Frontage Road W.Vail, Colorado A1-657 Re: Outdoor Boiler InstallationLot 4, VaiI Valley 3rd Filing Gentlemen: The boiler installed in the mechanical roour of the house on Lot #4, 1825 Sunburst Drive, vail , was supposed to have sufficient outputto heat both the house and the driveway snow melt system, however, we now find that the boiler is not large enough to handle both. The existing mechanical room is physically too smaLl to allow alarger boiler to be installed, along with combustion air and theboiler flue size constraints. In order to correct the situation, the owner of the house, Robert warner, Jr., would like to add an exterior boiler to heat the snow nelt system, and the existing interior boiler would be used to heat the house. The proposed new outdoor boiler could be installed onthe east side of the house behind a fenced enclosure similar to the one that was approved as a trash enclosure. The enclosed site andbuilding elevations indicate the Location and size of the enclosure. We await your decision regarding this matter. As you know, we had an extremely wet late spring. As a result, we have not been able to start grading and compaction of fill until this week. As I stated in ny letter to Abe Shapiro, we hope to have the landscaping done by June Lst. However, as wet as things have been for the last month, we are behind schedule. We will keep you posted j.f we do not neet the original date of June L. In your letter you also stated that the construction access road which crosses Lot 3 should also be revegetated at this tine. It is our understanding that the golf course wishes to keep this road open, andtherefore the road would not be revegetated. I believe all the neighbors would prefer to elininate the road. As busy as people are at the Town of Vail, I regret that you did not contact us first concerning any questions that you may have had relating to the three homes that we are developing on Sunburst Drive. Regarding the [work roadl, it is the Golf Coursels desire to keep that road open as a work road for the golf course. We used an existing road and that road will renain after our construction and landscaping are complete. We would prefer to landscape directly to the golf course. However, as of last year, the golf course found it necessary to rnaintain the lwork roadrr. As you are ahrare, for the last two weeks it has snowed consistently teaving the ground snow covered, frozen and saturated. Because of this, we have not been able to begin our landscaping. As soon as the weather improves and the sun comes out and dries the land, we will imrnediately begin removing any construction debris and start final grading for landscaping. Because of the wet spring, I will be somewhat at the nercy of landscapers who have been on a late start throughout the valley because of the anount of precipitation during April. Applicant: Debra and Robert l{arner' Jr. I. DESCRIPTION OF THE REOUEST This application is to rezone three undeveloped erinaryTSecondary lotE to a Special Development District. Development proposed for the SDD includeE three friroaryTseconaary structures. The PurPose of this request is to pemit GRFA on one of the 3lots (Lot 4) to exceed- that wfiich is per:rnitted under existlng zoning. In addition, site coverage 6n thl.s same lot ls also I'n excess of what is pernitted under existing zonlng. I{ith the exception of lncreases in GRFA and site correrage to lot 4, the deleJ.opnent proposed by the SDD is consistent with the underlying Prilnary,/Secondary zoning. Setbacks, building heights and parklng are all consistent with frinaryTsecondary devEloprnent standards. Tlre following tabte s'urornarizes the development proposed for these three lots. Lot 4 Eevelopnent exceeds perrnitted GRFA by fS-ee sguare feet. Collectl.vely, proposed_developnent on the three iots souLd exceed the total allowable GRFA by 804 "quiie-ieet. Site coverage on Lot 4 exceeds pernitted slte co:verage by 398 square feit. Collectively, all three lots are 29i square feet below per^nitted slte coverage' 'tt :! tr' Each of the three lots wlll be developed wlth a snall secondary unit. The appllcant has agreed to enter lnto a restrict-ion agreement w-itn the Tonn eo that these unlts wlll not be subdlvided and sold off as would be pernltted by existing zoning. I'ryo sets of criterl.a are to be used Ln evaluatlng a rezonlng reguest of this type. Tlre first of these are 3 crlterla aeJigned to evatuate the appropriatenesE of the zone change. secoidly, the Special DevelbprnLnt DlEtrict zonlng includes nine aeiign crileria. These nine criteria address speclflc issues relative to the proPosed SDD. II. CRITERIA TO BE USED IN EVALUATION OF PROPOSAL A. Evaluation of the Recnrest: 1. Suitabill.tv of the oroposed zoning. It is inportant to understand the pulposg of Speclal Developrnlnt District Zoning when evaluating the approp-riateness of this request. As stated ln tlre zoning code, the purpose of SDDs is to: 18.40.010 SCIB9Sei The purpose ot tfre Special Developlellt Dlstrlct is to encoirrage flexiUility and creativlty ln the developnenf of land in order to pronote its most appropiiate usei to inprove the ge9{Sn. character a-nb gilafity of new developnent withln the Townt to facifitate-the adequate and econonic provisions of streets and utlllties; to preserve the natural and