encountered only in TP-3 at the time the field investigation was conducted, it is possible that seasona1 variations will cause fluctuations, or a water table to be present in the upper soils during tlte spring rnonths, or after a prolonged period of rain. The crawl space area must 1:e protected by a suitable drainage system to lower the surrounding water table, and to protect tlte floor from hydrostatic uplift. It is recotmrtended that a subsurface peripl:era1 drain be constructed around the exterior of this foundation to intercept potential subsurface seepage and carry it away from the building. rhis drain should consist of an adequate discharge pipe, grave1 collector and sand filter. The discharge pipe should be given free gravity access to the ground surface. Surface Drainage The ground surface should be sloped away front the buildings on a11 sides to control surface water run-off. Surface water flowing toward the structures from upslope areas sltould be diverted around and away frortt the buildings by means of drainage swales or other similar measures. The minirttum gradient wit-hin l0 feet of the buildings will depend upon surface landscaping. Bare or paved areas should have a minimura gradient of 2 per centa while landscaped areas should have a mini:tturn gradient of '7 per cent. I I I I 14 I I. I I It should be noted that this subsurface investigation was preliminary | in nature. As stated previously, the primary purpose of tJtis investigation was to determime the various soi1 profile components and the engineering ! characteristics of fi:e materials encountered. A secondary purpose was to provide information t,o the design engineers and architects which ! could be used to formulate preliminary design criteria, and to aid in tJ:e development of a final design. I When building locations are determined and the plans and specifications I are more complete, additional borings or test pits should be made at 0 tlte actua1 building locations.
