In order to sign off on these plans, the Town Engineer has indicated he needs to obtain a copy of the site plan and a copy of a survey which indicates existing contours. In addition to the outstanding issues with regard to the grading of the drive, other outstanding issues include allowable GRFA and ridge heights. The following is a summary of my calculations lor the residence, based on the April 24, 1991 plans: Total Allowed GRFA for Site: 3,764 sq. ft. GRFA Summarv Lower Floor Entry Level Second Floor Third Floor GRFA Total: Primary 561 1,071 669 N/A 2,031 sq. ft. Total Proposed GRFA, Primary and Secondary Units: TotalAllowed GRFA Primary Unit (60./"): 2,257 sq. ft. Therefore, Primary unit is € sq. fl. over allowable GRFA Total Allowed GRFA Secondary Unit (40%): 1,504 sq, ft. Therefore, Secondary unit is 46 sq. ft. under allowable GRFA I Mr. Jerry Singleton September 3, 1991 Page 2 Wfr regard to the building height, the maximum allowable building height under the Primary/ Secondary Zone District lor a sloped roof is tlil feet. The ddge elevation on that portion of the lot closest to the real property line ls 8,045 ft. The existing grade under his ridge is 8,011 ft. Therefore, a portion of this ridge exceeds the allowable maltimum building height by one foot. According to my calculations, tre lanGcape area exceeds the minimum required by 109 sq. ft., and there is 41 sq. ft. of site coverage remaining on the site. As I indicated at the Design Review Board meeting, these outstanding issues will need to be resolved when building permit plans are submitted. As a side note, because this lot is under 15,000 sq. ft. in size, the property owner, Jerry Singleton, entered into an agreement to permanently restrict the secondary unit as a rental for employees of Upper Eagle Valley. Should ownership of this site lransfer prior to issuance of building permit, the Town will require lhe new property owners to enter into a similar agreement. lf you have any questions or comments regarding this matter, please do not hesitate to call me at 479-2138. (b)"insured claimanl": an insured claiming loss ot damage hereundea. (c) " knowledge": actual knowledge, not constructive knowledge o. nolice which may be imputed to an insured by reasoB of any public records. (d) "land": the land described, specifically or by ref€rence in Schedule A, and improvements affixed therelo which by law constilute real properlyi provided, however, the lerm "land" does not include any propelly beyond the lines of the area specifically described o! refered lo in Schedule A, nor any right, title, inlerest, eslate or easement in abutting streets, roads, avenues, alleys, lanes, ways or *?terways, but oothing herein shall modify oa limit the €xtent to which a righl of access lo and from th€ land is insured by this policy. STIPULATIONS 2. @ntinuation of Insurance after Conveyancc of Tille The coverage of this policy shall continue in force as of Date of Policy in favor of an insured so long as such insured retains an estate or interest in the land, or holds an indebtedness secured by a purchase moncy mortgage given by a putchas€r from such insured, or so long as such insured shall have liability by reason of covenants of warranty made by such insured in any transfer or conveyance of such estate or inlerest; provided, howeve., this policy shall not continue in force in favor of any pu.chaser from such insured of eilher said estate or interest or the indebledness secured by a purchase money mortgage given lo such insured. 3. Defonse 8nd Pros€cution ot Actions - Notice ol Claim to be given by an Ins0red Claimsnt (a) The Company, aa its own cost and without undue delay, shall provide for the defense of an insured in all litigation consistin8 of aclions or proceedings commenced against such insured, or a defense interposed against an insured in an action to enforce a cont.act for a sale of the estate ot interest in said land, lo the extent thal such Iiligation is founded upon an alleSed defect, lien, encumbrance, or other mattel insured against by this policy- (b) The insured shall notify the Company promptlv in wriling (i) in case any action or proceeding is begun or defense is interposed as set forth in (a) above, (ii) in case knowledge shall come to an insured hereunder of any claim of title or interest which is advelse to the title to lhe eslate or interesl, as insured, and which miSht caus€ loss ot damage for which the Company may be liable by virtue of lhis policy, or (iii) if tille to ahe €stale or interest, as insured, is rejected as unmarkctable. lf such prompt notice shall not be given to the Company, then as to such insured all liabiliry (Continued on inside back flap) (Continued from inside front fiap) of the Comprny shall ceas€ and terminate in regard to the matter or matters for which such prompt notice is requLed; provided, how- ever, that failure lo notify shall in no case prGjudice the righls of any such insured unde! this policy unless the Company shall be prejudiced by such failure and then only to the extent of such prejudice. (c) The Company shall have the right at its o\.n cost to institute and wiahout undue delay prosecute any action or proceeding or to do any other act which in its opinion may be necessary or desirable to establish the title to the estate or inlerest as insured, and lhe Compsny may take Eny appropriate action under lhe terms of this policy, whelhet o. not it shau be liable thereunder, and shall not thereby concede liability or waive any provision of this policy. (d) Whenevet the Company shall hav€ brought any action or interposed a defense as requi.ed or permiated by the provisions of lhis policy, lhe Company may purue any such litigation 10 final determination by 8 court of competent jurisdiction and expressly teserves the right, in its sole discletion, lo appeal from any adverse judgment or order. (e) In aU cases where this policy permits or requires the Company to prosecute or provide for the defense of any aclion ot proceeding, the insured hereunder shall secure to the Company the right.to so prosecute or provide defense in such action or proceeding, and all appeals therein, and permit the Company to use, at its option, the naire of such insured for such purpos€, Whenever requesled by the Company, such insu.ed shall give the Compsny all leasonable aid in any such action or proceeding, in