scenic features of open space areasi and to further the overall goals of the conmunity as stated ln the Vail Conprehensive Plan. An approved development plan for a Special .oLvetopnent Dislrlct, in conjunction with the properties underlying zone district, ehall-estlltisfr the requirenents for guiding developnent and uses of property lncluded l-n the-Special Developnent bistrict. The elenente ln the develoinent plan ehall be as outll'ned in SectLon 18.40.060. As stated, the lntent of thls zoning reguest le to per:rft deielopnent-on one.of the lots to exceed what is i"r-fit"a by ixlsting zonlng. This purp- -ose-l'e not Lonsistent iith the overalt purpose of-the Special Developnent DiEtrict. tlith the exceptlon-of GRFA, ihere is nothing about this proposed developnent plan that could not be acconplished under exietlng zoning' tlhile SDDrs have been proposed and approved for nany different reasons, they have generally.not been used sinpryasatooltoallowfordensityincreaseswithnopubiil purpose as described in 18'40'010' \. 2. The residential use proposed by the SDD ls ldentical toshat is penitted under existing zoning. lfhlle thisproposal Ls generally consistent wlth nunicipalobJectives, the rezoning Ls no nore consistent than what would be acconplished by the properties existing zoning. The proposed rezoning will not further the growth of anorderly, vlable connunity. ff approved, this rezoning eould represent the gradual deterioration of Vail.re lowdensity residential neigbborhoods. one may considerthis reguest and conclude that the uEes and developmentare generally consistent with what ie pemitted underexisting zoning. However, it 1g inportant to understand that zonlng ln Vall has been adopted inorder to establish consistency between neighborhoods. The anount of GRFA allocated to a lot has a directrelationship to the size of the lot. the proposalconflicts with this basic principle of zoning for the Town of Vail. In order to preser:rre the overall fabricof these areas, it is inportant to naintaln theintegrity of the existing zoning. This proposal, byvirtue of lts devlations fron the development standardsof the underlying zonlng, ls inconsistent vlth thiscriteria. rII. SPECIAL DEVEI'PMENT DTSTRICT DESIGN CRTTERIA This proposal iE generally consistent with thiscriteria. I{hite the level of developnent on Lot 4greatly exceeds allowable GRFA, the design of this structure is eensitl.ve to nlnfualzing bulk and naas. Each of the three structures are in conpllance with Prirnary/Secondary height and setback regulrernents. Developnent on lot 4 does, however, exceed pernitted site coverage by 398 sguare feet and GRFA by 804 square feet. 3. A. i. B. c. D. Uses proposed for these three sltes are consLstent withthe eurrounding neighborhood and the Priuaryr/Secondary zone district. CornplLance wLth oarkincr and loadincr recnrirements asoutllned in Chapter 18.52. This proJect is consLstent with the Townts parklng requirenents. Confonrrity with appllcable elenents of the Vail Cornprehenslve Plan, Town policl-es and Urban DesLon Plans. The goal 5.5 of the Iand Use Plan trencourages the development of enployee housing at varLouE eites throughout the conmunityrr. The applicantrs connitnentto restrict the subdlvision and resale of each of thethree secondary units is a positive etep towardsprovlding enployee units. In order to fully conplywith this goal, deed restrictions liniting the use of these secondary units to lonE tern enployee rentals shouLd be establlshed. Identlfication and niticration of natural and/or oeologic hazards that affect the property on which the Special Developnent District is proposed. E. A slte specific analysis of these properties has beenconpleted. L,ots 3, 4, and 5 are located ln noderate debris flow and rock fall zones. Lots 3 and 4 are located in a noderate snow avalanche zone. The Townrs hazard ordlnance reguires uitigation of the snow avalanche hazard. l{itigation is not reguired for developnent on the lots lnpacted by rockfall and debris f,low hazards. Ilowever, thls developnent nust be donein a way that does DqE lncrease the degree of lrazard on adJacent property or Town Rlghts-of-way. t geologic hazard analysis of the proposed site plan hai been conpleted. All hazards can be nitlgated bystructural reinforcernent of the proposed reeidences. Subject to the renoval and,/or redesign of proposed landscape walls along Sunburst Drive, this developnent will not Lncrease the degree of trazards on adJacentlots or town rights-of waY. I F. responsive and senBitLve to natural f?aturea. vecre€ltion and overall aesthetlc tmall-tv of the connrunity. The proposed developnent plan is conslstent sith these considerations. G. Each of the three units have been designed wlth two driveways, resulting in 6 drlveways over approxinately 290 feet. Six driveways to aente three lots Is unnecessary and decreases the anount of area that could be dedicated to landscaping. H. I. The proposed with what is developnent. open space andtlpically found landscaplng ls conslstentln Prlnaryr/Secondary A phasing plan has not been proposed as a part of this SDD. IV. STAFF RECOI.IMENDATION Staff reconmendation for this request is denial . The proposed rezoning is inconsistent with the purpgsl of tl9- Speli"f Developn6nt District and is also inconsistent vith tle three