Any application for site improvemenE or modifications including, but not limited to, driveway modifications, site grading, site walls, removal or modifications to existing landscaping, installation of accessory structures or recreational facilities. ADDMONAL REVIEW AND FEES A. If this application requires a separate review by any local, state or Federal agency other than the Town of Vail, the application fee shall be increased by $200.00. Examples of such review, may include, but are not limited to: Colorado Department of Highway Access Permits, Army Corps of Engineers 404, etc. B. The applicant shall be responsible for paying any publishing fees which are in excess of 50% of the application fee, If, at the applicant's request, any matter is postponed for hearing, causing the matterto be re-published, then the entirefee for such re-publication shall be paid by the applicant. C. Applications deemed by the Community Development Departrnent to have design, land use or other issues which may have a significant impact on the community may require review by consultants in addition to Town staff. Should a determination be made by the Town staff that an outside consultant is needed, the Community Development Depaftment may hire the consultant. The Department shall estimate the amount of money necessary to pay the consultant and this amount shall be forwarded to the Town by the applicant at the time of filing an application. Expenses incurred by the Town in excess of the amount forwarded by the application shall be paid to the Town by the applicant within 30 days of notification by the Town. DESCRIPTION AND BACKGROUND OFTHE REOUEST The applicant is requesting a minor subdivision to establish this parcel (a.k.a. Chamonix Corners) as a separate ptattdO tot. tne applicant is requesting a variance from the minimum lot size in the CC3 zohe distiict (25,000 sq. ft.i io allow the lot to be 21,736 sq. ft. and a parking variance. The variance for landscape area is no longer a part of this reguest. This property was platted as part of Tract C, Vail Das Schone, Filing No. 1 , in '1965' in Eagle Coudty.' tn iglZ, while still uirder Eagle County jurisdiction, a deed was recorded which, in esseni:e, divided Tract C into two parcels. This was an illegal subdivision according toJagl_e County regulation. Since 1977, the parcel has changed hands several times and now First Bank of Vail owns the parcel. At the direction of staff, the applicant is requesting this minor subdivision in order to make the lot "legal." The applicant is also proposing to remodel and expand the building, adding approximately 964 sq. ft.-t6 the building, improving the exterior of the building and providing landscaping on-site. The lot is non-conforming with respect to landscape area, therefore, no landscape area may be reduced on-site. The proposed plan provides additional landscape area on-site. The applicant is also seeking a parking variance (3 parking spaces) to allow 31 parking spaces, where 34 parking spaces are required for the proposed expansion. The parking variance may not be necessary f tne PEC agrees with the staff analysis of the parking requirement for a furniture store. A furniture store is currently assessed parking based on the retail requirement of 1 parking space for each 300 sq. ft. of net floor area (in this case requiring 15 parking spaces). There is no specific category for a lurniture store. However, furniture stores tend to occupy large spaces due td me size and bulk of products sold, the related storage areas, and the number of customers visiting such a store. Most other communities assess parking for furniture stores at 1 space per 1,000 iq. ft., which in this case would reduce the parking requirement by 10 parking spaces (requiring 5 parking spaces). The code allows the PEC to determine parking r6quiremenis when a use does not fit into one of the categories within the regulation_s. The relationship of the requested variance to other existing or potential uses and structures in the vicinity. As with other properties annexed to the Town of Vail, many exist as nonconforming lots. Staff believes the proposed subdivision with have iittte, it any, negative impact on existing or potential uses in the vicinity. 2.