effecting settlement, securing evidence, obtaining wilnesses, or prosecuting ol defending such action or proceeding, and ahe Company sh8ll reimburse such insured for any expense so incu|'ed. 4. Notica of Los - Limitation ot Action In addition to the notices required under paragraph 3(b) of thesr Conditions and Stipulations, a stalement in writing of any loss or damage for which il is claimed the Company is liable under this policy shall be furnished to the Company within 90 days after such loss or damage shall have been delermined and no righl of aclion shall accrue lo an insured claimant until 30 days after such statement shall haw been furnished. Fsilute lo fumish such statement of loss or damage shall lerminate any lisbility of the Company unde! this policy as to such loss or damag€, 5. Options to Psy or Otherwiso Sottls Claim! The Company shall have th€ option to p8y or otherwise s€ltle for or in the name of an insufed claimant 8ny clrim insured againstor to terminate aU liability a'ld oblig8lions of lhe Company hereunder by paying or tendering payment of the amount of insurance under this policy togelher with any cosls, attotneys'fees and expenses incurred up to the time of such paym€nt or lender of paymena, by the insured claimant and authorized by the Company. 6. Oetermination and Payment of Loss (a) The liabilily of the Company under this policy shall in no case exceed the least of: (i) the aclual loss of the insured claimsnt; or (ii) the amount of insurance staled In Schedule A; o. (b)The Company will pay, in addition to rny loss insur€d aSainst by this policy, all costs imposed upon rn insured in litigalion carlied on by the Company for such insurcd, and all cosls, attorneys' fees and expenses in litigation carried on by such insured wilh ahe written authorization of the Company. (c) When li8bility has been definitely fixed i'l accordance with the conditions of this policy, the lo$ or damag€ 3hall be payable within 30 days the.eafte.. 7. Limitation of Liability No claim shall arise or be maintainable under this policy (a) if the Company, after having received notice of an alleged defecl,lienor encumbrance insured against he.eunder, by litigation or otherwise, .emoves such defect, lien or encumbtance or establishes lhe title, as insu.ed, within a .easonable time afte. receipt of such notice; (b) in the event of litigation unlil there has been a final determination by a court of competeni jurisdictiotr, and disposilion of all appeals lherefrom, adverse to the title, as insured, as provided in pa.ag.aph 3 hereofi or (c) for liability voluntarily assumed by an insured in setlling any claim or suit without prio. wriiten consenl of the Company. 8. Reduction of Liability All payments under this policy, exc€pl payments made for cosls, altorneys' fees and expenses, shall reduce the amounl of the insurance p.o tanto. No payment shall be made without producing this policy fo. endo.sement of such payment unless the policy be lost or destroyed, in which case proof of such loss or destruction shall be furnished to the salisfaction of the Company. 9. Liability Noncumulative It is expressly understood that the amount of insurance under this policy shall be reduced by any amount the Company may pay under any policy insuring €ither (a) a mortgage shown or referred to in Schedule B hereof which is a lien on the estate or interesl coveredl by this policy, or (b) a mortgage hereafter execuaed by an insured $,hich is a charge or lien on the estate or interest desctibed or referred to i.l Schedule A, and the amount so paid shall be deemed a payment under this policy. The Company shall have the option to apply to the payment of any such morlgages any amount that otherwise would be payable hereunder to the insured owner of the estate or interest co\'€red by this policy and the amount so paid shall be deemed a paymenl under this policy to said insured owner, 10, Apportionment If lhe land described in Schedule A consists of two or more parcels which are not used as a single site, and a loss is established affecting one or more of said parcels but not all, the loss shall be computid and s€ttled on a pro rata basis as if the amount of insu.ance under this policy'was divided pro rata as lo the value on Date of Policy of each sepalate parcel to the whole' exclusive of any improvements made subsequent to Date of Policy, unless a liability or value has olherwise been agreed upon aE lo each such parcel by the Company and the insured al the time of the issuance of lhis policy and shown by an express statement hercin or by an endorsement attached hereto. 11. Subrogation Upon Payment or Ssttlamont Whenever the Company shall hav€ s€ttled a claim under this policy, all right of subrogation shall vest in the Company unaffecaed by any act of the insured claimant. The Company shall be subrogaled lo and be entitled to all rights and remedies which such insured claimant would have had against 6ny person or property in resp€ct to such claim had this policy not been issued, and if requested by the Company, such insuted claimant shall transfer to the Company all rights and remedies again$t any person o. prope.ty neceisary in order to petfect such right of subrogation and shall petmit lhe Company lo use the name of such insured claimant in any transaclion or litigation involving such righls or remedies. If the psyment does not co!€r the loss of such insured claimant, the Company shall be subrogated to such rights and remedies in the proportion which said payment beats to the amount of said loss. If loss should result from any act of such insured claimant, such acl shall not void this policy, but the Company, in that event, shall be required to pay only that part of any losses insured against heteunder which shall exceed the amount, if any, lost to the Company by tesson of lhe impairment of the right of subrogation. 12. Liability Limit€d to this Policy This instrument togethe. with all endorsemenas and other instruments, if any, stt8ched hereto by the Company is the entire policy and conttact between the insu.ed and the Company. Any claim of loss or damage, whether or not based on negligence, and which arises oul of th€ slatus of the title to the estale or interest covered hereby or any aclion asse.ting such claim, shalt be restricled to the provisions and conditions and stipulations of this policy.