critlria used to evaluate rezoning proposals' The developnent standards established by the_Townrs zoning ordinance lre in place for a reason. These developnent- standards are thJprirnary tool ueed to ensure proper and orderly developmenl ttrroughout the Town. In addition, the twolots affected by snow avalanche will require nitigation.Ideally, I would like assurances that any required nitlgation can be accompllstred through the design of the structure, and will notrequire the construction of large berms on the south side of thelots. Thank you for your response to these reguest. I look fonard to seeing you on Wednesday for the Design Review Board neeting. In respect to your question concerning a Special Development District for these ttrree 1ots, the staff at this tiure can find no reason to support applying Special Development District zoning to these threelots. The purpose of a Special Development District- is: l-8.40.001- Purpose. The purpose of the Special Development District is to encourage flexibility and creativity in the developnent of land in order to pronrote its rnost appropriate use; to irnprove the des:gn character and quality of new developmeni within the Tcwn; to facilitate the adequate and econornical provision of streets and utilitles; to preserve the natural and scenic features of open space areasi and to further the overall goals cf the canmunity as stated in the Vail Colrprehensive Plan... Our understanding of your reqttest is that the rnain purpose for the Specia). Development District ls to increase the GRFA and site coverage for Lot.l by deducting GRFA aird srte coverage for the other two }ots. fn our opinion, ttris request ltas no relationship to good site planning which is based on develoDlr€Dt being related to the size of the lot. Cther alternatives to accong:lish Lhe same objective vhich would relate the development to the size of the lot wouLd be to request a rninor /- subdivision. You wourd subdivide the lot so that the corresponding'development you wish to have for each rot relates to the rot size. youcould also propose to remove a lot rine and, cornbine two of theproperties to get the size of house your owner wishes. rt is also important to note that these three rots are in moderatedebris hazard, severe rockfall hazard, and perhaps a possibre avaLancheinfluence zone. The possible avaranche infiuenc-e zone is somewhatdifficurt to deterrnine due to the configuration of the road on ourzoning map versus the avalanche map. Mearsr p.E.., Inc. . Gunnisonr Colorado May, 1990 STUDY OBJECTIVES AND LIMITATIONS This analysis of geologic hazards (snow avalanche, debris flows, and rockfall) and specification of design criteria for structural protection was requested by Mr. Glenn Magee and has the following specific objectives: a. Determination of design velocities and energies of the geologic processes at the building sites; b. Calculation of design loads on exposed building surf aces at Lots 3, 4, anc'l 5; and c. Discussion of the overall hazard increase resultinq from the proposed construction. The study j.s site specific, therefore the analysis and clesign critcr:ia ;rrescnted here shoulcl not bc applied to other locations. Furthermore, the I oading critcria spcciIied in this rcport depends on building locations, orientations, and shapes as given in the Junge Reich Magee plans datcd lularch and ApriI, I990. Changes to these plans may invalidate the clesign criteria- DESCRIPTION OF TTIE IIAZNRD Description of the type and severity of the avalanche, debris- flow and rockfall hazard is summarized in the f oI lot'ting "haz"erdmatrix" which was extracted from a February 7, 1968 Ietter report to I"1r. Snow avalanches affecting Lots 3 and 4 originate in a fairly smalI, but open and active ava Ianche pa th which begins approximately 600 feet above and south of the proposed building Iocations. The largest rocks have a mass ' Iul , of 1,300 kg (2B7Olbs/32.2 = B9 1bs-ft/secl, or "s1ugrs" ), and wilI impact the surface at a velocity, V, of 4.5m/s (f5 fL/s\. The actual expression for stiffness, K, as represented in (3) must be replaced$rith an appropriate expression for the particular structural members being analyzed. f.. Debris-flow loads are the same regardless of wall orientation. unlike snow-avalanche loads. The loads are assumed constant on the various surfaces becausedebris flows can turn in unpredictable directions nearthe buildings and can impact the walls at right angles. AVAIANCHD, DEBRIS-FLOW, AND ROCKFALL HAZARD Any development within areas known to be reached by avalanches, debris f lovrs, or rockfall will increase the overall hazard. Thishazard increase is a natural consequence of the additionalexposure of persons who wilI be using the area. There exists il III I I I a t N at a t I ; f, { some small probability that the persons one wishes to protectwill not be insi.de the specially-designed building when thegeologic process occurs. Town of Vail ordinance on "geological ly-sensitive areas" recognizes this small residual hJzard to those who may be outsicleand accepts the risk because outside total exposure represents asmall percentage of the total time. This small hazard can bereduced even further if residents become educated about thegeological processes (including snow avalanches), and heed allofficial warninqs.
